hours to get there. mostly clear and a cold start this morning. air quality is better in most areas but it's another spare the air day. temperatures will becoming up for the second half of the day. in the extended forecast we will stay dry and mild through new year's. coming up what areas have sunk into the 20s this morning. i will have a look at your neighborhood and what you can expect coming up. >> just a few hours ago more than a million had their unemployment benefits cut off. we are live in emoryville to explain what is next for some of them. >> reporter: there are more than 13,000 people in the east bayh loan who lost those unemployment benefits overnight. the number is nearly triple for the entire bay area. relief is not likely to come any time soon. congress did not extend benefits for the long term unemployed before it adjourned for the holidays and with lawmakers not expected to return to washington until after the new year many families are going to about struggle. we spoke to the executive director of the work force board. he said people looking for work need to freshen their skill set and be open minded to nontraditional work opportunities. >> the new job market is not the same one of the past. we are seeing a lot more part time, a lot more temporary work and project based work. >> reporter: he said specifically the refineries are seeking skilled workers so additional training may be what some need to land work again. now coming up in the next report we will talk act the -- about the economic impact and also discuss where bay area families may turn for help. live in emoryville. >> there is more bad news for target customers who lost their information in a data breach the chain says thieves got pin numbers for customer's debit cards. many customers at the pharmacy. also at the register but we are putting our faith in target that they are doing the right thing. >> jp morgan chase has limited card amounts and are reissuing cards to affected customers. some say they have received replacement cards already. >> its welcome news for the 180,000 passengers who rely on ac transit every day. transit workers have approved a new labor contract. we understand the contract passed by 100 votes. we have photographs of the vote last night. they represent about 1600 bus drivers, maintenance workers and clerical staff. >> we are glad our members agreed and ratified this contract. it's a big relief to ensure that they are secure and our riding public will continue to get the service that they have been used to in and that they deserve. >> workers will receive a 9.5 raise but they will have to contribute to their health coverage, paying about $120 a movement $120 month. >> new this morning oakland police say a shooting victim is in grave condition. last night officers responded to a report of gun fire on the 2300 block of 96 avenue. they found a man suffering from a gun shot wound. he was rushed to the hospital where he is listed in grave condition. there are no suspects. oakland police are looking 20th who shot and killed a man driving near a school. residents heard gun shots about 11:15 yesterday morning. the car came to a stop in front of prescott elementary and the man's family later identified him. family members say they hoped his death will not lead to more violence. >> he is my nephew. he is young and he has two children and it's very sad. >> reporter: this was oakland's 87th home received the received -- homicide of the year but that's down from last year. there is a new chapter in the fight over a 13-year-old girl. her family said they found a long term care facility in southern california that agreed to take over her care a nursing home in the south bay had agreed but then changed its mind. before she can be transferred she does need a new breathing tube and a new feeding tube. children's hopped said itchildren's hospital said it won't do the surgery. >> we need to buy more time. we will have to go to court and buy time. we will have to do this. >> this be sums sums -- becomes a very sad thing for the attorney to continue a myth that the girl will get better. she won't. she is dead. >> reporter: doctors declared her brain dead following complications from surgery a judge rule that the hospital can remove her from life support after 5:00 p.m. on monday. her attorney is planning to file another restraining order to block that >> people are concerned about the number of pedestrian deaths. the news is reporting there have been 21 traffic related deaths this year and that's 26 if you include bikes. that's the highest total since 1997. police say most of the incidents involve people crossing high traffic areas at night and outside of crosswalks. the victims range from three to 82. law will be out in full force tonight looking for drunk drivers. officers say with the increase in holiday parties across the bay area they want to make sure the roads are safe. they say if you plan to drink tonight or any time set a sober driver. the crack down will start at seven and continue through four tomorrow morning. >> the beach is seto to reopen. crews have been restoring damaged wetlands, creating new access trails and building a new bridge over redwood creek. the project was 11 years in making and the last part cost $4 million. it's 11-miles the golden gate bridge. people who plan to hit the beach are warned to watch out for big waves. strong rip currents can pose a threat. they are warning people not to turn their backs on the surf or get to close to the water. dog owners should also keep their pets on a leash. they said those owners shouldn't go into the water to try to rescue dogs that get caught in the surf. >> the bad news is no rain in the forecast. the [ male announcer ] available at these fine retailers and nespresso-us.com. welcome back. thank you for joining us a live look there over the oakland estuary. greeted by a winter chill this morning. 