ashley. train service did resume today, two days after a train derailed. a doctor spoke with laura anthony. laura, she wasn't able to find the first aid kit? >> reporter: that is right, she was able to return on the train service, despite being on a derailed car. she says us first kits are required on every car, but right after the crash, she and others couldn't find it. >> one with a bang, again, 4, 5 times. >> she's a medical doctor on the second car of the train as it, and the car in front of it derailed. she says she and others sprung into action. >> were you doing first aid? >> we wanted to do, but there is nothing in the train. we wanted to do something, but could not reach the people there. they could not do anything. >> some told us they were nervous. >> pretty overwhelming. i mean, this is quite a drop and i didn't think it was far down. i saw it on the news. >> reporter: with trains back in service, ace is cooperating with investigators and looking at ways to try to head off a similar incident in the future, installing front facing cameras and perhaps mudslide sensors. >> it's terrific idea and great technology. it's something our agency is not aware of. >> reporter: we can see union pacific put sheeting over the bank in the area, and trains will continue to run at slower speeds through there, just 10 miles per hour. >> safety first, there will be lower times until it's safe to operate at track speed. >> reporter: ace reports ridership was down by 20%. three people are in jail, the arrests in los angeles. investigators say monique butler recruited a young woman, who she considered to be a friend to go with her to a birthday party. they took the young woman to oakhand. she was put on a website for sexual exploitation. after four days she frantically called her mother. >> she was being held he against her will, she was scared and needed help, 20 years old, never involved in the criminal justice system. worked in a mall, went to school and enjoyed making new friends. >> butler is accused of false imprisonment. >> attorney general kamela harris wants to create a task force focused on human trafficking. when harris was the district attorney in san francisco she sponsored a bill that outlawed such labor trafficking in the state. an i-team investigation uncovered a los gatos couple facing charges for sexually abusing their adopted son. tonight, the victim is speaking publicly for the first time. melanie woodrow picks up the story from san jose. the young man is suing his adoptive parents. in 2000 a little boy from russia named dennis says he was given what he thought was a second chance. >> i lost especially being an orphan, and this was my way of living again. >> reporter: abc7 news profiled the story of russian orphans and the couple that became his parents. 16 years later, they are facing 44 criminal charges, including continuous sex abuse of a child, unlawful sexual intercourse and incest and are facing civil litigation. >> they're living in denial. >> reporter: dennis told law enforcement he was abused shortly after arriving in the u.s. when he was nine. >> there was a lot of fear because i had just gained something that what i believed was a gift. >> he says carolyn joined in when he was 15. after 10 years, dennis says he called 911 at 19 and says because he was older than 18, his report was brushed aside. a psychologist, a mandated reporter, called the sheriff's office, in january, sheriff smith told the abc7 news i-team we will examine how this unusual report was handled. a sheriff's office spokesperson now says the department has addressed it internally. ralph and carolyn's attorney declined to comment. >> now is the time to make it right. >> carolyn flynn bonded out, ralph flynn is still in jail. >> i told my truth, i realized i got more strength. >> reporter: the 23-year-old says he wants to be a voice for other survivors. in san jose, abc7 news. new at 6:00, the suspect who spray painted racist graffiti on san leandro school offices is new in custody. a worker found racial slurs and symbols monday morning. police say they used forensic evidence and surveillance video in the investigation. another drizzly day here is about to get worse. tomorrow, a stronger storm is coming in, however. spencer christian has been tracking what we can expect as this next 24 hours developing to our north as you can see. and in fact there are two storms coming our way. 2 to 4 inches of rain in the north bay. here is a look at periods of heavy rain, heavy in the north bay. flash flooding is possible and there is flood wash from the delta, sacramento, to south lake tahoe this is in effect from 4:00 a.m. tomorrow to 5:00 p.m. sunday. and by 11:00, there will be a little bit of rain and by 5:00 a.m., by 9:00 about to push into san francisco. more details in just a few minutes. >> spencer, thank you. the excessive force lawsuit against san francisco police is now in the hands of a jury, filed by the parents of alex nietto, a 28-year-old man shot to death by police officers