little bit after meeting yesterday to get unity in your party. >> yes. harris: i can't wait to get your thoughts. let's move. start with the day after the big sit-down. house speaker paul ryan and donald trump emerging their their meeting accept waiting the positive and saying they will work toward party unity. both son seeded it may not happen overnight. in other words it didn't happen overnight. donald trump on "hannity." >> this is a big subject and we have a lot of things. i think for the most part we agree on a lot of different items and we're getting there. i feel very strongly about border security. i feel very strongly about trade. i feel strongly about building up the military. to a large extent i think paul is there also. harris: meanwhile more signs the republican establishment may be falling in line behind trump. former house speaker john boehner and senator orrin hatch announce endorsements of their party's presumptive nominee. even some of trump's fiercest critics appear to be warming up to him. senator lindsey graham, who had some, shall we say, choice words for donald trump, says, he had a quote, very cordial phone conversation with the candidate on the eve of his washington visit. so nice is nice. is it real? >> i believe it's real. lindsey graham reaching out to donald trump is an indication that he ceasing unity of the party would be good for the country. so i think that that was a big step that he made by calling donald trump. now there is one more call i wishing he would make. call mitt romney and ask him to stand down. harris: oh. how do you think that would go, exactly? >> mitt would be polite and gentlemanly as he always is but he needs to stop pushing back. what i have said many times on my show, look, mitt, look behind you. you don't have an army behind you. there is nobody back there except few voices. i think lindsay's move is good one. harris: and judge, he also lost twice. >> mitt romney lost twice. the fact criticizing donald trump about the tax, get over it, mitt, move on! everybody was angry when he came out and criticized donald. if you had that much energy when he ran for president, maybe he would have won. here is the bottom line. everybody knows in washington they need each other. there is no better salesman than donald trump. >> yes. >> donald trump like you, is a it. he walks into a room. you make no mistake who he is. and he will engage people. he is charismatic. people are surprised he is such a nice guy. he is a sweetheart of a guy. i've known him for 30 years. harris: couple things are not jiving, even though accentuating the positive, eboni. donald trump puts it this way. he is aware of slow process. speaker ryan puts it this way, that it went, very, very well. calling on his party to move forward, so on, so forth. it won't happen overnight. one is a slow process. one, it won't happen overnight. they're coming together. how slow is too slow. >> i think there is such a thing as too slow, as mr. cain said, the party unity will be very important to be successful in november. we'll talk about how democrats need to get that message as well but to your point they're being consistent, from both paul ryan, donald trump, we're seeing it will be a process. no one is overstating how quickly it happens. they're measuring expectations from the public. i do think paul ryan doesn't have a lot of leverage. it was very gracious schuss to donald trump to refer him to the gop but most people in the country think it is donald trump's party. >> what is interesting call him leader gop. paul ryan was not elected to be anything more than a congressman. because of position he holds which is such a powerful position, paul is thinking he is on level with donald trump. donald trump make no mistake is the leader of the party right now. >> here is what i think is happening very quickly, paul ryan is trying to appease 434 members of congress. it is like herding cats. they are nervous who would be at the top of the ticket. until they're comfortable they can ride trump's coattail that they are being a little reluctant. >> i totally disagree about mitt romney. i think mitt romney does nothing but help donald trump. every time he stands up to complain about him he reminds supporters that he is outside of the establishment. he is furious his own tax details torpedoed him. he should have been found a way to be proud of money he made in private equity. he was constantly embarrassed about it. donald trump turned that on his head. >> gd point. harris: the idea of power in the party, that leadership, if there is vacuum where the leadership will come from. with speaker rye i don't know, it is interesting he says he doesn't want fake unification? did he read what senator lindsey graham said early on? he called donald trump a loser. called him a lot of things and now he is on board. you think it is real but it was literally over -- you don't think it is real? >> no, i've in politics too long. i know it is not real. they know they need each other. if it were real, paul ryan would say we need to endorse the person republicans are electing. make no mistake, it is republicans. this is a primary. harris: is he losing some of his power through this process? >> i believe he is losing his power. i think he knows his position right now based upon the way that donald comes into a room, into a campaign and into washington, he knows that he is on shaky ground. melissa: i have a question -- >> i have a quick question, judge. that is interesting and you make a very interesting point but maybe i'm being naive here. seems like it could be real to me for many people are meeting donald trump actually for the first time. >> yes. >> they're being introduced to him. so from everyone i know that has spoken to him, met him first-hand, once they meet the actual man, that seems to be different. >> there is no question about it. people like him. he is engaging. he is a great guy. you're right, a lot say gee he is nice guy. >> i never knew. melissa: i want to get your take on it because i don't agree. melissa: they're like two dogs circling each other and checking each other out. i don't think paul ryan is losing his power. i think he is in control of everybody in washington. they're trying to see where each other lies. they have so much more in common than either do than hillary