story tonight.the death of an executive.his private plane plane going down today in rural alameda county. family members say john sacco, who's from the sacramento area. often flew to the bay area for business. sacco is the head of earthshine consulting. he was killed today when his single engine plane crashed in the steep, rugged, rain-soaked terrrain near castro valley. as kron'4's jr-stone tells us, the tragedy began with an afternoon call of a missing aircraft. >> j.r. :a small flame could still be seen late tuesday afternoonhours after that plane crashed in route to oakland. this is video from our helicopter parternship with abc 7 news. the man who died in that crash was john sacco according to family members in the sacramento area. officials tell us that in his last radio transmission he described having engine trouble. a short time later he went off of radar. it took crews several hours with off road vehicles to find the area where sacco crashed. >> : they were finally able to go down a very steep incline they were able to find the wreckage of the plane and ultimately the deceased pilot >> j.r. :sacco owned an environmental consulting firm called earthshine consulting. we're told he was flying a piper-pa 32 and had left lincoln, california earlier today. this is not his plane but it's what the 6 seater looks like. crews that spent the afternoon finding the wreckage described what appears to have happened. > > : clipped some treetops before crashing into the ground >> j.r. :as to the weather conditions.extrememly poor. >>:when our deputies first got here this morning the fog was very thick for them just walking to see so you can imagine in a plane traveling at plane speed that is going to be very difficult. >> j.r. :j.r. they will not be able to move this wreckage until the sun comes out >> grant :it was a close call in the city of alameda. after our most recent storm brought down a massive tree on a popular street early this morning. kron 4's alecia reid joins us now. with some of today's storm damage. de >> alecia :this was a 50 year old ficus tree, on possibly the busiest street in alameda. it came tumbling down tuesday morning, completely covering the roadway. the clean up effort required blocking vehicle traffic from the park street bridge to clement avenue. officials with the city of alameda public works say they have been keeping their eyes on the trees planted on that block. >> : we looked at this tree and we assessed it not too long ago, it appears to be just a weather related incident >> alecia :thankfully there were no injuries or property damage when the ficus came down. in the wake of this recent incident and with more rain in the forecast, the city's public works department says they will reassess the two remaining tall trees on this block. >> grant :more rain is on the way. meteorologist dave sparh is tracking this week's storms. he joins us now with what we can expect in the coming days. >> dave : a few lingering showers will be possible this evening from san jose southward. another storm system will approach from even our spec conditions seem to be improving but we should also look out for some fog and our air temperature values are at lower 50s and these are already in the '40's probably will not be a major issue tomorrow morning but 7:00 a.m. we have some scattered clouds by noon some weather in the bay area. a local air force officer is one of the service members killed by a suicide bomber in afghanastan monday. she was a leader in the gay community and had a big roll in the repeal of the controversial "don't ask don't tell policy". --big role kron four's jeff bush spoke with her family tonight. >> jeff :air force major adrianna vordenbruggen was a driving force for equailty in the military and married heather lamb in 2011 right after don't ask don't tell was repealed. you can see adrianna on the right of this recent picture with heather on the left and their four year old son, jacob in the middle. adrianna was a career air force officer and was forward deployed to afghanastan earlier in the year and was killed by a suicide bomber last week, along with five other service members. heather's family says that adrianna was a hero and a loving mother. her body is beiing flown back to the states this weekfuneral arraingements have not been made yet. i'm jeff bush in santa rosa, kron four news. >> jeff >> grant :a young san jose man is in custody tonight , charged in a deadly drunk driving rampage. the suspect.identified as 19- year-old carlos villa-lobos.was arrested for felony drunk driving, hit-and-run and having two outstanding warrants. police say villa-lobos drove through a red light and hit a car that was turning left. this was in the area of senter and singleton roads around 10:45 last night. the man driving the other car was pronounced dead. that victim has been identified as 36-year-old carlos torres of san jose. still ahead a young man shot in the back by the police received a substantial settlement and we will tell you why donjon a scrap may not be a safe choice--dungeoness crab and an animal twist you may not have seen million dollars...after finding police violated his civil rights. as his sister translated, hung lam...who did not want his face shown on camera.. talked about how his life has changed since he was shot in the back by a san jose police officer. he is now confined to a wheelchair. the jury found that police were negligent when they shot him outside his home in january of 2014. lam had held a knife when officers confronted him. but his attorney says witnesses confirmed he was only a threat to himself. results of a california highway patrol report are now in. on the tour bus company at the center of a horrific accident in san francisco last month. 20 people were seriously hurt when a city sightseeing tour bus lost control in union square. kron 4's justine waldman tells us the company failed in a few different places. >> justine :the report now. out of the 6 inspected 4 of those buses are out of service. and overall the company. got an "unsatisfactory" rating. the random inspection . happened right the tour bus crash in union square. and the results in this report. show the city sightseeing preventative maintenance program is not adequate to ensure the buses are kept in safe and proper operating conditions. >> : any violation that puts a vehicle out of service is considered a bad violation >> justine : kevin dee with chp wrote the report. he inspected 6 of the buses foundseveral violations including: a steering issue brake lights not working properly an emergency exist not working and a fuel leak >> : they cannot operate vehicle until the items are fixed >> justine : the report also shows.the company also failed to inspect its own fleet every 45 days. some drivers were not enrolled in the dmv's pull notice system, which allows employers to monitor their employees' driving records. plus, the company did not keep proper driving logs. and several drivers were not enrolled in a drug testing or background check program. >> : how significate of an issue is that? automatic fail >> justine :the bus company has 120 days to fix the issues. then the chp will do another random inspection to see if all the violations are corrected. >> : would you want to ride one of these buses? i can't answer that. de >> justine :city sightseeing sent kron 4 a statement saying right after the chp inspection. it fixed many of the mechanical issues. and has now changed its paperwork procedures. we are still at chp waiting for the report on the bus involved in that crash. in at chp headquarters in vallejo justine waldman kron 4 news. >> grant :a big blow for thousands of holiday feasts in the bay area. california's dungeness crab season will not be open in time for christmas. it might not be the end of the world but it is disconcerting that this problem is still going on croatia well for some of us that maybe the end of the world > >alecia : the latest tests of crab from crescent city to monterey show that the levels of domoic acid have *not dropped below federal safety limits in most fishing grounds on the north and central coasts. but there is a sliver of hope. determined shoppers should be able to find some out-of-state crab.but supplies are limited and prices are high. it depends on how much you are willing to pay for it >> grant :most of us are mezmorized by beautiful christmas trees.but don't be lulled into a false sense of security. today the san
