equipment. right now there is light traffic in the area so the backup isn't too bad. but if you are heading that way, expect traffic to get worse. cell phone video shows how close it is to the road. a driver shot it through his window. the fire is 15 acres and 25% contained. firefighters are fighting the so-called crystal fire from the ground and the air and using natural resources. a helicopter gathered watered from the nearby crystal springs reservoir to dump on flames and firefighters used retardant to get it under control. it's visible against the blue sky. this fire is 25% contained. we are tracking this fire. check cbssf.com for updates. a major decision in the murder case of kate steinle. the 32-year-old was shot and killed near the ferry building. kpix 5's anne makovec tells us what happened inside the courthouse this morning. >> reporter: the judge ruled there is enough evidence to try the suspect for second-degree murder. a charge requiring malice during the commission of a crime. juan francisco lopez-sanchez is accused of killing kate steinle as she walked with her father on san francisco's pier peer in july. he has admitted to firing the deadly shot but says it was an accident. >> if you believe that he wanted to kill kate steinle, why not get closer to her? why not fire more than a single time? >> reporter: a ballistics expert testified the bullet that killed kate may have ricocheted before hitting her in the back. lopez sanchez's lawyer says the gun misfired when he found it wrapped in a t-shirt under a bench. at one point, lopez-sanchez told police he was shooting at seals in the bay but his lawyer now says that's not true. >> it is a individual with a second grade education trying to put out an accident, you know, explanation for what happened because he doesn't understand american jurisprudence. >> reporter: that gun had been stolen from a federal ranger's car in june. how exactly lopez-sanchez acquired it will all be part of the trial. >> we're very confident there's sufficient evidence to prove the trial and we look forward to trial and providing justice ultimately for kate steinle. >> reporter: in addition to the second-degree murder charge he is a felon in possession of a gun which could enhance the punishment to life in prison. lopez-sanchez is due back in court on september 18. in san francisco, anne makovec, kpix 5. >> the shooting sparked a national debate over san francisco's policy over ignoring federal requests to detain inmates wanted for deportation. sanchez was released from san francisco sheriff's custody back in april. expect heavy traffic around the bay this labor day weekend. bart is closing the transbay tube for track repairs. service between oakland and san francisco stops friday night and reopens 4 5's kiet do tells us three officers have been arrested and accused of killing him. >> i want to express my profound sorrow. >> reporter: at an emotional news conference the sheriff conveyed her condolences to the family of inmate michael james tyree and condemned what she called a violent and cowardly act by three correctional deputies. matthew farris, jereh lubrin and rafael rodriguez were all arrested yesterday on suspicion of murdering tyree in his jail cell. >> each accused murderer was booked, fingerprinted and photographed at the santa clara county main jail, the very same jail where they are accused of taking the life of an inmate they swore to protect. >> reporter: tyree was found dead in his cell last thursday naked and lying in his own feces and vomit. a coroner report detailed multiple blunt force injuries. sources say video evidence showed the three correctional deputies entering tyree's cell where they are accused of beating him to death reportedly over his refusal to take his medicine. tyree was in jail for petty theft and drug charges. he was due to be released to a mental health facility but remained in jail because none were available. paula canny is alameda county jail where they are in protective custody and held without bail. right now, sacramento police say they have arrested one suspect involved in an altercation on a college campus that left one person dead but the shooter is still at large. it happened yesterday afternoon at sacramento city college. investigators say four men were argumenting in a campus parking -- arguing in a campus parking lot when one suddenly pulled out a gun and shot. one man killed, second wounded, third was grazed by a bullet. >> some students will want to talk about it as well as staff. there are probably some who might not necessarily want to. but maybe they feel the urge. we know that it's important. >> and the school was placed on lockdown while police searched for the gunman. classes are back in conventions. i never have done a convention here in san jose. i'm excited because it's a great pop culture and great for the fans to do something positive. i have a chance to interact with the fans. all the celebrities have a q & a taking photo ops. >> wizard world runs all weekend at the san jose convention center. probably one of our favorite stories. >> absolutely. all week. >> a custody battle it brewing over the infamous chicken that fouled up the commute wednesday morning. there he is! that little guy, no one knows how he got on the bay bridge toll plaza. and since the chicken wasn't microchipped, there is no record of its rightful owner. right now, the chicken is staying at an oakland animal shelters. he is happy in his cage. out of traffic. the bird has three people [ laughter ] let's check our weather watchers. most of them hit the road to enjoy their holiday. currently air temperatures between 65 and 75 degrees. dana, george, steve and brian all reporting some clear conditions from the coast to our inland areas. this is our live weather camera looking out at san jose where the relative humidity is 40%. it's calm. we dropped down to 49 degrees there early this morning. it is now 71 degrees. 