Under the law passed today, states could allow Insurance Companies to charge more for people with preexisting conditions but to offset that cost, states could set up high risk pools basically grouping people with preexisting conditions together and subsidizing their healthcare. But california has tried this before. Some people said they dont want to go back. You know, im at a loss right now because i dont know what to do. Reporter gary mccoy is hiv positive and has a history of cancer. With the preexisting conditions that i have, if i were forced into a high risk pool i certainly couldnt afford it. Um, it would mean death. Reporter high risk pools arent actually new. Before the Affordable Care act when Insurance Companies could reject individuals for pre existing conditions, 35 states including california had high risk pools. According to a recent report on the california experience, californias high risk pools had a long waiting risk. In 2001, more than 7,000 people with preexisting conditions were trying to get into californias high risk pool. There were also lifetime caps of 750,000 and an annual cap of 75,000 for the people who were in the high risk pool. And finally, those in the pool had higher premiums and deductibles than those outside. Deborah couch is the executive director of the insure the uninsured project which issued the report. She says its not clear what the new high risk pools might look like since theres only a few sentences devoted to it in the new law. We dont know, are they gonna send us all back to filling out our big long Health History forms . Are the insurers going to have their own separate criteria for turning us down . Thats how it was. Reporter and while high risk pools may sound like a new idea, some people remember californias very well. Im sure anyone who has ever on a waiting list got turned down with a preexisting conditions they have no amnesia about this. This affected their lives.
