scene in just a moment. thank you for joining us friday the 13th i'm pam cook. >> and good morning i'm dave clark. we will check weather and traffic right now. we are going to steve paul son. weather is changing. >> it is. we have low clouds in place. between two lows. but this one coming on. i will tell you history tells us we need to keep an eye on this one. each one of these lows looks to be getting a little stronger. this one will move in on sunday. we get a slight warm up today. there is plenty is go around. mild to cool lows. we're a little cooler this morning and there is a lot of drizzle in the forecast as well. it wasn't as extensive for me. some areas are getting pretty good drizzle out there. i don't see much change in this pattern. i don't see much change in my computer model. 50s and 60s as well. a lot of cooler temps by 5-7 degrees. san francisco going 67. there is a little bit cooler lows and a stronger breeze. gust of 30 miles an hour at the altamont pass. today a slight bump up. low clouds and fog. morning drizzle. the breeze has picked up no doubt about it. and that low cloud deck means some 60s, 70s, and low to mid 80s. we are looking at interstate # 80 traffic is -- 880 traffic is moving along pretty well. no problems there. there are no problems by the way if you are driving at the bay bridge toll plaza westbound it's a light commute into the city. and if you are driving on the nimitz freeway heading south out of hayward that traffic is off to a good start. let's go back to the desk. happening right now an early morning fire at a shopping center. tara moriarty is on scene with a look at the damage this morning. tara. >> reporter: good morning. yes, all we know is we arrived a couple minutes ago and this fire broke out shortly after 4:00 this morning. we have a lot of crews here on scene. if we take a look over here you can see this is a strip mall. that is is a pizza parlor and they are up on the roof there. we are not sure exactly where this fire started because no one has been able to talk with us just yet. if we pan over to the left, you can see there is a starbucks. we've been noticing firefighters have been going in and out of there. and they have a ventilator already. we understand there is a wall in the back of the strip mall that may have caught fire. we don't know exactly where the fire started but we are just to give you an idea we are off crow canyon place. that is just off of 680 we have three engines. two trucks here. we are waiting to get an update from the battalion chief. as soon as we get more information we will pass it along to you. tara moriarty ktvu channel 2 news. time is 5:03. we have developing news from san rafael. a speeding car smashed into a tree and part of a house just hours ago. ktvu claudine wong is there to show us the damage and also to tell us what happened out there. >> reporter: in the last 30 minutes police did clear the scene. we can show you now where this all happened. you can see the marks. that tree basically saving this house from further damage. now let me show you what it looked like a little earlier this morning when this car was still right in the front yard of this home. let me tell you what chp happened. it was about 3:00. they were on 101. officers spotted a car going 80 miles an hour. tried to pull that car over. that car went through an industrial area. and made a u-turn and ended up in a residential neighborhood where we are now. went through a few stop signs. still at a high rate of speed at 60 miles an hour. and then lost control and crashed into this house. there were two people inside that car. the driver was taken into custody. the passenger was out on the street and talked to us. he says he was actually asleep just before a few minutes before all of this happened. >> the last 15 seconds of waking up it's like come on turn. and the car losing control. >> reporter: when you woke up were police already behind you guys? >> possibly. i mean last thing i remember is taking a turn too tight and next thing i know we're in the back of a house. >> reporter: was your buddy that was driving were you drink something >> i'm a christian i don't drink. >> reporter: was your buddy drinking? he was the one driving. >> i can't comment on that. >> reporter: he couldn't comment but the chp could. he was intoxicated. they did take the driver into custody and took him away in the back of a squad car. there were people home when all of this happened. we talked to the homeowner who said he was asleep when he heard a loud, loud noise. he came outside. [ inaudible ] >> reporter: and then the police told you to go back inside? >> yeah. >> reporter: what about your house? >> the house is okay. expect for the fence and the tree. >> reporter: the police say the tree saved your house. >> i love that tree. >> reporter: he loves that tree. and back out here live in front of his home you can see that tree did save that house. live in san rafael claudine wong ktvu channel 2 news. time is 5:06. we may soon find out if prosecutors will file charges against a park and recreation worker who ran over a mother. thomas beer mouse ky allegedly hit and killed christie while driving a city work truck. she was sunbathing with her baby daughter. a new police report shows a sharp increase in crime in berkeley during the first six months of this year. robberies are up 25%. burglaries rose 34%. there have been four homicides this year so far