>> mike: good evening, welcome to washington i'm mike emanuel in for bret baier. breaking tonight a pivotal. eagle pass texas is under a state of emergency tonight. the democratic mayor of eagle pass made the declaration as thousands of illegal immigrants are crossing into the country in virtually nonstop fashion. we have fox team coverage. peter doocy at the white house shows us what the president's press secretary did when he asked about the crisis. we begin with correspondent bill melugin who has the latest from eagle pass. hello, bill. >> bill: mike, illegal crossings here at the southern border are back at record high levels. border patrol agents tell us their morale has never been lower and after two and a half years already, it appears this border crisis is show nothing signs of stopping. >> illegal crossings into eagle pass, texas surged once again today with fox news cameras catching a nonstop flow of migrants beginning at sunrise and continuing almost nonstop all day long. neither texas razor wire near federal border patrol have been able to decide migrants from crossing into eagle pass where a mass illegal crossing of 3,000 illegal migrants took place on wednesday. most of them adult men from venezuela. cbp sources tell fox there were over 10,000 migrants encountered at the southern border on wednesday. an all-time record high number only seen once before, in may, before the end of title 42. eagle pass' mayor, a democrat, has declared an emergency, and is calling out the white house. >> eagle pass is a city of 30,000 people. we cannot sustain this flow. we need help, we need it now. we need people from the top. i'm talking from our president, our vice president, we're scared to even go outside. we can't walk anymore because we have random people walking the streets. >> meanwhile, the biden administration announced late last night it will offer nearly half a million venezuelan migrants in the u.s. legal status and work permits through an expansion of the temporary protected status program. as biden bows to demands from sanctuary states and cities who say they are full. >> we have to let the word out that when you come to new york, we'res not going to have more hotel rooms. we don't have capacity. we have to also message properly that we are at our limit. if you are going to leave your country go, somewhere else. >> and, mike, on top of the tps for venezuelans, dhs just announced this afternoon they are also redesignating temporary protective status for afghan nationals here in the u.s. listen to this. they say any afghan nationals who cross into the united states between may of 2022 and yesterday will now be offered work permits and protections from deportation even if they controlled the u.s. border illegally. we will send it back to you. >> mike: bill melugin starting us off live from eagle pass texas. the biden administration is refusing to answer questions about the border crisis. white house correspondent peter doocy has that part of the story tonight. good evening, peter. >> peter: mike, officials around here are very effective with branding. when they want to take credit for economic policy, they call it bidenomics. so, what about immigration policy? >> what do you call it here at the white house this 10,000 people illegally cross the border in a single day? >> so what do you call it, peter, when g.o.p. puts forth -- wait, no. no, no, no. no. >> peter: karine. >> no, we are going to move on. no no, no, no, no. rear we're moving on. >> peter: the press secretary said the strategy is improvement. >> the president has worked very hard to implement a strategy when it comes to the border humane safe and has orderly enforcement. >> a different border was top of the agenda in the east room today, the one between russia and ukraine. >> we have begun the process of formalizing our long-term commitment to ukraine security alongside the g-7 and with other partners. >> the visiting president volodymyr zelenskyy is seen in the west wing as being politically savvy enough to ignore a congressional fight over funding for ukraine's defense. >> president zelenskyy is not coming here like a babe in the woods. >> officials did catch "special report" last night where the saudi crowned prince was ask about iran's nuclear weapons am ambitions. >> bret: are you concerned though iran gets a nuclear weapon about them getting a nuclear weapon? >> when we are concerned any country getting a nuclear weapon. if they get one, we have to get one for security reasons, for balancing power. >> peter: the white house sees that as another reason to stop iran from building a nuke in the first place. >> one of the major reasons that we are working overtime with partners and allies to ensure that iran never gets a nuclear weapon is that if they did, not only would they be a direct threat to the region and beyond, but it likely would trigger a regional arms race. >> peter: the ukraine meeting at the white house tonight is part of the white house strategy to answer questions for people concerned about president biden's age. we have learned that he is starting to tell campaign donors he knows the people are talking about his age and he gets it. but, he thinks that just gives him an argument to talk about his experience with two things, vax sinating the nation and rallying the world against russian aggression. >> mike: