claims the officer is well known in the community and he says he can't believe he's still on the job. >> you have an officer that's doing these kind of things to people and pulling guns on people, but he's not on paid administrative leave. it seems like you wouldn't even want him on the force anymore. >> reporter: and vallejo police denied multiple requests for an on-camera interview. instead, released a statement. the police chief saying in part, quote, i have complete confidence in our internal affairs division in our use of force experts who will conduct this investigation. upon completion, i will thoroughly review the entire investigation and personally make a final determination. meanwhile, that subject you saw in the video was booked on suspicion of being under the influence of a controlled substance, resisting arrest, and a probation violation. reporting live in vallejo tonight, i'm elyce kirchner, nbc bay area news. >> thank you, elyce. a developing story in the east bay. nbc bay area's sky ranger was overhead as a hazmat university worked in a neighborhood near antioch high school, responding to mercury contamination. this is happening on manz nieto way. the hazmat unit used a tool that detected mercury on the street. right now no answers about how that got there. we talked to a neighbor who was the one who discovered it earlier today. >> i looked down and saw some shiny stuff. i was like, what is this? i went to touch it and it was liquid form. i'm like, what is this? and i got back up and looking at my best friend, and everything from the -- getting a cigarette from him, he's like, dude, you know what that is? i was like, no, i don't know what that is. he was like, dude, that's mercury. >> reporter: manz nieto way is blocked off. it may take day s to figure out how that mercury got there. more back and forth today over the coyote creek flooding. just a short time ago, the water district fired back. the mayor's letter says he's disappointed with the lack of representation from the water district at this public hearing last week, which was addressing the flooding. that letter pointed out that the lone representative who did attend was not able to provide answers to the public's questions or any possible solutions moving forward. then just over an hour ago, the water district responded with its own detailed letter, which stated they had sent the most senior communications official and that the mayor knew in advance he was the only one coming. they went on to say, quote, some of the statements the made by city officials at the city hearing what else mayor liccardo's letter today were made in good faith but without full knowledge or facts. the mayor also says they're interested in finding -- the letter also says they're interested in finding ways to improve communication and that they are focused on solutions that go beyond what they call political theater. growing frustrations about the coyote creek floods. today, san jose mayor sam liccardo once again criticized the valley water district for failing to send out a warning. we've learned the city is moving forward with a temporary stopgap to make sure it has the tools to warn people next time. nbc bay area damian trujillo live in san jose which is still a mess. damian? >> reporter: terry, yes, the mayor is working on several angles with regard that alert system. right now we're at ol aeander park. they're still working on that right now here, and at other parks across the city and across the county. while some of the flood victims here are worried about now, the city is planning for the future. the san jose s.w.a.t. team uses this tool, called an lrad, when confronted with a barricade situation. this is a demo, when they first purchased the device in 2008. now the city is buying several more lrads to use if they need to alert potential flood victims in the future. but those who suffered through the current flooding are too busy worrying about now to think about the future. this home is gutted, appliances lost, and so is the deposit money she gave contractors who never turned up to do the cleanup and repair work. >> after the flood, i was so vulnerable and so shocked and overwhelmed. i was, you know, i was desperate. so i just took what came. >> reporter: city and county crews are also working to repair area parks. this is hillier park in south san jose, a popular weekend retreat for many families, now closed. >> but it was pretty dangerous, so, little kids could be running around. and you know, it's just adults, because of the river. it's kind of really big and, yeah, it's pretty dangerous. >> reporter: froind, crton frid were power washing rock springs park and also removed the contaminated soil at the park. crews were back there today, replacing that soil with new tan bark. seven city parks remain closed indefinitely. and the city remains on the verge of declaring a shelter emergency. that is to help some of those flood victims. we're live in san jose, i'm damian trujillo, nbc bay area news. >> thank you, damian. there are new accusations