trey: good evening and thank you for joining us i'm trey gowdy. it is "sunday night in america". president joe biden's impeachment inquiry begins thursday the first public hearing in the house will focus on the constitutional and legal question surrounded the presidents alleged involvement corruption and abuse of public office. hunter biden on the other hand has garnered significant attention and a couple of indictments over the past couple of years. it was famously paid for board work in an area on which he knew nothing and his artwork with art is the right word brought much more than market value. hunter biden could not be impeached. prosecuted but not impeached. his father on the other hand can be impeached but not prosecuted. all of which depends on the evidence of allegations of propriety can be f proven. house republicans are looking for evidence and plan to subpoena the bank records of hunter and james biden. will the committee seek documents from the president himself? and what is in the corporate records and bank statements and tax returns? james comer is the chairman of the house oversight committee from the great state of kentucky and he joins us now. thank you for joining us. you were looking from unredacted e-mails from national archives if memory serves, did you get them and are you satisfied with what you got? >> there are 5200 e-mails that joe biden used in communication with a former fashion with the government. we identified this now we want the e-mails and the unredacted version. the national archive sent 14 of the 5200 e-mails yesterday and i'm sure you're going to be surprised to hear this. the 14 did not state anything but the media as soon as we got the e-mail, the 14 out of 5200 said this is a big nothing burger. this is another example of the biden white house coordinating to the media to pay a false narrative. were not satisfied with 14 out of 5200 e-mails. we expect all 5200 e-mails and that's why we had to go deep to the impeachment inquiry route to try to speed the process up from where the government agencies are stonewalling and obstructing our investigation. >> chairman you're going to need to give me a second to restart my heart. i was shocked to hear the d.c. media was not interested in a public investigation. equipment tax returns, whatever evidence do you need that you currently do not have. we subpoenaed the bank records from the shell companies. the problem the biden family has in the president has his families received over $20 million from foreign nationals. the biden family in the white house cannot say one thing that this family did to receive the $20 million. that's a big red flag with every american. next we want to see the personal bank records because the way the bidens operated is joe biden set up these meetings and phone calls with the foreign nationals who were all bad people needing some type of assistance from united states government, their being investigated for corruption and get sweetheart deals once the meetings took place joe biden communicated with all of them then the wires started transferring from those countries to the shell companies. according to the banks the bidens would launder the money from the shell companies to nine different biden family members to incremental payments. we want to know what happened with the money once they received by the bidens in their personal account. we did what we said we followed the money from romania and china to the biden shell companies to the biden individually now were looking at the biden individual personal bank records and we want to see where we spent that money. if you look at the laptop there are many instances with people like eric sherwood communicated with hunter biden this bill is due for your dad how are you going to pay for. we want to see if hunter biden was paying for things of value for joe biden. >> have you or will you seek the president's own bank records. the biden family members asking for the presidents records. i assume you have a return already, other records asking from the president himself may ratchet things up a bit. have you done and do you plan to do it. >> it's looking like were getting be asking for his bank records. all roads lead to joe biden from day one this is his investigation and not his son his son is the key central figure we believe he was a front man. reverting proven that this family was influence peddling the media and the biden said that was not true. now they're disputing that, they're moving the goalpost and maybe the president son was selling the illusion of access. joe biden never benefited personally from that. that's why investigation is now because overwhelming evidence that would point to the fact that joe biden was receiving benefits from his family influence peddling team and that we continue to investigate. >> i want you to remember something-year-old colleague from south carolina. the d.c. media never met like any good lawyer you have anticipated my next question whether or not you get the sense that he understands the half the country really believes his department is partisan. does he not understand it or agree with her. we are in dangerous times and half the country has 0 confidence in his department. does he appreciate that. >> i think he appreciates it but i'm not sure he cares and inputs on the air above the fray and the neutral party in the department of justice of years before when people can trust her system but they don't anymore and was so many examples that you cited just a couple classified document scandal they see the aggressive prosecution of former president trump and they see the same department of justice will walking to give special treatment to hunter biden they see the weaponize the permit of justice is labeled concerned parents as domestic terrorist and they see them go after and want to spy on catholics in their own churches and they have federal courts affirming what we do intuitively and this is colluding with big