peter, thanks a lot. there are new questions tonight about the seeming inevitability of former president trump's campaign to regain the republican nomination. he is apparently been hurt by recent comments on abortion. now, one rival in particular appears to be benefiting. here is correspondent mark meredith. >> thank you so much. it's great to be here. >> stumping today in new hampshire, former u.n. ambassador nikki haley is seeing a spike in support of ahead of next week's second g.o.p. debate. a poll of new hampshire republicans finds haley now essentially tied with businessman vivek ramaswamy. their gains come at governor ron desantis' expense. is he now polling fifth. in iowa, desantis maintains a second place lead but the latest fox business survey shows him still trailing former president trump by 31 points. [cheers] trump held multiple events in iowa wednesday telling supporters his victory is all but guaranteed. >> we're going to win the iowa caucuses in an historic land slide. >> g.o.p. strategist karl rove believes trump's lead still. rove writes the higher he races expectations the easier it will be for his performance to disappoint. they are convinced trump will prevail. >> he did what he said he was going to do. and he put our country first. >> still, trump is facing skepticism from some evangelical voters about his views on abortion after he criticized florida's recently exposed six week limit. >> i think what he did was a terrible thing and a terrible mistake. >> desantis says trump wants comments insulted many conservatives. >> for him to then attack people like iowa, south carolina, florida, all these other states, i thought, was a big mistake. >> south carolina senator tim scott says abortion should also drive republican turnout. >> what the american people in the republican primaries want to know is where are we different? >> the former president's abortion comments are also sparking criticism from g.o.p. leaders who are not even running for the white house, including georgia's governor brian kemp and the governor can of iowa kim reynolds poet before whom are defending efforts to limit abortions in their states, mike. they were pretty upset by these the bankrupt crypto currency giant ftx and one of the largest dark money experts in the country. kelly o'grady has details tonight from los angeles. hello, kelly. >> good evening, mike. yes, less than two weeks until sam bankman-fried's fraud trial begins a new suit now targets the alleged crypto-currency parents. the team is suing the stanford law professors and the filing surprises political link. the suit highlights ftx's father bankman served advisers major left wing dark money group. arbella is denying any connection with fbf's father instead blink subsidiary. mr. bankman has never had any role with arabella advisers. a vendor to the new venture fund it. briefly worked with the ftx foundation to provide administrative services. the suit looks to claw back 26 million in gifts and senator plans to file a bipartisan resolution to ensure the senate dress code remains consistent with previous expectations. chuck schumer's decision to allow casual clothing was seen as a concession to pennsylvania's john fetterman, who prefers hoodies, t-shirts, and shorts. convicted murderer alex murdaugh has pleaded guilty to financial crimes. today's federal court appearance was the first time the disbarred attorney admitted responsibility for a crime before a judge. murdaugh is serving life in prison without parole for killing his wife and son, but he adamantly denied shooting them at his double murder trial. today in court murdaugh pleaded guilty to 22 counts of financial fraud and money laundering. he will be sentenced at a later date. ♪ ♪ for the seconds time this month we have a major search for a person considered a dangerous criminal. this time it is not an escaped prisoner but someone who was simply let go. senior correspondent mike tobin has the latest from chicago. >> the u.s. marshal service has offered up to a $10,000 reward. >> manhunt underway after accused murderer mason walked out of the indiana jail. authorities did not inform the public for nearly a week. >> we have used this time as a tactical advantage for us. >> no dramatic escape but human error appears to be the blame. clerks thought they were eliminating reabundant paperwork and removed the order to hold mason. two days after his arrest he walked out of the door of the jail. >> i made it pretty well-known short staffed, underpaid. it's not an excuse but a fact. >> sheriff says mason got a ride from a girlfriend desiree oliver who subsequently purchased men's underwear, a travel kit, slippers and a burner cell phone. oliver has been around but mason is still on the run. is he accused of killing catchings in june of 2021. the two men allegedly got into a fight. when it ended, investigators say mason shot and killed catchings. the sheriff believes with two years' experience as a fugitive, mason is good at life on the run and that someone is still helping him. >> we are going to be very aggressive in pursuing you. we will find you. we'll criminally charge you just as we did desiree oliver. >> clerical blunder in indiana is a contrast from the manhunt that ended about a week ago in pennsylvania after convicted murderer danelo cavalcante crab walked his way up and out