chanting loud enough inmates could hear about 50 protesters marched outside the camp -- centric clara county main jail armed with signs that said file charges on the deputy and inmates deserve safety. >> not in vain. >>reporter: they prayed for the family of michael tyree found a week ago inside a week ago inside his jail cell. authorities say the 31 -year-old died of blunt force trauma due to internal bleeding, and bleeding, and arrested three correctional deputies for murder. for some, his death hits too close to home. >> they handcuffed him and beat him up he was bruised all over his body. >>reporter: he claims his son was beat up by santa clara county sheriff deputies while he was in jail. he says his son filed a grievance but officers were exonerated. >> the thing people have mental health issues a lot of times they tend to accept it as other fault something inside setting them off. >> things like they should not have to happen. >>reporter: he represented him in the mental health treatment court and said his death underscores the need for better services for the mentally ill. sheriff laurie smith says as she enlisted that she enlisted the help of the fbi and launching a full investigation into his death. >>reporter: this is not indicative of values we expect an honor with the men and women of this department. >>reporter: revising policy and procedures the sheriff announced she is requesting more cameras for the system. i also checkedi also checked with the da's office and they are still reviewing the case like a charges are filed the agreement for the suspect on tuesday. >> is the thought here that those three officers killed in may and called and said there was an inmate down and tried to resuscitate and save the inmate? >>reporter: there is an investigation into that. we know that they were the three correctional guards plasticine in that cell with the inmates they left and one of the guards came back said man down and other guard pulled the amount and that is when the report was taken so there is some investigation into what happened. we don't know if there was any sort of cover-up or what. so, we will definitely -- i think they are i think they are looking into that. >> i am sure much more information will come out. thank you. developing news from san francisco a kite surfer suffered life-threatening injuries after being dragged into traffic. happened about 3:15 this afternoon. it appears a kite surfer was in a parking lock -- parking lot when a strong gust of wind carried him onto the highway. officers say he was hit by a car and hospitalized with head injury. we will have more as it continues to develop. a san francisco superior court judge wrapped up a hearing for a man accused of killing kate steinle on appearance emphasis cholesterol. the judge found there was enough evidence for the case against juan lopez sanchez to control. to go to trial. >>reporter: public defender. gonzales has wanted the case to be thrown out he says his client would had absolutely no reason to kill kate steinle. aa photograph, flowers and stuffed animals, reminders of our life lost far too young on a san francisco pier. a san francisco pier. this video captured that horrific day, july 1. people rushing to help kate steinle. the 32-year-old shot and killed 32 -year-old shot and killed while walking with her dad. >> you believe he wanted to kill kate steinle why not get closer to her why not fire more than a single time. >>reporter: the attorney for her accused killer says it was an accident. he picked up the gun wrapped in a shirt not knowing what it was. >> he is a homeless person who is in effect destitute. he has nothing. there is no evidence there was ever an effort to commit a crime crime. >>reporter: police say sanchez was sitting in one of these chairs when the gun went off. ballistic evidence shows the bullet struck the ground before striking steinle in the back , further proof, the, further proof, the defensive, this was indeed an accident. sanchez then says he threw the gun into the water in order to keep it from firing again. sanchez and initially told police he was shooting at steals or fish which contradicts the defense's claim the gun misfired misfired. >> it is an individual with a second grade education trying to put out an accident explanation for what happened because he does not understand american jurisprudence. >>reporter: a judge ruled sanchez must stand trial for murder. he argued he was a convicted felon and not supposed to touch a a firearm. he admitted to firing the weapon and that act alone was dangerous to human life. >> we are confident we have sufficient evidence to prove the case, we look forward to trial, we look forward to ultimately bringing justice for kate and her family. >>reporter: and sanchez is convicted he could be looking at up to 19 years in prison because of his priors and the gun charge. of second-degree murder sticks it could be 43 years to life. his arraignment set for september 18. >> i am curious what is sanchez like inside the courtroom and was kate steinle's family there today? (door squeaking) it's finger lickin' good. if you want to head to the russian river this holiday weekend you need to know something. there was a toxin in the river that is being blamed for the death of a family dog. rob [ name indiscernible ] tells us if people are also at risk. >> reporter: for many the russian river is the place to be this weekend. there's a dark side however. there's a toxic algae on the shoreline. >> we will be more cautious and it lowers the fun level of little bit. >> reporter: a golden retriever died shortly after swimming in the river last week. anna toxin a has been found. a new advisory has been issued to pet owners to keep their daughters off -- to keep their pets off of the river completely. >> we have had an algae problem before. >> reporter: dr. john fitzpatrick is a longtime russian river veterinarian. he has seen two recently stricken by this algae and they survived. >> it was on the feet. the other dog they thought had gotten into a small area and drank some water and informative. >> reporter: the county health officials has no human seven reported sick with the algae. health officials face the dilemma of possibly having to close the beaches over the busy labor day weekend. they say that is unnecessary. they advise keeping small children away from where the algae collect. businesses along the russian river do not believe that this will keep people from coming here this week and. >> historically this is a busy weekend in the russian river area. the weather is supposed to be beautiful. i imagine we will have some busy days ahead of us. >> reporter: you may see fewer docs. >> we still came but the dog, we have to keep it at home. >> reporter: for the dogs they get into the river, the best advice is to rinse it off for early -- thoroughly with freshwater. if your dog shows any signs of sickness, sea veterinarian immediately. jerry brown is now offering concrete details on how he intends to pay for fixing california roads, including a $65 a year user fee for drivers. the governor's plan also includes raising taxes on gas and diesel plus $500 million in new pollution penalties. the governor is also calling for $100 million in [ indiscernible ] which is called overstaffed. it is not clear if the governor has the support of the state legislature to pass this plan. let's talk about the weather . we saw amber lee on the great highway earlier. unfortunately that kite surfer was literally blown onto the great highway. it is really windy. >> we have gusts about 40 miles an hour. certainly along the great highway the gusts are nearing that. you saw amber out there and she could barely talk because of the scene that was blowing across the great highway. the winds are blowing in the dunes can be unstable. if you're a kite surfer, it's very dangerous. we are monitoring that story now. it looks like he was down by the sewage treatment plant. we used to call that south lot. that area by south lot, south of [ indiscernible ] avenue is right on the highway. you come up the rocks onto a highway. it's not that big of a pull to get there. in the meantime we have temperatures impacted by the winds, 85 in santa rosa -- santa rosa today, that's a warm spot. 70 degrees in antioch four strong winds at sfo to about 40 miles an hour. this is the system in here. i will highlight it. this is causing all of that. perhaps you know folks up in lake tahoe. this system, number 1, is going to drop the over light -- overnight throws. -- overnight lows. truckee is supposed to get down to 24 -- 42. that's pretty cool. very cool it lake tahoe and snow perhaps at mount lassen and mount shasta as this is to lose in. another interesting bit of information, a lot of the tropical storm activity is coming up over the top. they should be making their way into the great plains as we go to the next couple of days. hurricane moisture will be coming in. a very active pacific and what are pattern -- and the weather pattern that's very active. 77 fairfield, 74 liberal -- livermore, let's check out sfo, 60 -- 35 miles an hour on the wind gusts. it's pretty clear because of the strong winds. the that is because of the low pressure center. you are looking at temperatures that will warm over the next five days. slightly warmer tomorrow, sunday warmer still with low 90s inland. the warmest day of the holiday weekend will be monday, labor day. it's a nice-looking holiday weekend for you. friday should rat -- [ indiscernible ] toyota shelled out $50 million.