35 degrees reported at the airport. >> flu season has officially arrived this past week the number of cases that tested positive for the flu more than tripled. health officials in santa clara say the season starts when 10% of the cases test positive for the flu. for weeks it had been at 6% but this past week it jumped to 19%. >> the solution is the flu shot. it's vet the shot, wash your hand, avoid close contact with people that are sick. >> doctors say this year's flu shots effective at preventing this season's flu. santa clara health officials say during the last flu season there was one death from the flu nationwide. this season there have been four so far. >> an outbreak of noravirus at a east bay nursing home appears to be contained. 30 people in walnut creek were treated last week the health department said all the affected patients and workers have recovered. investigators did not find a source of the infection and that outbreak is especially troubling for people being treated for other health issues. they are at greater risk. >> people can die from it. it's usually because it aggravates an under lying condition. >> health workers say they expect to see the virus infections rise this time of year. it affects about 20 million people in the united states yearly. a new law that takes effect january first is urging schools to stock up on epi pens to help children with life threatening food allergies. that new law doesn't require the school to stock them but it does give them incentives if they do. some say food allergies are a growing problem. >> they have increased by about 50% in the last decade. currently approximately two to 6% of all children have some form of food allergy. if you think about that that's about one to two children in every classroom in america on average. >> individual states will have to pass their own versions of the law before schools can get the injections. with very little training any staff member can use it in an emergency. >> the new year will bring a new law that closes a loophole letting teen drivers use voice texting. it bans them from using them a change last year to a texting while driving law lets drivers use voice programs to dictate texts but didn't exclude young drivers. the new law will and teen drivers will be safer for it removing from that is becoming increasingly difficult especially for the young generation. we are trying to bring them back to the very basic thing of when you are behind a wheel you need to drive. >> officer hill said while many young people consider can themselves good drivers they are most at risk for crashing because they lack the experience to deal with unexpected hazards in the road. the president has a big challenge ahead in 2014. with his approval rating at an all time low it would seem he has nowhere to go but up but even that's not a sure thing. how it went so wrong so fast. >> reporter: his year started like this. >> so help me god. >> reporter: its ending like this. >> has this been the worst year of your administration? safe. the national park service is offering shuttle buses at point reyes during the pacific gray whale migration. they are offering the service to cut down on traffic from whale watchers but the whales aren't the only animals attracting more visitors. northern elephant seals are also returning to the area. tickets for the shuttle buses go on sale. >> this time last year we were getting that lost those long term unemployment benefits and nearly tripled that number in the entire bay area. there is not any relief in sight. congress didn't extend benefits for the long term unemployed beforea adjourned for the new year. with lawmakers not expected to return to washington dc until after the new year, many families are going to be struggling. >> i try not to think about it to much because there is nothing i can do about it. i just don't eat out. i don't go to entertainment things. i just stretch as much as i can everything i have. >> reporter: leaders at the work force board said employers want skilled workers, specifically the refineries are looking for help so additional training may be what some need to land work again. those expects also say local charities may be other top stories. ac transit buses will continue to run now that workers have approved a new contract. the deal races salaries 9.5% but worker also have to make contributions to their health insurance. and a man is in grave condition after being shot last night. police were called to the 2300 block of 96 avenue after 11. they say the victim had at least one gun shot wound. oakland police are looking for the person who shot and killed a man who just happened to be driving near a school. neighbors say they heard gun shots near the intersection of eighth and campbell. the victim's car eventually came to a stop in the front of prescott elementary. >> final preparations underway for the snow globe music festival but this year people will see changes. that after the death of a 19- year-old who wandered away from the festival and was found dead in the snow. an autopsy showed she was under the influence of drugs. this year more security and buses will be added to the event. heated tents will also be added. 