walnut creek. a chase started a little more than an hour ago in antioch when officers noticed a stolen car. that car crashed into at least one other car near treat boulevard. officers took one person into custody there. they're looking for three other suspects who ran. no word yet on injuries but we have seen an ambulance in the area. >> a major victory this morning for animal rights activists. one of the country's most well known circuses is getting rid of the elephants. >> bob is live in san jose. this is a really big change but some folks still say this is really not enough from the circus. >> well, kris and scott, animal activists we spoke with wish the next time wring lg brothers comes, it could be 100% animal free. they do applaud the announcement this morning that it will begin phasing out the use of its 13 elfnlts from the circus by the year 2018 and will be retiring them to the center for elephant conservation in california. it's not responding to pressure from animal rights groups but rather over concern from circus goers who think they're not treating the elephants well and the wave of anti-circus, anti-elephant ord nnlss. the city of oakland banned the use of a poker like device trainers use to train and control the elephants. now an effort spearheaded by the belmont bay animal rights group. you can see them demonstrating the device for the past 28 years he has been protesting and documenting ringling's abuse of animals. he's not surprised by the decision to remove the elephants. he doesn't think he should retire them to the conservation center in florida but to a sanctuary elsewhere. >> i don't think they ever cared about the elephants. i think they should be sent to an established sanctuary personally where they can be with other elephants who are out there roaming freely in the sanctuary. >> that was pat, the head of the humanities for education. he thinks he should be banning all animals, moving to an animal animal-based perform ps. we spoke with peta this morning, and while they're excited about the news they criticize them for waiting until 2018 to phase out the elephants acts. >> thank you very much bob. >> new details on the biggest terrorism trial in the u.s. since the oklahoma city bombing case. >> the second day of the trial of accused boston marathon bomber dzhokhar sartsarnaev. he's accused of planting the bomb that killed three and hurts hundreds of others in the boston attack. >> just hours after taking the witness stand wednesday, boston marathon bombing victim rebecca gregory took to facebook posting an open letter to the man she had just seen face-to-face for the first time dzhokhar tsarnaev, the man accused of planting bombs at the finish line of the 2013 boston marathon. she wrote in part today i looked at you right in the face and realized i wasn't afraid anymore and today i realized sitting across from you was the crazy step forward i needed all along. she signed it, someone you shouldn't have messed with with, #bostonstrong. gregory was one of six witnesses caughted by the prosecution. most victims of the bombing. karen mcwaters told jurors it was chaos, confusion, creeping yelling, smoke. hard to hear. she described the moment her friend crystal died in the street. her hand wend limp in mine and she never spoke again. we expect the jury to hear more videos of the attack. marriage next month. the court released the calendar for the final two months of arguments for this term. the gay marriage cases will get two and a half hours on the last tuesday in april. they come from a federal appel appellate court in cincinnati that upheld bans on same-sex marriages since the 2013 ruling striking down part of the federal anti-gay marriage law. a decision is expected by july. >> that's not the only case the supreme court will hear. also on the docket hornverses the department of agriculture. marvin horn is a farmer in fresno. he objects to the rule that says california raisin farmers must give the u.s. government up to half their yearly crop to keep raisin prices stable. this has been going on for years. farmer horn says the government shouldn't be able to seize his property if he did nothing other than grow raisins. police are out in big numbers this morning looking for people who are breaking into cars and stealing valuables in palo alto. on tuesday night alone, burglars hit nine cars in the downtown area near busy university avenue. the thieves are looking for electronics, targeting garages and rental cars police say because they know they often have valuables inside. >> they may look in windows and see an ipad or a lap pptop bag. that's all they need to see. they grab the items and they're gone quickly. >> overnight, police arrested two men in a public garage after finding stolen property in their car. those arrests are not tied to the recent car burglaries. >> the u.s. ambassador to south korea is recovering after being stabbed during a -- perapportatory had to close. >> activists in san francisco are fighting a massive housing project in the mission district. protesters shut down a developer's community meeting last night. they say they are fed up with that development. a company called maximus tried to present new plans for 1979 mission, the housing and retail center at 16th and mission, but opponents shouted them down. >> want to tear down the building i live in and put up more condos. >> we think it's a good compromise and bier going beyond what other developer have done. it's not just rental housing. it's for-sale housing. >> maximus has agreed to fund the creation of 90 affordable housing units and fund a playground. >> new details of alleged sexual harassment at one of silicon valley's high profile companies. >> stefphanie life and the accuser expected to thak the stand in hoirs. you were inside all morning long. what can you tell