The Coroners Office has not released the name of the victim. Osha is investigating at the site. A discovery on a trail. A hiker is killed while walking his dog. We have new clues in marin county. 67yearold steve carter was found last night lying in one of the safest and most scenic hiking spots in the county. This happened in fairfax. The hiker had parked it in a nearby lot, but now its nowhere to be found. Tonight investigators have released Surveillance Video of three people of interest taken from a nearby convenience store. They say if you spot the trio or the car, call police. If in fact, it is true that the suspect or suspects involved in this crime did in fact steal that car, we are still missing a weapon, were still talking about people who we are considering armed and dangerous. Is it a systemic problem . Inmates inside the Sonoma County jail say they were dragged one by one from the cells and beaten by deputies during a fivehour long assault. Deputies were responding to a Service Inside the maximum security wing. Nbc bay area Mark Matthews is there where an attorney for the former prisoners says there is video of this alleged beating, mark . Reporter the video exists. We have not seen it yet. The sheriff has not released it. But there is video from an earlier lawsuit filed by this same attorney. Well get to that in a second. First, the family members of inmates who claim they were beaten by deputies last may. Just said mom, i knew they were coming. Lori banks says her son danny was one of more than 20 inmates who were punched and kicked by guards for allegedly yelling at deputies to stop a beating. She read from a letter that her son wrote. Deputy me dare is said if he heard one thing from me, that they would come back and beat me. Another man wrote his own letter to his sister. Attorney isaac shah wagger has more than a dozen letters. Hes filing a lawsuit. The Sheriffs Department is cat gore i cannily denying the accusations saying in part that correctional deputies were responding to the actions of a seemingly coordinated mass disturbance. Hes talking about another lawsuit that he filed last year when jailhouse video turned over in that case shows an inmate being tased 23 times while deputies hold him to the ground with his hands behind his back. Trial in that case is set for next march. The Attorney Says the sheriff also has video from last may. If he wants to stand up for his deputies and say that what happened is fine, then i want to see the video that backs it up. The Attorney Says if the sheriff does not release that may 28th video voluntarily, it will eventually come out in the course of the lawsuit. Reporting from the sheriffs headquarters in santa rosa, Mark Matthews, nbc bay area news. Leaders made a decision about the troubles at the Santa Clara County jail. They formed a commission to do a top to bottom evaluation of the procedures. It will be made from a Broad Spectrum of the community from retired or active judges to some of the families of inmates. Applications to be a member on the commission will be on the county website as of tomorrow. Nbc bay area was the first station to break the story about the investigation into a death at the jail. Three correctional deputies are accused of murder in that case. Just in, more lackluster numbers for sjpd. They need help but not many are signing up. Only ten cadets are joining the latest academy class. Sources are telling us three cadets dropped out. Numbers have been dismal with the most recent class only graduating 18. Theyre trying to rebuild police force after resolving labor disputes with the police association. Trouble in the cockpit. An Emergency Landing was made when the copilot suddenly lost consciousness. This is video from albuquerque, new mexico during that Emergency Landing. Everyone landed safely and the flight was later moved over to San Francisco where people arrived. Their first officer, the copilot had a seizure and was unconscio unconscious. In San Francisco, many among the 177 passengers praised how well the flight crew handled the emergency. The crew handled it in an exemplary fashion. They let us know what was going on. They didnt tell us anything that wasnt true. They landed. We stayed on the plane for like half an hour, 40 minutes. The medical emergency forced united flight 1614s pilot to land in albuquerque. They said theyre looking for a doctor on the plane. They said we had to get down as soon as we can. Nobody knew what was going on. Once they were on the ground, passengers learned what had happened. Once we were on the ground, the pilot came on and said my first officer had a convulsion, had a seizure and is being taken to the hospital and we hope everything is okay with him. At that point, i thought, my goodness, what a stressful situation that a pilot went through and he got us on the ground safely and handled it perfectly. In burlingame last week, the same group hit four spots overnight. The thieves used their own tools and a blowtorch to break into secured toolboxes. He served his country for more than a decade, including time with the California National guard. You decided to leave the guard. Why . Because im embarrassed to have ever been a part of it. They dont care. He wore a uniform for 24 years as a guardsman and as a marine, army soldier and airman, including flying supplies into baghdad during the iraq war. Was your life on the line going in and out of there . Every day. Every day. When you join the military, did you ever expect to be in this situation . I did not. He served in kuwait during an eightyear assignment in the guard. In your opinion, do you deserve better . I think all servicemen deserve better. Ive been waiting for more than four years for a completed line of duty. Six years. Two years. Is centers on illness and injuries they sustained while in service to their country and on a l. O. D. , line of duty. Think of it as a workers comp decision. Financial support for Service Members injured on the job. Heres the problem. Regulations state the guard must complete l. O. D. Investigations in 75 days or less. Does the guard meet that deadline . Not by a long shot. Stern berg made his First Official l. O. D. Request in 2011. He cited a series of medical conditions and injuries he says he sustained while serving on active duty and in the guard. In total, hes requested seven l. O. D. Investigations. He said none met the military deadline. The reason im coming to you is because ive exhausted pretty much every administrative remedy that i can. He says numerous letters to the guard and state and federal lawmakers fail to produce answers. In may, the guard responded to an inquiry from u. S. Senator barbara boxers