breeze. san jose starting off at 52. will go for a high of 74 and beautiful san jose. for us, we start off clear skies here. mostly clear. a little breezy. blustery at times. cool for some. not too bad for others but it will be slightly warmer this afternoon. we do have the red flag warning out for the north and east bay hills. that goes till friday afternoon. that's that northerly wind but again nothing yet. but we expect that maybe to pick up a little bit. i mean, this just looks like a breezy, blustery day to me. not so much in the windy category. for us it's sunshine, good to go once we get cranked up of course. breezy, windy for some but it's a north, northeasterly direction. yesterday was a little more west, northwest. 60s, 70s or soft 80s. here's sal. good morning. right now we are doing pretty well around the bay area as you can see. traffic is moving along pretty well on 80 westbound as you head out to the mcarthur maze. no major problems getting out to the mcarthur maze and to the toll plaza. when you get to the toll plaza, it is light so you're getting a good commute. it's early enough for you to get a nice commute into the city. also, if you're driving on the peninsula, perhaps you're trying to get to the airport to catch a flight that is a nice drive on 101 to san bruno. 501, let's go back to the desk. >> thank you, sal. we have new information now on that deadly stabbing in san francisco we told you about at 4:30 this morning. police have just told us that the mafn was wear -- man was wearing dodgers gear. he was killed in the area of 3rd and harrison streets near at&t park just after 11:30 last night. officers say there was a confrontation between the man and a giants fan. three people were detained in the area and police are interviewing witnesses. we're talking with investigators and we'll have an update on this developing story coming up at 5:30. time 5:02. happening now, a red flag warning in effect for parts of the bay area because of high winds. ktvu's claudine wong live in the oakland hills with how homeowners are getting asked to get ready and be prepared. >> reporter: a little bit breezy. the winds we're expecting over the next couple of days not hitting this particular area quite yet but i want you to take a look behind me. when you talk about fire danger, it's not just the winds. every other factor that goes into it. that brush behind me very dry. this area has similarities to the area, how it looked like when we had the firestorm through here 22 years ago when you talk about the dry brush and trees and red flag conditions. now, homeowners know in this area that they've got to do their own part to make sure that their area stays safe and they're able to protect their home. >> mostly what we like to do is preventive care so there won't be any problems when there's high winds. >> reporter: when we have days like this it's kind of a joint effort between firefighters putting the word out, letting people know to be safe. homeowners doing what they can and pge crews, we know they have 96 crews that have been dedicated to cutting back trees, trimming areas that might be of concern because again when you have the high winds, you have the trees that are a problem, power lines that could come down and that could make for very dangerous situations. that's the situation we have out here and for the next couple of days. certainly something everyone needs to keep in mind. live at oakland, claudine wong, cut news. time -- pge trying to restore power to eden medical center in castro valley after a downed wire knocked out power overnight. the hospital is joog generators right -- is using generators right now to run things. service to patients we've been told has not been affected. at the height of the outage, more than 3,000 homes and businesses lost power. the power should be fully restored by 9:00 this morning. a suspected stalker is now behind bars in a child pornography case in santa cruz. jeanine de la vega joins us now from santa cruz this morning with what we've learned about the suspect and the crime. jeanine? >> reporter: pam, the latest incident happened here at pacific collegiate charpter school. police -- charter school. the suspect was caught by police photographing female students on and near campus here on tuesday. 31-year-old joshua paul james was arrested on charges of child pornography as well as child annoying and stalking. police were originally called on monday to santa cruz high school after two student athletes who were running as part of their training reported that a suspicious manual was following them in -- man was following them in the car. the next day female students at collegiate school report add suspicious man in a car similar to the description from the day before and officers were able to track down james. after searching his home, they found obscene matter depicting children and they say james had been filming and taking photographs of girls between 13 and 15 years old for his own gratification. detectives seized photography and computer equipment as well as storage cards and right now they're in the process of looking through the images to see if there are any more victims. reporting live in santa cruz, jeanine de la vega, ktvu channel 2 news. time is now 5:05. a vigil will be held tonight for a san francisco state university student who police say was the victim of a random killing at a muni stop. 20-year-old justin valdez was shot down monday night in the city's eveningleside nights neighborhood. investigators have arrested a man captured on muni's cameras right before that shooting. >> the kind of person just continue was, he did not deserve what happened to him. the guy deserves to be punished. justice needs to be served. >> authorities say valdez grew up in southern california. his friends say he was a good student, a good swimmer, someone who was passionate about the environment. the vigil later today will be at 7:00 p.m. at san francisco state. police also say