>> new at 5:00, a judge has harsh words for oakland city leaders about how they handled the investigation. >> abc 7 news reporter laura anthony is live at the federal courthouse in san francisco. she has more now on what the judge had to say. laura? >> reporter: this hearing just wrapped up this afternoon here in san francisco. all the major players inside the courtroom. federal judge felton henderson told the city of oakland and its police department that its long history of federal oversight is far from over. he told city leaders and attorneys for all sides, the sex abuse scandal shows we're still not finished after 14 years of reforming this department. the hearing comes after an independent report found then oakland police chief sean wentz and top city officials including mayor schaaf were inept in their handling of a sex scab dndal involving a teenage girl. >> as you all know, the judge has not made a ruling, but he will make a ruling in a couple of days. and from there, we will have a clear direction about how opd will become the best agency that we can be. >> we want the court to put in the order that there has to be an investigation, and to the actual roles and conduct of those investigators and of commanders who are listed, identified in this swanson report as having diverted the attention away, or engaged in a form of cover-up. >> reporter: civil rights attorneys, including john burris, want the oakland police department to release the specific names of opd command staff involved in the lack of effort put into investigating the allegations that came to light after officer brendan o'brien committed suicide in 2015. now, it's not clear when judge henderson will issue his order, or what exactly will be in it. he said he would issue the order in the next couple of days, and he said he would be ordering further reporting as he put it and oversight of the oakland police department. in san francisco, laura anthony, abc 7 news. to developing news on the massive construction fire in oakland, the drone view 7 shows you the gutted shell of what was an apartment complex. investigators are sidelined tonight unable to examine the rubble while neighbors and nearby businesses are in limbo. these pictures from sky 7 as it raged on. it's been three days since that fire, and we're no closer to answers really about how it started. wayne freedman is live at the scene with the latest. wayne? >> reporter: hello, dan. the department of federal -- i'm sorry, the federal bureau of alcohol, tobacco and firearms moved in to begin their investigation. they did not get very far because of all that rubble. it's going to be a longer investigation. there is a lot to dig through. meantime, we have people who live in this neighborhood, work in this neighborhood, the flames are out for them but the troubles are only beginning. the flames are gone, the twisted wreckage still here. after friday morning's early blaze, neighborhood adjusting to living with aftermath. >> it's puzzling, because i don't know what i can and cannot do. >> reporter: puzzling that while the district attorney investigates alongside federal authorities, people would at least like some confirmation of what happened. >> arson. >> everybody says that. >> it's obvious. >> not a good way to go about changing things. >> reporter: before the fire this was a tough neighborhood in transition. gentrifying. garcia evacuated and had already become a victim of that. today when returning to a smoky home, the problem became more complicated. >> we are going to try as to stay here, but our landlord is quadrupling our rent. >> why? >> because he can. >> reporter: on the subject of economic impact, it is everywhere from office workers, trying to get their stuff from a building with heat cracked windows. >> you know, what can you do. >> reporter: to a row of small restaurants a block from the fire on 23rd street. not only did they lose three days of business, because of the blaze, but the construction workers who ate lunches there did not return today. >> i wonder how i can pay my rent. >> reporter: just one question among many in this neighborhood wading through aftermath. in oakland, wayne freedman, abc 7 news. authorities have arrested two men wanted in connection with the murder of a san jose teenager. santa clara police say today giovani ortiz and eric james were arrested at a modesto hotel on july 7th. they were both booked on murder charges in connection with the incident last wednesday on brookdale drive in santa clara. 