Tonight, her side of the story, in a jailhouse interview. Police say she violently shook and dropped this boy, thor thompson, just sustain months old. The boy ended up dying. Reporter raj, the 24yearold, gene bailey, said she did not hurt the little boy, but the little boys father says bailey had been watching the little boy and their 3yearold daughter since june. They trusted this woman. But tonight, she is behind bars, and Authorities Say she is responsible for the little boys death. Little thor thompsons father says it happened in front of their 3yearold daughter, who has recreated what she saw when her dolls. The 18monthold died while in the care of this woman. Police say gina bailey, a military wife, violently shook and dropped the toddler. It happened while the 24yearold was baby sitting thor at a home at Travis Air Force base. Did the baby fall to the floor under your car . No. Reporter as far as you know, the baby never fell . No. Reporter talking from behind bars to our sister station kcra, bailey said she didnt do it. When did you notice something was wrong with the baby . When we were leaving, he spit up in the car. Reporter she says the baby spit up blood when she was driving him home last thursday. The boy later died at uc davis medical center. After that, his father and the driver did cpr for an hour. Our detectives went to work. Reporter Police Arrested bailey last night. One of the worst things weve had to investigate. Reporter the bilittle boys father told us when their son died they consoled bailey with food and flowers. Bailey will be arraigned tomorrow. Eliyce kirchner, nbc bay area news. A new twist in the case of a girl whose familiar is trying to change her brain dead status. Her mother says she has bowel and kidney function. Jahi mcmaths mother says she is not brain dead. You may remember jahi was pronounced brain dead after complications from surgery in oakland. Er her mother says they would like to move her back to oakland. In order to do that, her current braindead status needs to be reversed. We called the coroner, who simply said his office declared her brain dead. In milpitas this morning, investigators say an officer got out of his car to check on a suspicious man. Thats when a man slipped into the officers vehicle and took off. Police used gps Equipment Installed in that police car to track it down. Officers did find it abandoned nearby. But by then, the suspect had car jacked this suv from a woman. Tonight, that suspect is still on the run. Theyre definitely on the naughty list. Police are on the lookout for some brazen burglars. As Jodi Hernandez reports, the suspect may be responsible for a spike in mail theft as well. Reporter seems theres a real grinch targeting this neighborhood. In one case burglars even tried to steal the presents from under somebodys Christmas Tree. Its very safe here, very familyoriented. Its disturbing to know that this is happening. They had stacked all the presents up at the door ready to take them with them when they left. I think they may have been disturbed or interrupted in the course of it. But they had the packages all ready to go. Reporter theyve been targeting mailboxes. This mail was found dumped in the streets in vallejo yesterday. Police are offering free home checks for folks leaving town for the holidays. Two men opened fire at an east bay nightclub. Its now considered a hate crime. Two suspects are in custody tonight. Here they are, Carlos Cervantes and salvador aguilera. Police say the men made repeated statements about the victims sexuality during a fight at Club Caliente on sunday. Police say aguilera grabbed a gun and cervantes ordered him to open fire. He fired directly at the four victims, striking each one of them, before the two men got into aguileras van and fled the scene. Four people were shot but are expected to make a full recovery. Police staked out aguileras home, then took both men into custody yesterday afternoon. All this rain is great for our drought, but the water is leading to some problems too. A multimilliondollar development on the peninsula could be in jeopardy because of flooding. Our scott budman is in san francis francisco. Reporter there are a lot of Biotech Companies here. Theres rumors they want to build even more in this area. But this area, oyster point, gets a lot of water that comes in when the king tide hits. And the concern is that when that water goes back out to the bay, it brings pollution along with it. The king tides are bringing more than just water to south San Franciscos oyster point. Theyre bringing debate. The city has talked about plans to someday develop on top of what once was a landfill. But having this amount of water collecting on the surface is not a good thing. Reporter some say the flooding here, fairly typical during king tides, needs to be addressed first. The water causes migration of leachate to go out into the bay. Reporter thats contamination to go out into the bay, something the city of San Francisco says is not a problem. Theres perimeter monitoring at the landfill. Were not seeing anything outside of the landfill. Reporter the Regional Water board was among those visiting the site today, along with an engineer who weighed in. The long Term Solution would be probably some type of the building of some type of levees around here so that we dont have this problem. Reporter trying to limit flooding with lots more rain predicted in the future. The water board says its a violation to have standing water on top of a landfill. A minivan hit a San Francisco motorcycle cop on a training ride. Investigators say the driver of the minivan ran a red light and struck the officer this morning at harrison and 7th near the hall of justice. Our nbc chopper was overhead. Paramedics took that officer to the hospital. Thankfully, his injuries were not lifethreatening. Today the south San Francisco drug company kalobios was told nasdaq will delist its shares. They fired Martin Shkreli on monday after he was arrested for misconduct at his former hedge fund and another drug company. Shkreli has pleaded not guilty to fraud charges and is free on 5 million bail. He gained National Notoriety earlier this year when a company he founded raised the price of a cancer drug more than 5,000 . A south bay city has a new plan to honor a young girl in hopes of sending a message about gun violence. The city of morgan hill will place a statue of the girl outside city council chambers. She was killed four years ago in a driveby shooting. Ian cull has more on the citys tribute. Reporter tara romero was 14 years old, waiting for a ride home after a Birthday Party in 2011 when she was caught in the crossfire of what police call a gangrelated driveby shooting. She died at the scene. I cant believe Something Like this would happen. Reporter her father joseph had spent years fighting for justice and to honor his daughter. It was like ripping my heart out. Reporter as he battled with depression apolofollowing tara death, he decided to have a statue made of her. Its expected to be completed by spring. Now the Morgan Hill City Council has decided to place it front and center, right between city hall and city council chambers, in a new area deemed the demonstration garden being built next month. While it does represent tara romero, its a good reminder of any child in our community and making sure that we are committed to maintaining that safety. Reporter the statue will have a plaque explaining what happened to tara with the hope of spreading a message of peace through the city and region. And i just hope that all this has a positive effect on the community. Black lives matter was the message. Eight women stood across all lanes of the exit at 101, calling for justice for mario woods, shot and killed by Police Officers earlier this month. The protest lasted about 15 minutes and all the women were arrested. Things got really disrupted at the minneapolis airport. Protesters were inside the terminals, as you see, forcing the security checkpoint to actually close down. This is part of a National Black lives matter protest. Several people there were arrested. No school today in San Francisco. A water main break this morning forced city college to cancel classes at its ocean campus. Heres a look from our nbc chopper today. No visible signs of a water main break, no water on the ground, and no word yet when those repairs may be completed. Right now there is no way to know if childrens furniture contains toxic chemicals. The Consumer Federation of california wants to change that. Theyre calling for a law requiring companies to include labels saying whether a piece of furniture is flame retardant and free from toxic chemicals. Adult furniture is already required to have those labels but the Consumer Group says big name childrens furniture labels have fought hard to keep those labels off their products. They say its not about the boys autism but parental responsibility. It saddens us that the community has made this about discrimination.
