the bay area. so a lot of freeways are dry including here at the bay bridge toll plaza, where you can see it is extra light so far coming into san francisco and obviously no metering lights at this time, either. the drive out of hayward looks like this, 13 minutes between 880 and 101 so free and clear for the most part over the high- rise and a live look at the nimitz. there may be overnight roadwork approaching downtown oakland exit but so far everything looks good including southbound 880 towards the oakland coliseum and continuing towards hayward. so it could be a very wet evening commute. bart is on time. maybe a great option for your drive to work today. that is your latest "kcbs traffic" update. back to you guys. thank you. three people are being treated for injuries after a traffic accident that caused a chemical spill in concord around 8:00 last night at concord avenue and john glenn drive near buchanan field. the chp says a ford taurus collided with a pickup causing both vehicles to overturn and hit light poles. >> pickup truck involved today full maintenance vehicle so there's a small quantity of basic chemicals that spilled out, some of the containers broke open. >> a hazmat crew was called to clean up the mess. two adults and an 8-year-old girl in the taurus were brought to nearby hospitals. the chp says the male driver of the taurus was also arrested on suspicion of driving under the influence. a former member of the oakland raiders was among two men killed in a crash on interstate 80 in oakland. a mangled mess was all that was left near 5th street early yesterday morning. the chp says 30-year-old thomas howard was driving more than 100 miles an hour when he lost control. he hit a big rig and then two other cars, killing himself and a 64-year-old man. howard played five years for the raiders. the linebacker was cut from the falcons last week. google is doing something it's never done before because of a story kpix 5's christin ayers first broke on friday. the internet giant is now replacing satellite images after a bay area father found his murdered son's crime scene online. >> thinking about everything what happened with kevin, you know,. >> reporter: jose barrera brushes away tears when he talks about his 14-year-old son kevin shot dead four years ago in richmond. friday, his pain was compounded when we discovered these satellite images available on google maps. they show the crime scene and his son's body. >> it's really hard and painful for my family because like i say, you know, all the memories coming back. >> reporter: jose told us friday that he wanted google to take the images down. after our story aired, he got a call from google maps' vice president. >> we apologize. we really sorry. and we gonna remove those images. >> reporter: google confirmed that they will replace the satellite images something the search giant has never done. in a statement to kpix 5, google has never accelerated the replacements of updated satellite imagery from our maps before. but given the circumstances, we wanted to make an exception in this case." jose told us he is grateful though it still pains him that google published the images in the first place. four years later his son's murder remains unsolved. and he hopes google's mistake will bring attention to a murder case that has gone cold. >> what we wanted to resolve the case. >> reporter: in richmond, christin ayers, kpix 5. >> the images still searchable on google maps. google says it will take about eight days to remove the image permanently. relatives of a man arrested in san francisco are accusing police of excessive force. as kpix 5's joe vazquez reports, it all began with a man illegally riding his bike on a sidewalk. [ screaming ] >> reporter: his hands are in cuffs. his face bloodied. this is cell phone video of 21- year-old dj williams as he was'sed friday afternoon. his family and cops agree that he was riding his bicycle on the sidewalk and didn't obey officers when they ordered him back on to the street. but what happened next is in dispute. dj's family says he was listening to music and simply didn't hear officers so he kept going. and that's when a handful of cops used force to put him in custody. [ screaming ] >> one choking him, one pin all his weight on him leaning on him and the lady over there trying to put the handcuffs on him. >> reporter: they hurt him pretty bad. >> yeah, they did, and he started beating on him for no reason. >> reporter: police tell a different story. they say undercover officers identified themselves, flashed their badges and ordered dj off the sidewalk and when he didn't comply, they decided to arrest him. >> they attempted to detain him. however,he became combative and resisted arrest. >> reporter: the situation escalated as bystanders yelled at the cops to let people go. officers threw the cuffs on several others, as well. >> hey, bro, let me see your face, i can put it on camera! >> reporter: at least one other man appears to have blood on his face as he heads off to jail. joe vazquez, kpix 5. >> williams' family plans to hold a rally at the mission police station this afternoon. police are looking for the person who shot and killed a teen at a hayward park. officers went to centennial park about 3:30 yesterday afternoon after a caller reported hearing gunshots. they found a 17-year-old boy unconscious near the baseball field. he died a short time later at a nearby hospital. a psychiatric evaluation has been ordered for a 10-year- old boy who was caught walking around school with a knife. police say the boy grabbed the 8" knife from a faculty lounge yesterday morning at hillview crest elementary school. classmates reportedly overheard him saying he was tired of getting picked on by some girls of. a parent was able to take the knife away but did suffer a minor cut. four men working on a house were robbed in broad daylight in oakland. they were painting a home on webster and 49th streets and had just finished a lunch break. two robbers then showed up one with a gun. the robbers took the painters' cell phones and wallets. afterwards, the painters ran next door to ask a neighbor for help. >> called 911 and literally within i want to say five minutes oakland police was here while i