>> the students return from winter break has been pushed forward an extra day to wednesday. is it enough toim time to get the school, the diminished space and limited material ready for the kids? >> it's been a hard year to begin with because we had so much disruption with the construction and the upgrades that the school is going through. >> i think they'll be -- >> construction crews have been here since june upgrading this building on the north side of the playground for handicapped accessibili accessibility. they started gutting the inside of the other half for upgrades. six days later the fire erupted and claimed the south side of the school. a quick decision had to be made to reverse the demolition accomplished and rehab the classrooms immediately so students have somewhere to go. allison's whose two children attend, she knows it will work out. >> one thing about the school, it's a really strong community. i think we'll pull together and get through it. but it's a challenge. it's maybe a challenge we didn't need this year. >> paul greenwood, the director of creative arts charter says they're still waiting to hear from the insurance company to find out what they might get from that. he says actually a lot of people have been very generous. complete strangers have gone to the website and donated money to help the school. live in san francisco, traci grant, nbc bay area news. an electrical fire damaged a large office building. the fire reported before 4:00 at the union bank building at 400 south el camino real. it offices the for a congresswoman and a senator. they were not there, nor was the staff because of the holiday. there was no damage to offices either. it was on the 11th floor of the building and the sfring sprinkler system put out the flames before they spread. fire officials say there's more water damage than anything else at this point. san francisco arson investigators are trying to figure out what caused a fire that damaged three victorian homes on new year's day. it started at 8:00 on masonic. it burned fast and took a hundred san francisco firefighters an hour to knock down the fire. it started somewhere in the back of the home. the homes are close and they're thankful that it wasn't windy. today, neighbors though, still a little nervous. >> from the back of our place i could see the entire rear of the house was in in flames and starting to spread. it was pretty frightening. first thought was to get the kids out if we needed to. >> ten people were displaced because of the firement one firefighter did suffer a minor injury. another person was taken to the hospital as well. that squirrel monkey stolen from the san francisco zoo is getting r and r. banana sam has been found and returned to the zoo. joe risotto junior shows us the pictures of the monkey and why the mystery still isn't solved. >> the squirrel monkey that was -- >> of all the exhibit at the san francisco zoo, one of the most popular today was the one with nothing in it. it's the exhibit where banana sam, the now world famous squirrel monkey, was stolen on friday in a brazen robbery. though the monkey's theft and joyous return on sunday made international headlines, the star seemed unfazed by the hoopla. he sat in quarantine in the zoo's hospital dining on monkey chow under the close watch of keepers. >> banana sam is doing remarkably well. he's alert, he's eating well and reacting normally to everything. we're quite pleased. >> if the monkey could talk, he might be able to explain his weekend ordeal at the hands of captors who cut their way into the pen he shares with 17 other squirrel monkeys. but without sam's account, keepers are playing it safe. >> we have no idea what he's been exposed to. and so we need to take every precaution to be sure that he hasn't contracted any bacteria or virus. >> back at the pen, workers were making last repairs before the squirrel monkey exhibit could reopen. as for the emotional repairs, they take a little longer to fix. >> it's shocking and devastating and it's hard not to take it as a personal blow because this is like our family and this is like our home. >> police haven't yet announced any suspects. they're still checking out the story of a man who said he came across the missing monkey in stern grove on sunday and lured it into his backpack. so far the zoo hasn't yet paid out the $5,000 reward. >> we're waiting for the dust to settle with the police investigation. >> while sam waits for the medical all clear, visitors stared at his empty pen and the sign announcing his return. >> he's here for all of us to enjoy. for someone to steal a monkey is just not right. >> although visitors had hoped for a glimpse of the zoo's biggest celebrity. they were content knowing he's safe. joe risotto, junior, nbc bay area news. new tonight at 6:00, it's been almost two years since a small plane crash in east palo alto killed three engineers. the families who lost their home and business to the crash will finally be able to rebuild. the san jose mercury news is noting that settlement in is imminent. jones has not been able to operate her business which is an in-home daycare center since the five-bedroom house was destroyed. they blame the crash on the pilot and owner of the plane. the settlement will be announced had week. it is now illegal to smoke anywhere in public in alameda. starting today, there's