of the chester county prison. amid concerns of poor leadership, during a town hall, the interim warden of the prison said razor wire and measure have been added. >> i'm confident that we have mitigated the factors in which cavalcante and bold he is escaped. >> back in indiana the marion county sheriff's department is standing behind the decision to not inform the public that an accused killer was on >> so we just watched supply demand, if there is shortage of supply, our role is to nail shortage. if there is oversupply our role is to stability of the market. >> bret: doesn't have anything about that. >> it's purely about demand/supply. >> bret: what about that defense and action so far. >> this is essentially a change in the stance. we first saw in october they said look, we want to get in front of the market because it looks like demand is going to weaken. and history vindicated that. it turns out of the demand was weaker than expected. the cut looked well advised. now, typically, opec has not cut when inventories have been lean. they have been cutting when inventories have been long. so this is a change. >> bret: another change for saudi arabia a big shift away from oil and toward additional investments elsewhere. >> bret: when americans think about saudi arabia, i think the thing that first came to mind is oil. that is how you have raised a lot of revenue. but, interestingly, 2030 and the vision is to try to increase nonoil businesses and also green energy. >> we have been using oil, yes. we will continue using oil, of course. we would be marketing oil, yes. but how about we would like to demonstrate to the whole world that we are equally transitioning. we are actually going to get better and better with it. >> bret: saudi arabia is an oil-rich country but it is trying to diversify its economy to be nonoil or a bigger part of nonoil. this image behind me is a perfect example of what we're seeing in the country. the history to the ruins at the ray a, the birthplace ever the saudi kingdom and in the distance, a gaggle to cranes. there are more cranes in this country than in any other around the world. the net oil export revenue last year, $311 billion. the cost of the projects around the country $1.1 trillion. besides real estate, they are spending big bucks on big names and events. dr. christian know reynaldo and nay march to dustin johnson and phil mickelson, saudi arabia is investing heavily in professional sports what do you say to the people who charge that's part of sports washing, that you are trying to use all of that to somehow improve or somehow affect your image. >> sports washing increase #%? then we will continue doing sport washing. >> you have chris an know rendell who is a huge draw. did that change the dynamic here. >> that changed everything. this investment in the players and the clubs and the and the events we host reflect directly to the youth and the kingdom. >> bret: according to forbes. reynaldo will be the highest paid professional athlete this year. >> sport is important for the kingdom, for the crown prince? >> well, sports is important, i think, for everyone, especially for the kingdom and for the conference. 70% of the population is below the age of 40. and this population wants to compete in different sports. >> bret: and the kingdom is investing in ports at the youngest level. to compete on the global stage. >> so it's a bit of a farm club from around the country? >> exactly. and different regions we choose these kids and move them. they have special coaches for each sport and nutrition and so on. >> and you have had some successes, some real stars. >> yes. we have had some, you know, some real outcome from this in the past two years that this year we had a couple of our athletes who participate on asian level and on regional level who have achieved some medals. >> okay, we're going to move on. >> they need to secure the border. they need to enforce the immigration laws and they need to protect the citizens in texas and throughout the country. >> unfortunately, republicans refuse to actually fix the system and have continuously refused to come up with solutions. >> let's take a look at the border numbers of the southwest border under the biden administration. more than 6 million encounters, 200,000 plus average encounters per month. that is up 348% compared to the trump administration. with that, let's bring in our panel. katie pavlich, you. >> great to see you. >> so, olivia, on capitol hill they don't love it when the white house says it's their fault, right? >> no, no. they don't. and, you know, this is an issue where have you finger pointing. if you talk to members like chip roy and donnie gonzalez they have very different views of how to address the border but they will say that is one of their top issues. they are in a border state. and the border numbers that came out recently are bad. if you look at what they were compared to july, coming in, there is a 60% increase. and so this is going to be an issue. you hear talking presidential, talking about down ballot and, you know, that's also why republicans are trying to attach a policy, hr 2, their border bill to the government spending. they have think they could have a win on that. but they can't seem to really take off on actually getting anything passed right now at the moment in the house. >> mike: guy, being a multi media star, what are you hearing from people on the radio. >> i think there is a huge amount of frustration just among american voters in general because the images, to the extent that they are being shown by much of the media, but the images speak for themselves. it's absolute chaos. 