they didn't just tell him one thing. >> a heart broken mother accuses vallejo police of murder after her son dies in a hail of bullets. i'm alan wang. ama has the night off. it happened this morning on pepper drive in vallejo. abc7 news reporter thomas roman is live at vaw vallejo police headquarters with the latest on the investigation. thomas? >> alan, there are conflicting reports about the shooting. witnesses say marrow romero never got out of his car when police officers approached. but police officers say he pointed what looked like a weapon at them. >> reporter: she is mario's sister and she woke up to gunshots. she said she ran to her window and saw police shooting into her brother's parked car. >> my brother was not out of the car. the door was not open. if he was anywhere near out the car there would be bullet holes on his door. 24r* are no bullet holes on the door. >> reporter: she -- >> she was in the park with her mother, sister and friends denouncing them for shooting her unarmed brother. a vallejo police cooer rolled up to a car outside the martin home. they turned on the spotlight and got out of the car. as they did this, the driver exited the car. both officers noticed he had a handgun protruding from the waist band. they could see the grip of the gun. >> they opened fire and officers say 23-year-old romero spun around while his door was open and pointed the weapon at them. he was asked if police issued any warnings before opening fire. joy none. >> do you know how many rounds officers fired? >> excess of 30. >> the officers felt so threatened even after romero got in the car that they reloaded after firing multiple rounds through the car's windshield. one officer got on the car's roof and fired into the car. she watched from her home from across the street jie. it was a lot of shots. it was a pause and then you hear somebody talking. they had to open the door to get him out of there. >> they found a pellet pistol along with 30 tabs of ecstasy. >> i am crushed. i am angry. they killed my boy. >> she says she wants answers. mario romero leaves behind a three-year-old daughter. there was another man in the car and he suffered a nonlife-threatening wound and he was taken to hospital. both men are on felony probation , and they say officers wouldn't have known that at the time. the shooting is now under investigation. in vallejo, thomas roman, abc news. >> thank you, thomas. a terrifying afternoon for a woman who hid while two teens robbed her home. it happened on saturday afternoon. police say the teens kicked in her front door. that's when the homeowner ran and hid in her bathroom where she called 9-1-1. police arrived just in time to catch the suspects trying to get away. police believe the 18-year-old and 19-year-old suspects are responsible for several other residential burglaries in the same area. fresno state fraternity pledge has been taken off life support last night after he suffered brain damage during an evening of heavy drinking. police want to mow if hazing played a role in the death of philip danes from bakersfield. he started pledging a fraternity last week. he attended a party at the frat on friday night, and now fresno state officials suspended the school's recognition of the frat while the tragedy is being investigated. the countdown has begun in charlotte. in just 36 hours, the democratic party will kick off the national convention. but already there is controversy surrounding the california delegate. abc7 news political reporter mark matthews is in charlotte tonight where the protests and the politics are already in full swing. >> the chairman of the convention is mayor antonio villaraigosa. you would think he would get good seats. >> in the back in the corner in the dark. >> you know i know where the california delegation is. >> yep, they are in the cheap seats. first rows are reserved for swing states like iowa and nevada. >> i hope california is never up front. >> california delegates are being met by an army of volunteers. can't say if it contributed to the rejection of a delegate, but then two delegates showed up one falsely claiming to be a congressman and he was asked to go home. no names are being released. today only one arrest as several hundred marched through uptown charlotte. the march on wall street went through the wells fargo building and the bank of america headquarters. you remember the woman kicked out during romney's speech? she is here in charlotte with her code pink crew. >> you can see people of all races and economic backgrounds in the streets. a lot of young people that makes me inspired. >> inspiring young voters is the goal to convention organizers. they will stream the entire convention gavel to gavel on the internet. and they will live stream a spanish language version as well. >> we know the latino vote could be the deciding vote for the presidency of the united states of america. and so it is great to be doing this. it is very, very important. >> dolores who co founded the farmer's union knows president obama pretty well. three months ago he awarded the civil rights and labor leader the medal of freedom, country's highest honor. young latinos are motivated and the internet is their platform. >> and they are really excited about this election. it is a good thing. >> tomorrow the california delegation gathers for their first meeting of the convention. they will be meeting priet bright and early with nancy pelosi at their hotel. we will be there too. >> and mark will be live this week though the invisible monologue at the republican convention. the hollywood star spoke with an imaginary president obama in an empty chair just before mitt romney spoke at the gop convention on thursday evening. usa today released an interview with the president today. he told the paper, quote, if you are easily offended you should probably choose another profession. and two new polls show president obama and mitt romney locked in a dead heat on the eve of the democratic convention. the latest poll shows the president ahead 47 to 46%. a new routers poll shows the candidates tied at 45%. romney had lead that survey by two points after the gop convention. in southern california, a wildfire is burning in the angeles national forest forcing the evacuation of thousands camping out this labor day