clinton. look from economic point of view and what happened in the obama administration. we've seen median income fall. we've seen income inequality grow tremendously while he is in office, exact thing he is supposed to be against. economy slowed down so much. we can afford from pocketbook perspective. i focus on economics and taxes. we can not afford another obama administration. that is what hillary clinton is. harris: former presidential candidate on the couch, i've been in the field with you. >> yes. harris: i was on the trail with you. i got on the bus. >> that's right. harris: and so what i saw with you and people and shaking hands and getting to know them is something you can answer personally. how important is it to unify the party in terms of voters? donald trump has gotten there against all odds, in terms of delegate count. had to hire somebody to take over that? he has not really run a traditional campaign. how important is is it for party to unify on capitol hill, with regard to people as you feather out across the nation are not capitol hill? >> i think it is very important because if you look at the last presidential election three million conservatives stayed home. according to reince priebus's rnc. because this campaign has been so brutal, a lot of people will stay home. if you get the unity between the establishment and donald trump and donald trump supporters, you may not get all of them to go out and vote but you will probably have much smaller number. melissa, talk about two eagles circling one another. what number? i called ops, they gave me quote, secure cell which i tried but only got long, high pitch whining sound. mills responded. they were supposed to connect us. i tried some time ago to do the secure call. call them ask them to try the connection. hillary says, i give up. call me on my home number. these documents apparently showing clinton was aware of security risk but chose to ignore them. judge, i want to start with you on this one. >> you do? melissa: yeah. what do you think about that? saying, i give up, call me on my home number? >> what do i think? i think the same thing i thought in the beginning. every drip, drip, drip, that we're getting is indication of her knowledge things are supposed to be secure whether they're phones or blackberrys. we get these admissions along the way. there is no question that she sign an agreement she would not communicate on these non-secure ways of communication. it is just being proven day after day. so the question is, does this affect the campaign? no because people like hillary, like hillary. they think we're all crazy with this. >> yes. >> but at the same time, what you've got is a woman who, as debbie wasserman-schultz, we were just talking about that, said this morning, you know americans they don't care about that they want to know a president has their back. how could have president have her back when her emails are being hacked into because they were intended to be non-secure. the topping on the cake, jim comey? i never heard of security inquiry. it is investigation. i'm in law enforcement. melissa: investigation is in our name. this is the one that really gets me. harris, this is the fact exchange with jake sullivan said we're trying to send this we had issue sending secure fax. they were working on it. clinton wrote, if they can't, turn it into non-paper with no identifying heading and send it non-secure. take the label off and send it to me on regular fax. harris: the judge mentioned that document that the former secretary of state signed. that meant she understood signing her name, she understood things are classified as born documents based on content and not any sort of marking that would be on there. that means she is willing to take a born classified or top secret-type document and turn it into something else so she can transfer it. transfer it in two-ways. one, non-secure, to people that we don't know what kind of clearance they have on the other end. both of those, as i understand it, not allowed, not allowed period under any circumstances. you're very familiar with security clearance and all of that, having been a candidate and having seen some of the advisories the presidential candidates see. what do you think of this? >> drip, drip, drip, will be followed with deny, deny, deny because it is getting bigger and bigger and bigger because there is more evidence. what she has consist tently done to deny it. i think this is much bigger than she is letting on and her staff is letting on. harris: does she not understand? >> in terms of information that is accumulating. it is not just one thing. you're right, some of the liberal media and supporters they think we're crazy. we're not crazy. >> i want to say i assure i'm not part of the right-wing conspiracy, i can tell you this, prosecutor ral standpoint, this is not required. knew or should have known standard. judge's point, very, very correct. all this actual knowledge she is demonstrating here will do nothing but compound severity for which, from in my perspective she would be in jeopardy. >> harris, she signed something, before she signed that she had training by top secret educators. and when you say, herman, deny, deny, deny, we're past that. it is lie, lie, lie. >> i was trying to be nice. >> it is the playbook. >> i guess i'm not. >> trying to be nice. harris: well the big question is, you see comey answering book on this, he does not like the fact that she is trying to minimalize what he is trying to do, put it in a box, compartmentalize it calling sitting other than an investigation. it is not the federal bureau of inquiry. the i does not stand for inquiry. it stands for investigation. >> it undermines authority for the chief law law enforcement officer in the country and disrespects him. harris: wonder how bernie sanders is feeling. he continues to win, win, win. despite his recent victories in indiana and west virginia, party leaders are citing a number of reasons for their display may including clinton's nearly 800 point lied in overall delegate count. clinton's campaign says she is resisting on sanders to drop out. associate press, now that trump locked up the republican nomination, they fear the that billionaire businessman is capitalizing on him staying in race and echoing his attacks and appealing to the frustrated