17-year-old teenager was hit by gunfire while driving his car. he died on july 7th. a strange thing happened in san francisco this morning while police investigated a deadly shooting. officers were at mission and 24th street after a man was shot and killed in the area. when police gathered evidence, look at that, a bathroom sink crashed through the rear window of the patrol car. no one was inside the vehicle. and no one was injured. police are trying to figure out whether the sink was thrown by somebody on the street or tossed from a building. no arrests have been made in the man's murder. still, no sign of a man who vanished without a trace more than six weeks ago. richard moss was last seen along the san mateo coastline. jonathan bloom has an update on the search for moss. >> reporter: well, it's hard to go even a few feet around here without finding one of these. a poster for the man who is a raiders fan and electrician's apprentice, a skateboarder, and now a missing person. the search for richard moss has become a large organized effort by his father who is out here again. >> i'm sorry. it's just really tough, to be honest with you. >> reporter: dan moss is making his third trip to the mainland since his son disappeared. 22-year-old richard moss was on his way to work, made a stop through mcdonald's, and simply vanished. >> the car and the person are missing. there's three miles from here to work. that's it. nothing. it's in a little tiny town. >> reporter: surveillance cameras along the route showed him one mile and gone the next. the only evidence, his aaa card found in the sand. >> i'm leaning towards maybe some sort of foul play. >> reporter: on his first trip out, moss chartered a helicopter. this time they searched through bushes with long poles in an effort that's grown to some 200 volunteers. >> i did not know that there was this many good people in the world. >> reporter: local merchants have donated printing, lodging and mailing services. they've gotten checks from strangers, even three flights from a flight attendant. one thing in short supply in answers? >> we're talking about a human being. for example, why can't we look at the bank records? >> reporter: now they're visiting elected officials, starting with jackie speier hoping to cut through the red tape. >> if you knew him, he would be one of your buddies, you know? he's just that kind of a kid. he's an adult now, i guess. he's our baby. >> reporter: jonathan bloom, abc 7 news. authorities day identified the oakland man who died in the russian river sunday afternoon. garcia was with a group of friends and family on a stand bar about 300 yards upstream of steelhead beach. he swam across the river to the shore. on the way back he went under water and did not surface. it appears alcohol was not a factor in his death. an affluent east bay town is apparently extremely short on cash. late last month more ago authorized a fiscal emergency. that's the first legal step california cities can take before declaring actual bankruptcy. it gives officials in the wealthy town to speed up a referendum for fees to boost revenue. . there was damage to a bridge in april and a massive sinkhole that they're blaming for the problem. 290,000 gallons of water is being dumped after someone broke into a water tank and possibly contaminated it. someone cut through a chain link fence and a lock on friday in order to get to this tank. it provides water to 1,000 customers and has since been taken offline. tests have not turned up any kind of contaminant. >> the number one priority is to protect our customers' drinking water supplies. we made the decision to start draining the tank. >> who would want to contaminate water? especially since we just got past a drought. and now all that water is wasted. >> a backup tank is now being used. the tampered tank will be replaced on saturday. this is the second time in three years someone has broken into that water tank. the water district is reevaluating the security measures. developing news on the wildfires raging across california. 5,000 firefighters are battling 15 wildfires in the state. cal fire officials say they anticipate thunderstorms in parts of the state as a low pressure system brings a slight cooling trend. but they're afraid that stronger winds are expected in northern and eastern california. up in butte county, more than 4,000 people are under a mandatory evacuation order because of the wall fire. it started friday and has scorched 5,600 acres. 17 structures have burned to the ground, up from just ten yesterday. the fire is 35% contained, and some good news, some of the mandatory evacuations have been downgraded to voluntary. the largest fire can be seen from space. look at this. infrared imaging from nasa shows the progress of the alamo fire over the weekend. that fire has burned more than 28,000 acres, and is now 15% cop tand. homes are evacuated and more than 100 structures are threatened. one has already been destroyed. firefighters are having a tough time with the steep rugged terrain. we are learning tonight about a potentially disastrous situation and how it was prevented at sfo. >> ahead, hear what pilots and controllers said to stop a tense moment from becoming tragic. also, would you buy a new house without ever seeing it in person? >> reporter: well, sfo is now talking about the incident, and that's because it is now in the hands of the faa. but key to this investigation is the acknowledgement made this morning by the faa. quote, the pilot inadvertently lined up for taxiway c, as in charlie. you'll hear that in this recording which runs