mcdonald's that has become one of san francisco's biggest homeless hangouts. good evening. i'm brian hackney. >> kpix5 is here with what the city wants to do about it. >> reporter: the city of san francisco made an official offer to buy the mcdonald's that sits near the historical intersection after years of complaints from residents and police. jennifer garcia has lived in the haight since the beginning of the year and walks past this mcdonald's almost daily. >> i think those that walk through kind of avoid this area a little bit or don't really know shouldn't really walk through that alleyway after dark behind the mcdo's. >> reporter: that's why the san francisco's supervisor london breed wants the city to buy the site and redevelop it into affordable housing. >> this is the reason why i'm pushing so hard to purchase this property is because of the complaints that come from them. it's because of the frustration that they have from what they experience walking in their neighborhood. they are sick and tired of it. >> reporter: breed said police responded to more than 1,000 911 calls to the mcdonald's within the past three years including a shooting last thursday at 2:30 in the afternoon and calls in the past for stabbings, saws and illegal drug use -- assaults and illegal drug use. >> it's just elevated to a point where it's not sustainable. this sadly is just an attraction for a lot of problems, a lot of crime. >> reporter: in fact, while we were interviewing supervisor breed we saw two people loitering and engaging in what looked like possible suspicious activity. neither went into the mcdonald's to buy food. >> folks kind of hanging out meandering around kind of loitering, maybe sleeping on the streets, not abnormal for this area. >> reporter: supervisor breed said she's been trying to close the deal with mcdonald's for years using money from the city's housing development fund. mcdonald's released the following statement about the deal. the company says they received a letter of interest from the city and the proposal is under review currently. >> it would be great if we can build housing. it's something we need the most. >> housing on some kind of community space would be a really huge bonus for this community. hopes to close on >> the city is not releasing the dollar amount they offered mcdonald's for the property, but hopes to close the deal in the next few months. katie nielsen, kpix5. tonight a smoky fire forces evacuation of a berkeley apartment building on addison street near acton in the poet's corner neighborhood. flames started on the third floor. that's where the heaviest damage is. the unit below sustained some water damage. one person suffered burns, but no other information was released. tonight we're learning what was behind last month's deadly ride malfunction at the ohio state fair. investigators now say excessive corrosion to a metal suppt beam caused the fireball ride to fail and send several people flying into the air. an 18-year-old was killed in that accident. seven others were injured. officials said the ride was inspected hours before the malfunction. the pride's manufacturer says it -- ride's manufacturer says it has worked with regulators to develop a new inspection protocol. backlash tonight in silicon valley after a google employee suggests women may be unsuited for tech jobs. the male google engineer wrote a manifesto on gender inequality and posted it to an internal google forum where it went viral. the essay criticizes the company for trying to elevate women and minorities to leadership positions saying, "genetic differences are the reason those groups don't make it to executive offices." the anonymous author said, "we need to stop assuming gender gaps imply sexism and the abilities of men and women differ in part due to biological causes that may explain why we don't see equal representation of women in tech and leadership." the writer also criticizes google for shaming dissensers into silence. google's response from its new vice president for diversity said the essay, "advanced in correct assumptions about gender. diversity and inclusion are critical to our success as a company." this comes as google is still being investigated by the labor department for the pay gap between male and female employees. chicago is about to sue the feds over its declared status as a sanctuary city. chicago officials will file a lawsuit tomorrow against the u.s. justice department, this after attorney general jeff sessions threatened to withhold crime fighting grants from cities that don't cooperate with immigration officials. the democratic mayor of chicago rahm emanuel says in a statement, "we will not be blackmailed into changing our values and will remain a welcoming city." governor jerry brown spoke out this morning about the trump administration threatening sanctuary cities. he said washington needs to find middle ground on immigration. >> if does require some sensitivity and that's why i take a more nuanced and careful approach to dealing with what is a difficult problem because you do have people who are not here legally. they've committed crimes. they have no business in the united states in the manner in which they've come and conducted themselves subsequently. >> governor brown pointed out the many contributions immigrants