in vernal heights park almost two years ago. vic lee worked in court today and joins us, vic? >> reporter: jurors will be back of course tomorrow. police say what determines reasonable force is what they see and they say what they saw was nietto pointing a gun at them. his family lawyers say he never drew a gun. >> i feel emotional and nervous because the death of my son. it was very difficult. >> his family seemed relieved the trial was over, yet eager to see justice. the civil trial mainly over conflicting versions of what happened when officers shot and killed nietto at vernal heights park. >> the story is nothing but a story in order to cover up the death of a man who died far too soon. >> march, two years ago, officers responded to a 911 call, man with a gun. and they encountered nietto in the park. he appeared to draw a gun that turned out to be a taser like this one. police fired 59 shots. 14 struck nietto. witnesses discounted testimony that officers yelled show me your hands and he says he only heard stop. and the defense lawyer was able to get the witness to admit he had a shaky memory from drinking but he says he told the truth about nietto. then, a piece of wrist bone was in his jacket pocket. his lawyers said that proves his hands were not drawn. >> there is no holes in his pockets proves his hands were in his pockets. >> reporter: the civil suit charges excessive force and the city and police violated his civil rights. civil suits in federal court require unanimous jury verdict. vic lee, abc7 news. vic, thank you very much. an attempted armed robbery hit close to home for neighbors who say crime in their part of san jose keeps getting worse. and chris nguyen has the story of the clerk would fought back. she has nothing but praise for one of her co-workers. she works in san jose, where police say two armed robbers stormed into the building, shot a clerk and demanded cash before 10:00 last night. the clerk was hit in the arm and somehow grabbed a baseball bat and chased the robbers away. >> daisy live as cross the street and was frustrated. >> it does make you more worried. >> this neighbor is now thinking about moving out. >> we have an alarm system, and cameras to try to keep us safe. >> she says this is the second time that sunnies has grade girl crossed the street. a car drove up and hit the girl, breaking her legs. >> i'm sorry to say i'm not surprised. and when janet steps up to the crosswalk, cars come close to her. >> reporter: a library bathroom. the suspect reportedly grabbed a woman around the neck, and she was able to fight him off. officers in the library chased the suspect and arrested him. he was booked on charges. a series of storms coming our way, so the next several days will be wet. and storms are on the way. noer the bay and south bay, wetter in the north bay, it tends to get wetter over 35/100ths in mount st. helena. now, moving on to current conditions, 63 in san francisco. hayward, 63 is a popular number now. and what a beautiful western sky with the clouds and colors. you can see these forecast features, a stormy pattern and heavy rain at times. we're going to break friday night into saturday and two storms ranked two, storms producing 2 to 4 inches of rainfall and flood risks will increase. starting at 5:00 in the morning it will be raining into central sonoma county. by 9:00 rain approaching golden gate and sweeping eastward. by 2:00 all areas will be wet and this is going to be a soaking storm. by 5:00, it looks like wet and windy conditions across the bay area for the morning commute. and into mid day, scattered showers. by 1:00, 2 storms will produce rainfall totals to almost three inches up in santa rosa and two inches in san francisco. looks like the south bay will get lowest totals. there has been concern about flooding but our forecast is calling for the russian river to remain below flood stage which is encouraging news. low temperatures low to mid-50s and tomorrow, we'll see highs from about 60s to maybe mid-60s around the bay and here is the after the. more storms coming our way in five days. and there is a break and sunday and monday, weaker and by the time things clear out and dry off, we'll have received quite a bit of rain. what will you advances. yesterday, she filed a lawsuit against him and the uc regents in superior court. >> you know, very high stress situation and i tried to cope with it the best i can. >> reporter: her lawyer says it started in 2014 and escalated. >> he pressed her into him and continued to kiss her in the cheek and put his hands on her waist. >> she filed a complaint with the office of prevention of harassment on campus. that office sided with surel after the dean admitted wrong doing. >> she said that this happened every day and the only thing he disputed is that it only happened once or twice per week. >> he the dean admitted to kissing and hugging other women, they reduced his salary and told him to write a letter of apology. >> he wasn't going to be eligible for merit increases for a
