significant. it was a heavy day out there. >> reporter: nick vaughn, a pro from l.a., made a special trip to mavericks. he says surfing these take equal parts common sense and guts. >> it's dangerous. you don't want to hurt yourself and ruin the season. >> reporter: the assistant harbor master says these waves are best observed from a distance and only surfed by the pros. >> they're going to do what they do, but for the general public, they're beautiful to look at, but stay at a safe distance, otherwise things can go bad fast. >> reporter: another professional surfer, savannah, decided to get some perspective. >> it's big and the conditions are tricky. you can see how messy it looks. it's not an easy day. even just a paddle out will take an hour. >> reporter: officials said the winds and conditions just weren't right for the titans of mavericks event. the assistant harbor master says this is all part veal anyone yoe, and he's expecting more big waves through the weekend. julie. >> beautiful scene out there. ann, thanks very much. fallout continues from the storms that hit california this week. a rockslide has shut down state route 140 into yosemite national park. these are pictures taken from opposite sides of the slide. it's so bad that caltrans doesn't even know when the road will reopen yet. fortunately no one was injured. the skies did clear today. we are getting a break before another storm comes on shore. let's go straight to meteorologist mark. >> these breaks are so important with that storm sequence out there. tonight it's fairly nice. just a few high clouds paying aus visit, but all these storms, really a boost to the surf. take a look at some of the reports. 15, 17, 19 feet. the high surf advisory will expire at 4:00 a.m. tomorrow but it has been a very active weather week going back in time from sunday to monday morning, then yesterday we had the system out there, even tracking a few rain showers earlier today. all those numbers really adding up. take a look. these were from the system from yesterday with santa rosa picking up over two inches of rain, san jose nearly half an inch of rain but those numbers, it's been very beneficial. beautiful outside 0. you can see the sun setting behind san francisco. just a few high clouds. partly cloudy conditions. on the radar, there's in the a lot to show you right now but we will go ahead and expand the view. this is our next system developing offshore, that cold front, and this will be a factor later in the day friday, possibly into the weekend. we'll talk more about the timing and how much rainfall you can expect in a few minutes. breaking news in the sacramento area. a person has been arrested tonight in connection with national security. this is according to the u.s. attorney's office. very few details at this point. we just know it is connected to terrorism. that's according to officials. it is one of three arrests today. we believe they are connected this one in sacramento, one in houston, and another in milwaukee. we are working to get more information and we will have an update on-line and coming up at 6:00. police now say they know who fired the shots in downtown oakland earlier this week that injured an innocent bystander. police say this man pulled out the gun and started shooting tuesday morning. it happened during an argument on broadway just around the corner from city hall. valdez was last seen wearing a light colored coat and white pants. police found a gun a block from the scene. they think it was the one used in the shooting. the woman who was injured is expected to be okay. the couple charged with a horrifying deaths of two kids and the abuse of a third has been moved to the monterey county jail. police arrested 39-year-old tammy huntsman last month after they found the bodies of the two kids in a storage locker. the coroner says they died from ongoing physical abuse. they found the third child starving and freezing in an suv. police say huntsman may be the children's aunt, and that they were in her custody at that time time they died. both of the suspects are set to be arraigned tomorrow. a castro valley woman accused of attacking a muslim man pleaded not guilty today. cell phone video shows the 50- year-old confronting and throwing coffee at the man. the video went viral. a group of muslim men say slader assaulted them as they were praying in a park on december 5th. slader told ktvu she's a christian and believes their god is the devil. she is now facing trial for misdemeanor hate crime. the jury in the raymond chow trial wrapped up its third day of deliberations. during the trial the prosecution portrayed chow as a gang leader who ordered the deaths of two people. chow pleaded not guilty. his defense attorney argued the prosecution didn't prove its case and it was based on testimony from untrust worthy informants. the ntsb released their preliminary investigation into a plane crash that