live. second deadly accident involving an amtrak train in just the last 24 hours. >> yesterday another pedestrian was hit and killed and this afternoon another amtrak train hit a car apparently stuck in traffic in the intersection here behind me. authorities say a mother and child were inside that vehicle and were killed instantly. >> i heard the brakes and the horn. >> reporter: they heard the amtrak train before they saw it. >> i hear the train horn, i hear the screeching and then bang. >> you see parts go everywhere, parts here and there but you knew they weren't going to survive that. >> reporter: police say the capital corridor train hit this now crushed toyota rav 4 with a another and 3-year-old inside. >> pushed that car what appeared to be an eighth and a quarter of a mile down the train tracks. >> reporter: it happened near washington avenue and camman road in san leandro around 1:15 this afternoon. >> reporter: authorities say the vehicle was parked on the track on the other side of the guardrail and both the woman and child died on impact, hit so hard first responders had to pry the vehicle out from under the train. >> i don't know what speeds the train was traveling at but i do know as they pass these rail crossings, they do go at a very high rate of speed, which would explain why that car was pushed so far down the track. >> a witness said he spoke with the con didn'tor moments after the crash. >> he said please tell me people got out of the vehicle. i said no one was out of the vehicle. they're gone. >> reporter: and amtrak tells me that train was headed from san jose to the sacramento area and none of the passengers or crew members on board were injured. meanwhile investigators say they'll be contacting local businesses here asking them in. the man accused of killing a woman and dumping her body in the park turn himself in tonight. he is responsible for killing a 25-year-old woman last week. her body found on the edge of a duck pond at newhall park. he is awaiting extradition to california. >> newly released dash cam video show as deadly police shooting in palo alto. prosecutors say it's clear that the suspect wanted to die. we're showing you just a portion of this disturbing footage. it shows a mentally ill man charging at police while holding a knife. two officers opened fire killing him. the shooting haas last christmas outside of raff's mental facility. he had tried twice before to take his own life. >> a new scandal rocking the oakland police department. the investigation centers around a woman who may have had sex with officers while she was underage. authorities now say that the almeida deputy who was also being investigated did have a facebook relationship with the woman, but they have no reason ailments but now they have been set up to accommodate veterans quickly and conveniently. army veteran christine says she's likes the idea of walking into the cvs minute clinic and get attention right away. she usually uses v.a. health care services in the bay area and while satisfied with the care acknowledges sometimes patient back log forces her to wait a day or two. seeing a chance to combine suicidal 15-year-old pointed one at officers. >> there was no markings on it to indicate it is a toy. >> reporter: the lieutenant said officers responded to santa rosa's coffey park last night after getting a 911 call reporting a man in the park with a gun. police say it turns out it was the teen-ager who placed the call. >> to force a shooting based on a desire to commit suicide by police. >> reporter: police say an officer fired several shots after the boy pointed the weapon at him, hitting the teen in the foot. >> if you're a distance away from this, it looks real. >> reporter: for stromberg who lives right across the street from the park, the incident is a stark reminder not to take his guns out in public. he's well aware 13-year-old andy lopez was shot and killed by a sheriff's deputy in 2013 while carrying an air soft gun in santa rosa. he says last night's shooting isn't surprising. >> if they have an air soft that looks like a real gun, people are going to behave that it's a real gun. >> reporter: the teen-ager remains hospitalized tonight. we're told he's being treated for the gunshot wound and for any mental health issues. police say he is corroborating with the investigation but faces felony charges. reporting live, i'm jodi hernandez, nbc bay area news. >> a south bay man is accused of killing his father and putting the body in a trash can. this is 21-year-old anthony torres castro. police say after he called his father friday night, he dumped him in a garbage can. the father died of month force trauma. no word on why he was killed. >> man walking by a home saw smoke coming from the family's home early this morning. the man then banged on the front door. all six members of the family made it out okay, the parents, kids and grandparents. the fire brought down part of the roof so the home won't be available for a while for the family to go back in. the red cross is helping find alternative arrangements for the family. >> this bit of news is likely to put the sting out of fear that gripped a concord neighborhood. dna tests are back on the bees that attacked people and pets two weeks ago and the tests show the insects were just aggressive honey bees, not africanized killer bees. two dogs died and several people ended up in the hospital. >> is it a country club or a free public park? a wave of complaints prompted san francisco to change its policy at the park. >> the city had a policy of charging groups to reserve a seat at the park. sharon katsuda is live for us. >> reporter: this is only tuesday and this park was packed today. you can see some people out here still roaming around. they say that's the beauty of this park, you can sit down and plop down on this grassy area for free and now they can even do that with a large group. park goers are happy to hear the recreation and park department is letting it slide for now. the agency has suspended a program requiring large groups to pay for use of the lawn area. after $20.5 million dollar renovation at the park, the city reintroduced the permitting process. the department said they've done it in the past at del ores park. >> they need to have free life, not just be in a cacoon or something. >> the $33 permits would help recover costs for picking up trash. >> once we start to auction off lawn space in our parks, i think we're moving in a very dangerous direction. >> just dividing people, separating people apart. >> reporter: the department said there's a longstanding system wide permitting charge at other parks in the city. but parks and being outdoors and a three-day weekend coming up. >> it's going to really improve as we head through this memorial day weekend. we still have cloud cover and fog at the immediate coastline. we had a little bit of everything today. the fog, some patchy drizzle and eventually some sunshine. 