12,000 are expected to attend the event which starts tomorrow. a 4-year-old who drowned in a pool has recovered after at least four minutes of not breathes. was at ate aunt's house when he fell in to the pool. he was pulled out unconscious. his father preformed cpr while they waited for the paramedics . >> cold water helped him. any other time had it been in july, he it wouldn't have been the same outcome. >> reporter: firefighters say that the cold water in the pool helped slow down his heart rate, avoiding brain damage. everybody at the hospital said they were surprised at how fast he recovered. his parents said they couldn't be happier the >> the body found in the waters near the kobe last month has been identified as a 23- year-old student. he disappeared in san francisco's mission district on october 28th. police say before went missing he called his sister and said he was being followed . the cause of death hasn't been released. that report will help determine what happens next in the investigation. >> if it's a homicide we will do a homicide investigation or otherwise it stays as being the made cal examiner. >> miss will trying trying -- police want to identify that man. they believe he used the victim's credit card after he disappeared. >> two men wanted in connection to a robbery. police arrested a 21-year-old during a traffic stop and a 20- year-old turned himself in. the two are accused assaulting and robbing a 68-year-old in the casino parking lot at about 6:30 tuesday morning. the victim had severe head trauma in that attack. oakland police hope to catch a robbery suspect with help from the suspect himself. vehiclors say this man took a selfie with a stolen cell phone. the photograph went to the victim's database where she saw the picture the next day. the woman said the suspect and another man were armed and stole a necklace. it's thought they may be responsible for similar street robberies. >> the final report on the shooting at sand sandy hook shows adam lanza's behavior worried his mother. she said his mental state was getting worse. worse. that report includes the audio from 911 calls made from the school moments after the shooting started. >> the shooter is outside the door? he shot a -- >> stay with me. please. we have someone on the way. >> hurry. hurry. hurry. >> police say that before going to the school he shot his mother in the home they shared. >> amazing pictures, look at that right behind them. that happened at a hotel near fresno [inaudible] pretty incredible you can rescued, still after a ice breaking ship trying to get to them has turned around. it's now been a hundred hours since the ship first ran into trouble. temperatures quickly dropped between antartica them received this e- mail that was sent out yesterday by target ceo updating them act the fraud. the breach that doesn't seem to end is making customers nervous. just yesterday target announced that some customer pin numbers were compromised. they say that the data was encrypted which reducing reduces the risk. thieves took it from united states target stores between november 27th and december 15 to contribute to their health coverage, paying about $120 a month. ac transit board is expected to improve the contract on january 8th. >> new this morning, oakland police say a shooting victim is in grave condition around 11:10 last night officers responded to the report of gun fire in east oakland. there they found a man with at least one gun shot wound. he was rushed to the hospital and is in grave condition. police don't have any suspects. police are looking for whoever shot and killed a man driving near a school. residents heard gun shots near the intersection at about 11:15. the car came to a stop in front of prescott. that man's family later identified him. family members say they hope his death will not lead to more violence. >> he is my nephew. he is young and has two children and it's very sad that this -- these youngsters killing each other. . >> this was oakland's 87th homicide of the year but that's down from 131 last year. and there is a new chapter in the fight over a 13-year-old girl. her family said they have found a long term care facility in southern california that has agreed to take over her care a nursing home had agreed but then changed its mind. however, before she can go she needs a new breathing tube and feeding tube. childrens hospital said they will not do the surgery but would allow an outside doctor to preform it. >> we need to buy more time to have to go in court and buy time. we will have to do this. >> this becomes a very sad thing for the attorney to keep pushing a myth that the girl will get better. she won't, she is dead. >> doctors declared her brain dead after complications a surgery. the judge ruled the hospital can remove her from life support on monday. her family's attorney is planning to file another restraining order to try to block that move. >> people in san jose are concerned about the number of pedestrian deaths. the news reporting there have been 21 traffic deaths this year, 26 if you include bicyclists. that's the highest total since 1997 and the most of any city in the bay area. most of the incidents involve people crossing high traffic areas at night and outside of crosswalks. the victims range from three to 82. police have arrested the drunk driver responsible for a five car crash. it hand around 5:15. police say that a 69-year-old was driving to fast for the conditions when he collided with four cars stopped at a red light. three of the drivers were hurt but nothing is considered life threatening. law agencies across the bay area will be out in full force looking for drunk drivers. officers say with the increase in holiday parties they want to make sure the roads are safe. they say if you plan to party tonight set aside a sober driver. the crack down will start at 7:00 and continue through 4:00 tomorrow. >> the beach is set to reopen after being closed to the public. the crews have been restoring damaged wetlands, installing a new parking lot and building a new bridge over redwood creek. it was 11 years in the making and the last of the three phases cost about $4 million. people who plan to hit the beach are being warned to watch out for big waves. the coast guard said that strong rip currents can pose a threat to anyone who isn't prepared. so they are warning beach goers don't turn your back on the surf. dog ownersers are also told to keep their pets on a leash