killed a south bay family near bakersfield. the report confirms the small plane broke apart in midair before crashing. it happened on december 19th. the plane was flying from san jose to henderson, nevada. the ntsb is still trying to figure out what caused the plane to break apart. other pilots in the area reported dense clouds in the sky around the time of the crash. the pilot was jason thomas price. he had nearly 270 hours of flight experience at the time of the crash. he, his wife, and their three children were all killed in that crash. renovations are nearly done on san francisco's dolores park. so far more than $20 million has been spent. workers are now putting on the finishing touches. there are new picnic benches, new grass, and the park is more accessible to the disabled. one of the biggest complaints over the years has been graffiti and trash that people leave behind. >> i think there will be enforcement backed up by reminders to people to take care of their trash, not put their waste, whether it's human or otherwise into this park. >> the new restrooms are now built into the side of a hill. dolores park is set to reopen next thursday one week from today. governor jerry brown unveiled his new budget proposal. it's a record $170.7 billion plan. keba arnold is in the newsroom to explain how the money would be spent. >> reporter: the plan calls for significant increases in funding for education, healthcare, and infrastructure. it also includes adds 1 billion compromise on a new health insurer's tax. it replaces one that will expire in june. brown said the tax is critical to maintaining the state healthcare program for the poor. >> most every program you are going to hear about in the next nine months will be good and will help people. but we also want to look at what's the capacity of the state and what's the willingness of taxpayers to pay more. >> reporter: governor brown said tax revenues allow the state to boost spending on programs but he also warned of the boom and bust cycle proposing to put an additional $2 billion into the rainy day fund. critics now of the governor's budget plan say it's more of the same and nothing is actually getting done. >> we're still not seeing an emphasis on repairing our roads. we've got a budget that's for they were years has been at 10 billion a year. i'm trying to figure out why he's asking us to raise gas taxes when he hasn't fixed caltrans. >> reporter: the long debate begins in the legislature over spending priorities. >> keba arnold, thank you. governor brown also wants drivers to pay a highway user fee. the money would be used to help repair the state's crumbling roads. as cristina rendon tells us the fee breaks down to about a quarter a day for drivers. >> reporter: california's bridges and roads are in much need of repair. the governor is seek new fees and taxes to help. >> the roads we have to deal with, they're just there, they cost money. >> reporter: he's suggesting a fee on all cars, including electric and hybrid, to raise about $3 b. the agency says the fee breaks down to about 25 cents per day. >> i'm generally physically more on the conservative side but when it comes to our infrastructure, the united states has been lagging behind. in the long run it's good for our economy. it increases productivity. >> it's not bad. we can help out, improve our roads. >> reporter: but some feel it's too much even if the difference comes down to spare change. >> we pay enough already. it's already hard living. it's not fair. >> our governor has to think about the minimum wage people, the people with nothing. >> reporter: the proposal is part of the governor's plan to raise $36 billion over 10 years for road and highway repairs. brown says millions of cars driving billions of miles takes a toll. >> it's a lot of wear and tear. you've got to deal with it. that's what i'm proposing. >> reporter: if approved that $65 fee would be against north korea. even a major ally is looking into allegations of nuclear testing in the country. and we talked about the huge waves hitting the coastline. our chief meteorologist bill martin has waves hitting the central coast. >> chief meteorologist bill martin wanted to see those big swells firsthand so he headed outside. he joins us live now from mavericks. the pictures are incredible. what's it like seeing those big waves in person? >> reporter: well, you know what's neat, julie, when i started off early this morning coming out to the coast i went right to sharps park pier. the pier goes way out. the waves breaking over the end of that thing, as big as it gets. but the pier is actually vibrating. i had forgotten but when the waves get this big on the west coast, they actually crash onto the north american plate. it vibrates the north american plate and actually registers on the seismograph at uc berkeley. the waves were that big today. they're registering on the seismograph. we've seen bigger