today that the city is ignoring the concerns of a specific group as it examines recovery efforts in the wake of the recent flooding. advocates met with city officials this afternoon to discuss how to help those who lived along coyote creek when the flood hit february 21st. advocates as well as some homeless individuals said they want to be included when san jose decides how to divvy up $6 million in donation money. the homeless say one big obstacle is trying to provide the required documentation to qualify for funds. >> having to bring proof of this and proof of that, when everything's been washed away. why would i make up a bizarre story when what happened happened. >> reporter: san jose's homeless response manager told nbc bay area, if a city is moving carefully to catch any potentially fraudulent claims of flood damages, he says the city is working to identify the homeless who live along the creek and calls today's get-together the first a series of meetings. okay. i want to show you some pictures from sky ranger, from above. that's former president obama getting ready to jet out of the bay area after spending 23 hours here. nbc bay area's marianne favro joins us live the from the fairmount hotel where mr. obama held some meetings. he liked coming here as president and now he's back here, as well. >> reporter: and this time he didn't come on air force one. about a dozen people gathered outside the fairmont hotel in downtown san jose hoping to get a chance to meet the former president. sources tell us he was here to meet with high-tech leaders both last night and today. former president barack obama left the bay area just over two hours ago. you can see him here, stopping to shake hands and take photos with a small group of people before boarding a private plane at moffett field. it's something san jose state student ipso lopez had hoped the former president would have done outside the fairmont hotel in downtown san jose, where he spent last night and most of today. ipso waited for hours, hoping to thank mr. backup fobama for his immigration reform. >> he supported all of us. i actually come from a family who emigrated from mexico, so he's done a lot, especially for all of us in that community so i would just say thank you. >> reporter: david manzo designed this barack obama jack in the box. he, too, waited outside the hotel. >> our goal is to get him to sign one. >> reporter: sources tell thaus mr. obama met with high-tech leaders last night and held similar meetings today at the hotel. security was tight with specially trained dogs canvassing the hotel and secret service agents visible near entrances. mr. obama only left to head back to his waiting jet this afternoon. this is believed to be mr. obama's first visit to the bay area since leaving office. before he arrived here in san jose late yesterday afternoon, he had a lunch meeting with billionaire investor warren buffett in omaha, nebraska. reporting live in san jose, marianne favro, nbc bay area news. >> thanks, marianne. new at 6:00, neighbors say the noise is deafening and ton top of that, it's constant. some planes are so loud the county knows them by name. nbc bay area's peggy bunker live at san carlos airport with a look at the possible solutions to all of this. peggy? >> reporter: well, you know, terry, that airline, surf air, they operate in lake tahoe and a couple of other smaller california cities, but the county says it is not just them. they say that airline coupled with a bunch of others smaller planes and the next jen software has simply changed flight patterns and noise over the bay area. it's the sound that some peninsula residents say is driving them crazy, and it's getting worse. >> dozens of complaints a month to hundreds if not thousands of complaints a month. >> reporter: complaints from neighbors by the san carlos airport so incessant that san mateo county the now looking at curfews and restrictions on pilots and airs that use the air force. >> so the faa does have requirements about restrictions that can be placed within airports. what the county is proposing is an option that we believe will comply with faa requirements. >> reporter: the faa proposal is in the planning stages, but the county is proposing that between the hours of 6:00 and 9:00 and 6:00 and 9:00 p.m. seven days a week that aircraft rated as loud would be restricted to one flight in and one flight out the during those windows. surf air was specifically named in the complaint. >> they use a type of aircraft that's considered noisy. >> i think the problem is largely surf air. >> reporter: oliver coolidge flew for major airlines for 38 years and says living near the airport in a busy bay area means planes overhead are part of the landscape. >> i think you live close to here, airplane noynoise is a pa >> reporter: but he says pilots do want to be part of the solution. >> i think we all want to be good neighbors. >> reporter: they'll be putting together focus groups before the board of supervisors consider the issue in july. ultimately, it will be up to the