criticism. activists called for the former police chief to be fired. reforms were pushed and an interim chief named. >> being a police out here in the streets isn't an easy job. don't get us wrong. we not anti-police, we anti-haters. on. >> reporter: on the same day the city police officers association held its own remembrance. >> prompted by the murder of sergeant scott lunger one year ago today, allies on high alert tonight after a shooting rampage in munich, germany, kills at least nine people. now within just the past few minutes we learned that police believe this shooter is among the dead and that he did act alone. police are treating the shooting spree as a possible terror attack. it belonged at a mcdonald at a popular shopping mall. terrified shoppers were running from the building. president obama was briefed on the situation at the white house. >> it is still an active situation, and germany is one of our closest allies, so we are going to pledge all the support that they may need. >> german police first thought there were as many as three shooters but now they believe the man acted alone, killed himself after that rampage. this is the second attack in germany in less than a week on monday, a man wounded passengers with a knife on a train in bavaria. isis is claiming responsibility for that train attack. our coverage of today's attack continues on "nbc nightly news." is gearing up for the democratic convention and clinton's push for voters to pick her instead of trump as their voice. one factor in clinton's vice presidential picking process might be the matchup. trump's pick for his running mate mike pence is not known as a strong personality or a strong debater, freeing up hillary clinton, it is believed, to pick somebody who is not so fiery like, for that's his decision of a san francisco judge in the case of hall. he pled guilty to misdemeanor battery in 2013 in a domestic violence case, bargaining for probation to avoid jail. the in 2014, another woman filed a complaint and today the judge revoked the probation. next month the judge could extend his probation and pose more fines, require counseling or even order jail time. while one fire after another broke out in the same neighborhood in san jose, investigators say it now appears it could be arson. this is one of the discount carpet stores at san carlos in lincoln in the rose garden area just southwest of the sap center. the other happened at a trash dumpster nearby. it burned a storage facility full of carpet. the store is still open. a new shark sighting for the second time in a month. the shark was seen circling off the coast of pacifica. this is unsettling news, the beaches are expected to be packed due to the heat wave. >> reporter: that's right, janelle. there are warning signs like this all along the sidewalk here. you would never know it by looking at the beach. those people either didn't see the signs or they don't care that they're swimming with sharks. dozens of surfers take to the water at lindh mar beach, despite the sign yards away warning of a shark sighting within the last 48 hours. surf camp instructor todd johnson says he's not worried. >> a big shark couldn't get into the water where we're surfing. it is maybe waist to six feet deep. >> reporter: the captain with the pacifica police department says the warning comes after a shark was sighted yesterday just off the coast. >> reported it was about six feet in length, and 18 and about 80 yards off shore. >> reporter: johnson says he saw one too, today. >> probably about an eight foot shark, just cruising along the deep water in the north end of the beach. >> reporter: johnson says it was either a salmon shark or a great white shark. >> i don't want to get close enough to find out really. >> reporter: that's not keeping johnson or his students out of the water. >> if they're hunting, you're not going to see that. that's the one i'm worried about. not the ones that are cruising on top of the water. they're always here. you can't -- you just got to put that in your head. >> reporter: that's what is keeping mark fisher from jumping in. >> sharks what you hear about your whole life. that's what everyone is scared about in the ocean. so being from minneapolis it would keep me out of the water. >> reporter: police aren't telling people to stay out of the water, but they want valley humane society where we have cute puppies with us today. we're going to talk more about our clear the shelters event and how you could make take home something as cute as this in a few minutes. into a frightening situation for a girl on the peninsula. she was walking near the corner of douglas and fair oaks in red wood city when a man tried to kidnap her. michelle roberts is live near that area. >> reporter: the girl was about four blocks away when she encountered this man, she ran to the school behind me where she found help. the sheriff's department says they have been out searching but so far have not been able to locate the suspect. >> i'm just -- i can't believe it. it is unreal. >> reporter: neighbors who live near the corner of douglas and sarah oaks in red