and 23 if your dog gets caught in the surf don't go into try to rescue it. it's often though get out on their own but the people get caught up and can't get out. that's a good warning for everybody. >> nice the security breach is hurting business or not. target is being proactive about its image. the ceo sent out this e-mail letter to customers yesterday, outlining the fraud, the security breach that doesn't seem to end is making many of those customers nervous. just yesterday target announced that some customers pin numbers were compromised. the company spoke people say that the data was encrypted which reduces the risk of fraud to customers. thieves took the personal information from united states target stores between november 27th and december 15 december 15th. not all target 19-year-old who wandered away last year and was found dead a few days later. the teen was under the influence of drugs. this year more security and bus also be added to the event. there will also be heated tents. 12,000 are expected to attend the event that starts tomorrow. a 4-year-old who drowned in the pool what recovered after four minutes of not breathing. he was at his aunt's house on christmas when he fell in to the pool. after several minutes he was pulled out of the water unconscious. his father preformed cpr as they waited for the pair midi paramedics. >> the cold water helped him. any other time had it been in july, he -- it wouldn't have had the same outcome. >> firefighters say the extremely cold water in the pool helped by slowing down his heart rate and avoiding brain damage. everybody at the hospital said they were surprised at how fast he recovered. his parents say they couldn't be more gratel. >> the body found in the water near the cove has been identified as a 23-year-old. he disappeared on october 28th 8. his sister said he called her before he disappeared said he was being followed. the cause of death hasn't been released. that report will determine what happens next. >> if it's a homicide we will do a homicide investigation. . >> police are still trying to determine the identity of this man. investigators say he used the victim's credit card after the disappearance. >> two machine are men are in jail in connection with a robbery. police arrested one during a traffic stop and the other turned himself into the county jail. the two are accused of assaulting and robbing a 68- year-old man in the casino parking lot at about 6:30 tuesday morning. the victim had severe head trauma. >> oakland police hope to catch a robbery suspect with help from the suspect himself. investigators say this man took a selfie with the cell phone he allegedly stole from a woman back in august. the photograph went to the victim's database where she saw the picture the next day. the woman said the suspect and another man were armed and also took a gold necklace from her. it's thought they may be responsible for similar robberies in that area. >> the final report on the shooting at sandy hook show he the shooter's behavior worried his mother. she told a friend his mental state was getting worse. that report includes the audio from calls made from the school moments after the shooting started. >> the shooter is outside. >> he -- he shot a hundred shots. >> stay with me. we have someone on the way. >> hurry, hurry. hurry. >> police say before going to the school he shot his mother in the home they shared. watch closely. there it goes. right behind them. that news crew was in the middle of that interview with the side of that hotel came down. that is a 124 year old hotel. it was empty and it was already scheduled to be destroyed the building already in downtown porterville. they had gotten a grant -- the cause of that fire is under investigation. >> updating. i'll have those for you, coming up. new information now on the massive security breach of customer information at target stores. that retail giant says hackers made off with personal identification numbers. ktvu channel 2 reporter katie utis has the latest. >> reporter: people we've spoken with say they have been happy so far with how target has handled what could be considered a pr nightmare for the company. the ceo sent out this e-mail to customers just yesterday, saying that pin numbers were not compromised. however, we're learning now that that may not be the case and the news caught some shoppers off guard. >> i'm a loyal target shopper, and i know this isn't their fault and appreciate what they are doing to correct the situation in terms of providing everyone with a year's worth of fraud protection. but it seems like the information is a little inconsistent. >> reporter: just yesterday, target announced that some customer pin numbers were compromised. but company representatives say the data was strongly encrypted, which makes it more difficult for thieves to use. the massive security breach happened in u.s. target stores between november 27th and december 15th. information from around 40 million payment cards was taken during the attack on target's server. they are investigating with federal investigators. chase bank has already replaced many customer cards, but many people that we're speaking to this morning say from here on out, they may simply just use cash. more than 1 million american families had their unemployment benefits cut off just hours ago. congress did not extend benefits for the long-term unemployed before adjourning for the holidays. two senators proposed continuing checks for three months, but lawmakers are not expected to return to washington until next month. that means 36,000 people in the bay area lost their benefits when the clock passed midnight. >> i try not to think about it too much, because there's nothing i can do about it. i just don't eat out. i don't go to entertainment things. i just stretch as much as i can everything i have. >> many