man. those police officers are cleared of any criminal charges. good evening, i'm ken bastida. >> i'm elizabeth cook. joe vasquez is in san francisco with the fallout tonight. joe? >> reporter: liz, the shooting death of a 21-year-old immigrant from guatemala has caused a lot of anger here in the mission district for the last couple of years. these demonstrators have blocked off valencia for several hours in the rain tonight. but the district attorney insisted there is not enough evidence to indict the police officers. >> the suspect has the knife. >> reporter: a three dimensional animation recreates the police shooting. the visit owe was pieced together from witness videos and evidence. it happened in february. petes was swings a large knife chasing a man down the street in the mission. he swiped his knife at officer craig tiffy. tiffy's partner thought his partner had been stabbed. then both officers opened fire. lopez died in the street. >> for officers to be charged for the shooting death of pettis lopez, we would need to provide beyond all reasonable doubt that they did not not act in self-defense or the defense of others. >> reporter: they ruled they were trying to protect themselves. >> there is reasonable doubt. >> i don't believe that is what happened. i don't believe it. >> reporter: florencia rojo was his neighbor. she is part of a community group that protested the district attorney's decision. >> i believe the witnesses and what they told me. that he had wriggled away from the officer's grasp. that he was already away from the officer and the officer shot him. >> reporter: according to the da, the officers say pettis lopez's knife had them in fear for their life and they fired six shots. all six shots were too his back as he turned away. >> we are not disputing he was shot in the back. what we are saying is in the circumstances, that does not make it unlawful. >> reporter: clearly, there are folks here who disagree, these folks are weekend rain on easter weekend. we will talk about that coming up. >> thanks paul. new fall out tonight for united airlines. veronica de la cruz tells us a doctor dragged off a plane is taking legal action. >> reporter: the attorneys for david dao. chicago aviation police officers forcefully removed david dao from an overbooked flight on sunday. tonight, three of the officers are on leave. and now, the ceo of united is changing airline policies. the carrier is banning police from removing passengers from its flights. >> you saw a bad moment. this will never happen again on a united airlines flight. that is my premise. that's my promise. >> today, the carrier said it will reimburse all passengers on board that flight. and tonight, it turns out, the travelers who shot cell phone video of that incident may have violated airline policy. passengers are not supposed to take images of other passengers or airline crew without their consent. that means that united could take legal action. the legal experts say that it is unlikely in this case. dao's attorneys will hold a news conference tomorrow. the chicago city council will also be holding a hearing. veronica de la cruz, kpix5. tonight, we are getting our first look at the prime suspect in a parking lot homicide. newark police arrested 28-year- old josue perez of oakland. he is accused of killing a man inside a car this saturday in the grocery parking lot on newark boulevard. the man is identified as a 29- year-old man from union city. police do not believe this was a random shooting. parents in san jose got a let tore night warning them about a data breach. it happened at the campbell union school district office. the superintendent says school officials are still working to determine what information was compromised. but they did say names, addresses, numbers, and gpas were likely viewed. at this point, the district doesn't think any student records were altered. san jose police are investigating. also tonight, berkeley police are bracing for another round of pro and anti-trump protests this weekend. if history repeats itself, christin ayers says things could get ugly. >> reporter: the farmer's market here at civic center park has already been canceled in anticipation of a protest in berkeley that could be bigger and more violent than last month. berkeley is asking do you know these men. >> these are people who were involved in criminal acts during the march 4 protest in civic center park. >> reporter: already, they have issued nine warrants in a protest that pitted conservatives against liberals and devolved into a bloody brawl. now, another protest is scheduled saturday in berkeley's civic center park. >> no one has the right to use violence or intimidation to silence any american's rights. >> reporter: one of the organizers called saturday patriot day and acknowledge there will be a counterprotest. >> we understand there will be violence used against us. however, we will defend ourselves in a lawful matter. >> reporter another response to the chaos that broke out on campus at uc berkeley in february after ultraconservative milo yiannopoulos visited the university. in march, there were protests that berkeley police did not do enough to stop the violence. this time, authorities won't say what, if anything they will do differently. >> we anticipate seeing larger numbers. we staffed accordingly and we are preparing for a number of different contingencies. >> reporter: our understanding is that the counterprotesters will essentially be a cookout in the middle of the park. in berkeley, christin ayers, kpix5. tensions between the u.s. and russia are spiking tonight over the situation in syria. >> right now, we are not getting along with russia at all. we may be at an all-time low with the relationship. >> in a conference with the secretary general of nato, trump distanced himself from his campaign promises to repair ties with moscow and side russia likely knew about the syrian attack. >> any use of chemical weapons is