no smoking allowed on sidewalks, at outdoor caves or at the beach. you can't smoke in taxis or any other vehicle used as a workplace. because the toxins in smoking can't be ventilated. it's banned from multiunit kpleks and within 20 feet of an open door or window in your own apartment reaction is mixed. >> i'm not a smoker. i think when you're outdoors out in public where there's plenty of fresh air, i don't think anybody should be telling you what to do outdoors, basically. >> we're all starting to learn how to take of our bodies and stuff like that. anything that improves our health is a good thing i think. >> the law is strict. but it's not as strict as it will be starting in 2013. the city will institute even more restrictions in multiunit apartment buildings. along with the new years resolutions, shoppers are trying to stick to another habit. bringing their own bags to the store. the plastic bag ban went into effect january 1st. since it applies to everyone except restaurant and nonproperty or charity retailers like the goodwill, a lot of people are talking about it. nbc bay area kris sanchez joins us from san jose. whether shoppers are willing to change the habits, the hardest part is to remember to take them into the store with you out of the trunk. >> yeah. we heard a lot of that. oh, they're by the front door. oh, they're in my kitchen, oh, they're in the trunk of my car and i have to get them. it started out that people are willing to make that new habit of trying to use the reusable bags. what they're not trying to break is the habit of where they shop regardless of how groceries are sacked. >> we have walmart ones. we like the fresh and easy bag. they're the prettiest. we have a grocery outlet bag. this is the first time we're going to use them. >> most shoppers have a stack of reusable shopping bags. >> i have a lot of bags in the trung of my car. >> i was bags in my car. >> from now one, shoppers have to bring a reusable bag or carry out purchases or pay for a bag. 75 million a year to four million a year in the city is creating back and forth in the parking lot. >> we ran back and got them. i did forget them. >> while the shoppers are willing to go back to the car, most are not willing to start shopping somewhere else. >> no. not going to change. no. >> why is that? >> because i live here, so i should just shop here. i have to use extra gas to drive somewhere else. >> while michelle has a choice to shop where she works or where she lives, she says it will come down to convenience. >> possibly. it depend on where i am. since i work here, sometimes it's ease krer to go close to go here after work or on the weekend, for sure in sunnyvale. >> it will be good practice for her. sunnyvale will enforce their plastic bag ban in summer. san francisco was the first one to do this. they will vote in february on whether to charge for paper bags which are now free. it will take getting used to, but the short term inconvenience will pay off in the long run. >> we used to live in europe. they did that there. >> we did talk to pet owners who were saying this is a great idea to ban the plastic bags except for when it's time to pick up after the dog. we found a solution, you're probably familiar with it. 36 bags for the doggie bags if you like those. five bucks. [ male announcer ] find yoplait on sale this week. ten for six dollars at your local safeway store a known gang member accused of killing three members of a san francisco family will go on trial this week. jury selection is set to begin tomorrow. he opened fire and killed a man and his two sons in june of 2008. when he mistook one of the sons for a rival gang member. the killing sparked public outrage over the city's sanction wary policy which prohibits city employees from helping immigration officials with arrest. ramos had a criminal record but had never been reported to immigration officials when was a nor. he faces life in prison without parole if convicted. a man is in the hospital with serious injuries after being hit by a car in san francisco last night. the man was walking shirtless on the roadway west of fourth street when he was struck around 11 p.m. the chp says the victim was unconscious but breathing when he was found. the agency says the driver who hit the man stopped and cooperated with authorities. the accident blocked lanes on i-80 until about midnight. occupy wall street protesters showed up to occupy the rose bowl parade in pasadena today. hundreds of demonstrators marched the same route os the floats caring a banner representing the u.s. constitution. they chanted banks got bailed out, we got sold out. groups of police officers were in front and behind the marchers ready to keep order. but no problems. reaction from the crowd, though, mixed. >> they should occupy a desk is what they should to. >> i feel they have a right to protest about what they believe in. >> protesters worked with the pasadena police department in advance to avoid disrupting the rose parade and still being able to get their message across. the bay area being treat today football in january. >> yes, the 49ers play in the second round of the playoffs on january 14th. even though the tickets to that game don't officially go on sale until tomorrow, nbc's damian trujillo found a broker selling the best tickets in the house. how much are they going for, damian?