dance in past certainly, but this is sort of what you expect in an el niño year. you're looking at the pier. the pier is 30 feet up to the railing. it was lower tide. at one point that frontage road was closed off because of the high tide. lots of erosion because of the high tide in this big surf. el niño years bring out the big surf because you have these storms lined up out in the pacific, and they are generating wind, which generates swells. the other thing, they're coming from a more westerly direction. that allows the swell, instead of coming from the north or the south, coming in due west, like today, and like at mavericks, you get this giant wave because it hits the coast perpendicular. the swells today easily 50 foot. very disorganized. no way would they throw the contest on a day like this. it was very dangerous. the winds were slightly out of the south. that's how it will being a gain tomorrow. the swells peeked today at noon. 20 feet, 16 seconds. the buoys have since started to tick down but the morning high tides are very dangerous. if you're heading to the coast just to look at these waves, in the morning hours is when it's the most dangerous because the waves are pushing up along the coast. i was here in '82 for that el niño, i was here in '98 for that el niño. an equally powerful el niño. we're seeing these giant waves filtering in. so a very impressive day to say the least along the coast. nice tomorrow, not as big. >> bill, it's kind of odd to be talking about all of these waves yet the water behind you is flat as glass. how far away from the coast are you? >> oh, you know, we're right here. we're at the harbor, frank, and out beyond, another mile and a half out is mavericks. greg is pointing out there now. it's way out there. that's the thing, you come down to watch the waves, you're better off watching on tv or from some other source, because the wave breaks so far out in the ocean. when i was coming down the coast today especially by pacifica, you can see, surfers call it corduroy, but as far as you could see, you could see white water, many miles, 10 miles out at sea. this swell today was pretty epic, huh, jeff. jeff clark just said it. we're call is it epic. surfers don't use that -- well, ey do use it a lot, but it was big. we're expecting more big swells as we head into this el niño winter. >> i wanted to ask you more but we're out of time, about what the conditions have to lake for mavericks to get going but we'll talk to you later. so interesting and beautiful to see those big waves. >> let's bring in our meteorologist mark. you're a serve, too. when you see those waves, what's the biggest wave you have ever surfed? >> maybe if i round up, 12 feet, something like that, and that's scary. those today, 30, 40, some were claiming 50-foot faces. >> what do the conditions have to be like before they say, let's go mavericks. >> it's a very challenging forecast because you want the huge swell to come in, but you also want the clean conditions. not much wind, you want -- and today there's a lot of energy. like a swell coming in from due west, and you kind of want it more from the northwest. it's kind of more groomed, it's what we call more rideable. so it's a tall order to get the perfect conditions out there. but that will be -- they will be looking at the setup as we head into mid winter because we are expecting more sizable surf. rainfall totals over the past four days, those numbers have been adding up. we've been look at the numbers go way up. by the way, all the surf eve been seeing generated by all these storms, they're all linked. santa rosa over four inches, san francisco over two and a half inches, san jose 1.65. the latest on live storm tracker 2, we had some rain yesterday, especially in southern california. they picked up the bulk of the real intense thunderstorms out there and some flooding as well. still some lingering rain showers to our north. there's still a chance we could have a pop-up shower here in the bay area for tonight. but for the most part, san jose 51, livermore has dropped off, walnut creek both in the 40s, 46 to 49 degrees. outside right now, you can see looking out towards san francisco bay, a few high clouds paying us a visit, but a nice thursday evening. we are in the break as we've been advertising because we are expecting another system to march closer to our coastline for tomorrow. 30s and 40s out there first thing tomorrow morning. a cooler start with santa rosa 37, san francisco 48. we're going to have some clouds. there's still a chance of sprinkles but the forecast models not generating too much. still a chance of a shower. 