Reporter were in the promenade neighborhood of hercules, and people who live here say this neighborhood was crawling with kids who were trickortreating on halloween. But tonight police tell us someone put methamphetamine in one little boys candy bag. We actually ran out of candy to give away. Reporter halloween is a big event in the promenade neighborhood in hercules. A lost kids running around on the street going to different houses. Its just a great neighborhood and a Great Community for kids to feel safe outside and for parents to feel safe with their children outside. Reporter tonight some are questioning that sense of safety. Hercules police say a parent who brought his kids here to trickortreat friday found a plastic baggie of white powder in his 8yearold sons bafg candy. He will been checking his childs halloween candy after putting it up in the cabinet on halloween night. And while checking the candy, he found the baggie and suspected it to be Illegal Drugs and wanted to report he found that. Reporter police say the white powder tested positive for methamphetamine. Its a small amount but a serious crime. A tenth of a gram is enough to have felony charges filed for possession of a controlled substance. It is surprising because you dont know like now it makes you wonder why Something Like this is going on in your neighborhood. Reporter police dont know where the bag of drugs came from and only have one reported case. Thats terrible. Reporter jasmine lui says one is too many. Her younger siblings wont be having any more halloween treats. My mom will probably toss it now. Reporter not a bad idea. Hercules police say their School Resource officer is letting area School Principals know about the drugs found in a bag, hoping to spread the word so parents will check candy bags. A hazmat team was called to the Doubletree Hotel near the san jose airport. Around 7 30 this evening. Employees reported an odd smell and feeling sick in the lobby. Crews cleared out that lobby while hazmat tested the area. But nothing was found. Guests were allowed to stay inside of their rooms throughout the incident. The scene is now clear. Well, much like uber, its a new company thats growing quickly but San Franciscobased lyft is now dealing with its first deadly crash. The victim is a 24yearold man from san jose. Reporter well, raj, tonight Steven Holland is struggling to cope with the loss of his son even though the san jose native and San Jose College student did the right thing to call someone to drive him home from a Halloween Party saturday night. There was no way to predict the deadly outcome. They always say call for help if you need a ride home, call a friend, dont drive if youre drinking. Reporter and thats what Stephen Holland believes his son shane did when he and a friend decided to use his smartphone to access a lyft car to take them home from a Halloween Party early saturday morning. I dont know that he was even drinking. He may not have been. Reporter holland says shane and his friend were in a lyft car near interstate 880 near sacramento. It was raining that night. Reports say the lyft driver was going the speed limit. There was a car stalled out in the middle of the freeway and they hit that. Reporter the lyft car hit a tree, spun out of control and hit another tree. That second collision is what killed the san jose native. Things like that where somebodys stalled out in the middle of the road, you dont expect it. Reporter holland says hes yet to form an opinion about the driver of the car until he can gather all the facts. He says he knows shane will be missed by a lot of people. All the friends that have sent me condolences on facebook say he was great. Some of them had problems and he helped talk them through them or work with them on their problems and they really felt grateful to him for being a good friend. A former chp officer has gone from protecting the law to allegedly breaking it. Shawn harrington turned himself in today and was formally charged with two felonies. Harringtons accused of stealing and then sharing explicit photos of women from their phones after he arrested them. After posting bail he didnt talk to reporters but his lawyer says harrington admits he did make some mistakes. The ceo of a local Construction Company was arrested today for his role that i deadly construction accident that buried a worker in mud. Richard lu was arrested at sfo after flying here from china to surrender to authorities. The grand jury indicted him in august for the Involuntary Manslaughter of raul mercado. Mercado was killed in 2012 during the construction of a luxury home in milpitas. Three days before his death a building inspector had issued a stop work order, saying that construction site just wasnt safe. Election day is here. The polls open at 7 00 a. M. Reporter at the yes on d headquarters in berkeley tonight, volunteers make a furious lastminute pitch to get voters to pass a onecent perounce tax on sodas, energy drifrpgz, and sugary coffee syrups. When one in three kids are predicted to get diabetes in their lifetime, thats unacceptable. Reporter opponents say measure d and prop e in San Francisco are classic examples of government overreach. Its not really governments place to decide for us as consumers what is best for us to be putting into our bodies. This is the opportunity for the first city in the country to pass a soda tax. Reporter university of San Francisco politics professor cory cook says that explains why soft drink makers have put in 9 million to defeat e in San Francisco and more than 2 million to beat d in berkeley. Its really going to change how the city, the state, and this country