office and blamed much of the delay on sternbergs failure to produce requested documents. Its a claim that he denies. But the guard also admitted that his unit failed to initiate an l. O. D. Investigation for an alleged injury that happened back in august of 2011. The report was not started until march of 2013. Are you surprised to know that mr. Sternberg is frustrated with the system . Not after speaking with him, no, sir. The guard designated lieutenant allen downey to investigate one of the l. O. D. S. Weve learned it was overdue before it even crossed downeys desk. I can see from the document dated years ago that i knew that this was a long time in the making. Help me understand why this hasnt been resolved in more than four years. I wish i had a good answer for you other than my suspicion all along has been that this is a systemic problem. What are you saying . Im saying that this process is completely broken and does not work for anyone. California guard records obtained by nbc bay area provide insight into the delays. This february 2013 memo includes california has over 1300 overdue lods and is the highest number of l. O. D. S by any state in the nation. A weekly snapshot shows in february 2015, up to 88 of all l. O. D. S were overdue. Im not surprised. Doesnt even shock them. Its status quo. This is the Business Manager for the union that represents guard members. The regulations are there. Nobody is following them. He says hes heard the same store fri dozens of soldiers and airmen, that the National Guard has failed to complete their l. O. D. S. I get emotional and i get frustrated because i know a lot of these people. The Investigative Unit also obtained this database from the California Army guard. We crunched the numbers and found over the past six years, 73 of all completed l. O. D. S missed the deadline. And this may be more troubling. Of all filed, l. O. D. S requests, 59 were never completed. And because of significant tracking deficiencies, there is no way to know why many l. O. D. Requests were essentially ignored. These folks, they served their country, they deserve better. Why the delay . The Investigative Unit requested an interview with the adjutant general. He declined to answer questions raised in this investigation or by members of his guard. A spokesperson released this statement instead. Reading in part, the wellbeing of our soldiers and airmen is the California National guards highest priority. General baldwin is personally aware of whats going on. It seems to me that hes not taking his responsibility seriously to make sure that the rules are followed and that theyre followed within the required timeline. But for these guard members, its more than a failure to meet a deadline. The delays have taken a toll on their finances, their personal lives and their families. After serving our country, they believe they simply deserve an answer. Whats that saying to you every day . Wasnt worth it. I wasnt worth it. Why can they not fix this system . Angry . Yes. Michael sternberg finally received an answer about some of his l. O. D. S during our investigation. Guard issued a series of decisions. Again, 4 1 2 years after he said he submitted the request. Ultimately, his l. O. D. S were denied. He plans to appeal. The guard also acknowledged it has problems meeting those deadlines but says it has reduced the overdue l. O. D. S by 70 in recent months and the guard says its taking steps to address the delays but declined to provide us any specifics. Clearly, more to come. Theyre given a budget and the chance to pick players for their personal team and win money based on how well their team does. Now two of the most popular sites, fan tuel and draft kings are under fire after a draft kings employee tweeted data that could be used to gain an advantage in drafting fantasy teams. That same employee won 350,000 on fan duel, a competitor site that week. Mike of san jose plays on draft teams and was considering fan duel. Not anymore. Im definitely not going to invest any more money into either site until theres more transparency to find out whats going on here. For an employee of the competitors site to win 350,000 prize is a red flag to me. Today fan duel defended the employee saying he did nothing wrong. They released a joint statement saying their employees are barred from participating in any online Fantasy Sports contest until the industry develops a more detailed policy concerning the use of competitive data. But the scandal has prompted lawmakers to question whether Congress Needs to look into the industry. The answer is yes. I think it also should be a warning shot to everybody. Dealing with high clouds. We anticipate the comeback for tomorrow morning. Lets get you to that morning forecast. Its right here across San Francisco with temperatures starting off at 59. Also areas of low clouds for the peninsula and 58 and for the south bay, mainly clear with a little bit of chill in the atmosphere and 57 degrees. Now, the forecast is certainly very interesting when you take a look out here across the west. Were now tracking hurricane owe hoe to the south and east of hawaii. Current stats have this as a category 1 hurricane. Winds at 85 miles per hour. Pressure continues to drop at 975 millibars. But here is what is fascinating about this. The track of this actually has a somewhat parallel path to california the way things are playing out today. There is nothing thats showing a california, oregon or washington landfall. But it is certainly noteworthy, just due to the fact that el nino developing, we have increased activity out here in the west. Well keep a close eye on it. Certainly sub tropical moisture to the pacific west from this storm system. But not overly gusty winds. Back here across the bay area, were looking towards that el nino, its now been 242 days ive calculated since the last time san jose had one inch of rainfall and or higher in pay 24hour period. That el nino expected to open up middecember through march. Thats what the longterm models are showing. Were banking on that definitely and hoping we at least get average rainfall throughout this rainfall season. The forecast at least most immediately does not have any rainfall and just due to the fact that High Pressure is building in stronger offshore. That will mean a typical pattern of fog in the morning hours, some in the afternoon on wednesday. As we head throughout saturday, that area of High Pressure will get a little bit stronger and that will push temperatures into the 90s. The main reason well not see 100s, thankfully, after all the triple digit heat is this area of low pressure to the south. Slightly cooler air associated with it.
