>>reporter: the man appears to be barricaded in a home down this street. police have been talking to him for hours trying to get him to come out peacefully. as you mentioned this all started 9:00 a.m. this morning managers at o'reilly's auto parts say they saw a suspicious man and woman come into the store. the man began shoplifting while the woman distracted them. he took about $600 worth of misdemeanor of as police came in the front door the man ran out the back jumping the fence and heading into a neighborhood. residents say he then went into a home where a 19-year-old pregnant woman was sleeping holding her at knifepoint. family members say he let her go but remain hold up in the house that's where he's remain. the swat team known as merge has been out here. they ultimately used a bullhorn to talk to him they tried throwing flash-bangs toward the house of this is a school over a block away. katherine smith elementary and while they did not go on lockdown they did take special precautions when releasing the kids from school this afternoon. >> we head into our recess we made sure the kids stayed inside as much as possible. at the end of the day we made sure parents knew to avoid this particular part of the neighborhood and we give them alternate routes to the community. >>reporter: a woman believed to be the accomplice in this situation is in police custody and again, the residents remain out of their homes on this street and police are here waiting hoping that this man will come out of the home peacefully. heather, ted. >> the u.s. justice department is calling for massive changes within the van fran police department after a string of deadly officer involved shootings. now those shootings as you may remember ultimately led to the resignation of former chief. >> the department of justice relessed findings after a 6 monthlong review of the sf policies. tara moriarity joins us live from the city where federal officials found several deficiencies within the police department. >>reporter: they found no plouffe of racial bias as a whole. also it said they did not disproportionately use force against minorities. however the report did come up with several damaging findings. it was cell phone video like this of mario woods killing by police that spured the review of sfpd by the u.s. justice department. >> there are significant defish says. >>reporter: doj report found sfpd did a poor job investigating use-of-force antibias training and it's not transparent when comes to disciplining officers. the report outlines 272 recommended changes for sfpd which over the past year was plagued by scandals over racist and homophobic text messages and dead lie shootings that left communities angry and filled with distrust. >> i'm proud to report that the van fran police department will accept and implement every single recommendation. >>reporter: the mayor said the department has already made changes over the past several months including outfitting officers with body cameras and more training on crisis intervention and implicit bias. >> fair just policing that treats everyone the same and places the sanctity of life above all else. >>reporter: while the report found no proof of racial bias it did find officers stop african-american drivers in disproportionate numbers and that black and latino drivers were more likely to be searched than whites. >> we all knew these things were occurring. this report just kind of puts the emphasis on this is happening and we have proof it's happening. the question is now what do we do about it. >>reporter: chaplin is the acting chief the police commission is expected to pick three finalist from the mayor to choose from. >> do you think this police chief has to be a person of color. >> i don't think the ethnic background of the chief is significant to me. what's important is understanding of the issues of reform. >>reporter: now the findings which are being called a roadmap to a better police department also said that the city should strongly consider allowing officers to carry stun guns. now how will all these changes happen who will monitor the compartment? the police commission president she's asking sfpd to provide a report on how these recommendations are being implemented at least once a month. back to you. let's bring in lodge time member of the van fran police commission dr. jill marshall. first off i want to ask you your impressions of this report. what stuck out to you? were there any surprises? >>reporter: not really. we knew it was going to be thorough. we welcome the report and like you heard the mayor say and you heard the interim chief say it's a roadmap for us to make the changes that are sorely need flood the city of san francisco. >> dr. marshall. the findings state that there was no proof of racial bias by officers of the sfpd or by the agency as a whole. still there is perception out there. how do you go about changing what even the report found as that ace whole sfpd is doing a pretty good job and in some community is not how they feel. >>reporter: i think the best thing to do to deal with that is to make the recommended changes by the doj. this is an outside agency coming in giving us a report card. it identifies all the areas that we're deficient in and think as we do this and move forward and make these changes the belief will come through. it's up to us to do that and i know the leadership of the commission and of whoever our chief is going to be going to be dedicated to doing that. >> what about stun guns isn't it time. >>reporter: well, it's a recommendation. you know. it's funny i've always said we're only one of two cities that don't have stun guns and now we're the last city because i think detroit is now picking up stun guns. and so it's one of the recommendations as far as i'm concerned. we like to have all the recommendations because even though the city has traditionally -- it's here and that's what they are asking for. >> i've been to the police commission meetings for about 10 years and the topic of tasers has come up every year. and still they are not approved. how much weight do you think this report will have in actually getting your fellow commissioners to approve tasers for the department. >>reporter: i don't know. well i think it will be something is added to the weight of something that the city deserves the police department deserves especially if restraints aren't going to be there. we'll see. the doj report makes all these recommendations, i think it will help. i don't know that it will be guaranteed but certainly can help in making the case for tasers. >> quickly i know you are submitting three names to the mayor i believe by the end of the day today. how soon could we have a new police chief in san francisco? >>reporter: well it's not going to be by the end of the day today as far as i know. there isn't agenda item to come out of that. we're still talking about it i don't know that will happen at the end of the day. >> we will be waiting along with everybody else. appreciate it. appreciate your time and th insight. thank you. >> a man is officially murder charges. 