8:00 this morning, we started off with the same temperatures and by 1:00 in the afternoon, similar temperatures in the valley and we did win out with more sunshine for sunol and as we look at tomorrow's forecast, the cloud cover will stay put. we'll start off with temperatures in the upper 40s and low 50s. a little drizzle in san francisco and also the peninsula. by the afternoon tomorrow, we'll have increased sunshine, 72 expected for the south bay, remains chilly in san francisco at 62 and the north bay expecting 73 degrees. the big change is high pressure building offshore. that's going to help to warm temperatures up as we head to this upcoming memborial day weekend. by saturday, sunday, monday, temperatures are going up into the low 80s. if you are looking for something to do as we head through this upcoming memorial day weekend, san francisco, sure, it's going to be a little bit on the cool side, certainly could be a good spot to check out. you may want to head out to the p prosidio. it looks like a great day to commemorate our troops. back with my full forecast in about (scal): good day, m'lady! i am sir-can-a-lot, here to save you from another breakfast bore. wake up those eggs with glorious spam! see what spam can! do... at spam.com killing the father of her childen... right now at 6:30, facing a judge for the first time, the hillsborough mother accused of killing the father of her children appears in court. the body of keith green was found earlier this month, weeks after he was reported missing. >> his former girl friend and two other people are charged with murder. a lot of twists to the story. michelle roberts joins us from redwood city this evening with the latest. >> reporter: the three people were charged together on murder charges and possession of a firearm. but at this point authorities aren't commenting whether the gun was the murder weapon. the parents of tiffany for the hearing of their daughter. they are accused of killing li's boy friend and the father of their two daughters. the assistant d.a. says his office has a strong case against the three suspects. >> motives are things that we're looking for because they intuitively explain why a crime occurred. >> reporter: the suspects did not give a plea today. their lawyers asked for more time. >> our client is presumed innocent and it's miss marz 'job and mine to see that presumption remains through a trial. >> reporter: the suspects are being held without bail. they are expected back in court next wednesday. reporting live from redwood city, michele roberts. >> homicide directs drained a lake after a disturbing recovery. this morning a gardner found a man floating face down on the eastern edge of the park. there is evidence to suggest there was a struggle before that man's death. they drained the lake in the hopes of finding more clues. no word yet on what they found, if anything. the victim has not been identified. >> a man sent to the hospital after a chp officer physically subdued him will now be getting nearly $2 million from the state of california. >> we first exposed the incident and the fact that the officer involved remains on the job. but it's what we discovered about the financial payout that's upsetting a lot of people. stephen stock joins us with the inside story. >> reporter: this single case prompted us to ask more questions. we wanted to know how many civil suits like this have been settled by the chp and how many of your tax dollars were involved? so we sat down to get some answers. we want to warn you some of the pictures in this story can be hard to watch. these photos show the aftermath of a traffic stop on a remote stretch of i-80 west of trucky. they show this truck drifr unconscious, his hands still cuffed behind his back during a traffic stopafter he stopped breathing, he had to be flown to a level one trauma center because he refused to sign an invalid traffic ticket. even two years after the near-fatal incident, the berkeley resident still could not talk about it but public records clearly speak to what happened. after four years of litigation, the state recently settled out of court, costing taxpayers more than $2.1 million, 1.7 million going to his family. but that's not all. we reviewed state records for similar lawsuits alleging mistreatment at the hands of highway patrol officers. in the last ten years there were a total of 45 cases costing taxpayers more than $25 million. some of those settlements included no admission of liability by the state of california. >> oh, he is beating her up. >> my gosh! >> $1.5 million went to this woman seen on cell phone camera video apparently being beaten in her head and face next to a los angeles freeway. another $250,000 to this woman who was two months pregnant when officers hog tied her on the side of the road. >> it indicates we're wasting the taxpayers' money. >> reporter: lonnie hancock represents the east bay. she's been raising this issue of law enforcement accountability for years. >> think of what it says about the impact on that truck driver's life. he will never be the same. >> reporter: our investigation found that the officer in the case still remains with chp. as do at least 33 of the 53 highway patrol officers named in the lawsuit settlements we found. >> one of the most important jobs in america or perhaps the world is that a law enforcement professional. >> reporter: the commissioner acknowledge as rift between many communities and law enforcement. it's a gap he says chp is working to close. >> the more information i provide the better off we are at the end of the day. >> reporter: he says a dramatic decline in citizen