74 degrees in livermore. hey, we kick-started the morning at 45 in santa rosa. now up to 72. this is scene in san jose also. a scene from our mount ham cam looking towards the santa clara valley clear skies. the coast is clear. we also have clear conditions from sausalito, looking out towards san francisco. mostly sunny from the university of california cal berkeley looking towards san francisco in the east bay. some breezy southwest winds 10 to 20 today. in fact right now we're picking up a wind gust up to 28 miles per hour at sfo. and also 21 in the hayward area. it's going to pan out to be warmer on saturday, sunday and monday. right now, we have a lot of cool air mass aloft. meanwhile we have this area of low pressure. it is actually brushing up against the northeastern section of the state of california right here. basically precipitation free. and as it continues to spin over that northeastern corner of california, it's going to churn up some winds. it's drawing down that cooler air mass from canada and that's why our temperatures are unseasonably mild inland. but once it ejects to the east, high pressure builds in from the west. and we will have the warmer conditions. but meanwhile, we do have temperatures cooling off in the central valley in the 80s. 56 degrees in the high sierra. and because -- 65 degrees in the high sierra and because of that low, we have a red flag warning in effect for the greater lake tahoe area in addition to a lake wind advisory. some of the wind gusts in the highest elevations of the ridges up to 60 miles per hour so that's surely going to blow some dust around. sunset at 7:35. by the time it makes an appearance tomorrow we'll have clear skies. the winds are going to ramp up overnight. northwest 20 to 30 miles per hour. subsiding overnight, meanwhile with the winds 10 to 20 today, 64 at the coast to right around 80 degrees. warmest spot of our inland areas. warmer saturday but not as hot as it will be on sunday and on monday. and that's perfect for the harvest wine celebration in livermore at 90 degrees. meanwhile, we have a baseball game tonight. clear and cool and millbrae art and wine festival will be 7. >> it's labor day weekend, go play. >> have a great time. >> thank you the latest jobs report shows employers added fewer jobs than expected. but there's good news for tech workers. cbs's don champion on the increasing salaries in the tech sector. >> reporter: thomas kim recently landed a new job as a website developer. while some americans struggle to find work, kim says his search was pretty easy. >> i had been looking for a week or two? [ laughter ] let's check our weather watchers. most of them hit the road to enjoy their holiday. currently air temperatures between 65 and 75 degrees. dana, george, steve and brian all reporting some clear conditions from the coast to our inland areas. this is our live weather camera looking out at san jose where the relative humidity is 40%. it's calm. we dropped down to 49 degrees there early this morning. it is now 71 degrees. 74 degrees in livermore. hey, we kick-started the morning at 45 in santa rosa. now up to 72. this is scene in san jose also. a scene from our mount ham cam looking towards the santa clara valley clear skies. the coast is clear. we also have clear conditions from sausalito, looking out towards san francisco. mostly sunny from the university of california cal berkeley looking towards san francisco in the east bay. some breezy southwest winds 10 to 20 today. in fact right now we're picking up a wind gust up to 28 miles per hour at sfo. and also 21 in the hayward area. it's going to pan out to be warmer on saturday, sunday and monday. right now, we have a lot of cool air mass aloft. meanwhile we have this area of low pressure. it is actually brushing up against the northeastern section of the state of california right here. basically precipitation free. and as it continues to spin over that northeastern corner of california, it's going to churn up some winds. it's drawing down that cooler air mass from canada and that's why our temperatures are unseasonably mild inland. but once it ejects to the east, high pressure builds in from the west. and we will have the warmer conditions. but meanwhile, we do have temperatures cooling off in the central valley in the 80s. 56 degrees in the high sierra. and because -- 65 degrees in the high sierra and because of that low, we have a red flag warning in effect for the greater lake tahoe area in addition to a lake wind advisory. some of the wind gusts in the highest elevations of the ridges up to 60 miles per hour so that's surely going to blow some dust around. sunset at 7:35. by the time it makes an appearance tomorrow we'll have clear skies. the winds are going to ramp up overnight. northwest 20 to 30 miles per hour. subsiding overnight, meanwhile with the winds 10 to 20 today, 64 at the coast to right around 80 degrees. warmest spot of our inland areas. warmer saturday but not as hot as it will be on sunday and on monday. and that's perfect for the harvest wine celebration in livermore at 90 degrees. meanwhile, we have a baseball game tonight. clear and cool and millbrae art and wine festival will be 7. >> it's labor day weekend, go play. >> have a great time. >> thank you the latest jobs report shows employers added fewer jobs than expected. but there's good news for tech workers. cbs's don champion on the increasing salaries in the tech sector. >> reporter: thomas kim recently landed a new job as a website developer. while some americans struggle to find work, kim says his search was pretty easy. >> i had been looking for a week or two?
