class -- hard to find one. democrats are bored by these topics. what interests them is power, in order to win and maintain it they need reliable new voters, voters who will support them obediently without making difficult demands like a higher standard of living. that's why the democratic party suddenly supports open borders so fervently. immigration is the only issue that matters to them because packing the electorate is the only way they can regain control of this country. their goalre is clear and they will do or say anything to achievetr it. here is the governor of new york likening the trump administration to islamic terrorists for the crime of daring to enforce federal immigration law. a jihad to deport as many people as they believe who aren't in the united states legally. >> tucker: who theyes believe aren't in the united states legally, it's pretty easy to determine whether someone is here legally or not. it wasn't long ago that leadingl democrats like bill clinton argued in public that our country should deport illegal immigrants, they are here illegally, they are breaking our law. nowha democrats claim noncitizes even illegal ones have a right elections.our that is happening in san francisco and in parts of the state of maryland. inin the 2020 election it will e happen they get many other places, that's guaranteed. you would think congressional republicans would be upset about this allowing illegals to occupy and run our country makes a mockery of citizenship, it's terrible for america and it's a death sentence for the republican party. republicans on the hill seem okay with this. here's one example. in 2014 the obama administration changed the rules so that anybody claiming a threat from gang violence or domestic abuse can get asylum in the united states. many a did. that was the point, to open the borders without saying so. earlier this summer attorney general jeff sessions refers to the obama rule. now house republicans are teaming up withub democrats to stop sessions from doing that. just yesterday they tacked on amendment onto an appropriations bill that would preserve the asylum rights of anybody who claims to be fleeing gangan violence. that change would nullify any effort to secure our southern border. mexico and central america have plenty of gang violence. now all 150 million people who live there can cite that fact as justification to move here legally and stay permanently. when they get here they will find democrats eager to give them the right to vote. house republicans could stop this, they aren't even trying. one person who think republicans ought to care about this issue is former house speaker newt gingrich, he just wrote a piece about the left's plan to win through noncitizen voting we spoke with him just a short time ago, here's what he said. thanks for joining us tonight. you've argued that the entire point of the democrats immigration policy is to increase their electoral share. how do you think this works? >> it's prettyre straightforwar. they think they get the vast majority of votes from illegal immigrants in san francisco, they've now made it possible to vote without being a citizen. there are other places around the country where democrats are advocating they allow people who are not here illegally or people who have not yet become citizens to vote. i think they think their calculus is they have a harder time winning elections with law-abiding americans so the more people they can bring in who don't know american history, don't understand the constitution, aren't part of our traditional values, the better off their chances are. that's why every single democratic senator cosponsored senator feinstein's open border bill which had would have opene border for anybody in the world to come to b america. >> tucker: when you were a speaker there were about 22 million foreign-born people in the united states. republicans have controlled congress for a lot of that time, even today republicans on the hill are trying to undo the attorney general, one of the attorney general's efforts to tighten the border. why don't republicans on the hill understand the threat that these policies post of the country and to them? >> i don't get it. let's start with sanctuary cities which is the most popular position that president trump has, 84% of the country -- eight out of every ten americans believe sanctuary cities increase the risk of crime. that's easy for republicans that, since democrats to unify around. part of what's happened is you have the constant drumbeat of the liberal media which intimidates some republicans who forget and i recently wrote a paper on this, the weakest republican position on immigration is 60%. that is absolute control of the border. the strongest is 84%, that's closing down all the sanctuary cities and in the case of california, closing down the sanctuary state. republicans behave as if they represent they were minority interest even though most people who are here as immigrants would like to see the law-abiding country that's physically safe. >> tucker: it won't exist as a national party at this rate, fairly soon. a lot of members can do math pretty well but they don't understand thatli calculation. >> somehow they lose their nerv nerve. the drumbeat is constant and if you are in favor of controlling the american border, i'm