they're going to give us more information about the case later today. san francisco police also investigating a fatal motorcycle crash in the twin peaks area. it happened about 9:15 last night in the 1,000 block -- 1 thousand block of bar toll la drive. the cyclist was killed after slamming into a parked truck. the investigation into the cause of the crash continues. the menlo park city council approved a request by the police department to buy four surveillance cameras and three license plate readers. however, the council says the department couldn't use the equipment until there is an ordinance in place to address privacy concerns. the surveillance cameras will be mounted at intersections in the bell haven neighborhood where all five of the city's shootings since february have happened. the automatic license plate readers will be attached to three patrol cars. the u.s. successfully defended the americas cup. >> it will stay in america. >> oracle capped off one of the greatest comebacks in sports history yesterday, down eight races to one to new zealand. oracle won eight straight races including the finale about 44 seconds. the historic race is raising new questions about the future of the oldest trophy in international sports. coming up in just about 15 minutes, why new zealand's loss could have ended the country's loss of retaking the cup any time soon plus the possibility of whether the races will be held in san francisco again. pam, team oracle and the americas cup trophy will be proudly displayed this morning at the oracle open world convention. last night the convention lit up the sky at treasure island. they had huge tents and a giant ferris wheel out there and it was music by maroon five and black keys for oracle customers and partners. today is the last day of that big oracle convention. the attendees will be able to take a photo right next to the americas cup. a four-day festival celebrating technology and music begins today in downtown san jose. more than 70 bands are scheduled to perform at the c2sv festival, including the ocs, the limousines and the lemon heads. the band iggy and the stooges will also perform at an outdoor concert saturday at st. james park. speakers will include apple co- founder steve was any yak and pioneer john mcif i who by the -- mcphee who will give one of his first public interviews since he left belize. we're two weeks away from the end of the cooling off period for bart. the proposal from one local lawmaker to prevent future bart strikes. >> also, addressing government surveillance today. why lawmakers trying to expand their spying program. >> so far so good on the morning commute as we look at some of these pictures. you can see westbound 24 traffic looks good heading up to the tunnel. >> well, some lows this morning in wind protected areas. the breeze is definitely showing itself. how windy and how much warmer. so what can i get you? senators will answer questions about new legislation to cut back the national security agency's surveillance programs. the legislation would end the nsa's bulk collection of americans' communication records. the senators say putting restrictions on the scope of the surveillance program will not put national security at risk. >> under this bill, the federal government will still be able to get hold of terrorists and spies' phone records but only where the government can demonstrate a suspected link to terrorism or espionage. >> the surveillance programs have come under intense scrutiny since disclosures this spring by former nsa contractor edward snowden but the government collects far more internet and telephone data than previously known. time 5:12. there's a new poll out showing president obama's approval rating dropping as he face as looming battle over his health care reform and a possible government shut young. according to this new poll, 49 -- shut young. according to this new poll, 40% of the public dispray proves -- disapproves of his performance. 43% approve. the postmaster will go before a senate committee today, one day after proposing to raise the price of mailing a letter to 49 cents. the postmaster general justifies that increase by citing the post office's financial condition and also the closure of post offices around the country. the postal service he says needs approval for regulators to raise fees if they're higher than the rate of inflation. if it's approved, the new 49- cent rate would take effect january 26. police are investigating a shooting in san francisco a week after two people were shot on the same corner. a shooting comes a week after 24-year-old jimmy chandler and a 21-year-old woman were shot on the same corner. chandler died at the hospital. the woman expected to survive. police have not made arrests in either shooting. the child sced -- the trial scheduled to resume this morning for a man accused of trying to rape one of his teachers in redwood city. david value lass qez is accused of attacking a teacher. he was 19 when he allegedly tried to force the woman into her car at knife point. when she fell to the ground prosecutors say he tried to rape her but was stopped by another teacher. jury selection began earlier this week. opening arguments and witness testimony will now start. time 5:14. the jury could start deliberating in michael jackson's wrongful death case as early as today. jury members are being asked to decide who is responsible for hiring dr. conrad murray for michael jackson's this is it concerts in london. lawyers for michael jackson's family says an unsigned contract moves concert promoter aeg hired dr. murray. but aeg officials sajakson insisted on hire -- say jackson inmates. federal courts have given california until late january to reduce the prison population. this poll conducted by the public policy institute finds 60% of likely voters are not confident that local jails could handle all the extra inmates who would be shifted from state prisons and half say violence and street crime are problems in their communities. twitter will soon have a treat for football fans. the san francisco-based media company will carry n.f.l. instant replays. twitter is looking to cash in on sports fans' use of special media while watching tv. inthe replays could boost twitter's revenues before its highly anticipated public offering. the struggling san francisco 49ers face the rams in st. louis tonight. they'll battle their long-time rivals without the help of alvin smith. he's on indefinite leave and is in a treatment facility after a second drunk driving arrest in the past two years. patrick willis could also miss tonight's game due to an injury. they've lost two of the first three games. 