parallel to the runway. that's not supposed to happen. friday night at around 11:45, air canada 759 from toronto was on the final approach to runway 28 r. the sfo tower had given the pilot the all-clear to land. but apparently the pilot appeared confused about the runway configuration. >> reporter: the sfo runway has a series of very bright lights. these help identify the runway, never to be mistaken with a taxiway which has dim lights. as the pilot of the air canada plane appears to be moving toward the taxiway, another pilot alerts the tower. >> where is this guy going? he's on the taxiway. >> reporter: that's when the sfo orders air canada to abort the landing and go around. as the plane was climbing, the pilot of united airlines flight 1 to singapore which was taxiing to the runway for departure alerts the tower of the unusual move. twice. >> air canada flew directly over us. >> reporter: air canada issued this statement today. air canada flight ac 759 from toronto was preparing to land at sfo friday night when the aircraft initiated a go-around. the aircraft landed normally without incident. we are still investigating the circumstances. at sfo, leeann melendez, abc 7 news. back now to the breaking news we've been following in south san jose. the fire, sky 7 is live over the brush fire burning on a hillside. you can see the flames near san felipe and metcalf road. that's the southern part of san jose. an area with a lot of brush. officials have ordered the evacuation of residents in the 8000 block of san felipeo road. that is it for now in terms of homes. not near a lot of homes. a car crash actually sparked the fire. you can see the burnt convertible right there. right now, the fire is about 15 acres. but cal fire says it could grow to 500. so it's a serious situation. we are sending breaking news alerts as this fire develops with the abc 7 news app. meantime, new details tonight about a georgia man accused of stealing "star wars" collectibles here in the bay area. 45-year-old carl cunningham pleaded guilty to grand larceny in sonoma county. he faces four years in prison. last month abc 7 news reported that 120 items were stolen from the largest private collection of "star wars" memorabilia anywhere. there were more than $100,000. the collector said cunningham was a longtime friend. wells fargo customers who were affected by the bank's fake account scandal are closer to getting a cut of a multimillion dollar settlement. a federal judge granted preliminary approval over the weekend for the $142 million class action settlement. now, victims may still have to wait before they get paid. with the settlement expected to be finalized early next year. san francisco based wells fargo has admitted that 2 million potentially unauthorized checking and credit card accounts were opened between 2011 and 2015. the bank blamed unrealistic sales goals. supply and demand as well as younger buyers are changing the way people buy homes. this may not be for you, but maybe it is. a study by real estate website redfin finds a lot more people are buying homes sight unseen. they never even lay eyes on it. one in three recent home buyers put an offer in without actually ever seeing the property. 41% of them were millennials. that's three times the number of baby boomers willing to buy without seeing a property. curbed reports that millennials feel they have little choice in order to achieve home ownership. one-third of californians support to have california leave the u.s. and become its own country. the california national party conducted the latest poll. the results mirrored earlier polls this year that had 33% of californians in favor of the plan. that's up from 20% back in 2014. the california national party backs secession and includes many who identify as social democrats and progressives. >> about half of our supporters want an independent california through democratic and peaceful means before trump. and then the other half got onboard when they realized just how broken american politics had become. >> half of californians oppose secession, which would require amending the u.s. constitution. hi there, i hope you had a chance to enjoy the weather today. it has been changing. temperatures have dropped a few degrees. so if you're stepping out tonight and you're running some errands, definitely still warm inland, in the 80s. around 9:00 p.m., it will cool off. fog along the coast. 11:00 p.m., it will be foggy near the coast and breezy as well. i want to show you live doppler 7. you'll notice that the fog is just sitting from the san francisco all the way to the san mateo coastlines. unfortunately, that fog has not pushed inland to help those firefighters in south san jose where that fire is burning right now. 87 degrees, it is warm there. relative humidity, 29%. the only thing that is working in their favor right now is winds are not an issue. we'll keep an eye on it for you. you're looking at fog right now as we look across the bay there. 58 in san francisco. 67 in oakland. san jose, 77 degrees. you want to see cool?