was still on the phone with 911. >> the suspects were last seen driving south on webster and possibly a maroon colored car. palo alto is moving towards some of the toughest anti- smoking rules anywhere. kpix 5's andria borba reports the city council voted 8-1 to move forward with a new plan. >> reporter: the corner of ash and california in palo alto about to be butt-free, cigarettes butts that is. the ordinance by the palo alto city council would ban smoking outdoors on california and university avenues two main retail drags in the city. >> i think it's a good idea because i would prefer that the smoke doesn't drift in our store when the doors are open or if i'm eating outside to have someone smoking nearby. >> reporter: evidence of nicotine addiction can be found wedged between bricks and lined on top of utility grates all over palo alto streets. >> it's annoying if you're not a smoker. >> reporter: although finding a smoker on camera is tough. earlier in 2013, palo alto banned smoking in all parks. and, of course, smokers were snuffed out of california restaurants and bars decades ago and now sidewalk space getting yanked out from under smokers. >> some people gonna say they don't like it because there's so many places they ban it before and now that it's here in palo alto, but i'm okay with that. >> reporter: andria borba, kpix 5. >> a city council committee is expected to get a smoking ban proposal early next year. time now is 4:39. at least 8 people are dead after dozens of tornadoes strike the midwest. the reason so many people were able to were able to survive the twisters. >> police officers in new mexico open fire on a minivan full of children. what led to this dangerous situation? ,,,,,,,,,,,,,, help necessary to the midwen states hit by deadly storms. more than 80 tornadoes were repo president obama has pledged any help necessary to the midwestern states hit by deadly tornadoes. more than 80 were reported on sunday. at least 8 people were killed and hundreds of homes were flattened. one woman in indiana said she had just seconds to get her child and take shelter in her bathroom. >> i had just grabbed my baby out of the crib and we jumped into the bathtub literally probably 10 seconds before. >> that was back here. >> right here in this corner right here where her crib was at. >> more people probably would have died had the tornadoes hit at night when people were sleeping. the mayor of the town of washington, illinois says a lot of people were in church and no churches were damaged. trend mayor rob ford now says he no longer does drugs and he is quitting drinking but not quitting his job. the toronto mayor had plenty to say last night in an interview with the canadian broadcasting corporation. >> i haven't touched a drop of alcohol. i'm dealing with a team of professionals. i'm getting the help for sometimes my -- sometimes, my excessive drinking but guys, i think this is getting blown out of proportion. i'm here. i have never missed a day of council. you put my attendance record up against any counselors down there and i guarantee i'll be in the top 10 and i'm the mayor. >> the interview came shortly after ford plowed into a city councilwoman at a meeting. there was heated debate at the meeting which ended with the city council stripping ford of his powers. a traffic stop turned into chaos when two new mexico state police officers opened fire on a minivan full of children. john miller with a newly released dashcam video showing how the october 28 incident played out. >> like i said earlier you're doing 71 in a 55. >> reporter: little was routine about this routine traffic stop. the minivan's driver, 39-year- old ariana farrell argued with the state trooper who pulled her over. >> go ahead and turn the vehicle off for me. >> reporter: instead, farrell with her five kids in the car took off and the trooper pulled her over again. >> get out of the vehicle. get out of the vehicle right now! >> reporter: the trooper tried to pull the driver from the minivan. >> you're already facing evading charges right now. you ran away from me, aokay? >> i pulled back over. i didn't run away! >> reporter: farrell finally got out of the car but then -- >> turn around and face your vehicle. policeman, listen to me! >> reporter: farrell and the officer started to struggle as she got back in the van. then her 14 years sun rushed and scuffled with the -- son rushed and scuffled with the officer. as backup arrived, the officer point his taser at the boy and then smashed the minivan's windows. >> open the door! [ children screaming ] >> reporter: farrell sped off and another officer fired his gun, apparently at the tires of the minivan! after a four minute high-speed chase, farrell pulled over in front of a hotel. she and her son were arrested. >> those two police officers are now under investigation. the mother faces charges of child abuse, fleeing and misdemeanor possession of drug paraphernalia. the 14-year-old faces charges of battery of an officer. it's 4:44. let's check the weather. hey, where's frank? >> he is on the way. >> better show up with donuts! [ laughter ] >> we have had some showers overnight. some of that in the north bay already. about .10" of rain into santa rosa a little more across the mountaintops but still plenty more to come. our hi-def doppler radar showing you those scattered showers rolling on through overnight. then tapering off the further south you went but there's still more on the way just off the coastline. so, here's how we're going to play it. out the door today, cloudy skies, a chance of some showers early on today. i think then it picks up as we head in toward the middle of the day in the afternoon. rain becoming more likely all around the bay area especially into the afternoon hours. the temperatures will be cool only in the 50s and the 60s. so finally we are getting a cold front rolling into town. not the strongest one we have seen but we'll take it. looks like it will produce some rain outside throughout the day today but it will be picking up a little later on so as we get into the middle of the day and the afternoon we'll see the brunt of the storm system moving through. so the rain continuing on and off. picked up well by the computer system now. showers