in berkeley. there were five for all of last year. the police chief plans to present the findings to the city council next week saying that they show they need more officers on the street. california lawmakers approved the state to give the highest minimum wage in the nation. janine de la vega joins us from east palo alto. janine. >> reporter: pam, here at this mcdonalds workers start at $8 an hour. that's what i was told by employees. but they said an increase to $10 would greatly help. the legislature voted to hike the minimum wage to $9 next july and raise to $10 by january of 2016. governor brown has indicated he will sign the bill. the move is touted by democrats that say it's needed for the state's struggling workers but raising the rate is being called a job killer by republicans that will lead businesses to automate and result in fewer lower paying jobs. in san jose the minimum wage is already at $10 an hour. here's a look at some of the states with higher minimum wages than california. washington has the highest at $9.19 an hour. oregon pays $8.95. and vermont is $8.60 an hour. back out here live we do plan on talking to employees as well as people who go to these businesses and stuff to see what they have to say about the minimum wage hike. reporting live from east palo alto janine de la vega ktvu channel 2 news. time is is 5:08. a bill to add more emergency exits in limousines also passed a state senate. now it's going to the governors desk. ellen corbett proposed the bill after the limousine fire that killed five women back in may. this requires limousines have two rear side doors and one emergency rear push out window. sometime today firefighters expect to fully contain this huge wild fire on mt. diablo. cal fire now confirms target shooting set off the fire on the east side of the mountain. several neighbors say they heard target practice shooting early sunday afternoon right before that fire started. there is no word yet on who set off the fire which is one of the biggest on record on mt. diablo. >> to come back and see this is very shocking. and in the short run it's shocking but you know i think it's a good thing in the long run. >> the vegetation will be able to come in and nature can heal itself. >> mt. diablo state park has been closed since the fire started on sunday. it is now set to reopen on monday. we have new information about a fast moving grass fire that forced evacuations in san anselmo late yesterday. a homeless man is in jail he is accused of throwing a match that started the fire. crews were able to keep the flames away from several homes on sunny hill drive. the destruction from the huge wild fire burning in shasta county is a lot worse than thought. we will let you know from a volunteer fire chief that lost his own house while trying to save others. heartbreak for those working along the new jersey shore. we want to take you out there live this morning. boy, you can see the devastation there and firefighters appear still putting water on this popular board walk again in ruins. flames fueled by 30 miles an hour winds engulfed this tourist area yesterday morning. about 50 businesses burned to the bound ground and these shops were still recovering from super storm sandy last october. >> i'm devastated. my heart goes out to all of these people. >> it's staggering to believe that it spread so fast and so far from just that one store. >> two firefighters suffered minor injuries. we understand it started in a frozen custard shop. the fire raced down the board walk because winds sent flying embers on to tar roofs of businesses there. happening right there thousands of people rushing to higher ground in boulder, colorado. there is a warning a 30-foot surge of water, mud, and debris may be heading their way. 4,000 people are under a mandatory evacuation order. three neighbors have also been evacuated. the evacuation orders came days of rain that triggered flash flooding. >> we saw the creek which is just beyond our fence rise to the edge of that fence and put in more rock just to avoid seeing this happen. i'm sure the creek will be completely redone. it will have a different pathway. >> the colorado's national guard has been called in to help evacuate people in some of the areas. one area has been completely cut off by the flooding. president obama has declared a state of emergency in three of colorado's counties. it's 5:12. taliban fighters attack the u.s. consulate. the gun battle between the attackers and afghan security forces. plus the new al qaeda threat. a bay area family struggling to get by is trying to make do with what they have. it's temporary homes for the past two gate park. 5ñ new this morning john kerry is in switzerland. it's day two of the talks for a plan for syria to give up its chemical weapons. here is some video. in a news conference after their meeting today kerry said the talks have been constructive. >> we are beginning to work together in hopes that those efforts could pay off and bring peace and stability to a war torn part of the world. >> they also talked about trying to set up a second peace conference on syria but says that would require success first with the chemical weapons talks. taliban fighters attacked an american consulate in afghanistan today. all american personnel at the consulate are safe. the attackers used car bombs and guns. at least three members of the afghan security force were killed along with five