in favor of illegal immigration l. i voted for what promised us the control of the border, ronald reagan signed it reluctantly, the only reason he did it to get control of the border.. congress broke its word. we have ten times as many people come in under amnesty as we were told, 3 million instead of 300,000 and then the president didn't get the things he'd been promised which were a work permit system and control of the border. ever since i've been very skeptical, there's a large part of the national elite that for some reason loves immigration of any kind, dislikes controlling the border under any circumstance and routinely smears people. if you say i'm for illegal immigration but i'm against people crossing the border illegally, somehow that becomes a xenophobic, antiforeigner -- even though you are for legal immigration. >> tucker: you're attacking their f housekeeper, they've imported an entire serf class and they resent any effort to restrain it. most of us grew up learning that the american constitution guarantees birthrightt citizenship. anybody born in this country even to parents who are here illegally or on vacation is a u.s. citizen and all of the benefits of that for life. is that what the constitution says? michael antone does not believe it says that. lecturer at hillsdale college and he wrote a piece in "washington post" arguing that birthright citizenship is not a constitutionalal requirement. i'm amazed the post printed this piece, people were shocked at the idea that you would even question this but you made your case partly on legal grounds. why does the constitution not say what we've been taught that says? >> you have to read the whole 14th amendment. there's a clause in the middle that peoplee misinterpret. subject to the jurisdiction thereof, meaning the united states. what they are saying is if you are born on the u.s. soil subject to the jurisdiction of the united states meaning you're the child of citizens or child of the illegal immigrants you are entitled to citizenship. if you are here illegally if you owe allegiance to a foreign nation, if you're a citizen of a foreign country that clause does not apply to you. if you read the debate about the ratification of the 14th amendment, all of the senators who are discussingea what this s meant to do our very clear on this point. i tried to point out, i expected the left to get blown up and angry but what i didn't expect is how angry the so-called conservative intellectuals got with me and they essentially said any opposition to birthright citizenship is racist and evil and un-american. i'm still in the middle of this debate, i'm happy to do it, i'm a happy warrior on thesee questions. you ask the speaker why are the republicans so bad on this question? he gave you some answers. i ask a parallel question, why are the so-called conservatives intellectual scholars so bad on this question? >> tucker: the nonprofit people who have been consuming billions of donations for 40 years as the countries gets more liberal and then lecture people like you that you're not towing their line? it's deeply unimpressive. let me ask you this. the people who wrote the 14th amendment. did not envision a moment where thousands of chinese would fly to saipan and haveve their children there. people would sneak in illegally in the.s country to so their kis would get american benefits that wasn't a kind of consideration. >> the purpose of the 14th amendment was to settle the question of citizenship of freed black slaves. this was right after the civil war and you have some people citing the dred scott decision widely regarded as the worst supreme court decision ever which held that no black person could be a citizen and congress said we are going to overturn that forever. if you were born here and subject to the jurisdiction is all freed slaves were you are a citizen of no state can take that away from you. they also make it clear in the civil rights act of 1866 passed the same year by the same congress that you have to be not subject to any other foreign power to be eligible for birthright f citizenship. all the people attacking me and freaking out about this they don't have an answer that. they glide past it and try to opt to skate and point to other things that aren't relevant. if you read the debate it's very clear with the framers amendmene meant. >> tucker: its theology, it's not a policy debate and you've violated a tenant of their religion. good for you. anchor at univision interested it and the topic of immigration, i'm sure you heard that. it's a very interesting points that michael anton made that the 14th amendment was never envisioned to give birthright citizenship to c children of people who are breaking our law laws. leaving the legal debate aside, why as a matter of common sense does the united states own citizenship and all the benefits and privileges that come with it to children of people who sneak in here in order to have their kids here? and why would we go along with that? >> i don't think they sneak in here to have their kids. >> tucker: yes they do, a lot of people do. >> at the why they come to the u.s., havingf your kids be citis is not on the list. the reason why they come to this country -- >> tucker: that's not true. you say nobody comes into this country to have their kids here in order to