criminal charges facing a north bay teacher who smacked a special ed student jess. why is he still in the classroom? and san francisco may have lost the 49ers to santa clara but the two cities are united tragedy at a sanctuary. police say this lion killed a young intern when she entered his closure today. good evening. i'm ama. dan ashley is off tonight. the lion attack is our top story. it happened at a wildlife park in is central california. the cat haven sanctuary is 40 miles east of pres fresno. >> reporter: the lion attack took place at cat the haven. a central california sanctuary for big cats. >> the lion is in the enclosure with the patient. >> couscous this four-year-old male african lion. officials say he attacked a 26-year-old intern wednesday afternoon when she entered the closure. another employee tried several times to distract couscous away but it didn't work. >> she was attacked and fatally injured. the lion was shot and killed per our safety protocols. our thoughts and prayers go out to her friends and family. >> they are are just wild animals. >> sheriff's officials and the department of fish and game are now investigating what led up to the attack. >> anderson founded project survival haven 20 years ago, allowing visitors to get up close and personal with big cats. he also raised many of the animals including couscous and even demonstrated security around the closures to a local tv crew. >> i can open this door and he is not out, right. >> reporter: the business was closed to the public at the time of the attack. >> this is very rare. very rare. because of the safety requirements that we require through our permitting system animal employee interaction is limited. >> reporter: the department of fish and game says cat haven has a good history but detectives will be looking deep near their records. now, to a story the abc 7 news i team has been pursuing for six months. a sonoma county teacher who repeatedly struck a special ed student several times now faces criminal charges. though school administrators have been less than forthcoming about why he is is still allowed in the classroom. item reporter dan noyes has the story. >> reporter: i spotted 67-year-old willie swindle teaching a special education students yesterday even though he has been charged for striking one of them is several times during the last school year. >> in our opinion there was an assault based on the investigation. and that was the reason for is submittal of the case. >> reporter: swindle faces three misdemeanor counts of child endangerment that he did willfully cause and permit the person and health of said child to be injured. count one covers incidents during november of 2011 and count two during january of 2012 and count three on march 1 of last year. in the report in august michael delgado told me wind started picking on h him when was 15, slapping and pinking him and the most painful treatment claim when swindle would thunderclap both his ears at the same time. >> he would go. >> with both hands on your ears? >> on my ears. he has done it on my face. he has pinched my cheeks. >> swindle did not address the charges when i saw him yesterday but he denied hitting michael when i first met him last year. >> the family says that you struck michael. is that true? >> no, that was unfounded. they did an investigation. >> reporter: it was unfounded? >> yeah. >> reporter: michael's parent told me at time that the school district ignored their complaints and they are thrilled now you to finally have the criminal case move forward. >> finally somebody listened and, of course, with your help, mr. noyes and being persistent with this i feel justified. >> reporter: the delgados say the district offered an $18,000 settlement but they turned it down because it came with a confidentialallity clause and swindle would remain a teacher. >> nothing would be done to him. >> nothing. >> or the principal for being a mandated reporter. >> reporter: after i saw swindle still teaching his class, the principal escorted me to his offense and refused to answer my questions. >> he has criminal charges now and a court date for willful harm or injury to a child and he is still in the classroom. why -- >> no comment whatsoever at this time. >> reporter: the assistant superintendent for human resources mark click also refused to comment and directed the school's public safety officer to escort me off campus. >> you have an obligation to explain to the parents why he is still in the classroom. >> you leave now or you will be arrested for treasure papassing. i will walk you out. >> the the delgados said the officer failed to teak the complaint seriously and failed to investigate the case until the i team went to his superiors and now they continue to pursue the case because they want willie swindle out of the classroom. >> the money. no, we don't want the money. we wantages fish and game for your child and any children like mike. >> this district needs to know there is parents throughout that will stand up for the special need kids. >> reporter: michael delgado has been assigned to another class but he continues to see willie swindle on campus. the teacher has a court date in a couple of weeks. i will be there and report back to you. the state commission on teacher credentialalling tells me they can only take action if the educator is charged with a specified sex offense or drug offense that involves a minor so it is up to the district and it looks like they will allow willie wind toll continue teaching. for the i team, dan noyes, abc 7 news. police are investigating the 7th homicide just this year. in man in his early teens or are 20s was found stabbed to death late this afternoon. police have not made any arrests. the number of paroled sex offenders who have become fugitives has take and big jump since california's prison re-alignment began over a year ago. the department of corrections released figures showing that more than 2700 sex offenders failed to report to parole officers since october of 2011. an average of 180 sex offenders a month. a 15% increase compared to before realignment that was part of a federal court order to reduce the inmate population. meanwhile, there is a new push to stop a violent sexual predator from being released into an east bay community. 