" >>anny:we're only two weeks away from another possible bart strike. bart management and bart unions are trying to come to an agreement before the august 4th deadline. no face to face talks for the rest of the week. however, the state mediator did schedule meetings with the unions - not with bart. one of the unions put out a 40-page report - criticizing barts lead negotiatorthomas hock. ifsaying he's been involved in negotiations that have resulted in seven transit strikes since 2005. a bart spokesperson fired back >>: i think should be made all well aware of the fact that these negotiators coast of central california got a very - "very" close look at two humpback whales. they were in the water -- near their boat -- when the whales surprised everybody. take a closer look. the divers were only a few feet away when the two humpbacks jumped out of the water. they weren't trying to hurt the divers.and probably weren't even paying much attention to them. the whales had been feeding on sardines. the divers were fine.and now have a great story to tell. watch as a fierce momma bear in southern california frantically tries to free her cub after it got trapped inside a garbage dumpster. the rescue attempt happened in a forest parking lot in azusa. the mother bear was not giving up on figuring out a way to open the lid to get one of her babies out. another of her cubs was there too for moral support. fish and wildlife officials came to the rescue and scared mom and her cub away long enough to lift the lid so the trapped cub could climb out. after being stuck inside for about 20 three months ago. the 83-year-old is suing aeg live, claiming it negligently hired the doctor convicted of giving her son an overdose of the anesthetic propofol. aeg denies wrongdoing. michael jackson's mother has told a jury she believes the promoters of her son's ill-fated comeback concerts testified monday that she didn't know about emails discussing her son's health until after a trial against aeg live llc began nearly three months ago. the 83-year-old is suing aeg live, claiming it negligently hired the doctor convicted of giving her son an overdose of the anesthetic propofol. she told jurors that aeg's executives should have called her to discuss issues with jackson's health before his death in june 2009. she made the comments about aeg's actions after a lawyer for the company rob fladeboe, kron4 news. >>anny: kron4 reached out to limo driver orville brown about what his estranged wife is no saint. this is another look at the level fire taken from helicopt a partnership with abc seven news. the group of nine women were heading to a private shower party. five women died. orville brown did not return our calls. however, days after the fire, he did specifically tell kron4 news that he was not on the phone when the fire began and he was not play music but that wouldn't work. this is a brown or from our may interview. >> i did not have the music of. they had on in criminal wrongdoing create >>james: a man killed while trying to help victims of an alleged dui crash has been identified as 32 year-old kirk peterson of redwood city. he was walking across south of 260-cent to 80 towards the exit just before 3:00 a.m. sunday when he was hit by another car and killed three people in the initial crash suffered minor injuries. the goals who know peterson are fairly deeply sorry for his new wife who was there when the crash happened. >> i don't know what she saw but she saw the results and that is too much. >>james: the driver who broke over the good samaritan is cooperating with investigators. it is not clear whether or not that driver will face any charges. >>anny:as construction continues on the new eastern span of the bay bridge, the opening date remains in limbo. that's bolts. and the time it will take to fix them. but while conventional wisdom now puts the opening in december or early next year. a fall opening is not entirely off the table. kron 4's dan kerman explains. >>dan: the scheduled labor day weekend was postponed earlier this month because a permanent fix to those cracked bolts won't be done until december 10th that's installing a steel saddle. but that doesn't mean labor day is entirely off the table. but a lot of things have to come together and quickly. how is that possible? a panel of engineers has said a permanent fix isn't required to open the new span. in fact they say the first step to making that permanent fix, is good enough and will resolve any safety questions. that first step calls for inserting steel plates or shims to prevent the roadbed from moving too much in case of a quake the question is, is that enough until a permanent fix, is in place? the toll bridge program oversight committee has asked the federal highway administration to weigh in if they agree it satisfies their concerns. and if the oversight committee itself agrees and if those shims can be manufactured and installed in time then we gloria allred and the alleged victim - a city employee, irene mccormack announced the lawsuit yesterday. irene mccormack is the first accuser to come forward since former filner allies recently revealed sexual harassment allegations and demanded he resign. mccormack explained the inappropriate behavior that happened behind closed doors. >>:the past six months turned out to be the worst time of my entire working life. i had to work and do my job in an atmosphere where women were viewed by mayor filner as sexual objects or stupid idiots. i saw him place his hands where they did not belong on numerous women. i was placed in the filner headlock and moved around as a rag doll while he whispered sexual comments in my ear. mccormack resigned in june. the mayor has admitted he "failed to fully respect" the women who worked for and with him. but he denied sexual harassment and is refusing to resign. san mateo police are searching for the man they say exposed himself and inappropriately touched a young girl this is surveillance video released by police. it happened last month at the barnes and noble on hillsdale boulevard in san mateo kron 4's scott rates talked to police and shows us how close investigators are to tracking down the suspect >>: investigators have told me they have generated several tips since this video first aired and now they are trying to sort through some of those steps in order to generate some solid leads in passing- check-in this subject. you concede is very disturbing video as this man lores this young victim to the back corner of a store. this child was just in the children's book section what all this happened and you can see it was then a short time later when de young victim comes walking out of the back area followed by the suspect. investigators want you to take a very close look at this guy. he is described as a caucasian man approximately 6 ft. tall. he was wearing a fishing hats. he also had on sunglasses and was wearing tan cargo pants. of course if you had any information that could help investigators track this guy down, the san mateo police department would like to hear from you tonight. reporting in san mateo, scott now is 442. and of course if you have >>anny:there are four major wildfires burning across california right now. the biggest one - is the mountain fire in riverside county. the good news -- firefighters are slowly getting the upper hand. kron 4's charles clifford has an update. >>: >>charles:this is an overhead google earth view california. up in calaveras county, the chuckwagon fire has burned 18 acres and is 40 percent contained. in monterey county, the tassajara fire is burning in very remote terrain. this blaze has consumed more than 200 acres and is 90 percent contained. further south in kern county, the rancho fire has burned 712 acres and is 95 spence percent contained. and finally, the biggest fire burning right now in california is the mountain fire in riverside county. this is a view of the perimeter of the wildfire which has burned 27,332 acres. as of monday afternoon crews had this fire 85% contained and officials have lifted all evacuation orders and warnings for the area. although many trails and nearby campgrounds remain closed. more than 1800 firefighters continue to work on this blaze and wet weather on sunday and monday has helped crews get the upper hand demo car - representing the new bart fleet. 410 new bart cars are in production they feature more standing room, bike racks, and real- time information signs for passengers but it will take some time tahoe airport. karen was injured in the crash-- she is expected to be okay. the f-a-a and the n-t-s-b are investigating the crash. police in san jose are investigating the death of a seven-month-old wall street this morning. futures trading shows all three indexes in the positive. the week began with second- quarter earnings for mcdonalds falling short of wall street's expectations. here's a look at yesterday's closing numbers. the dow added two points. the nasdaq gained 12 points. and the s-and-p - rose three points. apple's latest earnings report is due out today after the stock market closes. as apple desperately needs to roll out an innovative new product. the stock has gone from 700 a share. down to 375. and now sits at 426. the report is expected to show that apple is making * less money as more customers buy its lower- priced i-phones and i-pads instead of the top-of-the- line models. most analysts are expected a 21% drop in earnings.if analysts projects pan out, apple's earning fell during the three months that ended in june, making the second consecutive quarter of decline. netflix is reporting second-quarter earnings that more than *quadrupled as the revival of the
