and passed on to the voters. abc 7 news reporter carolyn tyler joins us live from the newsroom. >> the ban would not have taken effect until next april but as soon as it was passed opponents began collecting signatures to put the matter to the voters. that gave supervisors two choices to consider this afternoon. repeal the law, or fight for the ban at the ballot box. they chose the latter. >> it's a battle we shouldn't be have to fight. not in the 21st century. >> reporter: but the fight continues for san francisco supervisor malia cohen. she's the sponsor of a landmark measure banning the sale of menthol cigarettes and flavored tobacco products in the city. health experts say the candy flavors encourage teenagers to start smoking. the ban was approved by the board in june and the mayor signed it into law. but now the voters will have a say after opponents gathered enough signatures to put it on the bol to the. >> it's time for us to stand up and say, enough is enough. we will not be seduced by your insidious marketing practices. >> reporter: the signature-gathering campaign was funded largely by the r.j. reynolds tobacco company, but organizations like the arab-american grocers association were also involved. marian suzuna says there are scores of small stores like hers -- ted's deli south of market -- that rely on tobacco products to get customers in the door. one analyst claims the loss in sales could be as much as $50 million a year. >> the corner market sector in san francisco is part of the fabric, both cultural and economic landscape. and this would have a detrimental effect. bite p it would put hundreds of stores out of business. >> the city is not backing down. this afternoon the supervisors unanimously expressed support for the ban. and will now work to convince voters who will find this as one of the measures on the ballot next june. in the news room, carolyn tyler, abc 7 news. dealing with aging infrastructure is not just about rebuilding bridges and highways. tonight the walnut creek city council is getting its first look at a $45 million plan to remodel and replace its community center and pools. the community center at civic park would get a makeover and one at heather farm park could be torn down and replaced. but the biggest single project would be replacing the three pools at the city's clark memorial swim center for $20 million. >> this absolutely is starting to deteriorate. and we need a new pool. it's pretty nice right now. to be completely honest. like -- look, i've been living in oakland these last years and i've recently been coming and swimming at this pool again. and -- i don't have any issues with the pool the way it is right now. >> city staffers say the pools have safety and water quality problems and defective underwater lights. a high school in what's being called the biotech capital of the world now has a state-of-the-art biotechnology lab for students. abc 7 news reporter jonathan bloom is live there right now. jonathan, students are really already doing experiments, right? >> that's true, they are. they've got gloves and safety goggles on and some of them are doing hands-on lab work every day. in fact, this year as many as 1,000 students will do course work in biotech. lot of them right here in this new building donated by genentech which cut the ribbon today. cutting the rib won on a state-of-the-art lab that was a pile of dirt a year ago. students aren't just excited for the new building, they're excited about science. >> changing things and plants, change their dna, change their colors by changing sequences. that's what i'm excited for, to get to work with a living thing. >> reporter: the science garage home to a new biotechnology program that's almost entirely hands-on. >> the kids have access to such great state-of-the-art equipment that i didn't even have access to when i went to college. >> reporter: aldo nated by genentech, south san francisco's biggest employer, which might have some openings down the road. >> the future of science is not here. the future of science is here. it's all around us. >> reporter: that is if genentech and south san francisco high can defy the odds. >> the fastest-growing careers are based in the knowledge of math and science. but half of students are disengaged in science by the time they hit middle school. that's a huge gap. >> reporter: so the new building comes with a new curriculum to get kids thinking like scientists. >> you're trying new things, you're failing, and you're learning from that. it builds in not only innovation but an opportunity for our kids to really grapple with things. >> reporter: and genentech employees will volunteer here as teaching assistants and mentors. >> san francisco is often known as the home of biotechnology. so it's as if we're having an older brother mentor a very younger brother into doing something that we might love. >> reporter: and might love to study more. a whole new reason to go to college. >> what colleges offer biotechnology? they come to me and ask. they're already thinking about that being a possible career choice for them. >> that's exciting. >> neat, yeah. mainly sunny skies across the bay area right now. and of course there are the few clouds i showed you there from our east bay host camera working their way locally over the bay this evening and during the overnight hours. this is emory view, similar to the one i showed you from the east bay hills. currently 68 at san francisco. 70 across the bay in oakland. 81 san jose. 83 gilroy. 65 at half moon bay. check out this view from our rooftop camera, abc 7 looking out over the bay under mostly blue skies. 79 in santa rosa. napa 83. 86 fairfield. 84 concord and live poor. santa cruz beach, air quality in the orange range, moderate air quality. we'll see a few greens tomorrow, good air quality expected in the south central bay and santa clara valley. and moderate elsewhere. we continue day by day to see the air quality improving. overnight with the few clouds pushing over the bay and locally inland, mild temperatures will prevail in the early morning hours. we'll see low temperatures mainly in the low to mid 60s. then afternoon tomorrow, clouds pull back to the coastline. it will remain relatively humid tomorrow. a little bit muggier than what we're used to here. but the sun will be bright in the sky with a few hazy clouds. highs range from low 70s at the coast to upper 70s and low 80s around the bay. we'll see mid to upper 80s, near 90 in the very warmest inland locations. it will be cooler thursday as a few more clouds come in. temperatures in the inland areas only in the mid to upper 70s. but temperatures will bounce back to near average on friday. and then on saturday the warm-up begins as inland highs will reach about 90, 91 in the warmest spots. and it's not going to be a heat wave but it is going to warm up. here's the accuweather seven-day forecast. once again fargo may have rung the closing bell but declines among bank stocks were one reason for today's losses. the dow lost 234 points ending at 21,753. the nasdaq tumbled 59 points. the s&p lost 18. in addition to bank stocks slipping, technology stocks were also down today. the declines are blamed on growing tensions between the united states and north