experts say cutting off those benefits could hurt the overall u.s. economy. people who are unemployed have to use that money to buy food, pay utility bills and provide housing costs. president obama says he plans to push congress to pass the benefits extension as quickly as possible. he's calling it an urgent economic priority. well, it's welcome news for the 180,000 passengers who rely on ac transit every day. transit workers have narrowly approved a new labor contract. we understand the contract passed by only about 100 votes. only on 2, we have photos of the vote tab lags inside the transit hall last night. they represent about 1600 bus drivers, mechanics, maintenance workers and clerical staff. >> we're glad that our members agreed and ratified this contract. it's a big relief to ensure that they are secure and that our riding public will continue to, you know, get the service that they have been accustomed to and they deserve. >> workers will get a 9.5% raise over three years, retroactive to october. but employees will have to contribute to their healthcare coverage, paying around $100 a month. the ac transit board is expected to approve that contract on january 8th. new this morning, oakland police say a shooting victim is in grave condition. around 11:10 last night, officers responded to a report of gunfire on the 2300 block of 96th avenue in east oakland about a man suffering from at least one gunshot wound. he was rushed to the hospital, where he is listed in grave condition. police say there are no suspects. oakland police are also looking for the gunman who killed a man driving near a school. residents say they heard gunshots near the intersection of 8th and campbell streets about 11:15 yesterday morning. the victim's car came to a stop in front of prescott elementary. the man's family later identified him as arbor ghosten. family members say they hope his death will not lead to more violence. >> the man found is my nephew. he is young and he has two children. it's very sad that these youngsters is killing one another. >> this was oakland's 87th homicide of this year, but that is down dramatically from last year, when there were 131 homicides in the city. well, there's a new chapter in the emotional fight over 13- year-old jahi mcmath. her family says they have found a long-term care facility in southern california that has agreed to take over her care. a nursing home in the south bay had initially agreed, but then changed its mind. however, before jahi can be transferred, she needs a new breathing tube and a new feeding tube. children's hospital says it will not do the surgery, but would allow an outside doctor to perform those procedures. >> we need to buy more time. we'll have to go to court and buy time. we'll have to do this by any means necessary. >> this becomes at a certain point a very sad thing for the attorney to perpetuate a myth that jahi mcmath will get better. she unfortunately won't. she is dead. >> doctors declared jahi brain dead following complications from tonsil surgery. a judge ruled the hospital can remove her from life support after 5:00 p.m. on monday. her family's attorney is planning to file another restraining order to block the move. mirror beach is set to reopen today after being closed to the public for the past five months. crews have been restoring damaged wetlands, installing a new parking lot, creating new access trails and building a new bridge over redwood creek. the whole project was 11 years in the making. the last of three phases cost about $4 million. the beach is roughly 11 miles from the golden gate bridge. people who plan to hit the beach this weekend are being warned to watch out for big waves. coastguard says strong rip currents can pose a threat to anyone who isn't prepared. they are warning beachgoers never to turn backs on the surf or get too close to the water. dog owners should also keep their pets on leash. the coastguard adds those owners should not go into the water to try to [ crying ] >> reporter: 1-year-old isabella sanchez knew something was coming, but her mother felt better having gotten the flu shot. flu season is here. officials at kaiser permanente in santa clara say flu season is official when 10% of the cases with flu-like symptoms test positive for influenza. for weeks, they say, it's been at 6%. then in the past week, the number jumped to 19%. >> most of the time, it manifests as a respiratory illness with a high fever, lot of achiness, usually a cough. >> reporter: lots of people are going to their local drug store for medicine to treat symptoms of the flu. but medical experts say the best treatment is prevention. most people we met at this cvs store said they had gotten their flu shot, but one family has no plans to do so. >> we've never gotten them and we've always been okay and we just feel like, you know, getting sick is a part of keeping yourself healthy as well. >> reporter: doctors say the patients they have seen have been hurting. >> some of them are quite miserable. it can be a very unpleasant illness. more importantly it, can be a dangerous illness, particularly in people who are chronically ill, maybe have some problems with their heart or lungs. but occasionally, even in otherwise healthy people, it can be very serious. >> reporter: santa clara county health officials say all during the last flu season, there was just one pediatric death from the flu nationwide. this season, there have already been four. >> the solution is the flu shot. get vaccinated. wash your hands, avoid close contact with people that are sick. >> doctors add this season's flu shots are very effective at preventing this season's strains of the flu. an outbreak of norovirus at an east bay nursing home appears to be contained. 