26-year-old john felix will face two counts of first degree murder along with one count of attempted murder. he will face charges for ambushing officers along with a host of other charges. officials say that felix used an af15 assault rifle when he opened fire through a screen door on those three officers. the officers were called to the home bring felix's father who said his son was quote acting crazy and wants to kill cops. if convicted felix is eligible for the death penalty but officials say the state won't be able to make that decision for at least a few more weeks. >> we want to know everything there is to know about this individual his background where he grew up, everything. so it's an exhaustive investigation so we're not ready to make that decision. however i will be making that decision within 3 weeks. >> officers say that jose gil vega and lesley zerebny were killed in that ambush. public memorial for those two slain officers will be held next tuesday. san jose state water polo player is accused of raping two women at a party. but according to authorities he is no longer on campus or even in the country. >> the action the university is taking. >>reporter: this news comes as a shock to students a lot of them didn't even flow about these allegations. university spokeswoman says that two female students came forward in september to report that a freshman water polo player raped them at an off campus party over labor day weekend. san jose state issued a temporary suspension which prevents the students athlete from coming on the campus or participating in any campus events including team practices. he has not been arrested but the van take clara county district attorney's office is reviewing the case. students are frustrated that the university didn't inform them about the investigation. >> i know all my friends have their pepper spray on their key chain and well aware of this type of area what could go down. for the most part i don't think they are too psychologically involved in that. >> you think they should have been warned? >> oh, absolutely. i think everyone should have been warned. which is why i'm so frightened i just now heard about it. i don't know why they are trying to keep it under the curtains. >> especially on campus it's one of the topics that come up a lot by knowing you're more alert and aware about it. i think you should definitely be heard about. >>reporter: the accused students is not from the united states he apparently left the country. san jose state did not issue a crime alert because campus police who interviewed him didn't think he posed a danger. we're told that those alerts are issued when the suspect is unknown and at large and the community needs to take action immediately. reporting from san jose state jeanine de la vega ktvu fox 2 news. authorities identified the inmate allegedly killed bill his cellmate in dublin. the victim is 73-year-old dat long of union city. deputies found him dead in his cell yesterday morning. his cellmate was found covered in blood. authorities believe long was either beaten or strangled to death. officials aren't releasing the suspect's name and say they are having trouble communicating with him. new at 4:00 the embattled ceo of wells fargo john stumpf is stepping down effective immediately. it involved employees setting up unauthorized accounts to meet lofty sales quotas. there are reports that the bank bank's managers pushed staff to also sign up customers for costly over draft protection. exactly how the governor denying initial requests by the clinton campaign after hurricane matthew. floridians now have until october 18th to register. in washington lauren blanchard foxnews. officials say that a student pilot deliberately crashed a small plane in connecticut this morning after getting into an argument in cockpit. the student pilot was killed, but the flight instructor survived. according to an official the instruct or said the student was disgruntled about learning to become a pilot. the two argued and the struggle or was unable to regain control of the plane. that plane crashed on a busy road in east hartford right near the campus of jet engine maker brat and whitney. people familiar with that facility says this crash happened during a shift change and will the potential to cause on the november ballot. this year there are 17 measures voters will be deciding on. today ktvu monty francis takes a look at two tax proposals and a move to legalize recreational marijuana. the tax in prop 55 is not new but extension of an a personal income tax increase approved by voters in the last election when they voted for prop 30. prop 55 would extend that income tax by 12 years but only for californians earning more than $250,000 a year. it's estimated tax would generate between 4 and $9 billion a year for public schools and $2 billion a year for healthcare for low income patients. prop 56 would also help fund the state's medcal program by hitting jet smokers where it hurts most, their wallets. the measure proposes increasing the tax on a pack of cigarettes from 87 cents by $2 to 2.87. you might think this proposed tax on cigarettes is steep but actually california has one of the lowest cigarette taxes in the country. in new york, for example, the tax per pack is $4.35. equivalent tax would also apply to other tobacco products and e- cigarettes. tobacco companies have spent $56 million to defeat prop 56. if it passes the measure would bring in an additional 1 to $1.4 billion to state coffers during the next fiscal year. if prop 64 passes, california would become the fourth u.s. state to legalize the use of recreational mann. it would allow adults 21 and older to possess up to an ounce of marijuana and would allow individuals to grow as many as 6 pot plants. voters turned down a similar measure in 2010. this time initiative was partially bank rolled by former facebook president shawn parker backed by lt. governor gavin newsom. a 15% sales tax would generate a billion dollars annually for youth programs, environmental protection and law enforcement across the state. monte francis, ktvu fox 2 news. all right for more on the marijuana initiative proposition 64 i'm joined by spokesperson and rodger morgan from the take back america campaign who is urging people to vote no on prop 64. first of all let's start with you. why not wait a too years? you know, colorado is out there with oregon but why not wait 2, 3, 4 years get real data on this before making a decision like this? >> well right now we have a broken system when it comes to nonmedical marijuana in california that's something that proponent and opponents of this measure can agree on. we have a system that isn't working. it's important that we tax and regulate marijuana in order to bring in more tax revenue for the state. this is something this measure is based after carefully studying the initiatives that passed in colorado, in oregon and other states and we've really crafted the measure that brings the best possible scenario to california. >> rodger, to that point, medical marijuana is an absolute joke in this state. anybody can get a card and go in this and get weed for whatever reason. why not take control of it, put some drug dealers out of business? >> number one i don't think you can control marijuana or an illicit drug. we've seem to have proven that in the last 19 years in california even where i live in placer county, we have bans on dispensaries and grow sites. and we have 4,000 illegal grow sites. >> it's out there why not legalize it make a