faa. now, we did reach out today to surf air to get their response on the issue. we did not hear back from them. the county says right now they're going to be holding those meetings and also talking to pilots and people at the airport to see what they can do with that proposal and a similar proposal made in florida a few years back did case is back in the news. last december, matthew mueller pled guilty to kidnapping a woman back in 2016. this case gained national attention after vallejo police initially labeled it a hoax. on thursday, muller will be sentenced. today, prosecutors offered their sentencing recommendation, calling him a dangerous predator who involves a 40-year prisoner term. his defense attorney argued for less, citing muller's career as a former marine and harvard-educated attorney. he also said he suffers from mental illness. the judge will have the final say. having a little fun with an unfortunate situation. take a look. it's been exactly one year since a massive sinkhole opened up at the intersection of ream boulevard and center street in moraga. this is what it looked like today. we have learned that group of high school students with a sense of humor decorated the fence surrounding the hole with a happy first birthday sign, as well as balloons and streamers and they're hoping they don't see a second birthday out there. crews continue to work on the sink hole that is so big, a traffic light was originally swallowed up in it. in fact, in the initial days following that hole opening up, a gas line was knocked out, and so was electricity for hundreds of pg&e customers. it could be a final blast of winter. an icy storm is taking aim at the east coast. and it's just days before the official start of spring. in fact, new york city could get up to 18 inches of snow. and that's already creating travel troubles. thousands of flights have been canceled. nbc bay area's michelle roberts joins us live from sfo, where lots of arrivals and departure boards are really telling the story, because nothing's going out to those areas. >> you can all tell there are delays when you see families kind of camped out in the benches and the terminals here. we talked to several of them and they say they're trying to shuffle around their travel plans, make hotels here in san francisco, because today a couple dozen flights were canceled, heading to the east coast. >> so i was happy the to get tout from all the madness. >> reporter: she took the first flight out of virginia this morning before the massive storm rolls in. >> i like the sun in california. i want to be back. >> reporter: nationwide, more than 1,700 flights have been canceled to and from airports on the east coast and nearly 700 more have been delayed due to a storm that could dump more than a foot of snow in new york and boston. today, a state of emergency has been declared in new york, where wind gusts could reach 60 miles an hour. >> bad timing, bad luck. >> reporter: this family is booking three nights at a hotel in san francisco after their flight home to new jersey was canceled. at sfo, 32 flights have been canceled today, due to the weather. and more are expected tomorrow. >> we have paid a lot of money. >> delta, american, and united airlines say they would waive rebooking fees for travelers affected by the storm. today the modis say they're still jet lagged from their vacation in new zealand, but will try to enjoy a few extra days in san francisthe bay area. >> we'll go down to san francisco and come back in the morning. >> reporter: the worst of the storm is expected tomorrow morning, so tomorrow already about 50 flights are canceled here at sfo. reporting live, i'm michelle roberts, nbc bay area news. >> so it's so bad back in the northeast, yet we're having some spectacular weather here. >> i know, it always happens that way. it's like a flip on the weather map. we get all of that wet weather over towards the eastern seaboard, and for us, the dry, sunny weather back here throughout the west. let's go ahead and get a look at the microclimate forecast. we want to start off with the developing nor'easter right now. and you can see all of the activity remains across the eastern seaboard. what i want to do is zoom in and get a closer look from wnbc. it's our sister station in new york. they have storm tracker four. it's their very own doppler radar. and right now we're finding dry conditions in boston, some rain/snow mix moving just here off to the west of new york city. and we're seeing snow develop in washington. so in terms of totals and the timing, worst of it happens for tomorrow. new york, 12 to 18 inches. boston, 8 to 14. philadelphia, 8 to 14. washington, 4 to 7. winds, 30 to 60 miles per hour possible on tuesday. as we heard from michelle's story, flight cancellations are already happening and will continue possibly even some drivers. >> video of the attack made the rounds on social media last week. nbc bay area was the first station to talk with the driver. that happened on saturday. today, we are learning investigators have a