tech before the last election cycle to center in silence conservative viewpoints online. it's completely out of control. he sits before us and goes to the hearings as if he is not accountable. it's really shameful and so infuriating. you been there another not giving you answers. it's one of the most frustrating exercises of my life somebody who actually believes in the rule of law and understands that is one of the bases of maintaining a constitutional republic people look to the department of justice to be a neutral party. they want to believe that lady justice has a blindfold on. we have equal justice under the law. you and i both know when the pandora box is open and the people decide i observing the facts and that justice is not blinded to two-tiered system, they give up on it and you can't maintain a constitutional republic like that. we need someone in the position who can extol the virtues and practice it every day. inflation risen by 17% and since we left office to work on energy has caused gasoline prices to go up 60%. one family after another is in their family budgets are struggling. get this economy moving today i'm not a huge fan of conflict. i'm a big fan of contrast. i think we need contrast. here are the three categories, policies, performance and personality or electability, what distinguishes you from the others that will be on the debate stage or one that will not be on the debate stage in the three areas. policy performance with the ability to do it and personality and electability. >> i say with great humility we served in congress as the governor of indiana and vice president for 40 years i'm incredibly proud of the record of the trump pence administration. i think i'm the most qualified but also the most consistent conservative in this race. i get to the policy issue. when donald trump ran in 2016 he promised the government as a conservative and he tapped me to be his running mate. to gay enter today we run as conservatives we builder military providing american leadership in the world and of course appointed three of the conservatives to the court that overturned roe v. wade and give america a new beginning for life. what i want people to know while we govern as conservatives during our years, donald trump makes no such promise today and he and many of its imitators in this race are walking away from america's commitment of fiscal responsibility and reform walking away from american leadership in the world. in a few days ago millions of americans are the president decide to heartbeat bill passed in florida and other states around the country is a terrible mistake. i want people to know i'm going to stand where i've always stood where i stand on donald trump just over a year from now. >> let me ask you about that. you may have more objectivity than the president. do you believe that president biden is only democrat that could be former president trump if he were the nominee. you know more about polling but it looks like biden's numbers are not great. president trump numbers are not great. is there no democrat without 50 years of baggage that would do well in a head-to-head with former president trump? >> it is a great question i think we have a good bench if you look at the cabinet secretaries pete buttigieg, romano, josh schapiro, gretchen whitmer, gavin newsom and the vice president. judging from the track record of history, this administration that be in the covenant president is been really tough to be in income the president and only happens a few times in recent memory anyone 7 million more votes than the president donald trump in 2020. if history is any guide we seen the special elections in the midterm election a year ago that really went broke for the democrats especially in the senate. republicans only picked up five seats, he's gaining on the fact that he defeated the guy once he could do it again and the trends in the right direction for democrats in the special election in the midterms. >> i try to put politics aside, it's hard to do but i try to put it aside to look at it from a human interest and point. being president is arguably the hardest job on earth. i'm not a doctor in a urologist. it just looks like the combination of the job and his age are taking a toll. if you were to conclude either great career and it's enough. when would he need to make that decision to give everyone an equal chance to be the nominee. what is the date by which settings to be done. >> obviously before the convention yet filing deadlines coming up in the early primary states in the process playing on the republican side. certainly by early spring. to your point is a good one if you look at the before and after of george w. bush, even barack obama in the 40s when they got elected, certainly the presidency takes its toll. i'm 38 and he's 80 i would say in many cases these in better shape than i am, the man worked out every day i've not been on a bicycle and a pretty long time. i think doctor joe, the president are pretty good judges of character in terms of what they're willing to put politics seems to rule in everything that comes into contact with. cdc director seems to recognize the damage that was done she is on something of an apology tour or at least a tour acknowledging the impact on her agency. will the effort work, can we get politics out of medicine. joining us fox news medical contributor doctor marty we carry. if she is trying to rebuild trust that almost necessarily means trust was broken, do you agree and what do you think led to the broken trust that wasn't warranted. >> the recent covid vaccine the recently design covid vaccine that was approved two weeks ago, regulators and the fda implies that moderna got together and decided to remove all regulatory requirements. it was approved based on data. moderna is vaccine which was approved and tested in 50 pe people. they only followed them for two weeks they did not look any efficacy. if they want to rebuild public trust