little tax revenue and maybe put some bad guys out of business? >> number one don't put the bad guys out of business. in colorado 40% of the sales are still from the black market. it doesn't put them out of business. they don't pay taxes and with prop 64 we're talking about 6 marijuana plants that can be grown in any residence, any apartment. you can't control that. if we brought in the u.s. military we couldn't control that. so, what's happened we haven't had any enforcement at the federal or state level so the whole burden of public safety has fallen on local law enforcement. they are already overwhelmed. proper prop 64 would put the nail in the coffin. >> smoking -- >> i wanted to point out this is most californians agree that the system is in fact broken right now. that's why the polling shows that between 57, 60% of california voters already agree that it's time for reform. they just want to make sure it's done right. and proposition 64 gets it done right. by regulating and taxing marijuana and bringing it out of the shadows, we could put a real dent into the black market that rodger is talking about. and i think the fact that you know you've seen that decline overall in colorado that's something that californians need. again this could generate up to a billion dollars in new tax revenue. >> doesn't legalizing though take stigma way from it won't it inherently over time increase usage and increase usage eventually with teens? >> the the studies show that's not the case. and to your point about minors actually it's a very important one because we want to make sure that there is safety in this this was built into the measure. right now it's actually easier for minors to get their hands on alcohol than it is to get their hands on marijuana. and the reason is that drug dealers don't -- >> i'm sorry, easier for minors to get their hands on marijuana than alcohol. >> it will make it even easier though. >> it will not by regulating it taxing it we want to make sure minors are not allowed inty store that will be sold in supermarkets or anything other than government regulated businesses that are allowed to sell marijuana. >> sounds good but practical? >> no. it's not practical. number one the medical marijuana program doesn't go away. we still got 18 and over that can buy marijuana with a doctors recommendation for a hang nail. so we put this on top of it. the other thing that's never spoken in this whole prop 64 campaign is the fact this is a harmless drug. okay. this causes brain damage for anyone 25 and maybe even 30 or under while the brains are still forming. it can cause loss of iq. mental illness, psychotic breaks leading to violence. addiction, suicide. >> i want to say a lot of those studies have been debunked. this is not about people under the age getting their hands on marijuana. we want to restrict that. >> this is mind altering what about driving under the influence? that's something that hasn't been ironed out. there's no way to really detect if somebody is at a level where they shouldn't. >> the measure actually provides $15 million over several years for the c hp to study and train law enforcement officers to detect impaired driving actually when it comes to marijuana. >> test state along with the handful of others? why not just wait? >> because i think it's time for reform. the system isn't working. i do want to go back to your point about impaired driving it is important. we want the chp we want the law enforcement experts to develop those measures that statewide standard. >> we wouldn't want advocates whether it's myself rodger or anybody else setting take standard we want the expertise of the chp that's why the measure brings in $15 million for them to study how best to do that and train their law enforcement officers to detect impaired driving. >> there are black and brown people incarcerated for marijuana. wouldn't this relieve that issue safer a lot of money in enforcement in our judicial system which is clogged up with marijuana cases? >> no it really isn't clogged up with anybody for simple possession. colorado is a good example if you want to look at it. 26% increase in latinos since legalization and 56% increase in arrest of blacks since legalization. actually went down 8% for whites. okay. secondly on the income question, all of the gallon intentions of taking this money and using it for good causes is a joke. social costs like alcohol and tobacco the social costs are 10 times greater than the income. colorado has proven that. they haven't had any excess income to give to schools which is one of the reasons it was passed. it's destroying the neighborhoods, the traffic fatalities are up 68%. they have actually doubled in california and washington because of marijuana impairment. and we've got at last count 12.6% of drivers in california were impaired by marijuana and that statistic is old. i think it's probably elevated one of 8 people -- >> you get so many different numbers. some numbers say that fatalities have acutally gone down in colorado. >> i believe that aaa study that rodger is citing, there are issues with that study in colorado. i mean, look it's important, impaired driving you know the chp must set a standard for that. again there measure provides funding for that to be done. i think the bottom line is look, you know 60% of californians agree that it's time to reform our marijuana system. okay, that's the support roughly for proposition 64. that's why it's important that they know that it's being done right. they want reform they want to make sure it's being done right and this gets it done right. >> final thoughts. why should i vote against prop 64? >> i think it has potential for destroy this state and nation. this whole proposition is financed by out of state bill ayers as was prop 215. >> that's not true. >> we have a few drug dealers financing itly as well. >> that's absolutely unsubstantiated. >> we don't need more marijuana brain damage we can't keep dumbing down our kids destroying our communities and natural resources that's exactly what this would do. we needless marijuana not more. >> we need to stick to the facts. the system when it comes to nonmedical marijuana in california is not working. people are being incarcerated over this. resources are going to waste. this is an issue that's been studied. this measure is a carefully crafted measure that includes strongest safety protections for children of think other similar measure in the country. californians know that it's time for reform and that's why you should vote yes on proposition 64. >> all right struggle with. >> exactly. it's your profession too. i think it's really, this is the perfect example of how technology can provide so many great opportunities for us. but then also impede some of the things we really love about our relationships and our family life. so, study was just recently done about how parents are sort of when they are on their phones their kids sort of start acting up. their relationships their interactions degrade. and media did a study families are fighting about this. >> okay. so i can sort of you know -- i think of it not only with parent and children, but right. but also like when i'm out with my girlfriends or something. they are looking at their phone. i sort of sometimes feel like well wait a minute. in miami less