5:16. boy, it didn't take long for things to get out of hand during last night's game between the atlanta braves and milwaukee brewers. a bench brawl broke out during the 2nd at-bat in the game in atlanta. it started after milwaukee's carlos gomez took a very long home run trot around the bases. he also yelled at several of the braves players and then got into a shouting match with the catcher. gomez and two other braves were kicked out of the game. by the way, milwaukee ended up winning the game 4-0. now 5:17. let's check back in with sal for a look at traffic. >> right now traffic is doing pretty well. if you are driving around the bay area there are no major problems to report. let's start off with a look at interstate 880 in oakland. you can see traffic is moving along nicely here in both directions. also we're looking at the commute right now on the bay bridge approach. it's been a very nice drive. no major problems if you are driving over to the coliseum. and if you're driving across the san mateo or dumbarton bridges, those bridges are looking good. no wind advisories yet although it's breezy out there but still not really that gusty. 5:18. let go to steve. thank you, sir. a very, very good morning. clear skies. a little cool for some. not too bad for others. nothing outrageous on the breeze yet. but i'll keep an eye on things. i've seen about 30 mt. diablo. it's a northerly direction. so we have the red flag warnings out. the rain saturday definitely helped, no doubt about it. we had a pretty good rain. if we hadn't had that, this would be more critical. northeast bay hills goes till friday afternoon. pop-up showers. maybe a few snow showers possible in the sierra nevada. 31 up in tahoe. 27 in truckee. 41 eureka. there's your cool air still working its way in. if it wasn't for the breeze, we would have much cooler lows. we'll probably get those tomorrow morning. red flag warnings out. it goes north bay all the way to san benito county. 48 in concord now. 49 napa. it's close for others. a lot of 50s. any breezes holding this up but if the braise tails off, temperatures drive right down. not much of a delta breeze but there is a northerly breeze. santa rosa is in there. novato. also oakland, north, northwest. some of the higher elvisions have -- elevations have turned northeast. sierra nevada again, maybe looking for some more pop-up clouds and showers. you get a little afternoon heating, that will help. for us another sunny day wall to wall. sunny and breezy as high pressure kicks in a little bit. it's not that strong but we will warm up a little bit. 60s, 70s coast and bay. 70s inland to near 80. near 80. a north wind will definitely help santa rosa and nap pa. windy in the owe on owe papa. windy in the hills. a pretty good breeze, gusts toward vacaville. a lot of 70s around the bay. a lot of mid- to upper 70s for many inland locations. santa cruz will warm up. looks nice on the coast. it's that time of year so we wipe out the fog. temperatures warm up. warmer, not as breezy on friday. clouds on saturday. a possibility of a system in the north bay on monday. 5:20. the world markets are mostly down. one of the few exceptions japan's nikkei. most markets across europe down this morning due to concerns about the american economy and the looming budget battle. our futures indicate a higher opening this morning across the board for the dow. the nasdaq and the s&p 500, that follows some losses yesterday. oil prices falling amid concerns about the u.s. economy as well and falling demand. oil prices fell to more than 102 a barrel on the new york mercantile exchange yesterday. that's the lowest closing price since july 3. time now 5:20. new video to show you from the oil and natural gas hurts farmers and pollutes ground water. chefs are asking brown to declare a moratorium on the practice until a comprehensive study can be completed on its effects on the environment. new video of an american blasting off into space. astronaut michael hopkins and two russian cosmonauts were on board after soyuz capsule when it took off this morning from kazakhstan. they flew six hours and docked with the international space station. their mission will include a space walk with an unlit olympic torch in november. you may still be able to drive one of tesla's cars. they will be add the to -- they will be added to hertz high end rentals. the car retails for $70,000. time 5:24. oracle's c.e.o. larry ellison won't make a firm commitment yesterday but says he wants san francisco to host the americas cup yacht race again. yesterday in front of a packed crowd at the americas cup village, oracle team u.s.a. hoisted the oldest trophy in international sports. they won eight straight races capping off an amazing comeback to beat new zealand. race organizers are estimating more than a million people watched all the sailing competitions on the basins july. however, with fewer foreign entries than expected, the financial windfall for san francisco probably won't be as much as they predicted. the chronicle reports the city will break even or come out this is beautiful. the two bay bridges there, what a shot. it's a bit breezy this morning and a change in the weather prompting some fire warnings around the bay area. steve is here. he'll have all out there. >> it does indeed. thank