korea. a new lawsuit filed here in the bay area is taking aim at the directors of wells fargo bank. the suit argues bank executives and members of the board of directors are ultimately responsible for a culture of deceptive practices and should be financially liable. in a recent development, the bank is accused of bundling a type auto insurance with its car loans without customers' knowledge. attorney mark mulavy says the suit is being filed on behalf of concerned shareholders. >> they want to change the way this bank is doing business. they're long time loyal shareholders. many of them have held shares for dozens and dozens of years. they don't want to run away from the problem, they want to change and fix the problem. what they're concerned about is the existing management doesn't seem to care. >> in a statement officials at wells fargo said they are evaluating the complaint. soldiers who meet at a north bay vfw post are fighting a battle against time and nature. it's a battle they hope they can win in the next too months before this situation gets even worse. do not give up hope. >> tonight, the new bipartisan plan that's giving those in the daca program reason to hope. changes for the maker of angry birds that could make them happy. four alameda county deputies accused of abusing inmates were charged with fell knees. eric mcdermott is suspects of choking an inmate until he passed out. he and justin lynn are accused of let ning an inmate whistle-blower. the judge increased bail for both help. they'll be held in jail if they don't post bail by next week. sarah kraus and steven sarkos are accused of helping an inmate throw feces and urine on another inmate. all four will be back in court next monday. the daly city man facing a weapons charge for a violent berkeley protest earlier this year pleaded not guilty. outside court kyle chapman said he had no comment. chump man is a trump supporter who calls himself "based stick man" online. he could face a year in jail if convicted. chapman is due back in court next month. to developing news the trump administration will phase out a program that protects 800,000 young undocumented dreamers. >> president trump says he wants defend dac at at sproul plaza. dreamers could have their lives turned upside down. >> joust focus on yourself right now. don't let these things distract you. >> reporter: this 19-year-old student at diablo valley college moved here from mexico when he was 7. he registered as a dreamer and dreamed of becoming a radiologist. >> i currently use my work permit to support my family financially. and support my life here in school. and if i can't work part-time and go to school, then it's going to be really hard for me to get by. deportation is definitely like a worry for me, my dad, and my mom and my sister. >> what some of these students are facing right now is the reality that if they've been cleared to work, they may not be able to work. >> reporter: the announcement that daca will be phased out over the next six months is devastating. >> anxiety from that side, then anxiety from my college life. it's really hard to cope together. that's why i'm here. to have our voices heard. >> reporter: at dbc, dreamers are hard to count, they're an underground population. last year 300 undocumented immigrants were eligible for in-state tuition and financial aid. this year applications are down 25%. at uc berkeley, up to 1,000 students are undocumented. >> the announcement has caused a great deal of anxiety. but also i would say resolve. that we make sure that our daca students remain part of our community. >> faculty and staff are inundating pratt for requests how they can help and support the dreamers here. leslie brinkley, abc 7 news. rescinding the daca program will take six months unless congress acts. as of today no new applications will be accepted. applications already submitted will be processed, including renewal applications. no permits will expire for at least the next six months. and all existing permits are valid for up to two years until their expiration date. this plan is all dependant on what action congress takes. the ball is in its court. abc 7 news anchor kristin zee looks at what some members of congress are saying. >> strong reaction from both sides of the aisle after president trump's daca decision. no surprise from leading democrats. house a time when both sides need to compromise on immigration reform." speaking of both sides, republican lindsey graham and democrat dic durbin held a news conference together reintroducing the dream act. it provides a path to citizenship for those who came here illegally as children. >> my challenge to the president that is you've talked very glowingly about these kids. help us. help us in the house. help us in the senate. i think you're a good man. get involved personally. work the phones. try to find a consensus here. >> even leading obama critic republican senator rand paul tweets, "president company didn't reveal an estimated share price. a struggling cab company in san francisco has launched a crowd funding campaign to keep it rolling. san francisco green cab was the first all-hybrid fleet in the city when it began in 2007. and believes it's the only driver-owned and operated cab company in the city. the company says state tax regulations give companies like uber and lyft an several lawsuits. the new ceo says to start he wants uber to focus on its core business and take big shots in building for the future. home prices along the peninsula continue to go up. new data shows "7 on your side" has learned the shutdown comes seven months after the franchise filed an arbitration complaint against the san francisco and pleasanton locations. both are closed and owned by this man seen in his linkedin profile, nick winn, accused of failing to report sales and pay franchise and advertising fees. the complaint reads, "cardio bar depends on reports and royalty payments and advertising fees to fund the operation of its business and generate a reasonable return of its franchisee." a cross-complaint accuses cardio bar franchise of fraud and breach of contract, saying it failed to provide promised training and advertising and the company's mandatory program significantly reduced his revenue. in their counter complaint, winn's attorney said mr. winn repeatedly ride to make his franchises work while only being met with obstruction and sabotage. >> it would be great for everyone to get their payments reimbursed for all the unused classes. >> reporter: the san francisco district attorney's office is asking consumers with unused classes to contact the consumer unit. attorney alex vasian told us if anyone has evidence the compan took money for new memberships after they intended to shut down the business, we want to hear about it. >> they want to conduct their investigation. i mean, might be prudent to do so. >> alexandria received a refund after disputing the charges on her credit card. both sides of the arbitration dispute declined our request for interviews. well, as we know, the bay area is a beautiful place. abc 7 news viewers prove it all the time. >> look at this. trina shared this sunrise picture from sausalito this morning. #abc7now which helps us find it and like you can do. what's coming?