wood city were speechless after hearing a 12-year-old girl was approached by a man on his bike yesterday afternoon. the sheriff's department says the man asked if she was lost and told her, don't worry, i'll take you, as he tried to grab her arm. the girl stepped back and ran several blocks to fair oaks elementary school, where she found a teacher. the sheriff department says the suspect is described as a thin white man in his 30s or 40s, blonde hair and riding a red bicycle. neighbors are grateful the girl was able to get away. and say the incident will serve as a reminder to be alert. >> i tell my daughters not to walk alone. try to have a friend with them all the time or a dog or something. if there is a car that comes by, and the person tries to talk to her, keep going. >> reporter: there aren't any surveillance cameras in the area that could have captured a picture of this man, but officials do say this is an isolated incident. reporting live in red wood city, michelle roberts, nbc bay area news. delay mond green one step closer to closing the book on his assault case. green is accused of slapping a football player in michigan earlier this month. today his lawyer said he reached a plea deal. green would need to stay out of trouble and pay $500 in finz. the case won't be closed until after he returns to the olympic games, where he's playing for team usa basketball. it was a mess, the dispute between santa clara county over a construction project. today, heads of turner construction open the doors to show that the relationship and construction are progressing. robert honda is live. are they really getting along? >> reporter: well, the proof will be in just how well this hospital bed is progressing but there are strong indications that the bad feelings are a thing of the past and a good thing for future patients. turner construction led a tour today through the much delayed hospital building project of santa clara valley medical center. a facility years behind its original schedule, which is what led to the company being fired and a public dispute including the county policing a video of a steam explosion amidst accusations of unsafe and sloppy working conditioning. now, after turner agreed to new personnel, new schedule, revised budget and to drop its lawsuit, the construction giant wants the public to see the project is back on track. >> it is hard to really dissect what happened in the past. all i know is that this is a spirited, cooperative, collaborative group that we're dealing with from the county. >> reporter: the new building figures prominently in the future. the $480 million project will house vmc's new elite brain injury and spinal rehabilitation unit complete with state of the art pool therapy as well as provide much needed beds. >> we're going to change the mix of beds so that we have more icu beds, more single occupancy rooms. >> everyone wants the same thing. everyone wants to see patients treated here in the shortest amount of time. >> reporter: the shortest amount of time appears to be the building, but ready by june and open for patients by fall of next year. live in san jose, robert honda, nbc bay area news. senate on foreign relations and military affairs. he also built a reputation for working across the aisle when governor as virginia. govern and mayor of richmond. he also speaks fluent spanish again, melanie. tell us about these cute little guys we have here with us. >> we have colin and janelle, two puppies, eight weeks old and available tomorrow. >> and despite some people think chihuahuas are loud all the time, these puppies are actually kind of quiet, right? >> these puppies are very calm, quiet and do not shake all the time. >> that's a good little side note. this saturday, he's got -- she's got so much energy. this saturday, tell us what is happening out here at the valley humane society in pleasanton. >> we're excited to participate in the clear the shelters event. we'll have 40 plus animals available for adoption. cats and dogs. and we're waving all our adoption fees. we really just want to help the really wonderful animals find loving homes and we're hoping to do that tomorrow. >> reporter: how could anybody not want cute faces like these? one other thing real quick, if someone has a little kid and getting a pet for the first time, you do well with trying to match them up. >> we want to make sure families create a good family bond and stay together and so as we have really young children, a lot of times we'll recommend a tough kitten so they can grow up together and we don't note animals backgrounds. we aren't totally sure. we work closely with all of our families to make sure we help them find the perfect match. >> reporter: thank you for having us comfortable day, half moon bay at 64. san mateo, 76. palo alto, mid-80s. san francisco, beginning to feel some of the heat. not going to be one of those offshore dry wind events. we'll have temperatures in the low 70s throughout downtown and sunny skies. with the north bay, east bay and for the votrivalley, we'll feel the heat the most across the trivalley. pleasanton, 97. livermore, 98.