make sure their kids are citizens. why don't you ask anybody who works in a hospital in saint brownsville, texas, if that's true. >> s there are a lot of people o use the 14th amendment, a lot of people who come from russia and china, there are a lot of tourists focused on -- it would be disingenuous not to recognize that. but you're saying undocumented immigrants come to this country to give their kids citizenship. >> tucker: i'm not saying that, i'm saying it happens a lot. while with the rest of us get bullied --wh why is it good for us? why are weor allowing that where we going along with this? >> i'm not going to fall into the trap of calling everyone calling for the end of birthright citizenship and nationalist. it's harder to defend birthright citizenship than it is to get behind those who call for the end of it. if there is no perfect immigration system. we chose to give birthright citizenship in this country and i would tell everyone at home to imagine what the u.s. would look like without birthrighto citizenship. at some point -- >> tucker: i'm not calling for an end to immigration, i'm thinking we should posit because it's making our country too volatile but that's a separate conversation. why would we ever grant citizenship to someone here illegally? you're breaking our laws and we are rewarding you by giving you this valuable thing to your offspring, why would we do that? why wouldn't we say if you're here illegally, birthright citizenship doesn't apply to your offspring? >> i would argue that it helps with integration when somebody in the family becomes a u.s. citizen, it helps with integration for the family and the community. that peoplehing should pay attention to. >> tucker: that's a fair point but let me ask you, a survey came out yesterday that showed that 22% of all u.s. households do not speak english at home, that's not integration, that's balkanization that's the opposite of integration. >> places like new mexico for centuries. >> tucker: 22%? language is the key toge cultur. anybody who pays 5 minutes of attention to this will tell you that the country in which people can't communicate by language is a disunited country.y. do you think it's a good thing that 22% of americans don't speak english at home? that's a bad thing? >>e. it's an interesting statisc becausee most of those 22% are first-generation immigrants. when you have their children who are u.s. citizens, the vast majority speaks english as their first language. it's interesting to say that -- >> tucker: why is it unfortunate? if you thought that someone was going to say something and inciting violence in order to ban him from speaking, but does this bother you at all? >> it does in the sense that it really matters how you structure it. in the way that it is structured in the 13 states, if you pose an imminentnt threat to somebody close to you, you have to meet a certain standard of proof, that judge makes the determination. the person comes in a test that right. we found states in indiana and kentucky, they've been found to be constitutional because the processes in the safeguards that have been put in place have passed that test. >> tucker: what's passed then test is the american judicial system which has been in place for hundreds of years. people wrongly convicted and the guilty go free but in general we think the system works. that's why we have s it. why not convict someone before taking his constitutional rights away? >> what we say often times especially in cases of mass violence -- 38 of 63 mass shooters express some kind of violent behavior before committing a mass shooting. they have not committed a crime before that. if they had committed a felony, yes but the bar is so low federally. that's why you're seeing these individuals -- >> tucker: it's inconvenient to convict someone before taking his rights away. what would happen if a relative said my daughter is a drug addict and she is not capable of making a decision to have an abortion, she can't think right. a judge could swoop in and say you're not allowed to have an abortion, you're taking that right away. >> i remember after parkland in vermont, police found an individual, an 18-year-old who had amassed weapons and wanted to commit apo mass murder in the school, police used that states laww that they had just passed o take those guns away from him because they determined he was at risk. >> tucker: i get it. that's why they have been effective. there is no doubt i'm sure that it's effective, the question is do we care? no one in the left cares about civil liberties anymore, that's why you don't answer my question. you say that because you're making a case against due process. >> i'm walking you through the structures of the laws. >> tucker:ot that's not due process. let me ask you this. the aclu is challenging it. you're not worried at all that this will be as the aclu is suggesting disproportionately used against african-americans. i think that person is in a gang, he looks dangerous that judges like i'm taking it away. you think the justice system is racist, you're going to let that system take a constitutional right away from people and you don't think it's going to be used disproportionately against african-americans. >> you have to make sure that doesn't happen. >> tucker: how would you make sure it doesn't happen?