weekend. the out of control fire has quickly grown to 3600 acres creating an orange glow against the night sky. the forest service says it broke out this afternoon near state route 39 just above the city of glendora. smoke could be seen from many parts of the los angeles basin where people reported falling ash. and a helicopter was damaged during a routine water drop over the north pacifier. this is youtube video of the fire burning in a rug get area of mendocino county. according to the forest service, they hit a dead tree while operating under smoky conditions. no one was hurt. the blaze burning since august 18th has charred more than 41,000 acres. seven homes and nine buildings have been destroyed and tonight it is 58% con intayed. -- contained. a man who sliped off a cliff in san francisco was recovered. it happened around 6:30 near the cliff house restaurant. emergency responders found the man trapped on slippery rocks. it took a half an hour to find him and hoist him to safety. the man did not appear to be badly hurt as rescuers loaded him on to a truck and ambulance. no word on his condition. still to come, vandals strike again in oakland. the memorial that has been ruined for a third time. plus, just in time for labor day, the ban on booze on a popular california river. and then later this hour, whales stranded on beaches in florida and scotland. boys who placed an impressive third in the little league world series. sky 7hd was overhead for the petaluma little league allstars. kyra was on the ground and her interviews are coming up at 11:35. the memorial honoring the victims of the oakland firestorm has been vandalized again. they damaged the sculpture on tunnel road. abc7 news reporter lilian kim reports from the oakland hills where some old wounds have been reopened for a third time. >> gordon piper lost his home during the open firestorm since 1991. he dedicated his life to honor the 25 people who lost their lives in the fire. he helped create this memorial garden. but for the people who live here it was a haven. but overnight it was a target of van you -- a target of vandalism. >> they were dancing on the grave of those who died and to have this happen three times and two years ago it is really frustrating. >> the sculpture was dedicated in 1994. the metal bars show burned trees. symbols of hope and renewal. they expect who ever is responsible is trying to make some money. >> it wasn't a quick job. it took some time to cutoff each of the five metal pieces. >> i am not sure of what the real value is. it is costly to us. >> we are a small group of volunteers. it is not a city park. it was maintained by volunteers. >> it is now up to the same volunteers to raise some money to fix the sculpture. they need about $5,000 to make the repairs and fix the security system. the garden is wired so volunteers know right away when somebody is visiting the site. no one received notification at the time of the overnight theft. hope is that who ever is responsible won't come back to do more damage. >> they obviously have no heart. if they come from oakland they don't understand what this means to people. it is a tremendous -- it is great symbolism. it is a memorial. >> lilian kim, abc7 news. >> dozens of first responders joined members of the community this afternoon and prayed for a san jose firefighter who is battling for his life. 15-year veteran frank ryan suffered a severe heart attack on thursday. he collapsed while fighting a fire on east santa clara church. >> can i get an amen? are you going to do that? >> dozens of people showed support for ryan and his co-workers outside regional medical center. a candle was lit and passed around and organizers plan on giving that candle to ryan's family. the dunbar 10 bridge will re-open for tuesday morning's commute. this is the latest video provided to cal trans. they are spending the weekend replacing the eastern seismic joint. they will be lifting the bridge five inches to put some 10-foot steel bearings in place. dunbar ton bridge was closed to traffic at 10:00 p.m. it was scheduled to reopen by 5:00 on tuesday. no booze in it the water. that word from park rangers in the sacramento area. they stepped up the enforcement of the alcohol ban in time for the labor day weekend. apparently there have been too many emergency situations in the past caused by people drinking on the river. >> it makes the trip be a lot better. we will get by with cookies and water and sand witches and it is a -- sandwiches and it is good for the family. >> alcohol plays a role in 50% of all drownings. and many people under estimate the power of a river when they have been drinking. now, if you love rollercoasters tomorrow is your last chance to ride an old favorite at the santa cruz beach boardwalk. labor day is the last day to ride the hurricane before it is dismantled. it is being sold to an amusement park in mexico. it will be replaced by a new definition camera in the east bay and looking down toward the bay bridge and san francisco in the background, we actually have clear skies. pockets of fog are moving around, and they are picking up a little bit of that. just in the last hour some of this has started to move into san francisco, but you can get a good sense of what i am talking about as we head down south just to the north and west of santa cruz along the 1. it is very dense fog. we have high pressure over us. it brings us the sinking air. any fog is being squashed to the surface. if you have travel plans tomorrow morning right along in this area you may encounter extreme reduced visibilities as that fog will be sitting very close to the surface. also santa cruz and watsonville and toward monterey bay. even the golden gate bridge will see reduced visibilities. very mild inland and livermore clear skies and 69. 66 in san rafael. santa rosa is clear, 55. 56 san francisco and san jose right now is clear with 65 dries. so very -- 65 degrees. very mild temperatures with highs today especially inland in the mid to low 90s. here is a look at our highlights. we will go with coastal clouds overnight and a possibility of dense fog near the coast. warmer for your labor day holiday, and then we will cool things off wednesday and thursday. cool in the north and compare that with 56 and clear skies in antioch and 47 for