important than what you have on your phone. i can see how that might translate to a airport child relationship. dad is your work more important than me. >> kids are engableing attention getting behavior. by the way common six media study about device use we found that 72% of kids and adults feel that they need to respond to their text immediately. now i always say every text that comes in is not like de conone we can wait. >> but what about responding to your children immediately? >> you mean when they are right in front of your face? i think what we need to do, we need to draw our boundaries between our technology and family lives. >> how do we do that? >> one of the ways is we can tell our boss i'm taking off early for the soccer game i got to pick up my kids but i'm going to be online later. pick up your kids and say i had to leave work early i need to check my e-mail have that be a ten minute activity. let your kids know what you're doing because then they won't just think you're ignoring them. another thick so setting boundaries turning the phone off. what if some parents feel that's not realistic? >> i think that's a perfect example how our modern lives are really enabling us to sort of work a lot but also get other things done like you can run to the store or whatever while you're still checking your e-mail. we need to be clear about those boundaries i think expressing that your kids i think that you know, i just got a story about how ceos are beginning to draw these kinds of boundaries. bosses and managers need to say if they send an e-mail in the middle of the night they say don't responds to this right away. so we need to be having these kinds of conversations with our co-workers as well as with our kids setting those types of boundaries. >> i think you bring up a really good point why related that tattles are climbing in north carolina 4 days after the hurricane hit the state. the storm is being blamed for the deaths of at least 19 people in north carolina thousands of people are being told to evacuate their homes with more flooding expected in the coming days. >> just during the past three days we're averaging 2 fatalities a day almost all of them due to drowning. we are putting out the report time and time again to stay away from water. >> u.s. is also providing storm relief in haiti sending the u.s. uss iwo jima to bring desperately needed supplies and manpower more than 1700 marines and sailors are on the war ship bringing power generators bulldozers and water pure fires. health officials are fearful of an outbreak of cholera from tainted drinking water. bill wants to talk about this rain i was excited about hearing rain in the forecast i was ready to get to you. >> i got to tell you guys it is going to be real wet. >> we are heading for a real rain event that begins as we head into thursday night friday morning and it's going to be a big player in the pacific northwest far northern california. when i mean big player some areas could see 8 inches to a foot of rain over 3 or 4 days. that's huge because think about where the surface reservoirs are. lake shasta lake orrville are in that quadrant. so that's where we want to water to fall. even though the bay area is on slate to get a fifth that much rain maybe inch and-a-half maybe two inches for most of us. the place where it matters are big surface reservoirs and the groundwater in the valley. but we're going to have rain. you'll notice it first of all on your friday morning commute. there is the system. this is just impressive for middle of october. right. look at that thing. thousands of miles past the date line moisture coming off a dying typhoon. what that means is it's warm, it's moist and it's pointed right at us. when you see this pattern you know you're going to get wet. if you see this pattern further south. we'd be getting real wet what we're seeing here is this pattern focus from that line nor. from marin county north. russian river drainage basin will do well as well. it's already rained in portland of that's where the real hit is going to be pacific northwest portland, probably northern california. but i mean real rain. i think they have flooding issues around seattle snoqualmie pass and places like that. it's not a snow event it's a rain event. it's subtropical moisture but it does bleed into our forecast as we head into thursday night friday morning and then again into the rest of the weekend it's going to be a wet week especially on sunday. here's the system increasing clouds tomorrow. showers late. i'm talking 3:00 in the morning. you're basically into friday morning now. maybe a half inch. if you go north in marin county you may get 2.5 inches on friday's events. but there's more behind it. here's the moisture. there's that plume of subtropical moisture. here comes friday morning. that's your commute. that's not good. that's wet. here comes friday afternoon kinds of drizzly. here comes saturday break and then saturday night look what shows up. there's something behind that on saturday night as well. so, definitely a wet weather period. this takes you through sunday into monday. you can sigh santa rosa is looking at over 2 inches of rain that's unestimating you go south of san jose almost an inch of rain significant, significant event for mid october. are we going to have flooding issues? maybe see urban flood advisory in the north bay ground i not saturated. we can really handle. the creeks are down the reservoirs are down you bring in 6 inches of rain we'll be fine. but in the pacific northwest where they could standing right behind letter. the man offered the officer some money to split the bill but mccloud declined and quickly left without giving letter a particular. i asked if he told flynn about what he people another perspective on police. >> each person i make contact with i want to leave them with the impression that wow that officer from hayward officer mccloud he was a great guy. >> the impact that one encounter has that one moment that officer mccloud had with that lady is going to rest flight for the rest of her life and her children too. >>reporter: this woman is also homeless and stays >>reporter: the man appears to be barricaded in a home down this street. police have been talking to him for hours trying to get him to come out peacefully. as you mentioned this all started 9:00 a.m. this morning managers at o'reilly's auto parts say they saw a suspicious man and woman come into the store. the man began shoplifting while the woman distracted them. he took about $600 worth of misdemeanor of as police came in the front door the man ran out the back jumping the fence and heading into a neighborhood. residents say he then went into a home where a 19-year-old pregnant woman was sleeping holding her at knifepoint. family members say he let her go but remain hold up in the house that's where he's remain. the swat team known as merge has been out here. they ultimately used a bullhorn to talk to him they tried throwing flash-bangs toward the house of this is a school over a block away. katherine smith elementary and while they did not go on lockdown they did take special precautions when releasing the kids from school this afternoon. >> we head into our recess we made sure the kids stayed inside as much as possible. at the end of the day we made sure parents