and another area. a driver led the highway patrol on a chase in contra costa county. sky fox is over the scene, a pickup truck with a white camper truck was eastbound on highway four, the chase went on for miles and finally ended when the driver stopped near lake alhambra and antioch. two people took off running, one suspect was detained and the other climbed fences and ran through backyards and was eventually caught. there is no word on what prompted the chase in the first place. the man accused of shooting two off duty oakland firefighters and killing one made his first court appearance just an hour ago. he is being charged with murder and attempted murder. >> jesse gary was inside -- is outside the hall of justice with the details on oliver juinio's arraignment. you've learned this is a free -- three strike case? >>reporter: oliver juinio has two prior convictions for violent crimes , a conviction would result in a sentence of 170 years to life behind bars, that's essentially life. let's look at our video. he was wearing an orange jail jumpsuit and shackles. the argues against, a jail sergeant said he is classified as a level for inmate, the highest security threat given and also classified as an escape risk. prosecutors say last thursday oliver juinio shot two off duty oakland firefighters in the 300 block of east taylor street. jake walter died a short time later at regional medical and his friend was wounded and taken to valley medical. the prosecutor said while the crime is still being investigated by the police, the shooting was unprovoked.>> what you have in this case, two young men came to san jose to enjoy themselves and without provocation they were approached by an individual who fired and kill -- killed walter and injured his friend.>>reporter: officials are talking to witnesses to see if something preceded the shooting, oliver juinio is held without bail, a bail hearing is scheduled for september 14 at 1:30 pm. there is a memorial for jake car associated with an amber alert that was issued for nine-year-old boy. the boy is still missing. the alert was issued this morning for daniel morozov from santa maria esther his mother was found shot to death yesterday. pounds with brown hair and brown eyes. police are calling his father a person of interest in the shooting and they say they believe the boy may be with him. the blue volkswagen golf hatchback that they were looking for was found in santa maria. they believe they may be driving a black 2017th jeep cherokee with the california license plate 1025 -- 7xzk698. authorities are paying attention to airports and border crossings. a deadly plane crash in oregon that killed a bay area pilot, marc rich of menlo park was on his way to view the solar eclipse and the home built plate -- plane took off and was a mile from the oregon airport when it crashed and burst into flames. president trump arrived in arizona for a rally. the president met marines at a marine corps air station and his speech will be at the phoenix convention center and will draw 10,000 supporters as well as a large crowd of protesters. details are emerging about the president strategy for losing battle. >>reporter: rex tillerson announcing the u.s. will rely on india and pakistan to execute the president's plan to eventually end the war in afghanistan and stop terrorism in south asia. did he say in the speech? i had a certain opinion coming in, but when you sit behind the oval office desk other factors come into play. i'd love to see a change in the rhetoric and more reality around thinking about building a wall. it's not so easy in a political environment. i'm not sure that we will see that. >> he's going in to arizona, it's starting to turned purple. jeff flake is a senator and he is up for reelection. trump has been bashing him on twitter. he has stood up to the president. talk about the relationship and mitch mcconnell aren't even talking to each other.>> what's happening is that the republican party i think is now coming into the game. we go back in time and remember donald trump, i will use the word hijacked the republican party. it could've been a democrat, it was a vehicle. everybody said, we have a republican in the white house and we can do a lot. now, on policy you are seeing the cracks in the veneer. when you are taking the top guy in the you. a fast-moving grass fire has led alameda county fire peters -- firefighters to evacuate camp parks. this is a picture of the area that has burnt 200 acres. >> it's 90% contained. that fire that we had, most of the big fires recently have been grass fires rather than those where the fire gets into the trees and you have forest fires. that's the situation just outside camp parks and near to stay away from sit -- civic center park. they want people to be safe and that's the main thing. a group of east bay political leaders addressed the media outside berkeley city hall in advance of a rally this sunday at civic center park in berkeley. the mayor said violent and hateful speech want be tolerated in the city. >> this is not freedom of speech, this is bigotry. this is racism. this is enough albia. there is no place for any of it and berkeley or anywhere else in our great country. >> i really do. it uses technology to its maximum. the technology has been developed in pleasanton and we have validated all of the results. it's all done through a machine. the machine takes a sample and whatever the sample has that is dna capable, it's put into a machine and 90 minutes later there's a profile. in the past it's taken multiple layers of testing for that profile and takes tremendous time. >> and it's expensive? is it cheaper? >> it will be cheaper as it's used more often. our own sheriff's department has been testing it with individuals coming in to confirm their identity through dna. the company has been aggressive wanting to get this into police agencies and crime labs to expedite testing. the expediting can help identify a perpetrator or exonerate someone.>> this was just signed into law, how real is this? >> we've been working on this for about five years with the fbi crime lab and our elected officials. we have de this up to just have the lot changed, i think the system is ready to go and now it will allow the nongovernment agencies to enter results into the national database without going through layers of work. it's validated. >> we've been hearing stories of the dna test that a been sitting for years, rape kits that have not been tested. how much of a backlog is there and how quickly can these new tests wipe out that backlog and how fast will the turnaround be?