of the attackers. the new leader of al qaeda is calling for attacks on the united states. in an audio message posted on the internet. he called on his followers to plan a large strike on the united states. even if it takes years of patience to carry it out. he named the boston marathon bombings on april 15th as such an example. happening today the penalty phase is not going to continue in marin county. they are asking jurors to when the death penalty. he is also suspected of committing at least two more murders. they are often the forgotten victims of the recession. they have identified 47,000 children living in motels nation-wide. the number of homeless kids in public schools has also jumped 38% since 2007. the ramirez family part of that statistic, mom angel, dad robert, and their boys live in a room at the easy 8 motel in newark. they were evicted from their home two years ago when robert marrier maze lost -- ramirez lost their job. >> they will still talk about our house. >> motel rules require guests to leave after 21 days. the family must check out and return after two nights. although the dad now has a job they don't have enough money to pay the necessary deposit for an apartment. newark school administrators say there are 250 students identified as homeless and in need of a system. time is just about 5:19. let's get you where you need to go. sal the roads? the toll plaza? >> things are okay for the moment as we get across the bay. as we look at the commute here. westbound bay bridge there are no major problems trying to get across the bay. and no problems if you are driving to san francisco along the freeway system there. the traffic also looks good on the san mateo bridge as you drive through. it's not a bad commute at all. as a matter of fact, a little bit of mist there. i think steve is looking at this picture saying yeah, you see? let's talk about 580. a little bit of slow traffic from the altamont pass. 580 does look good over to castro valley and hayward. dumbarton bridge looks pretty good. 101 and 280 are doing well. >> i hope that is mist there. otherwise my eyes are not too good. [ laughter ] we do have a lot of mist. chris richardson tweeted me saying we've had heavy mist and drizzle all night long. there are pockets of areas where it's misty and drizzly. one low here. another stronger one. next friday we could see our next rain of the season. we will be here sunday for a little cool down. gusts 30-32. lots of drizzle. cooler lows. still low 60s but moore 57. 57 walnut creek. 57 san francisco. that is cooler by five degrees than yesterday. westerly breeze of 22. sfo13. livermore 60. san jose has a northwest. that tells me it's not going to warm up too much today. plenty of low clouds in place that are making their annual push. i'll tell you they are not done yet with that rain. amazing amounts of rain. and continues. there is denver. remember they're at 52-80 feet. and boulder is even higher. you're taking this moisture and lifting it. they are getting torrential rain. if you know the area all those areas are reporting very, very heavy rain. they are not done yet. we will keep an eye on things. for us today maybe a slight warmup for those way inland. overall mist, drizzle, low clouds. breezy to windy in spots. low clouds, fog, sun. breezy at times. temperatures definitely a far cry. i think some will be soft low 80s. what we will see is this system will start to move in that low. this will give us another round of drizzle here. sure looks like it to me. for sunday cloudy drizzle. and partly to mostly cloudy. partly sunny and breezy. temperatures starting to come down. it looks like we will keep it there. especially on monday and the huge wild fire burning in shasta county turning out to be far worse than first thought. the fire outside of redding has destroyed at least 68 homes. that is almost double the previous estimate. sheriffs deputies say one man refused to leave his home died in the fire. one volunteer fire chief has been fighting the flames all week. chief doug atkins raced to save one home. just moments after he learned he lost his own home in the fire. >> at that point i was not thinking about my house. i was at a house making sure that one didn't burn. there was nothing in my mind but saving that house. >> the fire has burned 8,000 acres since it started on monday. full containment is expected this sunday. disgraced cyclist lance armstrong gave back the bronze medal he won. he says the bronze medal he won in the sydney, australia games is on its way to the international olympic headquarters now. earlier this year armstrong admitted to using performance enhancing drugs most of his cycling career. he was stripped of his tour de france titles and banned from sr. participating. we're live in san ramon where a starbucks employee opens up the shop for business this morning and discovered a fire. the low over my shoulder will be here on sunday. cooler lows by five to seven degrees. santa rosa 54. some low 60s but hayward 57. san francisco starting off 57. going 67 a little cooler today than the last couple of days. for the morning fog and drizzle clear and breezy. mostly sunny. breezy to windy though. temperatures 60s and 70s and 80s. unless you are up in the sierra, nevada you will have see the road sensors not showing a lot of activity as you drive on 80. now let's go back to the desk. happening right now an early morning fire at a strip mall in san