69-year-old charles christman is a high risk sex offender who served time for sex crimes against children. he is expected to be released to live near and elementary school in baypoint. more from jonathan bloom. >> reporter: garcia wasn't expecting a visit from the sheriff's offense letting her know that she may be getting a new neighbor. he has been classified as a sexually violent predator. >> reporter: deputies are going door are to door. alerting neighbors that charles christman, a 7 time sex offender with a history of molesting young boys may soon be moving to this cottage here in bay point. >> we just wish it wasn't so close to the school. >> reporter: the principal is not pleased. >> i have 107 students that need to walk past that area to get to and from school. >> she test tie fified in court to try it stop it. >> willow cove elementary is less than one quarter mile away. the issue is how do you measure the quarter mile. >> reporter: the deputy d.a. says as the crow flies it is well under a quarter mile. the court measured it along the street. >> i'm fighting fortress departments of the community. >> reporter: a battle all too familiar for neighbors. years ago kerry burst a violent predator lived at the same cot damage behind anthony ash's law offense. >> we do criminal defense work. if we didn't believe in giving people second chances it would be difficult to do that type of work. >> ash says with verse now back in society and gainfully employed he has done his research on christman and feels he is not a threat. >> he is physically infirm. he has not offended since 1989, 25 years a quarter of a century ago and he did go through all of the training. >> reporter: christman has about 16-pages of conditions he has to adhere to to keep residence. gps monitoring random searches and frequent checkins with the sheriff's offense. still the district attorney filed the appeal that he hopes will cause the court to rethink the decision. he said that he wants the court to stay their decision to let him move in until the appeal has a chance to be heard. in bay point o, jonathan bloom, abc 7 news. red light traffic cameras are on their way out in the city of hayward. the city council voted to remove the cameras at 8 intersections citing a lack of evidence that they reduce broad side accidents and police report an increase in rear end accidents. the council wants to get rid of the cameras as quickly as possible rather than wait for contracts to expire. the early termination will cost the city over $100,000. the bay area hopes to host super bowl l at the 49ers new stadium claire. the mayors of three bay area cities united in a regional effort. news reporter carolinas tells us about the proposal. >> reporter: the 49ers new stadium. the $1.2 billion facility will have solar panels. high tech communication systems. a roof top deck. and leed certified environmental homeruns. the regional mayors joined forces in the super bowl bid but say the specifics of their game plan are top former lapd police chief bill braton was a controversial choice. his goal is to reduce crime with a department he acknowledges is understaffed. he says he will come up with new ways to use state and 3,000 feet. that is in effect thursday morning tomorrow morning from 10:00 to friday morning at 10:00 affecting parts of the counties of monterey and san benito. nearly one inch rainfall at mount st. helena. 9/10 at santa rosa. notice how widely varying the rainfall totals are. only 6/1 at hayward. 80100 at mountain view. 9/100 in santa rosa. a third inch in redwood city and three quarter inch in showers mainly in the south bay. perhaps along the coast and into the santa cruz mountains tomorrow. but most of the remainder of the bay area probably will not see any precipitation from this is system and as we get into friday morning and then friday afternoon maybe a spot. >> shower or two leftover showers as we call them. for most of us a dry friday. rainfall totals as we project ahead to tomorrow evening, 7:00. probably not more than a tenth inch for the area affected by the showers tomorrow which means we are not getting much rainfall out of that system. overnight tonight lows mainly in the upper 30s to low 40s. tomorrow, sort of a cool to chilly day with highs only in the low to mid 50s. and again, maybe a couple of spotty showers. here is the accuweather seven-day forecast. we the pet alert may not have worked but something else did. >> i got a call from the marin humane society. >> a mazingly, a month after he disappeared players p was found up here in the marin headlands. a couple cycling in the hills found the cat skin any and hungry and brought him here to the marin humane society in nevada. a microchip identified h his owner and michelle got the call. soon after, an emotional reunion. >> i have to say he is one lucky cat. >> sherry harrington is a spokesperson for the humane society and says it is possible a pet finding service can h help locate a lot of pet. >> the more you can get the mess am out there your pet is missing and more help you can get. >> still a mystery how he traveled from san francisco across the golden gate bridge and into marin. michelle is just happy someone found him. >> relief. thank you. thank you. amber mentioned, pet april alert boasts hundreds of stories. one a woman's bird flew to pedaluma. someone saw the alert and the bird and she got the bird back. a different dad is okay after flying 3400 files -- cat is okay after flying 3400-miles in a suit case. she was taking a nap in the suit case when the owner accidentally zipped her in. fortunately she survived the journey from cairo to england despite getting tossed around by baggage handlers. the cat is now in quarantine in egypt and should head home in a couple of weeks. the owner had no idea until a relative call told say the cat was missing. up next on abc 7 news at. the kissing octopus.