bring to california from the service sector to silicon valley. some scary moments in san mateo county after a large tree branch fell into a crowd at a company picnic. three people were hurt including a child, but it could have been a whole lot worse. >> reporter: this video was taken by menlo park firefighters shortly after the tree branch came down. the limb crushed a group of folding chairs, a kids play table and behind it a baby stroller. firefighter shawn cole was one of the first responders on scene. >> one witness told us there was about two seconds between hearing the tree limb crack and getting out of the way. so they had very little time to move. >> reporter: to give you some idea just how big and heavy this branch is i'm 5' 7 and we're here in the middle section of it and it looks like it's about 4 feet in diameter. if this were to fall on anyone, there's a very good chance it would have seriously injured or even killed them because this thing is just huge and heavy. it was a private company party for riverbed, a startup based in san francisco, and firefighters say there were hundreds of people here. two dozen of them were sitting underneath the tree cooling off in the shade and then left. 20 minutes later the branch came down. in all two adults suffered minor injuries and a 1-year-old infant had cuts and scratches. it could have been a lot worse. >> very lucky. we're all very happy everybody got out of the way prior to that branch coming down. i can't explain fate or luck. >> reporter: this spot is it a popular location for special events. in fact, this private party today was supposed to be there, too but was relocated to another spot on campus. the organizer didn't want to talk on camera but said he wasn't worried and the tree branch falling is an act of god. the menlo park fire department admits they are not tree experts, but they think this might have had something to do with years of extended drought and the heavy rains we got this past winter. they'll work with the college to make sure all the other trees on campus are inspected later on this week. kiet do, kpix5. an update from sacramento and a story breaking last night at 11:00, a 3-year-old boy who went missing was found safe overnight. the toddler walked away from a family picnic and was lost for hours. crews thought the boy had fallen into a pond, but the boy was scared and was found hiding in bushes about 2 blocks from the pond. a neighbor helping with the search actually found help and the boy is back with his family now. a heart warming surprise for a bay area family, a travis airman deployed in kuwait comes home after being away from his family since january. kpix5's betty yu with the emotional reunion. >> reporter: this is jordan riley jacobs and baby caden thomas in the front row at the six flags discovery kingdom sea lion show. moments before their dad, technical sergeant jacob thomas, would pop up on stage as a surprise guest. >> the new guy in a super cool uniform. >> well, this new guy, ladies and gentlemen, is none other than to introduce to you technical sergeant jacob thomas, returning after six months deployment on leave. >> reporter: his 15-year-old son so overwhelmed he buried his face in his t-shirt. his sisters covered their faces as the crowd cheered. this is the first embrace the family has shared since january. sergeant thomas is based at travis air force base and returned a few weeks earlier than expected from deployment in kuwait. >> we were just going to six flags and i don't know. i just look up and my dad's here. so i'm thankful, you know. i have no words. >> it was crazy. >> reporter: jacob says his stepmom told the family she won vip passes to six flags. >> it was amazing. i tried to videotape it myself. i couldn't because they were crying so much and when they cry, i cry. >> reporter: his wife kristen also serves in the security forces. what are you looking forward to the most to do with him? >> to take a break from the kids. is that awful to say? we have four kids. i'm also active duty. so we've had a lot going on. >> reporter: jacob said he's grown a few inches and just might be taller than his dad now. what he missedmost about him? >> he plays computer games a lot. he likes playing madden. sometimes i try to play with him and he always beats me. i guess i miss that. >> reporter: we tried to get a word to sergeant thomas to get his reaction, but he said he was just too overwhelmed to speak to the media. the rest of the evening the family did enjoy vip treatment throughout the snapped some selfies. back in washington the white house is getting a makeover. construction crews got to work on an upgrade including some roof repairs. it has not had any major work since the 1940s. about a minute later you can see the whole area turned into a dust cloud, but nobody was hurt. an update on the oroville dam, crews are working nearly around the clock to demolish and rebuild the new spillway. you remember the massive chute that fell apart last winter leading to evacuation. construction workers are using dump trucks, cranes and bulldozers trying to meet a november 1st deadline. the project is on schedule with concrete being poured for the new spillway. one san francisco neighborhood is seeing some blowback over bicycles. the recent expansion of the ford go bike