7:00 a.m., mostly cloudy skies. by 12:00, 54 degrees. then by 5:00, the chance of a shower as that next system approaches the bay area shoreline. so we have that active pattern in the pacific. the upper level winds is the key with the storm track here. next storm friday night into early saturday morning, then it looks like another one developing. that will be into your monday forecast. still tracking the showers up to our north. let's keep an eye on that in the short term. for tomorrow, definitely more clouds, and some rain expected late friday night and into early saturday morning. here's the updated forecast model showing you this into tomorrow morning. lots of clouds. this is 3:00 friday afternoon. a chance for a few showers. saturday morning, 1:00 a.m., then we scale back. there is a slight chance of a shower on sunday but a better bet as we head into monday with that rainfall approaching the bay area coastline. temperatures for tomorrow, lots of 50s out there, san jose 56, half moon bay 53 degrees, and here is a look ahead, your five- day forecast, still a few rain clouds, especially friday night into saturday morning. slight chance of a shower on sunday. i would not cancel any plans but it looks like our next organized system moves in monday of next week. the high surf advisory is in place until 4:00 tomorrow morning but still waves are up around 10 to 15 feet. i always see people who they go to the beach, they go a little too close to the water. >> i think the biggest wave i've ever seen is probably 12 feet. i can't even imagine a 30, 40, 50 foot wave. >> can you imagine being a surfer and paddling into that? >> that surfer video, when he was on top and the wave just buried him when he fell. >> that's the thing, you have to commit. i don't really know what i'm talking about because i don't do it, but once you pull back, you're -- >> you are either all in or you're going to have problems. >> fun to watch from shore. coming up, sheriffs ask armed men in oregon to leave. now the countdown is on until the men must respond to that request. and the san francisco community that's calling for change following a deadly police shooting. the demand now for sweeping reforms and what the mayor is saying about that. >> group of local sheriffs asked the armed men when took over a wildlife refuge to leave. they were given until tomorrow to decide. the sheriff's deputies didn't say what they would do if the armed group refuses. the takeover has divided rural oregon. some residents of harney county wept there to show their support for the protest. >> seems a little over the top and extreme but how else are you going to get everybody's attention to get it out there? >> they wouldn't have done what they did with the refuge, our voices in harnett county would not have been heard. >> hundreds turned out for a meeting last night. they say they want the protesters to leave so they can get their lives back to normal. strong reaction continues tonight to north korea's claims to test firing a hydrogen bomb. talks are underway to bolster america's military presence in the area. >> reporter: intelligence officials are hard at work trying to determine if the test really was a hydrogen bomb. but the political fallout is already being felt. china, north korea's strongest ally, is calling for the resumption of de- nuclearrization talks to continue. >> it is the common responsibility and requires joint efforts from all sides. it takes two to tango. >> reporter: but in south korea there are strong calls to a response to the test. u.s. pill terry presence could be bolstered in the area but many officials see the test as a political maneuver designed to bolster the rule of kim jong- un. >> the nuclear test is an accomplishment of kim jong-un. >> we will work very closely together to determine the steps that we can take in order to address our increasing concerns about that nuclear test. >> reporter: congressional leaders say there is strong support for a sanctions bill and it could be ready for a vote as soon as next week. >> it is good news for drivers but bad for the energy markets. crude oil prices fell to the lowest level in 11 years. gasoline futures followed by moving lower. one reason, gas consumption fell late last month and gas prices have been falling, too. aaa says prices are down nearly 9% from a year ago. analysts say prices could continue to fall another 10 cents next week. on wall street another bad day as stock markets plunged again. the dow lost 392 points, more than 2%. nasdaq fell 146. it's down for six straight days. and the s & p gave up 47 points in its worst ever four-day opening of a new year. today's declines are the result of continuing turmoil in china's markets. still to come here, the eyes of the tech world on las vegas this week. it's day two of the consumer electronics show. we're going to look at one item in particular that a lot of people are talking about. also ahead, the second batch of results is in. see if steph curry was able to overtake kobe bryant for first place in all-star game voting. law enforcement looking to show their support for the super bowl in the bay area but some agencies aren't getting the chance. super bowl 50 at levi