30 people at the kindred transitional care and rehab center in walnut creek were treated last week. the contra costa county health department says all the affected patients and workers have recovered, but they didn't find the source of that infection. the outbreak is especially troubling for people who have other health issues. >> people can die from norovirus and it's usually because it aggravates an underlying condition that the person may have. or you can just get severely dehydrated, which can be a cause of death. >> health workers say norovirus is the most common cause of food-related illnesses in the u.s. and affects about 20 million people in the u.s. annually. a new federal law that takes effect january 1st is urging schools to stock up on epinephrine injectors to help children suffering from potentially life-threatening food allergies. the new law doesn't require schools to stock injectors, but it does give them financial incentives if they do. according to some experts, food allergies are a growing problem. >> food allergies have increased by about 50% in the last decade alone and currently approximately 2 to 6% of all children have some form of food allergy, and if you think about that, that's really about one to two children in every classroom in america on average. >> individual states will have to pass their own versions of the law before schools can get those epipens, but supporters say with very little training, any school staff member can use those in an emergency. the new year will also bring a law loophole that allows teens to text. a change last year to the texting while driving law allows drivers to use voice programs to dictate texts, but did not exclude young drivers. the new law will, and the chp says teen drivers will be safer for it. >> removing yourself from the social media is becoming increasingly difficult for especially the young generation. we're trying to bring them back with these laws to be very basic. when you're behind the wheel of the car, you need to drive. >> officer hill says while many young drivers consider themselves good drivers, they are most at risk for crashing because they are not used to distractions on the road. the national park service is offering shuttle buses at point ray's national sea shore during the pacific gray whale migration. park officials are offering the service to try to cut down on traffic from all the whale watchers. but the whales aren't the only animals attracting more visitors. northern elephant seals are also returning to the area. tickets for those shuttle buses go on sale today and the program will run through late march. the ice rink in san francisco ranks fourth on the nation's top 10 list of places to go for scaight. next month. a controversial star of the reality show "duck dynasty" is cleared to go back to work. the a & e network suspended phil robertson from the show earlier this month because of comments he made with gq magazine. robertson said he never meant to incite hate about his comments about gays or african americans. the network will start taping again this spring. it will also start a public service campaign to promote tolerance and acceptance of all people. britney spears kicked off her new show to a sold-out crowd in las vegas, for her 90- minute performance. the show featured target shoppers. some pins of customers were stolen during the cyber attack in the last month. katie? >> reporter: john, emeryville's target has been busy this morning. many customers received this e- mail from target's ceo. he says that pins had not been compromised, but now we're hearing that may not be the case, and the news caught some shoppers off guard. >> that makes me a little nervous to know that pins have been compromised. so now i'm debating on whether i'm just going to pay for my purchases with cash and just call it a day. >> reporter: the letter from target's ceo says customers with fraudulent charges will not be responsible. target or your bank will cover it. in yet another blow to the company's image, target announced that some customer pin numbers were indeed taken during the massive security breach, which happened in u.s. target stores between november 27th and december 15th. company representatives say the pin data was strongly encrypted, which makes it more difficult for thieves to use. information from around 40 million payment cards were taken during the attack on target's server. it's unclear at this point if the breach is hurting target's business. we've talked to plenty of shoppers here this morning who say they will continue to shop at their favorite retailer. however, they may just start using cash. live in emeryville, now back to you. well, here's a look at some of the other top stories we are following for you this morning. ac transit buses will continue to run. workers have now approved the new contract. it raises salaries 9.5% over three years, but workers are going to have to start making contributions to their health insurance. 36,000 people in the bay area lose their extended jobless benefits today. the new budget agreement did not include continuing their unemployment insurance. the president is pushing to have payments reinstated and hopes those checks will be retroactive. a man is in grave condition after getting shot late last night in east oakland. police were called to the 2300 block of 96th avenue just after 11:00 p.m. investigators say the victim was suffering from at least one gunshot wound. there are no suspects at this time. people in san jose are concerned about the city's number of pedestrian deaths. san jose mercury news is reporting there have been 21 traffic-related deaths this year, 26 if you include bicyclists, the highest total since 1997 and the most of any city in the bay area. police say most the incidents involved people crossing high traffic areas at night and crossing outside of crosswalks. the victims range in age from 3 years old to 82. santa rosa police have arrested the alleged drunk driver they say caused a five- car crash last night. it happened around 5:15 at the intersection of hole lan and lupe avenues. 