ramon. tara moriarty is the first reporter on the scene just about 30 minutes ago and joins us with the damage and details of what happened. >> reporter: firefighters are hunting down this fire right now that started inside the strip mall. they believe it began in the starbucks right over here to the left and it raced in both directions and that is why you see the firefighters up on the roof there going up on the ladder. they are actually having to break apart the stucco top find the fire and make sure it's out. the flames broke out shortly after 4:00 this morning. right off of interstate 680. crews found the fire at the back of a coffee shop. >> so the starbucks employee called 911 and said there is smoke inside her building when they arrived. so when the crews arrived there was heavy smoke showing from the rear of the structure. guys made entry into the building. there was a lot of smoke inside the building. >> the fire spread through the walls. we have three engines and two trucks on scene. not much damage. they've got all the ventilators out. but the fire appears to have started on the outside of the back wall. we're not sure if it started inside the starbucks or on the road behind it. that is something the fire investigator will have to try to figure out. live in san ramon i'm tara moriarty. a berkeley woman is pleading for the public's help to find her fiance's killer three years after his death. amber nelson says she was walking with her fiance after celebrating his birthday on september 12th, 2010 when two men tried to rob them. she was punched in the face. he was shot to death. >> it's now three years and there is still no major leads. there are no name suspects in the investigation. >> she says she visits the spot where sell don -- celedon was killed. an onramp and two southbound lanes were shut down for nearly two hours as chp investigated the crash. the driver reportedly stayed on the scene. we have not yet heard why the pedestrian was walking on the roadway. janine de la vega is palo alto janine de la vega ktvu channel 2 news. time is 5:37. unindictmented immigrants may be able to get a california's driver's license. supporters say the bill will make the roads safer by giving unindictmented immigrants that already drive here in california a chance to do it legally by getting licenses and insurance. the licenses won't work for voter legislation. more than 100 people were arrested during immigration reform protest. a group of women some who are undocumented immigrants formed a circle in the middle of the intersection right in front of the u.s. capitol building. activists say they will ramp up the pressure on the government this month and next month for immigration reform. san francisco based twitter is going public. the seven-year-old company is taking advantage of a new law that allows it to file confidential paper work for its new ipo offering. the company announced its ipo filing of course in a tweet. >> it's an exciting new technology. twitter has obviously been a critical, a social force. it has a broader political effect on the world. it's a new communication tool. >> analysts say the timing is closely to facebook's stock. this week facebook shares hit a record high and now trade at more than the ipo price. now to continuing coverage of the bart labor talk. telling bart workers don't expected a lot more money when major negotiations resume next week and the board has no plans to intervene in the contract talk. the two sides are so far apart on the main issues with the new strike deadline less than a month away. bart management rejects the unions claim national this labor dispute is stemming on concerns about workers safety. >> safety is just a smoke screen. they don't want to talk about the fact they want a 20% pay increase. >> i think it's unfortunate when people think of those things as we are trying to use them as leverage or bargaining chips, that is not the truth. >> the two sides haven't had a joint bargaining since july 11th. there is word this morning of a possible labor agreement for san francisco police officers. the examiner reports a deal includes a multiyear 5 burst pay raise for most of the police department. but new recruits would be facing a possible pay cut. city supervisors are expected to give final approval to this deal next week. a judge is allowing the city of richmond to go ahead with the plan to take over troubled mortgages. they filed suit to block the plan. but they -- willie brown says he feels blessed and honored to have the new western span of the bay bridge named after him. the california state senate has given final approval to change the name to the willie l. brown bay bridge. >> to have an african american adorn any instrument in california for the first time in the history of this state is unusually significant. >> brown says the next step is to raise money for road signs depicting the name change but opponents are not giving up. one man as filed a lawsuit claiming the legislature broke its own rules by failing to seek local consensus and naming a structure after a living person. governor brown does not have the power to veto the decision. a day in court for the three suspects in the boston marathon bombing. the charges they face for hiding evidence. scaling back on chemicals. the new pledge by walmart. all right. and right now we're still right now. a fire killed 37 people this morning at a russian psychiatric hospital. victims