When Michelle Dauber discusses all this, she doesnt have a clue what she is talking about. Reporter public defender gary goodman says it was the District Attorney who first reduced smiths charges from a felony to a misdemeanor and that perskys original sentence was part of a plea deal based in part on smiths age and lack of a criminal record.