69-year-old jose antonio franco was driving too fast for the conditions when he collided into four cars stopped at a red light. none of the injuries is considered life threatening. law enforcement agencies across the bay area will be out in full force tonight, looking for drunk drivers. officers say with the increase in holiday parties across the bay area, they want to make sure roads are safe. officers say if you do plan to party tonight or this weekend or any other time, designate a sober driver. the crackdown will begin at 7:00 and continue through 4:00 a.m. tomorrow. well, a san rafael man faces charges after police say he made threats at a bar last night. according to the marin independent journal, police took 28-year-old taylor james reider into custody. they say workers at the bar called 911 after saying a customer walked into the bar with a gun tucked into his waist band. police recovered a loaded .45- caliber semi automatic handgun. preparations are under way for the snow globe music festival in lake tahoe. there will be change this is year, following the death of 19- year-old alyssa burn of petaluma, who wandered away from the festival last year and was later found dead in the snow a few days later. an autopsy showed the teen had been under the influence of drugs. this year, expect more security and buses to be added to the event, heated tents as well. 12,000 people are expected to attend the three-day event, which starts tomorrow. two men are behind bars for a christmas eve robbery outside the grayton casino. police arrested a 21-year-old man during a traffic stop and a 20-year-old man turned himself in to the county jail. the two are accused of assaulting and robbing a 68- year-old man in the casino parking lot about 6:30 tuesday morning. the victim suffered severe head trauma in the attack. oakland police hope to catch a robbery suspect with help from the suspect himself. investigators say this man took a selfie with a cell phone he allegedly stole from a woman who was walking her dog on east 28th street back in august. that photo went to the victim's icloud database where she saw the picture the next day. the woman says the suspect and another man were armed and also stole a gold necklace from her. police think the two men may be responsible for similar street robberies in the area. well, the final report on the shooting at sandy hook elementary school last december shows adam lanza's behavior worried his mother. she told a friend her son's mental state was getting worse, two weeks before he gunned down 20 first graders and six teachers before killing himself. that report does include the audio from 911 calls made from the school, moments after the shooting started. >> the shooter is outside the door. god, he shot a hundred shots. >> just stay with me, please. we have somebody on the way. >> please hurry, please hurry. >> police say before going to the school, lanza shot his mother in the home they shared. watch this closely. oh, there it goes, right behind him. the news reporter was in the middle of the interview when the hotel behind him came crashing down. the 124-year-old hotel was vacant, scheduled to be demolished. the three-story building was located in downtown porterville. the city had received a federal grant to tear it down in 2007. the cause of the fire is still under investigation. researchers on a russian ship near the south pole are waiting to be rescued after a chinese ice breaking ship got stuck. temperatures quickly dropped between antarctica and new zealand, freezing the ship in place. the chinese snow dragon was sent to get them out and was just 6 miles from the ship when it got stuck in ice 10 feet quick. >> we moved as quick as we could, but the ship just couldn't get through it. >> the chinese rescue ship has given up on its rescue mission and is hoping a french ice breaker will be able to free them. a rescue ship out of australia is working its way towards the russian research vessel, but it is at least two days away. hundreds of people in the midwest reported seeing a fire ball streak across the night sky on thursday night. the incident was caught by surveillance camera in north liberty, iowa. the fire ball may have been a meteor crashing through the earth's atmosphere. pretty spectacular. the national weather service is now looking into the reports, but won't be able to determine for sure what the flash was because of its location in the sky. starting with a view of mount diablo this morning, 49ers stadium in santa clara. bowl organizers say the change in venue will be the only difference. clyde memorial church, san francisco's food bank will still receive donations to fight hunger. in the getting across the bridge this morning, no problems. san francisco, 63 this afternoon. a 4-year-old boy who drowned in a family pool has recovered after nearly 4 minutes of not breathing. wyatt was in his family's backyard pool when he fell in. after several minutes, he was pulled out of the pool, unconscious. his father performed cpr. after four minutes, wyatt started breathing again. >> the cold water absolutely helped him. any other time, had it been in july, i mean, it wouldn't have had the same outcome. >> firefighters say the extremely cold water in the pool helped by slowing down wyatt's heart rate, thus avoiding brain damage. everyone at the hospital says they were surprised at how quickly he recovered. the body found floating in the waters near mccovey cove last month has been identified as the missing brazilian student. before he went missing, his sister said he called her and told her he was being followed. the medical examiner's office has not released the cause of death. police say the report will help determine what happens