that the cdc they should show humility and do proper studies to provide closure to those who are vaccine injured including children who have died from the vaccine and they should return to regulatory standards. right now you cannot tell the difference between surgeon general and florida state if you are under the age of 65 take a pass. what i'm wondering then others are warning. doctors used to be above all of this, they were better than lawyers so i guess what happened when did medicine get lower down to politics. >> when you rule by opinion rather than doing the proper scientific studies it is easier to rule by decree when you're at the top of the medical establishment. the problem you run the risk of getting things wrong. it's not the first time with covid they got so much wrong with a road by opinion that the medical establishment told the saturated fat causes heart disease and they got that terribly wrong for 50 plus years they told us opioids were not addicted for 35 years so we have to roll by scientific standards and show humility and stick to the principles. right now my fear that vaccine complications have been massively downplayed including myocarditis that we know affects one in 2700 young people, now when you have young people with legitimate concerns, those concerns are downplayed and the response is simply listen to us don't ask questions and that's an unhealthy place for the medical community to be. i love being a doctor and i'm very concerned about what's happening at the profession right now. >> i am to. when i look at places where i can go to escape politics i have a great doctrine i would do whatever he than the added progressive prosecutors including shoplifting and property crimes now receiving a failure to enforce laws related to the homeless. it's not just republicans complaining, brooke jenkins the democrat district attorney in san francisco made reference to a culture of lawlessness. another democrat district attorney failure to address the homeless issue from compassion to chaos. he wound up suing city officials in sacramento beseeching them to enforce the law. there are stark differences between the two political parties and a host of issues including the committal justice system. every now and again, there is agreement, reality sets in people in good conscience are in accord. no one likes to be accosted on the street no one likes to walk by open-air drug markets. no one likes to step over people sleeping on the sidewalk. it is a credit to the district attorneys they described it correctly. a culture of lawlessness has sprung up in part of her country and some call compassion is really just chaos. joining us attorney in retired nypd paul mauro. great to see you, thank you for joining us. i was in the d.a. for ten years and i never sued my county or city leaders but then again i never had to. what is going on in california. >> and think we have a nationwide case of buyers remorse with the progressive public officials, california seems to be the petri dish for this. the sacramento that you're alluding to is really interesting. very rarely do you see a county district attorney suing a city within his jurisdiction because he thinks are not enforcing the law the way they can. just to get a legalistic based on the ninth district martin versus the city of boise has been misinterpreted to say essentially the homeless can be anywhere added in time. i would like to point out we had a successful challenge to the law in phoenix and the judge gave the city of phoenix toll for november to clean up its act and the city of thousand homeless people have set up an encampment. this stuff is beatable but you have to meet them on the playing field and go to the courts and have the facts and the voters have to be aware of the fact that if you vote for the stuff you're going to get it. nationwide we see something of an awakening and i think it's something that is very bright for the republicans in the upcoming presidential election next year and even in the debates we have not heard a lot about it. 80% lives in an urban area. you have the suburbs 90% has their fortunes tied to a city that is the right topic and were seated come to the floor. >> i think people good conscience realize that we are creating in some of the jurisdictions that you reference a culture of lawlessness and the culture of no consequence. it's making life very difficult for those who were trying to follow the law but shy of filing a lawsuit. i think you put your finger on it. stop electing people who are going to lead you to have buyers remorse, that seems to be the brevity or maybe i'm too simpleminded. >> you're not simpleminded. you're exactly right. and what you are seeing the endpoint in the progressive policies there was no breaks in the 20 summer of love with the endpoint and people waking up to it, how bad is it, the governor of california governor newsom not exactly a right-leaning guy says so go to the supreme court, he is counting on the conservative majority in the supreme court to bail him out and that's about it is in california and are major cities, their falling apart and centers of commerce and culture of immigrant aspiration and we are losing them it's easy if you save the cities, who cares. they are the engine and we need them. trey: i'm trying to steady myself at the notion that the ninth circuit made of come up with a wacky ruling. before i let you go it was a heartbreaking story about fentanyl and a daycare center where a child died. it takes a lot to suppress both of us but a day care center is a front for a size of a hardcover book. the key in the interesting thing they had a kilo press which argues this was heavyweight and they were very connected. that's what the feds are interested that's why they federal drug charges as well with a lot of leverage. all i say i hope there in protective custody because i am looking to get into the two and trying to interdict what looks like a major fentanyl ring