stadium is now more than a month away. a number of firefighters are commemorating the super bowl with special badges on their uniforms. first responders in one local department are not being allowed to wear them. >> reporter: levi stadium is buzzing with activity as the renovations for super bowl 50 are well underway. the santa clara police department has a major role ensuring the game goes off without a hitch. >> planning is going fantastic. we're working together with our partners, all of the surrounding agencies, our federal partners. >> reporter: now these officers are wearing the super bowl logo with pride. >> it gives aus sense of belonging. what a better way taupe joy the super bowl by have it being worn on your badge. >> the officers and firefighters are paying for their own badges which cost about $150 each. not every department involved can wear a super bowl badge. san francisco police have the badge but officers aren't allowed to wear them on duty because the chief doesn't want multiple badges confusing the public. >> the chief really felt that a sporting event didn't rise to the occasion to replicate our badge, which it's never been replicated in150 years. >> reporter: at the union headquarters this is a hot button issue. >> it's upsetting to me personally and to our membership. >> reporter: while the chief and members of the commission made this dizzy, firefighters may still be able to get badges. their union has applied with the nfl to create badges of their own. they would look exactly like department badges. >> i'm born and raised, native san franciscan. >> reporter: the california highway patrol is allowing its officers to wear the special badges. opponents of the new warriors arena filed a lawsuit. a mother of a boy with a severe heart condition joined the mission bay alliance in trying to block the mission bay arena. the mom is worried that game day traffic will block access to the children's hospital. they filed the lawsuit insuperior court. the suit argues that the planning commission ignored environmental and traffic impact when it approved plans for that arena. one nba player has more all- star votes than steph curry after the latest results were released. kobe bryant leads the league with 1.3 million all-star votes. curry is in second place with just under a million votes. as of now curry has the most votes among the guards in the league. that would put curry in the starting lineup for next month's game in toronto. as it stands now draymond green also has enough votes to start the game. what would you do with biggest draws, virtual reality head sets. >> one of the realities is that once you put it over your eyes you're perfectly immersed in a virtual world but you can't see the world around you. if someone walks into the room or if there's a big piece of furniture, you can hit your shins or walk right into somebody. >> the show also has all of the latest fitness and health tracking systems and smart home technology that changes the way we live. ces runs through saturday at the las vegas convention center. an unusual christmas tree recycling program has come to an end because they reached capacity which essential men's all the goats are full. people who were able to crop off their trees at this goat landscaping business in san francisco, the goats would then eat them. city grazing wrote on its facebook page, the goats are full, and they're refusing to eat any more. you can still put your trees on the curb next to the recycling bins. they will be picked up through the end of next week. the count there is down is on. officials have one month now to get their super bowl city ready for the big game. we will talk to the maine charge. also ahead, authorities in france kill a suspected terrorist, and it happened on the one-year anniversary of the charlie hebdo killing. what's interesting is what the suspect was wearing when he was killed. also, donald trump is dipping into his bag ethan couch to texas today. tanya couch had already been extradited from mexico to california. she is expected to be arraigned tomorrow on a charge of hindering the apprehension of a felon. in this case her so. bond is set at a million dollars. her son is being held in mexico city. he made news after he was given probation by using an affluenza defense after he killed four 0 people in a drunk driving crash. on the same day france marked the first anniversary of the charlie hebdo attack police shot and killed a suspected terrorist. a man wearing a fake explosive vest and waving a butcher knife was shot bey officers today outside a police station. prosecutors say he carried papers with the symbol of isis and was shouting, "god is great" in arabic. initial reports only included a minor planning, this man knows. >> i would say the state of preparation for the super bowl is strong. >> reporter: keith bruce, ceo of the super bowl 50 host committee says two-and-a-half years of