us? >> hey, good morning, kris and scott. ellen pao was seeking $16 million in damages for saying she was fired after complaining about gender discrimination. she's set to testify this afternoon, but all morning and still on the sand right now is an attorney who was hired by kleiner perkins to investigate claims of sexual harassment inside their really a couple dozen reporters are filling the room as this case has attracted a lot of media attention. we caught pao leaving her cab around 8:20 heading into the courthouse. she was smiling, seemed to be in good spirits. she's the 45-year-old former junior partner who said she was passed up for promotions because of gender discrimination, but kleiner perkins said she didn't earn the trust of management because she lacked the skills to work well with others including subordinance. the man on the stand, steven hirshfield hired to investigate two sexual harassment complaints filed by two partners they both filed it against the same person. the investigation into the complaint has been the focus all morning. it's really telling of the culture there according to the investigator. she said he was going out of his way to demonize ellen pao and she herself was afraid of him to the point of having discussions about security and that he had a temper. after that investigation, by the way, the firm did fire her in 2011. hirshfield's investigator also talked about john doerr who was trying to dodge the cameras yesterday, hiding behind staffers before he took the stand for the second day. doerr is the kleiner perkins part partner who hired pao to be his chief of staff in 2005. hershfield said he described him as someone with a female chip on her shoulder and someone who quote, always seemed to blame the other person for the fact the relationship ended and he's talking about how pao and nasri had a relationship an affair together. another example, he called one executive stupid after he asked two female junior partners to take notes at a meetling not meeting to single out the two women in the room. that could be mistaken as a lack of sensitivity to women. really what's happening here is you're hearing little tidbits come out in this trial. this is day eight, by the way. another thing that we heard this morning was talking about the executive who comes from an oracle background, a former president and coo there, how there's a culture of affairs there, how he had married a secretary after having an affair with her. kind of trying to paint a picture of what was going on also at kleiner perkins. we have a crew in there. pao is set to take the stand this afternoon. we'll have updates at 5:00 and 6:00. stephanie chuang nbc bay area news. >> thank you. a rare kidney transplant procedure under way in the bay area. >> here's a picture tweeted out by the california pacific medical center in san francisco. this shows one of the patients and a nurse prepping for a unique six-way kidney transplant. a team of doctors will operate on 12 people from the bay area and the central valley. they will essentially match good kidneys from six of the people and give nemto the six others in need. >> i'm excited. i'm not nervous about the surgery at all. i'm really excited because i know that there's a life out there that's going to be extended. >> how the procedure will take two days. it's the largest kidney donation chain ever conducted on the west coast, and i swear, i saw one on a medical drama. that's how big a deal it was. >> amazing. a gives it to b, b gives it to c. >> a litter of puppies found dumped in a pleasant hill park are now up for adoption. >> east bay animal rescue is screening the applicants to take home the puppies. back in january, a dog walker discovered the puppies tied up in a bag and left in a park trash can. police are still looking for whoever abandoned the animals. we'll remind you, there are groups that are willing to take the puppies who can't take care of them. >> it was in january, we took that shot. so they may be puppies or puppies. >> i know. they're probably big -- >> they're adorable but yeah. >> no such thing as a free puppy. christina loren is here with a forecast that makes us a little less guilty about enjoying wednesday, we start to get shower activity. now the models are hinting at a little more rich moisture to pass through the bay area. could see moderate to heavy rain from time to time especially in the north bay. that will continue into thursday. and then by late friday everything clears out. the good news is we're still bulls eyeing a half inch of rain in the south bay. closer to an inch in the sold her the winning emerald 10 scratch-off ticket. laxmi claims she promised to evenly split the prize which is dpl $350,000 each after taxes because he fronted her the money to buy the ticket. he even produced a note reyes signed, but she says she agreed only to give him a fraction of the money as a sign of good will and maybe even good luck for more wins in the future. >> only $50,000. but area news. >> and now, an exclusive investigative unit report washington, d.c. taking notice after an investigative unit report in which we first exposed an insider called failures at the agency is posed to protect whistle blowers, workers who spoke utout in the name of safety. last week we told you about darryl whitman who works for osha. he said managers told him to close cases quickly and meet quotas instead of investigating serious concerns raised by people who work in industries like airlines and pipeline safety. but after a show of support from workers who have also reported safety concerns and a call from the united states office of special counsel, whitman said the agency is now looking into his claim. >> when we don't step up and do the right thing, it's not just us, not just democrats about the way that she has handled the issue. >> after