10,000 encounters a day at this point. plus, all the got-aways. and just this unbelievably lame insulting talking point that it's the production' fault. republicans passed a border bill back in may. the democrats don't like it. they're not interested in enforcement, but the republicans have taken action. the president has plenty of tools at his disposal to make this better on the enforcement side. he chooses not to exercise those options because he is not interested in it. and so that exchange between karine jean-pierre and peter doocy earlier to me was just very, almost infuriating to watch because peter asked a specific question and the response from the press secretary was a quick deflection to something he didn't ask and then she just moved on to someone else hoping for a different question. >> mike: katie are, you are from one of those border states, what about it. >> talking to folks back in arizona. they are seeing the same situation play out as in texas with thousands of people coming over every day. most of them single adult males. and for the press secretary today to try to pivot to republicans, her argument is that republicans don't want to give the administration more money and that's not to enforce the border or to deter illegal immigration. it's to process illegal immigrants. they have no intention as she said today of putting a cap on the never of illegal immigrants who cross. essentially saying the number is going to be infinite. and when it comes to the border patrol's mission, they have completely violated that. the mission of border patrol is to protect the united states of america. and they have turned them into a processing organization. morale is low. you know, that's morale has been low for a long time on the border. it's not republicans who are sounding the alarm on this. they are, obviously, but democrats. the mayor of eagle pass, a democrat. the governor of new york democrat. the mayor of new york city a democrat. this is a bipartisan problem. the president has title 8 at his disposal through the executive branch to stop this, and they have no intention of stopping the flow. only managing it by letting as many people in as want to come. >> mike: bret, made a lot of news with his interview with the saudi crown prince. one issue was relations with israel. let's play it. >> now we have relation with israel now but the biden administration succeeded to make, i believe, the biggest historic since the end of the cold war. then we got to start the relationship and this relationship got to be continues. >> mike: bret is due to talk to b.b. netanyahu tomorrow. look forward to that interview. your thoughts on what this could mean between the vaudys and israelis. >> huge realignment. there has been some between the saudis and the arab states and iranians. clearly they're still concerned about iran and nuclear weapon, which also came up during the course of that interview. if saudi arabia joins with some of these other countries in the abraham accords, to recognize the state of israel, and have open relations with them. what a see change and hopeful one. let's pray for that outcome they didn't want to recognize the abraham peace accords struck under president donald trump. luckily they have and good for the world and the united states of america, endorsed that concept and saudi arabia certainly on the list to try to join those packs. of the most interesting part of the interview in terms the consequence was the saudi arabiaen prince saying that if iran gets a nuclear weapon, we have to get one, too. the iaea just came out a week ago saying they are no longer allowing inspectors in. this comes on staples in may from the iaea saying iran was enriching uranium to nuclear grade levels. it's for a nuclear weapon and they went in and stole a bunch of information from tehran in 2018, showing that the iranians have been disingenuous not for peaceful purposes. so that certainly plays into the negotiations with normalizing relations on a national security front. i can moo mike all right. i got a special topic for olivia. my hill correspondent friend about the dress code in the united states senate. dialing it back. going casual for senator fetterman no more jacket and tie. well, that's created quite a stir. caught my ear when senator mark kelly responded to this question from jake tapper. >> i wondered what you thought of schumer changing the senate dress code, do you like these more casual looks? should they be allowed on the senate floor. >> i don't like it and i think it would have been better if we had a discussion about it ahead of time. >> mike, we have a bipartisan issue happening in the senate, basically majority leader schumer changed the rule for fetterman and manchin is now trying to codify it. you have senator rick scott republicans to sign a letter saying that they have -- and i would also say attempt by the leader to change from one man's brand and you are seeing pushback in the clip there. >> mike: all right. i will ask you guys about the dress code after the show. thank