knew to avoid this particular part of the neighborhood and we give them alternate routes to the community. >>reporter: a woman believed to be the accomplice in this situation is in police custody and again, the residents remain out of their homes on this street and police are here waiting hoping that this man will come out of the home peacefully. heather, ted. >> the u.s. justice department is calling for massive changes within the van fran police department after a string of deadly officer involved shootings. now those shootings as you may remember ultimately led to the resignation of former chief. >> the department of justice relessed findings after a 6 monthlong review of the sf policies. tara moriarity joins us live from the city where federal officials found several deficiencies within the police department. >>reporter: they found no plouffe of racial bias as a whole. also it said they did not disproportionately use force against minorities. however the report did come up with several damaging findings. it was cell phone video like this of mario woods killing by police that spured the review of sfpd by the u.s. justice department. >> there are significant defish says. >>reporter: doj report found sfpd did a poor job investigating use-of-force antibias training and it's not transparent when comes to disciplining officers. the report outlines 272 recommended changes for sfpd which over the past year was plagued by scandals over racist and homophobic text messages and dead lie shootings that left communities angry and filled with distrust. >> i'm proud to report that the van fran police department will accept and implement every single recommendation. >>reporter: the mayor said the department has already made changes over the past several months including outfitting officers with body cameras and more training on crisis intervention and implicit bias. >> fair just policing that treats everyone the same and places the sanctity of life above all else. >>reporter: while the report found no proof of racial bias it did find officers stop african-american drivers in disproportionate numbers and that black and latino drivers were more likely to be searched than whites. >> we all knew these things were occurring. this report just kind of puts the emphasis on this is happening and we have proof it's happening. the question is now what do we do about it. >>reporter: chaplin is the acting chief the police commission is expected to pick three finalist from the mayor to choose from. >> do you think this police chief has to be a person of color. >> i don't think the ethnic background of the chief is significant to me. what's important is understanding of the issues of reform. >>reporter: now the findings which are being called a roadmap to a better police department also said that the city should strongly consider allowing officers to carry stun guns. now how will all these changes happen who will monitor the compartment? the police commission president she's asking sfpd to provide a report on how these recommendations are being implemented at least once a month. back to you. let's bring in lodge time member of the van fran police commission dr. jill marshall. first off i want to ask you your impressions of this report. what stuck out to you? were there any surprises? >>reporter: not really. we knew it was going to be thorough. we welcome the report and like you heard the mayor say and you heard the interim chief say it's a roadmap for us to make the changes that are sorely need flood the city of san francisco. >> dr. marshall. the findings state that there was no proof of racial bias by officers of the sfpd or by the agency as a whole. still there is perception out there. how do you go about changing what even the report found as that ace whole sfpd is doing a pretty good job and in some community is not how they feel. >>reporter: i think the best thing to do to deal with that is to make the recommended changes by the doj. this is an outside agency coming in giving us a report card. it identifies all the areas that we're deficient in and think as we do this and move forward and make these changes the belief will come through. it's up to us to do that and i know the leadership of the commission and of whoever our chief is going to be going to be dedicated to doing that. >> what about stun guns isn't it time. >>reporter: well, it's a recommendation. you know. it's funny i've always said we're only one of two cities that don't have stun guns and now we're the last city because i think detroit is now picking up stun guns. and so it's one of the recommendations as far as i'm concerned. we like to have all the recommendations because even though the city has traditionally -- it's here and that's what they are asking for. >> i've been to the police commission meetings for about 10 years and the topic of tasers has come up every year. and still they are not approved. how much weight do you think this report will have in actually getting your fellow commissioners to approve tasers for the department. >>reporter: i don't know. well i think it will be something is added to the weight of something that the city deserves the police department deserves especially if restraints aren't going to be there. we'll see. the doj report makes all these recommendations, i think it will help. i don't know that it will be guaranteed but certainly can help in making the case for tasers. >> quickly i know you are submitting three names to the mayor i believe by the end of the day today. how soon could we have a new police chief in san francisco? >>reporter: well it's not going to be by the end of the day today as far as i know. there isn't agenda item to come out of that. we're still talking about it i don't know that will happen at the end of the day. >> we will be waiting along with everybody else. appreciate it. appreciate your time and th insight. thank you. >> a man is officially murder charges. 26-year-old john felix will face two counts of first degree murder along with one count of attempted murder. he will face charges for ambushing officers along with a host of other charges. officials say that felix used an af15 assault rifle when he opened fire through a screen door on those three officers. the officers were called to the home bring felix's father who said his son was quote acting crazy and wants to kill cops. if convicted felix is eligible for the death penalty but officials say the state won't be able to make that decision for at least a few more weeks. >> we want to know everything there is to know about this individual his background where he grew up, everything. so it's an exhaustive investigation so we're not ready to make that decision. however i will be making that decision within 3 weeks. >> officers say that jose gil vega and lesley zerebny were killed in that ambush. public memorial for those two slain officers will be held next tuesday. san jose state water polo player is accused of raping two women at a party. but according to authorities he is no longer on campus or even in the country. >> the action the university is taking. >>reporter: this news comes as a shock to students a lot of them didn't even flow about these allegations. university spokeswoman says that two female students came forward in september to report that a freshman water polo player