courting clinton foundation donors at this new york city restaurant wednesday night, hillary clinton tweeted at 11:35 p.m. i want the public to see my e-mail. i asked state to release them. they said they will review them for release as soon as possible. she did not address why she used a private e-mail system exclusively while secretary of state or registered it to her home. raising questions about whether her e-mails were properly archived. >> it's important to insure that when official business is conducted on personal e-mail that those records are properly maintained and preserved. >> clinton aides say she turned over 55,000 pages last year to the state department but have not said whether she held anything back. and now the republican-led house committee investigating benghazi has subpoenas all of clinton's relevant e-mails. >> i can't do what the house asked me to do which is white the final definitive report if i don't have all of the documents and e-mails. >> bill and hillary clinton's long time attorney wrote the committee that contrary to reports, clinton used only one personal e-mail address as secretary of state. then switched to a new address after leaving office. but why would she go to such lengths to avoid using government e-mail? one possible clue this overheard conversation from 2001. illuminate the arts is taking down the lights to make way for bridge maintenance at the end of the installation's permitted run, but following a nearly year-long hiatus they'll be reinstalled in time for the bay area to host the 2016 super bowl. >> it will become the permanent fixture. >> once the lights are reinstalled, the group plans to turn over control to caltrans. >> our expectation is they'll really stay forever. >> the group had to raise $4 million in private funds. fortunately, that twinkle caught the eye of pat toby. >> i couldn't imagine for a moment that this incredible lighting display was going to be gone. >> so he dug deep deep into his pockets and kicked in $2 million. after funding operas, charities, and museums, he says the permanent loss of the light would your beach forecast is going to be right. >> thank you. because you know what init is right on the money today. temperatures ss already in the 70 at some of our local beaches. you always find the guy who looks like he knows what he's doing and ask what he thinks. santa cruz right now looking good if you want to head out there. you get paid in sunshine in ocean beach. we're scouting out the beaches. finding out how many people out there. not a lot of people out there. you could get the beach to yourself on a beautiful day today. wanted to show you what it looks in in half moon bay. spectacular. and one of the reasons why it's so warm is because high pressure is in control and it's driving the winds offshore. the wind moves from land to sea. as a result the warm downsloping winds actually negate the marine influence so it's just about as warm for today in the city by the bay as it will be down here in the south bay. temperatures are going to be really lovely as we get into the weekend. the ridge of high pressure will get stronger. that will translate to warmer temps. you can see the arrows pointing right back out to sea. that is our wind flow although the wind out there pretty light right now. temperatures mostly in the 50s and 60 at this hour. we're on our way to the 70s. so a rapid warming all the way through about 3:00 today. that's when the highs come in. 69 in san francisco. 72 is the high for the tri-valley, and the same for us in the silicon valley. let's get to some of the events i promised you. free admission day in redwood city. tomorrow san mateo county history museum. temperatures just lovely out there. that's a really cool museum to check out. if you want to head south, the santa cruz museum of natural history is offering free admission for tomorrow. temps will be really nice out there. 66 at noon in santa cruz. you can swing to the beach. temperatures will be lovely there. it's only going to get warmer throughout the weekend. here are your numbers. 76 degree in the south bay on saturday. 75 degrees on sunday. and i really want to stress the fact that hey, it's going to be beautiful, but these warm days will come to a close pretty rapidly by early next week we're tracking showers. the temps will stay nice and steady saturday into sunday. we'll max out mid 70s, just about as warm on monday for most cities. we will see a return of low clouds as we get into your monday. and then by tuesday night, temperatures will really start to drop off. got an area of low pressure on the way. a classic cold front. we stop the clock for you at 7:00 a.m. on wednesday. the heavy stuff moves to the north bay. i think that's where we'll get the highest rainfall totals. we're fair game even in the south bay. continue to move you forward in time. wednesday at 1:00 p.m. the showers continue. that will continue get another round as we head throughout thursday, and by friday late friday of next week everything clears up. i'm still counting on good half an inch in the south bay. closer to an inch up in the north bay. we'll keep you updated watching the system like a hawk. it's nice to have something to watch. back to you. >> thank you and followed up with them 20 years later with cognitive testing. people who had a lower fitness level in their 40s had smaller brain tissue volume in their 60s and performed more poorly on tests measuring the ability to make decisions. >> and a new study claims following a mediterranean diet cuts your risk of heart disease in half. greek researchers found people who most closely follow the diet were 47% less likely to develop heart disease in the next ten years. in fact sticking to the diet rich in fruit, vegetables whole grains and fish was more protective than physical activity. a