next in the investigation. >> if it's a homicide, we'll initiate a homicide investigation. if it's otherwise, it stays as the medical examiner's case. >> police are still trying to figure out who this man is. investigators say he used netto's credit card a few days after netto disappeared. tens of thousands of people in ontario are still without power, nearly a week after the recent ice storm. about 30,000 people in toronto are waiting for their power to be restored. police are urging residents to go to community centers, but many people are refusing to leave their homes. >> i told everyone, i'm like the captain. i'm not leaving the ship. >> it was way too cold. my son's fish froze in his fish bowl. >> police say they will continue making wellness checks until the power is restored, but there are still concerns the outages could continue. colorado's new law that makes it legal for marijuana to be sold goes into effect on new year's day. anyone 21 or older will be able to buy pot for recreational use, just like alcohol. anyone caught driving while high will be arrested. colorado police say they won't go looking for drivers under the influence of marijuana, but will spot them the same way they spot drunk drivers. >> every reason under the sun, too fast, too slow, impeding traffic, not signaling, following too closely. >> if drivers are pulled over, they could be asked to perform some of the standard drunk driving test, including standing on one foot or walking in a straight line. officers could also ask drivers to take a blood test. drivers can refuse those tests, but they could still be arrested on suspicion of impaired driving. well, drivers pulled over on new year's eve in los angeles may get more than the usual sobriety test. the la times is reporting drivers may have to submit to a new oral swab test. that test would check for marijuana, cocaine, and other drugs. so far this year, the swab test has only been used 50 times in the city and has yet to be presented as evidence. the city attorney says he is pushing to agressively enforce all impaired driving laws. voters could be asked to decide if california should legalize the recreational use of marijuana next year. you might see two ballot proposals. both would legalize the use, possession and cultivation of marijuana. the attorney general's office says california could save hundreds of millions of dollars in law enforcement costs every year if marijuana were legalized. the attorney general's office adds state sales tax on pot could raise more than $100 million every year. antiwar activist cindy sheehan has announced she will run for governor of california. >> when i ran against nancy pelosi in san francisco, i got almost 17% and came in second place. >> yesterday, sheehan picked up her candidacy papers from the solano county registrar of voters. sheehan gained national attention after her eldest son was killed in afghanistan in 2004 and she staged a sit-in outside of then-president george w. bush's texas ranch. an analyst downgraded twitter's stock from neutral to underperforming, which started a selldown with site also marked down other albums listed on rolling stone magazine's list of the best albums of the 2013. well, apple made a cut to its ceo's compensation package this year. tim cook is still going to get his base salary of $1.4 million. and he'll get his performance bonus of $2.8 million, which is close to what he earned in 2012. but cook did have to give up about 7100 shares of apple stock, worth about $400 million, because it was tied to shareholder returns and apple stock lost a quarter of its value in the last fiscal year. san jose has been named the richest city in the nation, for francisco area. >> well, it helps with the image and the fact that there are people that have money are staying here. >> reporter: the u.s. census bureau rewarded the san jose area for its median income, which topped $90,000 a year, with its high-paying jobs and desirable housing market. the south bay research group known for its accurate forecasting of silicon valley says san jose does a lot of things right, but by phone, the founder says the high cost of housing is something to watch. >> you have to pay people a lot more to live in an area where expenses are ridiculously high. and unfortunately, that's a comment about housing. >> reporter: in san jose, almost one fourth of home sales are done with cash. >> so it does make it harder for the guy who has to qualify for financing to get that property. >> i think the city should do a better job in fast tracking housing. >> reporter: some city officials agree, but point out san jose is still scraping by budget wise and needs more rich companies. >> although our region, our metropolitan area, has many jobs and great wealth, for the most part, what creates tax revenue in the city of san jose are employers. >> reporter: but they will stop adding automatic tips on large groups. starting next wednesday, the irs will start considering those service charges, and that means restaurants have to pay tax on it. the company that owns red lobster and olive garden has already eliminated its automatic charge for groups of eight or more customers. a new study shows san francisco's most common health problems result from the city being located between two busy freeways. researchers at mit found nearly all san francisco cans live within 1.5 miles of a major freeway. researchers say exposure to particulate matter is causing lung here, then go to bed and wake up early in the morning. there are weather concerns for the 125th annual tournament of roses parade, but they don't have anything to do with rain. floats in that parade have to be completely covered with natural materials and feature all kinds of seeds, barks, live trees, and of course flowers, especially as you might imagine, roses. but the warm weather in southern