good idea exactly who they're looking for. here's nbc bay area's tom jenison. >> reporter: according to police, the suspect group is known to be dangerous and has been violent in the past. >> reporter: the 911 call started like many chp dispatchers have taken in recent years. >> there are about 20 motorcycles involved. >> reporter: stunt bikers causing chaos on a california highway. minutes after that call, though, lyft driver alex contana found himself in a roadside showdown with those bikers after he smashed his rearview mirror and passenger window. >> they were all hitting and kicking from everywhere. >> reporter: contana, who's left leg is broken in three places, is in an interview with chp just before we talked to him and he now says he seems focused on one gang in particular, and may have some photos of suspects. >> they were going to, had me go through pictures to see if i could remember any of them. >> chp investigators say they're not ready to officially name any gang or suspects. >> we do know that their methods are the same. i just can't tell you for 100% certainty that these are the same peempl single time. >> reporter: he wants swift justice. he thought he was going to dry right there on the highway and leave behind his girlfriend and their new baby boy. >> all i could do is just lay there and cry and think about my kid. >> reporter: he hopes to see that photo lineup soon. he's certain he will recognize the person who started all of this. in san francisco, thom jensen, nbc bay area news. a multi-million-dollar settlement tonight including a south bay school and several children molested by a former teacher. today the morgan hill unified school district agreed to pay $8 million to the families of three students sexually assaulted by their teacher at paradise valley elementa elementary. in 2015, 55-year-old john lloyd pleaded no contest to lewd and lascivious acts on a child. but there was a snag in court today after the district apparently backed off a tentative agreement to provide future training for staff and students. the students helps to identify so-called grooming behaviors. for example, a teacher trading candy for hugs. instead, the district has called for a special school board meeting tuesday evening to discuss how to proceed. the two sides will meet back in court tuesday morning. mp a south bay man accused of jumping the south bay fence will stay. jonathan tran of milpitas appeared in federal court. the judge ordered him to stay within a hundred miles of his hometown and undergo a mental health exam. prosecutors say that he tried to -- that he claimed that he was a friend of the president's, when confronted on the white house grounds. he could face up to ten years in prison. the secret service says he was also carrying two cans of mace along with a book about president trump and a computer with letters about russian hacking attempts. tran will report to court next month. california is joining five other states in an effort to block president trump's revised travel ban. a new complaint filed today by california, washington, maryland, massachusetts, new york, and oregon. attorney generals from the state say the new travel ban is unconstitutional and harms people in their states. the universities and businesses have also asked for a hearing tomorrow before a federal judge since a new ban is scheduled to go into effect on thursday. mr. trump's revised ban blocks new visas for people from six predominantly muslim countries. controversial bill about california law enforcement and immigration agencies heading to a senate vote. the bill would essentially prohibit california agencies from communicating with federal immigration agents with a few exceptions. it would defy president trump's call to enlist the help of local law enforcement to crack down on undocumented immigrants. the bill does have the support of labor within religious, and civil rights groups, but critics say it would protect criminals. well, the white house has offered no evidence that former president barack obama tapped the phone lines and phones of trump tower. he leveled the claim over twitter last week, president trump did. the administration was expected to turn over some evidence to the white house intelligence committee to prove phones were tapped. nothing was submitted. the white house tried to clarify the president's tweets today. >> he doesn't really think that president obama went up and capped his phone personally. i think -- >> what does he think? >> i think there's no question that the obama administration, that there were actions about surveillance and other activities that occurred in the 2016 election. that is a widely reported activity that occurred back then. >> reporter: the house intelligence committee is holding its first public hearing on russia next week and the retire taping claims are expected to be part of that discussion. in washington tonight, a fierce battle over president trump's new health care plan. after non-partisan analysts claimed millions would lose their health coverage next