you very much. we kind of an interesting pattern here. we've gone from rain to warm to now we get sunny, breezy and cooler. some snow flurries, showers in the sierra nevada. for some a bite to the morning air. any breeze is holding the temperature up. if you get calm conditions, then that temperature takes a little dip. 52 san jose to start. a high today of 74. a little warmer today but under clear skies this morning. any cloud cover will be to the northeast. we might get a few clouds but clear skies, cool, breezy. nothing wrong with cool and breezy. sunshine, breezy and warmer later on today. we have the red flags warning out. north and east bay hills seem to be the most focus but nothing too outrageous yet. mt. diablo 34 miles an hour. the coast is clear as we like to say. and temperatures will be really close coast, bay and inland. a northerly breeze. sunny and breezy today. highs mainly 60s, 70s. any time you can get a little north breeze, santa rosa could check in at 81. a lot of 70s here. good morning. we've doing pretty well around the traffic lane here in the bay area. as we look at the east shore freeway, traffic continues to look pretty good getting up to the east shore freeway at the mcarthur maze with no major problems here. also looking at the commute on interstate 880 in oakland. the traffic continues to move along very nicely. it is moving along well. a little -- you can tell it's a little breezy out there. the camera is shaking. let's take a look at the hayward commute. southbound 880 looks good passing highway 92. contra costa county we do have a little bit of road work in antioch getting over to bay point -- getting over to pittsburg i should say. northbound 680 near olympic, there is a deer reported in at least one of the lanes. 5:32. let's go back to the desk. we are following the developing story we first reported at 4:30 this morning. police say a confrontation between a dodgers fan and a giants fan last night ended in a death. it happened just after 11:30 last night at 3rd and harrison streets at at&t park. officers say there was some type of scuffle between two men. the giants fan is accused of stabbing and killing a dodgers fan. three people were detained in the area and police are interviewing witnesses. time is 5:32. if you're driving in the east bay, you may have noticed caltrans has been testing new signs inned caldecott tunnel. it's causing traffic to slow down. they are similar those installed in the devil slides tunnel. it will let drivers know of lane closures and more serious things like fires or earthquakes. the signs will direct drivers to one of several cross passages that will lead to a safe evacuation. >> i like that. because then you are just prepared. you don't go into panic mode. >> the new signs are meant to prevent a repeat of 1982 tunnel disas we are a gasoline tanker -- disaster. that's when a gasoline tanker caught fire. 17 people were killed. so far no movement in the bart negotiations in the dispute over salary and benefits. >> the ongoing labor dispute will be a issue at the bart directors meeting. also steve glazier will call attention to his online petition to ban public transit workers throughout california from going on strike. he will distribute flyers to bart riders. he will -- he says a walkout would cripple the economy. he points to transit systems in new york, chicago, and san francisco's muni where workers are prohibited from striking. >> time is now 5:34. a santa cruz man is behind bars after being arrested for allegedly stalking children. police think there could be more victims. use mean de la vega joining us now from santa cruz to tell us about those incidents. good morning, jeanine. >> reporter: good morning. it's the quick reporting of students here from pacific collegiate charter school that led them to capture the suspect. investigators say they're now trying to determine how long he's been lurking around following children. here are two photographs showing the different looks of 31-year-old joshua paul james. he was arrested on charges of child important nothing grief as well as child annoying and -- child pornography as well as child annoying and stalking. female students at pacific collegiate school reported a suspicious man photographing and filming them while they were on campus. police linked incidents together and they were able to track down james. after searching his home, they found obscene matter depicting children and they say james had been filming and taking photographs of girls between 13 and 15 years old for his own gratification. detectives seized photography and computer equipment as well as storage cards and they're in the process of meticulously looking through those images to see if there are any more victims. in the mean times james has been booked into the santa cruz county jail. jeanine de la vega, ktvu channel 2 news. richmond police investigating two threatening letters sent to a high school as a possible hate crime. one letter started by saying and i'm quoting, your so-called students are a nuisance at the plaza where my business is located. it also says, quote, i can only hope and pray the next school shooting happens real soon. the high schools now have increased campus security and also alerted parents about those threats. >> we do take them seriously when they come in because you never know what the next steps could be. the number one thing the district has to do is assure the safety of kids before we can even teach. >> the first letter arrived september 12. the second one came a week later. police believe both letters came from the same person. investigators are now questioning business owners near the high school as they continue to search for suspects. police in berkley are renewing their push for stun guns. berkley's police officers union says stun guns would give officers an alternative to using deadly force in confrontations with dangerous suspects. police point to an incident where a mentally ill man stabbed himself several times. >> we had a situation where a mentally ill person was in a crisis obviously. we were called to respond to help him. if a taser had been available, then that individual could have been tased before he hurt himself with the knives. >> this is the second time this year berkley police have asked the city for stun guns. critics say using stun guns can be very dangerous, especially dealing with suspects with serious medical problems. 