unacceptable. cannot go unanswered and those responsible must be held accountable. >> in the past, trump called nato obsolete. it appears the trump administration is preparing for a massive crack down on undocumented immigrants putting together a deportation force. >> this is a new era. this is a trump era. >> reporter: with attorney general jeff sessions promising a crackdown on illegal immigration. >> we are going to shut down and jail those who have been profiting from this lawlessness. >> reporter: the washington post says it obtained a new plan from homeland security to dramatically escalate the number of undocumented immigrants caught and deported. the document shows the federal agency has secured 33,000 more detention beds, empowered cooperating police agencies and identified ways to quickly hire hundreds of additional border officers and make plans to build a border wall. there are border patrol plans to have a wall prototype by the end of july, but cost concerns are mentioned throughout the assessment. this little girl is just sitting down, then bullets fly right past her head. tonight, the terrifying close with the story you will only see on kpix5. >> reporter: jerry rice, famous for his winning catches, was auctions off one of his autographed footballs at the prince of peace charity event. >> going once, going twice, an it is gone. >> reporter: an event to raise money for children with special needs living in their orphanage in china. the winning bid, $3,500 going to amy fu who was visiting from china and very involved with the orphanage. [ speaking foreign language ] >> the translator: to her, this football is a football of love. it is so meaningful to her. >> reporter: but after a fun filled night of raising money, the football went missing. but the football was caught on camera in the hands of this unknown man who ran off with it. and while jerry rice was kind enough to give amy another autographed football, the prince of peace children's home is just hopeing to get it back. from a fund raising banquet they called share the love. amy says she just wants whoever took that football to return it so she can bring it back to china and show the children at the orphanage. milpitas police say anyone with information needs to contact them immediately. a police report has been filed. in milpitas, juliette goodrich, kpix5. tonight, bart is considering a plan to reduce its service to cut into its shortfall. along the proposals they are talking about starting weekday service an hour later at 5:00 a.m. and floating a proposal to reduce fare discounts for youth, seniors, and the disabled and proposing a 50- cent surcharge on paper tickets. they will discuss the proposals tomorrow. and tonight, bart is trying to protect riders from creeps but the first ad campaign didn't exactly go over well. the original poster called avoiding creeps 101 had tips such as don't sit by yourself or get distracted with phones or music. social media lit up with people accusing part of implying that it is riders' responsibility to keep from being a target of harassment. well, bart got the message. this is the updated psa called don't be creepy 101. it tells riders to keep their hands to themselves, don't leer, and, creepy behavior will not be tolerated. google taking on burger king tonight over a whopper of a new interactive ad campaign. kpix5's andria borba shows us what the fuss is all about. >> reporter: burger king's most famous sandwich was invicinitied in the 1950s but presenting it to a 21st century crowd proved to be a whopper of a problem. >> what is the whopper burger? >> reporter: triggered google home and amazon echoes to pull up the whopper's wikipedia page. >> it is a clever idea and a way of gaming the season for an advertiser. >> reporter: the stunt was quickly flame broiled into olive january by google who stopped the smart speakers from pulling up the page, but not before the clever densons of the internet changed the wikipedia page. with the relatively new smart speaker platform. advertisers were bound to take advantage. >> it is a way to kind of get a little more invasive with your advertising and a clever way the use modern technology. >> reporter: burger king may have got its inspiration from a january story of a six-year-old girl who ordered a doll house without parental permission on an amazon echo. it triggered smart speakers across the country to do the same. >> it could be opening the door to more advertisers trying to do this. >> reporter: he thinks it is likely burger king knew google would burn their buns for the ad. >> it was just a good pr play. >> reporter: in san francisco, andria borba, kpix5. a secret exposed on the tv show survivor caught everyone off guard. >> why haven't you told anyone you are transgender? >> totally set up. totally caught off guard. >> reporter: carter says some of the other coaches knew about his former career and wanted to share it with the team. >> it wasn't the full routine, but it was fun and i'm glad everybody enjoyed it. >> reporter: carter was a student at hayward state when hammer's records started going platinum. he dropped out and toured five years from london to the bay. he later became a successful high school football coach, but realized he needed to get his college degree to pursue coaching at the top level so he went back and graduated last june. it is a life lesson he passes onto his athletes. >> from inner city, born and raised in west oakland. i'm living proof that with some focus and faith, you know, you can get things done. and just have a wide vision on what you are trying to do and never let nobody tell you what you can't do. >> reporter: now into his second successful career, he hopes to help san jose state bust moves in the college football world this fall. in san jose, len ramirez, kpix5. fantastic. >> remember that video. staying with the mc hammer theme, the rain this winter, you know it is coming. too legit to quit. >> oh no. >> like that?