in the north bay but watch what happens about noon. you see some of the rain beginning to develop and spreading to the south heavier rainfall located to the north. in the afternoon for the commute could be a bit of a rough commute as we'll see rain moving through. maybe the heaviest with the system coming through into the evening hours. then toward wednesday, well, still some scattered showers maybe even a couple of thunderstorms with a system moving on through. temperature-wise 50s and 60s for highs today. as we look out over the next couple of days, unsettled weather continuing. the possibility of thunderstorms on wednesday. slight chance of some leftover showers on thursday. dry and much warmer weather over the weekend. let's check the roads with elizabeth. thanks, lawrence. lawrence has a mock turtleneck on so you know something's heading this way! let's go outside and show what you it looks like in the south bay. for the most part it's dry as lawrence mentioned so the roads are free and clear. here's a live look at 101 near the trimble exit. no big accidents or stalls along that stretch of freeway. if you could go to our maps there is some overnight roadwork still out there. this is going to be out there until 9 a.m. eastbound 580 various lanes blocked from north greenville towards north flynn. but if you are going in the commute direction, so far it really hasn't picked up yet through tracy coming off the 205 and heading westbound 580 through the livermore valley. in fact, it looks pretty good all the way towards the dublin interchange. this is what it looks like along the nimitz. there are several right lanes blocked. i think three right lanes blocked between 16th and broadway so again, about 5:00 in the morning. so another 15 minutes or so and everything should be picked up. if you are heading in the south bay once again here's a live look at the milpitas commute near 880/237. everything is good. could be a very wet evening commute so if you want to ride bart so far everything is on time. that's traffic. back to you. >> thank you. some americans hit hard by the mortgage meltdown several years ago could get some relief. cbsmoneywatch reporter alexis christoforous explains a settlement is in the works. >> reporter: the government and jpmorgan chase are expected to announce an agreement today concerning the bank sale of low quality mortgage-backed securities. the $13 billion settlement would be the largest ever reached between the government and a corporation. the mortgage securities collapsed during the financial crisis of 2008. $6billion of the settlement will be used to compensate investors, $4 billion will go to help struggling homeowners, and the remaining $3 billion will be paid as a fine. on wall street the dow blasted through 16,000 for the first time monday before pulling back to finish 14 points higher. that was still a new record. the nasdaq lost nearly 37. google is paying a $17 million fine to settle a privacy case involving people who use safari web browsers in 2011 and 2012. a loophole allowed google's doubleclick advertising network to follow safari users without their permission. the fine will be divided between 37 states and the district of columbia. there will be fewer fresh turkeys this thanksgiving. butterball which sells one in every 4 turkeys for the holiday says there's a shortage of fresh turkey 16 pounds and larger. they say if you can't find a fresh one, there will be plenty of frozen birds to buy. and that's your moneywatch. for the latest business news, follow me on twitter at #alexiscbsnews. at the new york stock exchange, i'm alexis christoforous. time now is 4:48. everyone from miley cyrus to the pillsbury doughboy is going gluten-free but is it effective or just a fad? "kcbs traffic" in just a few minutes. more and more people are trying to eliminate gluten from their diets. elizabeth cook looked into whether it's a fad or legitimate way to improve your health. >> reporter: what do miley cyrus and the pillsbury doughboy have in common? both have gone gluten-free. miley says she feels great. as for popping fresh he is going to make a lot of dough. gluten-free is a multi-billion- dollar industry. >> there's been a huge surge in products that are gluten-free. >> reporter: gluten is a protein found in grassy grains like wheat, barley and rye. less than 1% of the population has to steer clear of eating any gluten because of an auto- immune disorder called celiac disease. however, 30% of consumers believe they too need to give up gluten because it's healthier. so is it a fad diet, mass hysteria, or is there a grain of truth behind these claims? take a listen to kim rice. >> i was looking for answers. i was suffering with a lot of health issues. >> reporter: seven years ago rice was obese had asthma, allergies, depression, as well as numerous digestive issues. she went gluten-free and almost overnight -- >> my energy increased, my depression began to dissipate, my anxiety disappeared, i started sleeping through the night. it was amazing. >> reporter: rice is a true believer. >> it was really transformational to me. >> it's the diet du jour but there's some reality to it. >> reporter: the doctor with the california pacific medical center says there's a newly recognized condition that's neither an auto-immune disease nor a wheat allergy. it's called nonceliac gluten sensitivity. >> gluten sensitivity has been estimated to be maybe 30% of the population. so it's a big deal. >> reporter: the problem? there's no way to reliably identify it. the diagnosis is subjective. how do you feel after eating gluten? some doctors are skeptical. >> i think it's probably a bit overblown. >> reporter: dr. gary gray is with stanford medical center. he questions the evidence. >> i wouldn't say it's balderdash. it's just going to take more thought and a lot more scientific data, not very good science in it yet. >> reporter: as for eating gluten-free foods it's not always the healthiest choice. >> sometimes they have fewer nutrients. >> reporter: sonya represents the academy of nutrition and dietician. she says a lot of gluten-free foods are packed with refined grains, sugar and fat. >> sometimes they just contribute to a junk food diet. >> reporter: your best bet?