voters that backed vermont senator. sanders is having none of it. insisting he still has a path to the nomination. i think party leaders hit the nail on the head. the problem we still don't know where the people that back bernie sanders will to. when you look at percentages of those who say that they possibly will not back hillary clinton, would they all sit home? or would they look for commonalty from a guy they put it echoing bernie sanders? melissa: interesting you see crossover between trump and sanders votes. if you know anything about the real policy and look at it they have nothing in common between sanders and trump voters, they shouldn't have anything in common. they do because they're sick of washington and sick of people that tell them one thing and do something else. they are sick of moderates. they want people that care about of arage people and working folks. you see it in both groups. harris: how would you reach a bernie sanders supporter? >> a bernie sanders supporter is probably someone who didn't like hillary from the beginning. this is what party leaders didn't anticipate. melissa: that's a great point. >> from the beginning they didn't like hillary. now they're going oops, this may have backfired. bernie, go away because you're distracting too much from what is going on okay? bernie is going, wait a minute, maybe i do have some juice. he said i will stay in this until the end but he does not have a path to victory because the superdelegates are already in the hillary's pocket. harris: it is baked in. it is interesting, anytime someone raises north of $40 million in a few weeks you have to respect that, right? you can't just ask him to go away. somebody has given him that money. >> in little amounts too. a lot of people engaged the way donald is engaged. people who are not political, are like, enough of this. i believe that they go to a donald trump, the new ones. the dems who are more party dems stay with hillary. >> that is point of partisanship, very, very great. bernierat. people forget that. he is independent running as democratic nominee. he has no allegiance to this party. he is not interested in the best interests of the democratic party. for what? he is interested in his principles. whether you agree with him or don't he is true believer. he has zero incentive to drop out of this thing. drop out for what? i understand the clinton concern because they have to create a new playbook. they know they are not running against a establishment republican candidate. >> yes. >> they are running against donald trump. he is something unlike anything they have seen. they admitted they have to create something new. harris: unlike anything they have seen except when they were talking about her campaign and giving her donations and they have that kind of relationship she possibly thought she might control some of the message. now he has things, you are hearing his campaign, as reporter are promising to unleash all these investigations into his past, so on, so forth. wait a minute, i have a lot too. i have a lot on her. we don't know really what he has on her. we're not really sure. do we know much about their relationship? >> i don't know anything about the relationship in terms of, talking about donald and hillary well, i was at wedding and she was at the wedding. i've seen her to mar-a-lago. i've gone to marla large go. there were a lot of people at donald's events. donald is superstar. whether you like him or don't, he has got casinos and theater people. harris: does he have the goods on her? >> do i think he does? absolutely. without a doubt. and that he is waiting. harris: that is where bernie sanders staying in really hurts. it just gives the other side more time to build. want last word? >> my word would be, bernie is staying in. he doesn't want to do damage to the democrats because he still wants to be friends with them. so he probably has more than he is willing to acknowledge. remember the famous statement, who cares about the emails? well, we do. a lot of people do. but i think he is staying in because he doesn't want to do any, irreparable damage but he is enjoying the ride. harris: his presence creates -- >> he is enjoying the ride. it is not bierne, it is the -- burn, it is the ride. harris: we're loving this ride. latest firestorm. obama administration and republicans squaring off whether deputy national security advisor ben rhodes should testify about the controversial comments on spinning iran deal to the media. will rhodes show up? and the message it may send if he doesn't show up. the white house is telling schools nationwide to let transgender students use bathrooms of their chosen gender identity or face the threat of lawsuits and loss of federal fund for states which they live? how friendly were they? are their careers ending over this? this is pandora's box. >> it was manufactured urgency to begin with. they kept saying got to get it done, got to get it done. and they were not telling the public the truth while ma nip lating the deals and backdoor deals. this isn't the first time the administration intentionally told the public what when they wanted the public to believe and it was a lie. can we say obamacare? melissa: you're absolutely right. there are two different issues here, eboni. one this idea they created a false narrative. they said it started when the hard-liners were not in office. they were more moderate, they they wanted to reward them with better relationship with iran. the other issue, bragging with "new york times," controlling reporters, this hubris, narrative within the administration they think they're smarter than everyone else. >> my question is this though. let's say shows up and testifies admits, you know what? this is the biggest marketing scheme the administration has done. my question, then what? i'm not sure what they do with admission or information spending millions of taxpayer dollars to get. that is what is my question. harris: here is what i would ask if that is the case, if he gets called up into capitol hill. what you're saying is what is the follow-up question. >> that is my question. harris: if you spun it to reporters, what is the truth? >> say that all comes out. what do we do with that? harris: what did you spin? what was the truth? >> the key yes is then what -- key question is then