looks at this product. Reporter the d, a general tax, only needs a majority to pass. San franciscos measure creates a special tax, which raises money specifically earmarked for programs, and that requires a 2 3 approval. Even progressives here in San Francisco, about one in three tax measures get the 2 3 vote. So its very difficult to reach that bar. Reporter berkeley voters have this to say about measure d. You know, thats a little harsh. I think any additional tax is silly. The publicity i think is worth the penny so they dont end up like me, with type 2 diabetes. Reporter opponents of the tax say lowincome families will be disproportionately impacted by these taxes. She hides her face, but she wants you to hear her story of escape and survival from death squads in her honduran home town. They start to beat up my father a lot, and then they placed a gun over my babys head. Reporter they were members of mata 18, one of the most violent gangs in honduras and the world. Come to their home to collect extortion money from her family. We cant pay anymore because my father has no job to pay it. Reporter sophias father asked to be called roberto. After robertos wife and daughter were raped, his life threatened, he and his family fled honduras, unsure of their future. But sure he would die like his friend and neighbor if he decide. Thats why they now live in the shadows. Entire family, five people plus one infant, staying in this one small room here in the bay area. And this family is not alone. According to the u. S. Border patrol, more than 68,000 families have been apprehended crossing the southwest border with mexico so far this fiscal year. Compared to about 15,000 families last year. An increase of 361 . That corresponds to a spike in gangs, violence, and lawlessness in honduras, guatemala, and el salvador, the three countries where the majority of these refugees come from. I ended up doing several thousand hearings. Reporter tom haines served both as an assistant u. S. Attorney prosecuting immigration and as an immigration defense attorney before retiring as a Border Patrol attorney this past july. The immigration policies in the United States tries to accommodate two inconsistent ideas. One is, you know, we are a country that provides refuge for people who are suffering persecution. The Immigration Law is also designed to protect the homeland. Reporter the numbers of people fleeing Central America have become so large theres no room in court or in holding facilities. So after picking the refugees up along the border, federal agents rerelease them back into the u. S. If the immigrants have relatives already living here who can pay for a bus ticket. In exchange, these refugees agree to report to local immigration authorities once they get to their relatives hometown. The president is very committed to taking executive action to fix our broken immigration system. Reporter while admitting the Current System is broken, Homeland Security secretary jeh johnson insists the numbers of these refugees peaked back in june and have now declined to levels last seen in january 2013. The bottom line of all this is in recent years the total number of those who attempt to cross our southwest border has declined dramatically. Reporter even so, the sheer number of these refugees dropped off at local bus stations created a crisis, overwhelming local resources. In the last six months its been thousands of individuals. Reporter Theresa Cavendish serves as director of operations at Catholic Community services in tucson, arizona, one town particularly hard hit by the number of refugees being dropped off at the bus station. They are leaving in most cases truly desperate situations. And they are making the kind of choices that i might make in their situations. I only see the people who make it. Reporter the demand for resources grew so intense that Catholic Community services hired galen hunt, an americorps worker whose job is to do nothing but house, clothe, and care for the help dropped off by i. C. E. Agents at the bus station. As many as 40 refugees a day. Many of them were dehydrated. They were hungry. Their clothes were torn and dirty. Reporter over the course of several days the Investigative Unit documented family after family arriving at this bus station in tucson. Young mothers and their children. Even a father and a young daughter traveling alone. We talked with many of them. All of them feared for their lives. They rolled the dice to come here. Reporter we also rode the bus with several of these immigrants. Headed to places like atlanta, los angeles, new jersey, even eureka in northern california. If you stay there, you will be killed, and thats why we are here. Reporter sofia and her family also rode the bus. For three long days. Just to get here to the bay area. Were here because were saving our lives. Reporter now sofia and her mother make the trip to San Francisco to report in to immigration authorities once every two weeks, honoring the agreement they made in order to get that bus ticket to the bay area. They may be scared, but they admit they feel safer here than back home, if not entirely secure. Because for them a judge issuing a deportation order back to honduras would be issuing them a death sentence. Sauft saying get back, hes killing us. Reporter now, as we mentioned, these arent the only people who are living among us in the shadows. Weve talked to dozens of people who were directly involved in this immigration and refugee crisis. Over the next several weeks we will introduce you to some of them, including those who recently fled here to the bay area alone because they are children and they are still alone.