program is not going over well in the mission. kpix5's wilson walker has the story you'll see only on 5. >> there's a lot of bikes we find in this area really stripped. so it's nothing new for us to see a bike like that in pieces. >> reporter: there is no telling how many bikes were stolen, stripped or otherwise dismembered this weekend in the mission, but this one is certainly getting the most attention, one of the ford sponsored bikes rolled out as part of the city's expanded bike sharing. >> i love it. it's a great way to see the area at least r an out of towner. >> reporte maybe a hit with tourists, but some mission residents are not that enthusiastic. >> they're collecting that data to let ford know where to place their chariot shuttle buses. >> reporter: eric serves on the 24th street council and opposes these bike pods. he doesn't support the vandalism but has seen the photo and long threat of cheers on social media of bike stripping celebrated as a strike of a vehicle of gentrification. >> i'm sure a lot of people are saying see, you know, this is what can happen when that kind of company rise to come into this neighborhood -- tries to come into this neighborhood. >> reporter: it's not just that poor bike hanging by a tree. every one of these ford go bikes had the back tire flattened. >> we rented one, realized the flat and then noticed the entire line. >> we're sort of fed up. this is kind of like this is it. >> reporter: the director said the bike blowback comes from the long simmering brew of neighborhood frustrations, everything from evictions to traffic control. >> this is a larger issue around accountability and transparency from the people making these decisions. >> in general i agree with that, but if you can only have 1,000 bikes in the city without sponsorship and you can get 7,000 with some sponsorship, i think that benefit outweighs the costs. >> reporter: so like new homes and new restaurants the latest change to the mission landscape sparks another debate and judging by the number of flat tires here, these bikes may be in for some tough pedaling. >> i think it's a shame actually. i think that promoting responsible transportation using bicycles is a priority for any city. >> reporter: in san francisco wilson walker, kpix5. >> we spoke with the company that manages the go bike program. they describe this kind of neighborhood resistance as unusual and disappointing. they think most residents support the program. a live look now at the golden gate bridge and the traffic alert if your early morning commute takes you across the span. starting tomorrow the southbound side will be reduced to one lane every night until friday for pavement repairs. the closures will run from 9 p.m. through 4 a.m. all traffic into san francisco will be diverted to the far east side of the toll plaza. if you commute on caltrain, plan to pay more. october 1st zone fares go up by 25 cents. the eight ride ticket discount will be eliminated. monthly parking will increase to 82.50. caltrain said it needs the additional revenue to cover maintenance and operating costs. we have an update tonight from new orleans. widespread flooding turned streets into rivers. in fact, one area known as mid city got 9 1/2 inches of rain in three hours yesterday afternoon. they were all he time. across new orleans an intense downpour 50 miles per hour and as they criss- cross between pylons, the race itself becomes a bit chaotic to the untrained eye. these are the best hydrofoil kitesurfers in the world, but in this field of 47, one was battling more than just the wind. 16-year-old danielle morose of lafayette was the only woman in the race. >> it's a very male dominated world. so it's great to see another girl out there, especially because she's so young. >> reporter: danielle is the reigning world champion among women and trains closely with the men's champion who pretty much ran away with today's competition. danielle says this sport is mostly about technique, but men have the advantage of being heavier and can handle larger more powerful kite. >> racing the best guys in the world is definitely jobs to do it, but danielle hopes the sport will grow as she grows into it and one day she can pursue it as a career. >> four years later she's ranked17th overall in the world. she began when she was 12 years old. what bay area wineries will be doing tomorrow for the first time this year coming up. growers say the harvest is a week to ten days later than normal this year.. due in part to the wet winter. in wine country the first grape crush of the season starts tomorrow. the harvest is a week to 10 days later this week due in part to the wet winter, but the grapes are starting to change color as the season heads into the homestretch. one vineyard manager said the weather was about perfect this year, lots of rain balanced with extreme heat. >> luckily we had water in the soil, so it handled crushing. a manager building boom hit the south bay this weekend with a lot of people on hand to see the results. bricks by the bay took over the santa clara convention center. it's one of the largest gatherings of lego lovers in the western u.s. it included building seminars and games and organizers said the whole point is to appeal to people's imaginations. >> it's all about bringing together the