year. the congressional budget office, led by a trump appointee, concludes the republican health plan would cut the federal deficit by 337 billion over a decade, but the raidoff would be more than $20 million americans losing their health care. democrats pounds. minority leader nancy pelosi says many of those affected would be low-income americans who voted for donald trump. >> and thinking, i'm going to lose my coverage and they're going to give $7 million to each of the richest families in america, every year, instead of giving me health care. >> president trump tried to undercut the news, holding a white house listening session with people he called victims of obamacare. is it worse, better, or too much like the affordable care act? a lot of conflicting information about the republican plan to replace obamacare. well, with the help of factcheck.org, we look at the two plans and explain what would change and what would stay the same when it comes to health care. >> well, trumpcare is here and you are going to hate it. >> this is an historic step, an important step in the repeal of obamacare. >> there's the leadership plan that was brought forward, which i believe, when you look through it, is obamacare in a different form. >> reporter: lawmakers are all over the board when it comes to t american health care act. the plan to replace obamacare. fa factcheck.org lays out the similarities and the big differences. fur first, the requirement that all americans buy insurance tor face a tax penalty. the new plan gets rid of it. but not having insurance could still cost you. >> it also allows insurers to impose a 30% surcharge if you're -- if you allow your insurance to lapse 63 days or more. >> reporter: the expansion of medicaid will be phased out, and it will become a block grant program. >> reporter: they're going to cap the amount of money that the federal government provides to states on a per-capita basis. that's different than what they do now, where they guarantee federal matching funds, regardless of cost. >> reporter: what about financial assistance for people buying their own coverage? under obamacare, there are two forms. cost sharing the lower out-of-pocket costs, under the new plan, that goes away. the current law also provides premium tax credits based on income. the new plan bases the tax credits on age. older americans will get more than younger. >> however, it also allows the insurance companies to charge older americans more. so they could charge them five times more than a younger person's insurance policy, where the current law caps that at three times more. >> so, what stays the same? the replacement plan keeps the requirement that insurance companies provide coverage regardless of pre-existing conditions and the provision that young adults, under the age of 26, be able to remain on their parent's plan. that also stays. okay, are you having plane ticket troubles? nbc bay area responds to an alameda woman who didn't get a refund after double-booking a flight. a new milestone - ather piece oe it'sneoday. another milestone, another piece of the old bay bridge came down today. one of the last three pieces of the old span that was still in place. slow process with huge cranes lowering it on to the barges. the bridge portions the tonight are in oakland, where they'll be dismantled. caltrans will repeat the process tomorrow and take down the final portion some time later this month. getting from the bay area to a popular spot along the central coast just got a little harder. i want to show you this. the demolition of the storm-battered pfeifer canyon bridge. that's the span that's a straight shot between big and you are the bay area. crews spent the day destroying the bridge with a 6,000-pound wrecking ball. two of the three piers were cracked during the winter storm and that could take up to a year to rebuild, which will make going through that area a little bit of a hassle. police say it's proof that alcohol and water don't mix. a man had to be rescued from the oakland estuary this morning after apparently jumping in. fire department tweeted out this picture. witnesses say the man either fell or backflipped into the water. a rescuer was able to pull him out using a paddleboard. the security guard reported seeing the man in the area hours before the rescue took place. he's believed to have been intoxicated when he fell. well, the rain is gone, but the potholes remain and are causing lots of problems for drivers, several drivers popped their tires on a big pothole on northbound 101 and palo alto overnight. it was between bark dare rembac university avenue. it's a similar issue across the bay area. potholes covering the roads, according to a 2015 report from metropolitan transportation commission, about a third of our roads who waited for months for a refund from expedia, but couldn't get it. >> she finally contacted our consumer investigative center for some help and chris chmura is here with her story and a reminder about booking those airfares. >> yeah, something you'll find in the fine