complaints the last number of years demonstrates progress. >> everything we do should be to the best of our ability. we we should not have bad days as an officer. it's a lot of taxpayer money. we have contact with millions and millions of people. >> do you learn from these mistakes? >> i think in all those cases you may assume that nothing was done, no training, no lessons learned and i don't think that's true at all. >> reporter: how do you convince the public when hair not told. >> in our organization, there is a lot training being conducted. that's important for people to understand because the public doesn't always see the end result. you can't assume nothing is done. >> reporter: we have to take the commissioner's word for it because the way the law currently reads, all discipline, training, firing remains secret. >> unfortunately we've seen big settlements time and time again. >> reporter: davis points out under current california law, the public can't even find out whether these officers were investigated internally. >> when there's a huge settlement like this, it tells us the department must have had serious concerns with the officer's behavior in that case. what we really need to do is make sure the public is able to see what action the department took to correct that behavior and to punish that officer. >> to know nothing is to breed suspicion. >> that's exactly why state senator mark leno wants these records made public. >> you think $25 million is a lot of money? >> reporter: right now that is illegal in california. but for anyone who spotted a hot dog -- >> there are times i've left a shopping center and i've seen like a couple of dogs in a car. and i don't know how long they've been there. >> reporter: right now in california, smashing a window to rescue a dog in a hot car is illegal. but today they rallied for assembly bill 797, which would make such rescues legal, demonstrating their point by sitting in the hot sun in a closed car. >> if i see a baby or a car, i don't care how long it's been. i would rather pay the owner for that window than lose a life. >> reporter: sage emergency vet center say this is the season when they prepare for a wave of heat stroke cases to come through the door. >> cracking a window doesn't affect the temperature at all. they can go up 20 to 40 degrees hotter than what the ambient temperature is within 20 minutes. >> it causes multiple organs to fail. the liver basically dies and fails. >> reporter: some pet owners think rescuing an animal in distress is simply common sense and legislating such an act is unnecessary. dog owners say such a law could save lives. we're not out there to create a license to break windows. this is the tool so can you help save the life of an animal. >> reporter: now, the bill is called the right to rescue act. it's not law yet. if you do see a dog in distress in a hot car, make sure you call a security guard, police or your local animal patrol. >> a local fire in soledad is still burning. it's now 90% contained. strong winds fanned the fire across nearly 4,000 acres and that was in just a matter of hours. cal fire is now projecting 100% containment by this time tomorrow night. >> piece by piece. tonight another section of the old bay bridge is no longer standing. crews spent the day slowly lowering a massive tres on to barges. the steel structure weighs 2,500 tons. it will be disassembled at the port of oakland. this is the third of five spans that must come down to dismantle of old bridge. all the work is expected to take another two years to complete. so it's a slow and methodical process. >> let's bring in meteorologist jeff ranieri. i know it's only early in the week but it is a three-day holiday weekend. we need to start looking in the long game here. >> i thought i was ahead of myself earlier looking right head towards memorial day but it makes better sense. we have much better weather saturday, sunday and monday. if you're sick of the cool weather and the clouds, we do have that drastic chamber of commerce coming in the forecast. you can see on the doppler radar, we tracked isolated showers and thunderstorms getting close to middlestone. currently dry conditions throughout the bay area. it's just a cloud cover that we've been contending with for most of us. for the san francisco area, right now 58 and a beautiful shot here from the north bay, belvedere looking back towards san francisco with the overcast skies. right now 59 degrees. the one spot managing a lot of sun is san jose. you can see from our sky camera network, currently 65 and a lot of blue sky. don't expect a sunny start tomorrow. we'll see another round of clouds and possibly isolated drizzle. spotty drizzle in san francisco and 54 to start. coldest temperature would be 48 across the north bay. tomorrow morning the overhead view shows the clouds and possibility of spotty drizzle. it will be slow to clear out. you'll see at 11:00 in the morning, we still have clouds, maybe drizzle near the bay and also for the south bay. eventually once we hit 3:00 in the afternoon, that's when the sun shine builds and that's going to signal so much warmer weather in the next couple of days. can you see a preview in the sko scrolling seven-day forecast. we have this trough of low pressure that's been sitting across the bay area the past two days. it's a very simple thing that's happening. going to make room for this area high pressure offshore and it will keep that storm track away. so for tomorrow it's going to be more of that transitional day. clouds to start and by the afternoon we get that sun building in and with the morning fog being kind of thick, it will still help to keep our temperatures down. for the peninsula, it's going to have a hard time clearing at the immediate coast. that's why we have 60 in pacifica. but towards palo alto, we'll get partly cloudy and 70 degrees. san francisco stays in the low 60s for tomorrow. let's get you to the north bay, east bay and tri-valley. a slight chance of a spotty shower for santa rosa. oakland 65, 6 degrees hotter back into walnut creek if you're traveling on ca-24 and for the tri-valley, temperatures in the low 70s tomorrow. high pressure starts to kick into gear by friday, saturday, sunday and memorial day next monday. how much warmer are we talking?