5:37. an 18-year-old man now considered the only person of interest in that brutal beating of a pleasanton homeowner. police say 51-year-old david lamont was attacked saturday when he tried to confront a group of young people who were making a lot of noise outside of his home. he is still in a coma. investigators say the person of interest does not live in pleasanton. three other teenagers were also questioned but they're only considered witnesses. the university of can fran professor who died in a fire in berkley will be remembered during a memorial service today. former students say andrew goodwin was a brilliant teacher who loved music and pop culture. he was killed in a fire in his home in berkley earlier this month. today's memorial will be at usf's xavier hall at 4:30 this afternoon. public health officials in marin county investigating a potential e. coli outbreak. now, it was detected in three children, two of whom had to be hospitalized. an adult was also sickened. three of the patients live intive ron. the other -- live in tiveron. the other in inverness. they were probably exposed sometime between september 11 and september 15. several bay area businesses say they are expecting a boost in sales thanks to google's new same day delivery service. palo alto sports shop and toy world are one of 15 stores selling its products through google. the store manager expects sales through google shopping express to make up 10% of its business. they're also preparing for a busier holiday shopping season. >> we serve mostly the palo alto area, menlo park, a little bit of mountain view. now extremist group that took over a shopping mall today attacked a security post near a sop mollie -- sow amalia boarder and killed two police officers. the official death toll is 61. there may be more people buried in the rubble there. part of the shopping mall collapsed when the military fired rocket-propelled grenades into it during the four-day standoff. there have alsoen report -- also been reports that two or three somalian americans may have been part of the attack. while that hasn't been confirmed yet, what is known is that al-shabaab has recruited dozens of young men from minnesota the houses of congress by midnight on monday. now the lawmakers have another deadline. the treasury secretary says the u.s. could default on its loans if congress doesn't raise the debt ceiling by nonnegotiable. >> now, today house republicans will meet and talk about legislation to increase the debt ceiling. reportedly they're planning to add several republican priorities to that bill, including building the keystone xcel pipeline, tax reform and also delaying the individual mandate on the new health care law for one year. the people of california will pay the tenth highest rates in the nation for health insurance as part of the affordable care act. here are the average costs of a silver plan in the new health insurance exchanges. people in wyoming would pay $516 a month. in campfire likely sparked that wildfire that started on august 17. it burned 400 square miles and nasa satellite images indicate vegetation is dead in nearly 40% of that area. twitter users can get college board says just 43% of the students who took the s.a.t. this year earned a score of 1515 or higher out of 2400. that's the minimum score for a student to be considered ready for college. the college board says 78% of students who meet the benchmark for being considered college ready go on to enroll in four- year schools. caltrans has installed new traffic lights on a san francisco street where a teenage girl was hit and killed earlier this year. safety improvements are causing some confusion for drivers. officials say the lights on a two-mile stretch of slope boulevard will make it safe forepedestrians to cross but many drivers seem to be confused by the lights which continue to flash red for several seconds after someone has crossed the street. >> nobody here knows. you stop clara high schoolteacher accused with having sex with one of his teenage students is due in court today. he was arrested on tuesday following a tip. investigators say the 32-year- old had a sexual expected to formally charge the teacher during his court appearance today. he is on indefinite leave from teaching. the district said he passed the stringent teacher screening process which includes fingerprinting by the department of justice and f.b.i. a review by the california commission on teacher credentialing also done and the district checked references and says it continues to monitor teachers after they were hired. time now 5:56. a former oakland high school football star is one of two suspects charged with robbing casual car poolers in oakland. the bay area news group reports the 17-year-old dejon ford played football in owingland and was named to several all- star teams. ktvu news was there at the scene shortly after the bold crime occurred monday morning. a second suspect, 22-year-old delonte johnson also faces charges of armed robbery. the two suspects are accused of robbing a dozen people who were waiting in a casual car pool line in oakland's rock ridge area. the san francisco 49ers are setting their sights on college football's biggest game. the team is making a bid to host the college national championship game in 2017 at its new stadium in santa clara. the 49ers plan to play at levi stadium next year and the stadium will host a super bowl in 2016. the national championship game in college football is one of the most watched sports events on tv right