print. leslie morrison booked flights to mexico using expedia, but she inadvertently booked the return flights twice. leslie told us she caught her mistake and contacted expedia the very same day to cancel those mistaken tickets worth $2,500. now, leslie told us expedia told us, no problem. you'll get a refund within four to six weeks. well, she says she didn't. so leslie reached out to expedia again and says the company again promised a refund. guess what happened next? she never got that refund. so leslie turned to us this time. we asked expedia some questions and we wanted some answers. it told us almost immediately that it would issue leslie refund, $2,500. now, expedia blamed the delay on a glitch. it wrote to us and said, "we're pleased to share that the error in the processing of miss morrison's refund was fixed and her refund was processed." now, just a reminder here. federal law says that you get 24 from the south bay is now suing over that e. coli outbreak linked to soy nut butter. last we heard from the family of trevor simmons, he was hospitalized with kidney failure caused by e. coli contamination linked to soy nut butter. a second south bay e. coli patient, an adult, a woman, claims she's also been hospitalized after eating soy butter made by i'm healthy. the company has issued a voluntary recall. federal, state health officials continue to investigate the outbreak. the sale of yahoo! to verizon is taking shape and today we learned the deal will create a third company. after verizon buys yahoo! some of its assets will be spun off to create ultima. a member of yahoo!'s board will be its ceo. an s.e.c. finding today says his salary will be $2 million a year, twice what of it heading our way as we head throughout tomorrow here in the bay area and we have some changes our way coming by the midweek forecast. let's take a look at that microclimate forecast. a beautiful shot here across the south bay. and san jose was mild today. check it out! right now, 75 degrees after upper 70s in downtown for your official high and we'll see numbers drop down to 51 by 11:00 p.m. as we move into the exact reason of why it was so warm to start off the week, it was high pressure keeping the storm track to the north. also importing some hotter air, but the way that this moved in, it helped to drive some offshore winds throughout the bay area. so no cooling ocean breeze. many parts of the coastline today did warm up into the low 70s. let's go ahead and bring you into tomorrow morning's forecast. i think we'll all start off sunny as a result of that high pressure. 50 here for the tri-valley, peninsula, 53. and the south bay, 55. also looking good here for the north bay. not too cold, 48. san francisco, 51. and for the peninsula, fog-free and 51. microclimate forecast as we head throughout tuesday still has more above-average temperatures by at least ten degrees above where we should be here. 79 in los gatos. 80 in morgan hill. 82 down towards gilroy. for the east bay, also another warm day. shorts, if you can get away with it at work. it's going to be enjoyable. 80 in antioch. 79 in concord. also, 78 in danville. slightly cooler in oakland and 74. the peninsula, we have upper 60s in half moon bay, but belmont down to palo alto, still some warm upper 70s. san francisco, the changes will begin here first tomorrow. you can see winds will be more out of the west at 9 miles per hour. that's a cooler ocean breeze. that will drop temperatures to the 60s. 66 in the mission. also, 64 in the embarcaderembar. still a mild day for the north bay. 76 in santa rosa. 79 in sonoma and also expecting 80 in napa. now, we have some great weather coming our way, we do, again, have that major storm system hitting the east coast. i want to show you in case you missed it the major nor'easter that is developing here nor the eastern seaboard. you can see all of this wet weather from florida up to the northeast, storm is developing, but we think by tomorrow, it's going to ramp up and produce heavy snowfall. i want to give us a current look at what's happening now through our sister station, wnbc's doppler radar, storm tracker 4. you can see it's mainly rain outside of new york right now. snow in washington, d.c. but tomorrow, as those blizzard conditions get going, 12 to 18 inches in new york city. washington, 4 to 7. winds, 30 to 60 miles per hour. flight cancellations already happening. and of course, they'll be stacking up even more for tomorrow. on the extended forecast, we do start to see things change by wednesday. much cooler for san francisco down to 59 and some spotty showers. dry through saturday and then maybe some more scattered showers sunday and also into monday. for the interior valleys, after 80 today inland, we'll drop down to 69 by wednesday's forecast with a little bit of isolated rainfall activity. we're only talking trace amounts to maybe 500th of an inch. and another chance as we head into sunday and monday's forecast. it was nice today, wasn't it? >> oh, so nice. so looking forward to tomorrow, too. >> yeah, it's
