but also made it clear he's ready for the fight to replace him: "i intend to nominate somebody, senate. i expect them to hold hearings. i expect there to be a vote." but republicans remain dug in - insisting the next president should name scalia's replacement. the president today pointed out there is precedent for the senate confirming a justice during a president's final year in office. president reagans nominee, anthony kennedy was confirmed in february 1988. but kennedy's case is an unusual one. the vacancy came the previous year - in july 1987 when justice lewis powell resigned. reagan first nominated robert bork, who the senate rejected after a long, bitter debate. reagan then nominated the less-controversial kennedy in november 1987. the senate confirmed him three months later - 97 to 0. democrats say with 11 months left in obama's presidency, there's plenty of time to confirm a justice. that was jonathan karl reporting. president obama was asked if people should assume he'd nominate a moderate to replace scalia. the president said we would nominate except that it would be someone who was well qualified. pope francis caps off his time in mexico today. he'll travel to the former "murder capital of the world" to visit mexico's northern border. he'll deliver one more of the world" to visit mexico's northern border. he'll deliver one more mass and is expected to pray for undocumented immigrants who have died trying to cross into the united states. and a scary moment for the pope yesterday. he was shaking hands with well-wishers when it appears someone pulled on his garment and pulled him over onto a child in a wheelchair. pope francis wasn't hurt, and he quickly scolded those who knocked him down. you know how frustrating it can be when your flight is delayed by a few hours. it can really alter your plans... but imagine if your flight landed a full 24 hours later. details of a nightmare flight that city. plus ... how apple is responding to a recent court order asking the company to unlock an i- phone belonging to one of the san bernardino shooters. expected today into thursday as a winter storm moves into the region. this will bring gusty winds wednesday followed by snow and rain this evening through thursday. weak system is possible friday night, before the ridge rebuilds over the west with warming temperatures into early next week. && .short term... winds... the next winter storm is moving into northern california early this morning. the frontal boundary, as of 4 am, is just off the california coast in the eastern pacific. preceding this storm, is an impressive jet with 700 mb winds around 70 mph. as this jet becomes transverse over the sierra, winds will increase this morning. mixing and downsloping conditions will allow the sierra front from just southeast of susanville apple is firing back after a judge ordered the company to help the f-b-i in its investigation of the san bernardino terror attack. as kolo 8 news now's matt vaughan explains ... the tech giant is now caught between respecting user privacy and national security. syed farook, had an i- phone, which is now locked. the f-b-i says it's likely that farook's phone has vital information about isis ... and that's why they want apple's help unlocking it. and the company's c-e-o tim cook had a pretty strong response to the court order. ... the feds want apple to create and upload code to disable the lock feature on farook's phone. but cook argues that complying with the order would entail building a backdoor to the i-phone ... which could potentially render tens of millions of devices vulnerable. in a letter written by cook ... he suggests that creating a special software to bypass security features would be dangerous if it fell into the wrong hands because it would allow someone to unlock any i-phone. it goes on to say that while the company believes the f-b-i has good intentions ... it is not willing to undermine decades of security advancements that protect its customers. meanwhile ... i-phone owners have mixed reactions to the governments' order. "it's gonna give the government the right to go into everybody's phone either they're criminals or not, or you're just going along your business, the government "if it's for an investigation i feel it's justified." the problem that the f- b-i is running into is that there are more than 10 thousand - four digit passcode possibilities. and apple's operating systems includes a feature that ... if enabled ... could wipe out all information on the phone after 10 failed attempts to input the passcode. which worries the f-b-i since the agency claims that the information on farook's phone could be vital to its investigation. in cook's letter he states his concern that the government will continue to use this tool after it's created ... despite the fact that the feds have suggested that it would and speaking of apple ... the company is working on a fix for a peculiar bug that prevents some users' devices from restarting after they've changed the date to 1970. not sure why anyone would want to change the date on their phone to 1970... but users are advised to contact apple support in order to get their device running again. it's called the governors' accord for to contact apple support in order to get their device running again. it's called the governors' accord for a new energy future. how governor sandoval governors to promote clean energy and transportation. still no solution in the flint water crisis...and the lawsuits are piling up. you're watching kolo 8 news now. for news while you're on the move, listen to our news partner news-talk 780 koh "you're watching kolo 8 news now good morning reno." good morning. in the battle of the burgers, one made a "declaration of delicious"... ...jack. he set forth, armed with artillery no one saw coming. so that everyone could taste history-making burgers. we're making every burger better, like the new double jack. good morning. it's wednesday february 17th. i'm amanda sanchez and i'm dave lawrence. . . . happy birthday to a faithful viewer ed marlin. his birthday was yesterday. ed was the viewer who got dave all kinds of autographed kansas city royals gear