raped them at an off campus party over labor day weekend. san jose state issued a temporary suspension which prevents the students athlete from coming on the campus or participating in any campus events including team practices. he has not been arrested but the van take clara county district attorney's office is reviewing the case. students are frustrated that the university didn't inform them about the investigation. >> i know all my friends have their pepper spray on their key chain and well aware of this type of area what could go down. for the most part i don't think they are too psychologically involved in that. >> you think they should have been warned? >> oh, absolutely. i think everyone should have been warned. which is why i'm so frightened i just now heard about it. i don't know why they are trying to keep it under the curtains. >> especially on campus it's one of the topics that come up a lot by knowing you're more alert and aware about it. i think you should definitely be heard about. >>reporter: the accused students is not from the united states he apparently left the country. san jose state did not issue a crime alert because campus police who interviewed him didn't think he posed a danger. we're told that those alerts are issued when the suspect is unknown and at large and the community needs to take action immediately. reporting from san jose state jeanine de la vega ktvu fox 2 news. authorities identified the inmate allegedly killed bill his cellmate in dublin. the victim is 73-year-old dat long of union city. deputies found him dead in his cell yesterday morning. his cellmate was found covered in blood. authorities believe long was either beaten or strangled to death. officials aren't releasing the suspect's name and say they are having trouble communicating with him. new at 4:00 the embattled ceo of wells fargo john stumpf is stepping down effective immediately. it involved employees setting up unauthorized accounts to meet lofty sales quotas. there are reports that the bank bank's managers pushed staff to also sign up customers for costly over draft protection. exactly how the scandal is affecting the bank's bottom line should become clear tomorrow when it reports quarterly earnings. the fbi is investigating a plane crash in connecticut after they learned it may not have entrained in this. this is a significant atmospheric river but it's pointed north of the bay area. so from my hand approximately boom up to here it's going to go off. not tomorrow though tomorrow will be about a lot of cloud cover. and temperatures tomorrow mostly in the 60s and low 70s. that's your bay area thursday. at as we get into thursday night friday it's going to rain. we'll have the governor denying initial requests by the clinton campaign after hurricane matthew. floridians now have until october 18th to register. in washington lauren blanchard foxnews. officials say that a student pilot deliberately crashed a small plane in connecticut this morning after getting into an argument in cockpit. the student pilot was killed, but the flight instructor survived. according to an official the instruct or said the student was disgruntled about learning to become a pilot. the two argued and the struggle or was unable to regain control of the plane. that plane crashed on a busy road in east hartford right near the campus of jet engine maker brat and whitney. people familiar with that facility says this crash happened during a shift change and will the potential to cause on the november ballot. this year there are 17 measures voters will be deciding on. today ktvu monty francis takes a look at two tax proposals and a move to legalize recreational marijuana. the tax in prop 55 is not new but extension of an a personal income tax increase approved by voters in the last election when they voted for prop 30. prop 55 would extend that income tax by 12 years but only for californians earning more than $250,000 a year. it's estimated tax would generate between 4 and $9 billion a year for public schools and $2 billion a year for healthcare for low income patients. prop 56 would also help fund the state's medcal program by hitting jet smokers where it hurts most, their wallets. the measure proposes increasing the tax on a pack of cigarettes from 87 cents by $2 to 2.87. you might think this proposed tax on cigarettes is steep but actually california has one of the lowest cigarette taxes in the country. in new york, for example, the tax per pack is $4.35. equivalent tax would also apply to other tobacco products and e- cigarettes. tobacco companies have spent $56 million to defeat prop 56. if it passes the measure would bring in an additional 1 to $1.4 billion to state coffers during the next fiscal year. if prop 64 passes, california would become the fourth u.s. state to legalize the use of recreational mann. it would allow adults 21 and older to possess up to an ounce of marijuana and would allow individuals to grow as many as 6 pot plants. voters turned down a similar measure in 2010. this time initiative was partially bank rolled by former the state. monte francis, ktvu fox 2 news. all right for more on the marijuana initiative proposition 64 i'm joined by spokesperson and rodger morgan from the take back america campaign who is urging people to vote no on prop 64. first of all let's start with you. why not wait a too years? you know, colorado is out there with oregon but why not wait 2, 3, 4 years get real data on this before making a decision like this? >> well right now we have a broken system when it comes to nonmedical marijuana in california that's something that proponent and opponents of this measure can agree on. we have a system that isn't working. it's important that we tax and regulate marijuana in order to bring in more tax revenue for the state. this is something this measure is based after carefully studying the initiatives that passed in colorado, in oregon and other states and we've really crafted the measure that brings the best possible scenario to california. >> rodger, to that point, medical marijuana is an absolute joke in this state. anybody can get a card and go in this and get weed for whatever reason. why not take control of it, put some drug dealers out of business? >> number one i don't think you can control marijuana or an illicit drug. we've seem to have proven that in the last 19 years in california even where i live in placer county, we have bans on dispensaries and grow sites. and we have 4,000 illegal grow sites. >> it's out there why not legalize it make a little tax revenue and maybe put some bad guys out of business? >> number one don't put the bad guys out of business. in colorado 40% of the sales are still from the black market. it doesn't put them out of business. they don't pay taxes and with prop 64 we're talking about 6 marijuana plants that can be grown in any residence, any apartment. you can't control that. if we brought in the u.s. military we couldn't control that. so, what's happened we haven't had any enforcement at the federal or state level so the whole burden of public safety has fallen on local law enforcement. they are already overwhelmed. proper prop 64 would put the nail in the coffin. >> smoking -- >> i wanted to point out this is most californians agree that the system is in fact broken right now. that's why