planning are about to pay. >> we're really starting to move from all that planning to execution. >> reporter: all of the foot of san francisco's market street area will be trance folder into super bowl city designed primarily for bay area people to share the experience. but a lot can happen in the next three weeks. >> each and every day we're reevaluating the plans that were set last week knowing we the weather for today with some clouds out there. actually a fairly nice thursday. but we are looking at this system that could generate some rainfall. there's that system moving across the region. at least approaching the region. right now things are fairly quiet. i am tracking a few rain showers along the north coast. with that, we have to hold down the chance of a scattered shower for tonight and into early tomorrow morning. but right now you can see lots of 50s for your thursday evening. right now we're showing you this. santa rosa checking in, 52 degrees, some. here's our live camera looking to the bay bridge. beautiful. nice colors. but still a few high clouds paying us a visit. but in terms of rainfall, of course, the rainfall up to our north, the northern portions of the state very important because we have the biggest reservoirs up here. just within the past month shasta up. the rainfall has been boosting the water levels. take a look at the percent of average for storage levels. still way down. you get the idea. this has been a great start but we have a long way to go. not only for this season but also for the next few years. mostly cloudy skies for your friday morning. temperatures will be in the 30s and 40s. santa rosa 37, hayward 42, san jose lower 40s as well. oakland 6:00 a.m. tomorrow morning mostly cloudy skies, mid-40s. then you will see a sun/cloud mix. by 12:00, 55 degrees. i think the best bet for showers will be after 8:00. this will produce more rainfall across the entire state of california. next four day, eureka could pick up over an inch of rain. you get the idea these amounts are not major, but still we're going to add to the totals. it has been a very active week. the next system for friday night, another one set for monday. at least for 0 the. more clouds friday, the chance of a shower by friday afternoon into the evening hours, but a better bet late friday night. here we go. early saturday morning that rain marchs on shore. chance of a lingering shower saturday morning, and partly cloudy skies or mostly cloudy skies by saturday afternoon. there's possibly another shower for sunday afternoon, but i think a better bet later in the day sunday and into monday. temperatures for tomorrow in the 50s. here's a look ahead, your five- day forecast. for a break we'll continue into friday, at least for the first half of the day. maybe a few more raindrops later in the day friday into saturday morning. the stretch continues even beyond mid-january the forecast model is keeping rain around. >> at what point would the bust this drought? it sure seems like we've had a ton of rain. meteorologists say -- >> we had more rain then, last year, than we've had so far this year. >> reporter: so where are we? >> as far as rainfall numbers we're about on normal. >> reporter: what about east bay mud? >> january 2016 we're in better shape than we were in january 2015. >> reporter: the utilities local reservoirs are well stocked but the big sierra foothills are only a third full. >> they probably have twice as much water of what's in there. at this point in the year we're really behind. >> reporter: what we really need is a lot more cold rainstorms coming, a lot more snow, and whether cold enough to keep the snow frozen until late spring. >> snow melt in the springtime melts into the reservoirs, and that keeps the reservoirs full. >> reporter: if el niño fizzles and we have a normal or below normal wet season -- >> if we end up with normal rainfall for the year, it's going to make a minor dent in the deficit that we have. >> reporter: that deficit, thanks to the four-year drought so far, the same as if one of those years it didn't rain a drop. >> we go from being hurt, to really hurt. >> reporter: so what if we get 150% of normal? >> that's going to make a significant impact on the drought. there will still be some areas, reservoirs won't recharge totally, groundwater won't, but it will certainly get things going back in the right direction. >> reporter: what if we get double normal? >> if it's spread out, so the water can be managed, most of the reservoirs in the state will be back into the green for sure. >> this is very early in the season still. what we need to see is the kind of rain that just came through a few more times. >> reporter: the meteorologists define that as a steady rainstorm for 75 of the next 100 days. so in april, when the traditional wet season ends that will really put a department, a big department, in the drought. tom vacar, ktvu fox 2 news.