>> the rape kit still has to be tested through the crime lab, it may be mixed dna, it's not quite as directors taking the sample and putting it into a machine. if the rape kit is analyzed and we are doing it quickly. if someone is arrested and they have the profile from the rape kit and and 90 minutes they can confirm whether the perpetrator is included in the group or excluded. if there's anyone marked the doesn't match they are excluded. that can happen in 90 minutes or less. that's exciting. we are able to utilize technology in a way that's most effective and official -- efficient. california is the primary state and maybe that's because they are here and they been working with us. there are other states that are working with it. our state crime lab has also been testing it and validating the equipment in the anticipation of getting the lot changed.>> thank you new details in the effort to reach -- recall the judge. he's accused of killing an eight-year-old in santa cruz in 2015. a judge will decide if this teenager should be tried as a juvenile or an adult. to keep hair strong against hot styling tools, you need more than a conditioner, ...you need a miracle. pantene 3 minute miracle daily conditioner... has a super concentrated pro-v formula... ...that makes hair stronger* in just 3 minutes. so your hair is smoother everyday. pantene 3 minute miracle daily conditioner. because strong is beautiful. you don't let anything lkeep you sidelined. come on! that's why you drink ensure. with 9 grams of protein, and 26 vitamins and minerals... for the strength and energy, to get back to doing what you love. ensure, always be you. officials are searching for a judge in the efforts to recall judge aaron persky . jesse gary reports the state attorney general has spoken. >>reporter: attorneys representing the secretary of state appeal the ruling giving judge aaron persky a victory to have him recalled, it halted efforts that have collected 90,000 signatures over five months. >> the attorney general and secretary of state have intervened in the case on the side of our campaign to say we should be allowed to go forward and collect our signatures. grove oak documents filed say he can appeal which will allow the collection to begin. >>reporter: judge aaron persky filed an injunction and said as an officer of the court the secretary of state not the registrar of voters should oversee the recall. he has become infamous after sentencing of brock turner to six months in jail for sexually assaulting an unconscious woman outside a party near campus in 2015. he served three months and was released in september. the sentence which many saw as lenient outraged many in the women's rights movement which would those led to the recall. they say the sentence was handed down after consulting with probation department and reviewing the impact statements. >> our role is to make sure that he is treated fairly, during these recall proceedings and that's all i can say.>> he is desperately trying to avoid a recall election and he is really willing to waste county taxpayer money and to violate the first amendment rights of anyone in the county whether you agree or disagree we have an absolute right under the first amendment to collect those signatures. >>reporter: signature collection are on hold until the court rules and that's delayed until the court can find a judge, all sitting judges have recused themselves in santa clara county. they are now looking outside the county, perhaps a retired judge or one that is sitting on the bench with time to work this into his schedule. jesse gary ktvu fox 2 news. a hearing was held in santa cruz to determine whether aj gonzales will be tried as a note -- an adult. he's charged and killing maddie middleton, he was 15 at the time of the defendant has been held for two years. a hearing was not public and no information is been released on a decision in regards to whether he will be tried as an adult. let's talk about this with michael cardoza, isn't 14 to cut off? if you are 14 you could potentially be charged as an adult in california?>> it depends on the type of crime. the real cutoff is 16, that's normal crimes. when you get into murders and such, it's a 14-year-old cut off. >> this is a murder case. >> where do you see this going? this is a tough call?>> when i was a da and alameda county, the judges had the same power they have now, to decide whether a juvenile should be tried as an adult or be kept in juvenile hall. the district attorney's association in california went in and got that law reversed. the power went to the da and they could, do something called direct charge. if that were still in effect the da could say we are going to try him as an adult. the voters said we are giving it back to the judges, we will let them decide. they have five criteria to look for, one of which is sophistication of the case, the gravity of the case and whether he can be rehabilitated as well as his criminal history. >> they are looking at, if he is found guilty is there a chance for him to be rehabilitated in the juvenile system or is it just so heinous that he needs to go into an adult system and sit there for potentially the rest of his life. >> that is the question and the judge will have to answer that. how bad is the crime? remember a couple of years ago there was a man who drove down tree boulevard in contra costa and killed a family. there was a girl and the husband and a girl was injured severely. there was a question as to how we should be charged. juvenile courts lose jurisdiction and you walk away. should he be tried as an adult or sent to state prison? 90's for some of our hotter spots and we are only going up. this is a look at san jose where it was mostly clear and clearing early in the day. this is another beautiful view and it's mostly clear to the coast. we have sunshine and temperatures warmer anywhere from five, 10, 15 degrees warmer. san francisco 66 and it's beautiful, 71 oakland, upper 70s in fremont and 90 degrees in fairfield and livermore. we have a west breeze picking up this afternoon and gametime is 7:15 pm it will be 63 under partly cloudy skies. the low that brought us the cloud cover yesterday and the cooler weather will move out and we will have high pressure building back in. today, temperatures came up and we will continue to do so through the business week. it looks like by the weekend mid to upper 90s are possible inland. future cast shows overnight the fog will be back in low clouds across the east bay will likely have some in the north bay although this model keeps it at a minimum. it breaks away and we are mostly sunny away from the coast and we could see some sunshine in the afternoon in areas south of half moon bay and portions of the north bay coast. up to -- low 60s around the bay and 65 antioch, afternoon highs will reach 70 in sausalito and upper 80s in st. helena. in the east bay low 70s in berkeley to 90s inland. in the south bay 84, 86 saratoga and afternoon highs along the peninsula will be in the upper 70s. mid to upper 60s and daly city and half moon bay. temperatures will climb through the weekend upper 60s to near 70 at the coast and near 80 bayside and hot inland reserve site called camp parks. this is video when sky fox is was flying overhead. alameda county fire estimates 200 acres burned and there were flames and tall plumes of smoke. the fire is 90%