the polling shows that between 57, 60% of california voters already agree that it's time for reform. they just want to make sure it's done right. and proposition 64 gets it done right. by regulating and taxing marijuana and bringing it out of the shadows, we could put a real dent into the black market that rodger is talking about. and i think the fact that you know you've seen that decline overall in colorado that's something that californians need. again this could generate up to a billion dollars in new tax revenue. >> doesn't legalizing though take stigma way from it won't it inherently over time increase usage and increase usage eventually with teens? >> the the studies show that's not the case. and to your point about minors actually it's a very important one because we want to make sure that there is safety in this this was built into the measure. right now it's actually easier for minors to get their hands on alcohol than it is to get their hands on marijuana. and the reason is that drug dealers don't -- >> i'm sorry, easier for minors to get their hands on marijuana than alcohol. >> it will make it even easier though. >> it will not by regulating it taxing it we want to make sure minors are not allowed inty store that will be sold in supermarkets or anything other than government regulated businesses that are allowed to sell marijuana. >> sounds good but practical? >> no. it's not practical. number one the medical marijuana program doesn't go away. we still got 18 and over that can buy marijuana with a doctors recommendation for a hang nail. so we put this on top of it. the other thing that's never spoken in this whole prop 64 campaign is the fact this is a harmless drug. okay. this causes brain damage for anyone 25 and maybe even 30 or under while the brains are still forming. it can cause loss of iq. mental illness, psychotic breaks leading to violence. addiction, suicide. >> i want to say a lot of those studies have been debunked. this is not about people under the age getting their hands on marijuana. we want to restrict that. >> this is mind altering what about driving under the influence? that's something that hasn't been ironed out. there's no way to really detect if somebody is at a level where they shouldn't. >> the measure actually provides $15 million over several years for the c hp to study and train law enforcement officers to detect impaired driving actually when it comes to marijuana. >> test state along with the handful of others? why not just wait? >> because i think it's time for reform. the system isn't working. i do want to go back to your point about impaired driving it is important. we want the chp we want the law enforcement experts to develop those measures that statewide standard. >> we wouldn't want advocates whether it's myself rodger or anybody else setting take standard we want the expertise of the chp that's why the measure brings in $15 million for them to study how best to do that and train their law enforcement officers to detect impaired driving. >> there are black and brown people incarcerated for marijuana. wouldn't this relieve that issue safer a lot of money in enforcement in our judicial system which is clogged up with marijuana cases? >> no it really isn't clogged up with anybody for simple possession. colorado is a good example if you want to look at it. 26% increase in latinos since legalization and 56% increase in arrest of blacks since legalization. actually went down 8% for whites. okay. secondly on the income question, all of the gallon intentions of taking this money and using it for good causes is a joke. social costs like alcohol and tobacco the social costs are 10 times greater than the income. colorado has proven that. they haven't had any excess income to give to schools which is one of the reasons it was passed. it's destroying the neighborhoods, the traffic fatalities are up 68%. they have actually doubled in california and washington because of marijuana impairment. and we've got at last count 12.6% of drivers in california were impaired by marijuana and that statistic is old. i think it's probably elevated one of 8 people -- >> you get so many different numbers. some numbers say that fatalities have acutally gone down in colorado. >> i believe that aaa study that rodger is citing, there are issues with that study in colorado. i mean, look it's important, impaired driving you know the chp must set a standard for that. again there measure provides funding for that to be done. i think the bottom line is look, you know 60% of californians agree that it's time to reform our marijuana system. okay, that's the support roughly for proposition 64. that's why it's important that they know that it's being done right. they want reform they want to make sure it's being done right and this gets it done right. >> final thoughts. why should i vote against prop 64? >> i think it has potential for destroy this state and nation. this whole proposition is financed by out of state bill ayers as was prop 215. >> that's not true. >> we have a few drug dealers financing itly as well. >> that's absolutely unsubstantiated. >> we don't need more marijuana brain damage we can't keep dumbing down our kids destroying our communities and natural resources that's exactly what this would do. we needless marijuana not more. >> we need to stick to the facts. the system when it comes to nonmedical marijuana in california is not working. people are being incarcerated over this. resources are going to waste. this is an issue that's been studied. this measure is a carefully crafted measure that includes strongest safety protections for children of think other similar measure in the country. californians know that it's time for reform and that's why you should vote yes on proposition 64. >> all right all. caroline more is here this is something i can definitely relate to. get off work but i'm still at home doing work responding to e- mails, social media. it's what a lot of people these days struggle with. >> exactly. it's your profession too. i think it's really, this is the perfect example of how technology can provide so many great opportunities for us. but then also impede some of the things we really love about our relationships and our family life. so, study was just recently done about how parents are sort of when they are on their phones their kids sort of start acting up. their relationships their interactions degrade. and media did a study families are fighting about this. >> okay. so i can sort of you know -- i think of it not only with parent and children, but right. but also like when i'm out with my girlfriends or something. they are looking at their phone. i sort of sometimes feel like well wait a minute. in miami less important than what you have on your phone. i can see how that might translate to a airport child relationship. dad is your work more important than me. >> kids are engableing attention getting behavior. by the way common six media study about device use we found that 72% of kids and adults feel that they need to respond to their text immediately. now i always say every text that comes in is not like de conone we can wait. >> but what about responding to your children immediately? >> you mean when they are right in front of your face? i think what we need to do, we need to draw our boundaries