what? we've seen this a million times. we see it play out before. they go to congress. fight with each other who will get there. whether lois lerner from the irs or benghazi or whatever it is, that is why we are in this high-pitched presidential election. people have had it because then what never happens. melissa: all it is a public flogging. you go up to one of the hearings, you go up, get flogged. talking about facebook to talk about issue we get later in the show cultivating -- so what? you yell, this is in fact what americans are so frustrated about there is so much talking and hot air but in reality nothing happens. >> they're frustrated and angry about it. josh ernest in the clip you played, he started to deflect and deny and point fingers at somebody else. this is what they do. if he goes, if he goes up, they will try to get the truth out of him but one or two things are going to happen. he will deny that is the case. or if he admits it is case he will come up with some flimsy excuse hope at that that the liberal media just dismisses it. harris: if they're spinning it communicates they felt like there was a need to spin something that was true. >> exactly. harris: my question what is view about this deal that you did not want us to know? i want to know. but you don't just spin for the fun of it. i guess, except for maybe washington they do. maybe it's fun. the battle over transgender bathrooms is is can lating. white house is sending a letter to every public school district in the nation, telling them to allow transgender students to use restrooms and locker rooms of their chosen gender identity. not what is listed on their birthcertificate. while the guidelines don't have the force of law, the obama administration warns that schools could face lawsuits or lose federal aid if they do not comply. the letter says in part, quote, as is consistently recognized in civil rights cases, the desire to accommodate others discomfort can not justify a policy that singles out and disadvantages a particular class of students, end quote. they took it to the civil rights type of protection, and i understand that. my question though is, what are inherently, judge the problem with this legally? the. >> legally, as you said, harris, it did not have, white house's threat did not have force of law. what they're claiming title nine of the civil rights act which has to do with federal discrimination on basis of sex is going to be engaged. make sure the kids identify or go to the bathroom where they identify, right? the problem is, they don't, they can to the force schools to do this. this is local issue. this is a state issue. now they can say, we're giving you federal monies and therefore you better get with the program but this is not about discrimination. this is about estimately a accommodating and teeing up the issues so your 7-year-old or 8-year-old, god forbids goes to school, today i want to be a boy. harris: so that brings me to the next issue of the where do we start this conversation? if you mandate this in every school, that means i now have to have a different conversation with my first grader than maybe i would have had, would have waited on having. >> judge jeanine is exactly right. first of all they don't have the force of law behind them with this. the law says sex identity, not sexual identity. you wake up and say i feel like a chick, how are you -- melissa: i never said that actually. >> you -- >> it is unenforceable, first of all. here is the pushback. the fact that the state of north carolina is pushing back by suing the justice department administratively, that needs to happen from many states because they are clearly overstepping their bounds, trying to intimidate the states with blackmail. that is what it is. harris: let's flip it though, eboni, take it from perspective of parents who have transgender children and positive they see in this. so how does something like this helps. >> if it helps tremendously if you have transgendered student and living in their truth and i respect and get it. i also respect and understand concern of parents who have children not transgendered. harris: i will have to have that discussion. >> here is the issue. mr. cain, you pointed it out perfectly. you represent the great ambiguity that lies around the issue. the truth is, judge jean, you're right about title ix, we don't know what sex discrimination, what the language says in the statute really entails. ultimately supreme court will have to give us direction whether or not gender identification is inclusive. this is what happens, league ambiguity. much confusion. harris: you're saying very word sex it is a verb, it is a noun and that is where we have to figure out where we are now. melissa: i feel like every time i listen to with this conversation i living in crazy town. what difference does it make? harris: how do you want to see it? melissa: i think it is ridiculous -- harris: what sign do you want to see? melissa: i don't care. a lot of people, realize when you go into women's bathroom. very private. everyone is in their own stall. harris: not the next door though. do we make bathrooms universal and put urinals? >> you guys bathrooms are pretty nasty. i used to work in restaurants. i had to clean them. harris: my point, they're not the same. by putting up sigh that is gender neutral, i think we've been showing some signage is that where we're going? you and i have small kids, we use family restroom for everybody. >> ambiguity. anytime you have a law or rule this ambiguous it opens it up for abuse and it is those that will abuse it -- harris: what does abuse looks like? who cares? >> i would care if my 17-year-old granddaughter in there and somebody walking in looks like a woman. they have a beard. i would have a problem with that. melissa: but why? women's bathrooms are all private stalls. who care is in the stall next to you? >> they could be a pedophile person. they could be a pervert hiding in that stall. harris: that could be anywhere. >> hypothetical threat. harris: so my question is do they want to put stalls everywhere and become as nonissue? >> i mean isn't that, everybody goes in? harris: you can see why this is getting -- look at the couch. >> security is the problem. ambiguity. is the problem. >> we'll figure it out right now. melissa: how about that?