include patients and a nurse trying to guide them to safety. investigators think the fire may have started from a patient smoking that hospital dates back to the 19th century. time is 5:44. hopping -- happening today a school in the east bay will honor the life of an american ambassador. ambassador christopher stevens was among four americans killed in the attack on september 11th, 2012. ambassador stevens graduated from piedmont hospital in 1978. at halftime, the school will hold a moment of silence in his honor and renounce they are renaming the library the ambassador christopher stevens memorial library. in boston the three suspects in the boston marathon bombing case are due in court today on charges they hindered the investigation of the attack. they will be arraigned on charges of lying to investigators and obstructing justice. three people died in that bombing. more than 260 others were hurt. special fundraiser next week to support bryan stow. it will take place september 24th during the game against the dodgers. $10 out of every ticket sale will go toward the byeon stow fund. they will declassify part of a 2008 court order that required yahoo to turn over classified data. they order the court order be released that way it can show it objected strenuously at every stage but the objections were overruled. nasa's voyager one has become the first earthly object to leave the solar system. a new study suggests the probe drifted off in august of last year. voyager one is expected to be outside the helios fear. it has been on a long trip. it launched back in september of 1977. a flight that would make someone very superstitious a nervous wreck its landing right about now. it's flight 666. it's flying from copenhagen to new sinky. and it's on friday the 13th. now the pie not says the numbers have been a joke among the staff. friday the 13th considered bad luck in a lot of companies. numbers 666 have the devilish biblical associations. >> but flight 666 to hel hmm.  sal, would you take that flight? >> i'm not generally superstitious but why push it? we are in the whole year of 2013. so i guess i got over that. let's take a look at the commute now. of course anyone who does get into a crash today will remember that they got into a crash on friday the 13th. that is just the way it goes. and they will become superstitious. northbound 280 that traffic is moving along pretty well. no major problems here. i got word from chp. six vehicles, one big rig. if you are driving into richmond, 80 still looks good down to oakland. now let's go to steve. thank you, sal. a little low out here will play into our sunday forecast. we'll have more on that in a moment. there is plenty of good breeze and lots of low clouds. windy at times. pretty good gust. cooler lows this morning. and drizzle forecasted again. more 50s today than the 60s. there is no doubt about it stronger breeze. some of the higher elevations at 30 miles an hour. does not look like high pressure will build in that much. unless you are really far inland west. even northwest san jose. so there is a component of a sea breeze in place. plenty of low clouds in place and they are up there pretty high. if you are up in reno, and tar hill or truckee wrap around showers will give you something. mist, drizzle, low clouds, breezy to windy at times for friday. some locations not as strong. a cooler pattern will kick in on the weekend. it looks like sunday will bottom out. fog, then sun, morning drizzle. the breeze has picked up. much stronger today than yesterday morning at this time. more 80s on the temps. couple upper 80s. a lot of lower 80s. 60s closer to the coast. westerly breezes will take the edge off some of the afternoon temps. sunday looks cooler as that system begins to move in. in fact, i think that will be the main day as that system works its way in. we will see the pattern change a little bit. not a lot. breezy and cooler as we go into sunday. it looks like it will stay that way into monday and tuesday. pam and dave. >> thank you, steve. john muir health has announced it's cutting jobs for the second time this week. they announced they are -- in  anticipation of falling revenues once obama care takes effect. google continues to expand in the bay area. google has leased an office building in sunnyvale where it plans to move 1,000 pleas. he meets the office. georgia also rented 715,000 square feet at that complex last year. annual -- the nation's says kay was angry about being called to testify about noise former neighbor. that neighbor is ten years older than kai and reported to a judge he's been in contact with kai. police are trying to identify a woman found dead in petaluma creek. detectives found the woman's body yesterday afternoon in willow brook creek. it appears she has been there for several days. police are reviewing -- families of five missing men in san francisco are scheduled to hold a vigil in golden gate park tomorrow to call attention to the investigation. family members of shawn city christian hugh, shawn dickerson, cameron remmer, and jackson miller says cases involving missing men often get less attention from police and the community. 19-year-old shawn was last heard from in may when he made aen san francisco's bag ban is about to hit restaurants. the city is making sure restaurant owners know starting october 1st they have to use environmentally friendly bags. and the restaurant has to charge 10