between our technology and family lives. >> how do we do that? >> one of the ways is we can tell our boss i'm taking off early for the soccer game i got to pick up my kids but i'm going to be online later. pick up your kids and say i had to leave work early i need to check my e-mail have that be a ten minute activity. let your kids know what you're doing because then they won't just think you're ignoring them. another thick is it's so easy to do, you put your settings on your phone turn off your push notifications, turn off the sound, turn off your phone if you can. that will just not give you that little like ping i need to check my phone. even when people have their phones in their pockets there's this thing called the phantom vibration they think i got a text. don't even keep your phone in your pocket. >> okay. so setting boundaries turning the phone off. what if some parents feel that's not realistic? >> i think that's a perfect example how our modern lives are really enabling us to sort of work a lot but also get other things done like you can run to the store or whatever while you're still checking your e-mail. we need to be clear about those boundaries i think expressing that your kids i think that you know, i just got a story about how ceos are beginning to draw these kinds of boundaries. bosses and managers need to say if they send an e-mail in the middle of the night they say don't responds to this right away. so we need to be having these kinds of conversations with our co-workers as well as with our kids setting those types of boundaries. >> i think you bring up a really good point why we may not think about it now it is having an impact on our kids. we have to think about how we want to address that. thank you for joining us great tips there. head on over to bill in the weather center with a look at some of the rain that's headed our way. >> get to bill in just a bit heather. first the death toll is rising with the floodwaterness the wake of hurricane matt through. storm related that tattles are climbing in north carolina 4 days after the hurricane hit the state. the storm is being blamed for the deaths of at least 19 people in north carolina thousands of people are being told to evacuate their homes with more flooding expected in the coming days. >> just during the past three days we're averaging 2 fatalities a day almost all of them due to drowning. we are putting out the report time and time again to stay away from water. >> u.s. is also providing storm relief in haiti sending the u.s. uss iwo jima to bring desperately needed supplies and manpower more than 1700 marines and sailors are on the war ship bringing power generators bulldozers and water pure fires. health officials are fearful of an outbreak of cholera from tainted drinking water. bill martin everybody wants bill martin now here he is. >> bill i was just -- >> i don't think that's true. i don't know. everybody wants bill martin. >> here's the deal i think it's true. but everyone wants to talk about this rain i was excited about hearing rain in the forecast i was ready to get to you. >> i got to tell you guys it is going to be real wet. >> we are heading for a real rain event that begins as we head into thursday night friday morning and it's going to be a big player in the pacific northwest far northern california. when i mean big player some areas could see 8 inches to a foot of rain over 3 or 4 days. that's huge because think about where the surface reservoirs are. lake shasta lake orrville are in that quadrant. so that's where we want to water to fall. even though the bay area is on slate to get a fifth that much rain maybe inch and-a-half maybe two inches for most of us. the place where it matters are big surface reservoirs and the groundwater in the valley. but we're going to have rain. you'll notice it first of all on your friday morning commute. there is the system. this is just impressive for middle of october. right. look at that thing. thousands of miles past the date line moisture coming off a dying typhoon. what that means is it's warm, it's moist and it's pointed right at us. when you see this pattern you know you're going to get wet. if you see this pattern further south. we'd be getting real wet what we're seeing here is this pattern focus from that line nor. from marin county north. russian river drainage basin will do well as well. it's already rained in portland of that's where the real hit is going to be pacific northwest portland, probably northern california. but i mean real rain. i think they have flooding issues around seattle snoqualmie pass and places like that. it's not a snow event it's a rain event. it's subtropical moisture but it does bleed into our forecast as we head into thursday night friday morning and then again into the rest of the weekend it's going to be a wet week especially on sunday. here's the system increasing clouds tomorrow. showers late. i'm talking 3:00 in the morning. you're basically into friday morning now. maybe a half inch. if you go north in marin county you may get 2.5 inches on friday's events. but there's more behind it. here's the moisture. there's that plume of subtropical moisture. here comes friday morning. that's your commute. that's not good. that's wet. here comes friday afternoon kinds of drizzly. here comes saturday break and then saturday night look what shows up. there's something behind that on saturday night as well. so, definitely a wet weather period. this takes you through sunday into monday. you can sigh santa rosa is looking at over 2 inches of rain that's unestimating you go south of san jose almost an inch of rain significant, significant event for mid october. are we going to have flooding issues? maybe see urban flood advisory in the north bay ground i not saturated. we can really handle. the creeks are down the reservoirs are down you bring in 6 inches of rain we'll be fine. but in the pacific northwest where they could see well over that 8 inches to a foot they may not be so fine. there's the five-day forecast. heather holmes going to be wet on your friday morning commute. >> okay. now i know. i have been warned. license she told me right away lay my license is suspended right now and you though this is all i have me and my children we go from shelter to shelter. >>reporter: he could have towed her car but instead he asked letter a simple question. >> i say have the kids eaten necessity she said no. we're already here let's gets you a meal. take. >>reporter: the woman and her two kids officer mccloud is standing right behind letter. the man offered the officer some money to split the bill but mccloud declined and quickly left without giving letter a particular. i asked if he told flynn about what he did for the this woman. >> no not at all. it's something i just wants to keep to myself. >>reporter: the man who took the photo alerted hayward pd. 0ser mccloud hopes his gesture of good will gives people another perspective on police. >> each person i make contact with i want to leave them with the impression that wow that officer from hayward officer mccloud he was a great guy. >> the impact that one encounter has that one moment that officer mccloud had with that lady is going to rest flight for the rest of her life and her children too. >>reporter: this woman is also homeless and stays
