[ gunshots ] >> this is just a little bit of this. we're still receiving, it's streaming in to us now. you can hear the gunfire, and we can't tell you exactly when this was taken. because remember, this started more than 24 hours ago. this might have been closer to the beginning of the -- of the whole thing playing out. people weren't quite sure, as you could see from that video, that one woman yelling george, not quite sure what's happening. well certainly now, they know. as many as 69 people are dead. american citizens caught up in this. we are learning much more. seven hours ahead of us, ahead of the united states eastern time, so it's the middle of the night there right now. this is earlier video. it's helicopters circling over the westgate mall, as it's called. still shots coming to us. reports of gunshots, explosions inside that complex where an unknown number of hostages were taken. after many shoppers were killed andd. 10 to 15 terrorists we've learned, including some women among those terrorists. armed with guns and grenades, holed up in that four story mall. and now, the awful human toll of it all. as i just mentioned, at least 68 people dead, including children. from europe, africa, canada, and other places, you see the map there. the wounded ranging in age, we're told from 2 to 78 years old. many victims were at a cooking competition yesterday when the attackers began the slaughter. one couple found shot dead while lying in each other's arms. first responders first rescued about 1,000 people who were in that mall. one woman hid underneath a car in the basement of the parking lot as the attackers ran through shooting. >> when we were trying to get out, we saw a few people who actually -- >> another man talks about the moment he nearly died. >> unfortunately where i was the security guard doors just right next to where i was, i saw that. then he shot at me and fortunately the bullet, he looked at me, there was a graze. there was a graze here. so he shot -- he shot at my head but luckily hit the wall behind me. so that's when i blacked out. >> wow. grazed but obviously alive. the state department on record now saying the u.s. embassy in nairobi is closely monitoring the situation. and u.s. law enforcement military and civilian personnel are providing advice and assistance to those kenyan authorities. president obama has spoken with kenya's president by phone to express our nation's condolence. and telling him the united states supports his country's of for thes to bring the al shabaab network to justice. for this attack. al shabaab a terror group based in somalia right next door to kenya. kenyan forces went in to that country, in 2011, to help fight them off they were supporting the somali government. the terror group is claiming that that type of military support is why they're doing this. this is retribution for that. we have live fox team coverage. catherine harris is in washington with the latest on the fbi investigating al shabaab. and conor powell with details on the situation in kenya. let's start there live in jerusalem. conor? >> harris for the first time in hours, really the last two days, there is some encouraging news coming out of nairobi as kenyan special forces have essentially laid siege to this shopping mall to the westgate shopping mall, and the reports we're getting now is that most of the hostages are now free. according to kenyan police and military officials, most of the hostages that are freed are in good condition. they are adults. although some are suffering from dehydration. however, a word of caution here. we don't know how many of these hostages have actually been freed, nor do we know how many are still being held by the somali militants. and despite the encouraging news, this is not over. somali militants are still barricaded in this shopping mall. there is still fighting going on. there are still reports of loud explosions, and gunfire in nairobi -- or in kenya's capital in nairobi. the death toll has risen this evening already to 68 people. and kenyan authorities say it may increase even further before this assault is finished. there are concerns, harris, that the gunman may start executing some of the hostages. >> well, and conor, of course, every life is precious. we do want to make the point, though, that american citizens have been caught up in this. in fact our u.s. embassy has been ready to receive and assist anyone that they can. we'll have more details on the victims who are americans in this in just a moment. but you're in jerusalem and i understand the israelis were called in their military experts to help them carry out this then siege on this mall so they could free these hostages. how did they do so? >> well, that's right. so a lot of countries have been offering assistance, both advice, and support, including the uk and the united states, the kenyan government, but israel actually dispatched four people, part of a special negotiation team. now there have been mixed reports about whether or not the israeli members of the security forces here were part of an assault. the word we're getting is they were on the ground in nairobi but they were not part of any type of wave or assault into the shopping mall. they were there just to help advise and be part of a strategy sort of session there. they were offering technical advice. but israel did lend support to the nairobi police and military there right now. now keep in mind, that the shopping mall that is under siege is partially owned by wealthy israeli businessman, and israel and kenya have very strong political and financial ties. but the word we're getting is that while israeli officials were on the ground, they were not part of any assault there. it was all kenyan troops on the ground. >> conor powell reporting live from the region tonight. thank you very much. we are now getting word the fbi and others in 9 intelligence community are actively trying to identify the alleged al shabaab attackers. and whether any of them, the attackers, may be american. chief intelligence correspondent katherine harris is live in washington. who's coming out about these killers. >> federal law enforcement officials describe the situation in kenya as a major event because it's outside the scope of operations by al shabaab which is known for suicide car bombings and the alleged multinational character of the assailants. the situation in kenya is described to fox news as a complex assault with a number of similarities to the 2008 attack in mumbai, india, which relied on heavily armed assailants with cell phones for coordination. the prim difference is that mumbai involved a dozen commercial targets and kenya just one, and in mumbai, as well, nearly 170 were killed. fbi and the intelligence community are, quote, aggressively drilling down on the alleged al shabaab members and whether they are american citizens. this includes, i'm told, the scrubbing of travel records. >> catherine, this is actually not new the idea of americans going over to fight in somalia. >> well, that's right. one of the threat streams domestically is the recruitment of naturalized american citizens, who have traveled overseas to somalia to fight alongside al shabaab. the former chairman of the house homeland security committee explaining on the sunday talk shows the intelligence community's concerned that american passport holders travel to somalia, get training, and then return home. >> we know this probably still 15 to 20 somali americans who are still active over there. the concern would be if any of them have come back to the united states, and used those abilities here in the united states. >> first identified by fox news the leadership of al shabaab. the intelligence community is trying to verify reports earlier this month that he was killed in a shoot-out. this group has drawn historically very heavily from the minneapolis area largely because there is a significant population of somalis that sought asylum in the u.s. in the '90s. the first documented case of an american suicide bomber was a minneapolis native who blew himself up in northern somalia, in 2008. so the key here for the fbi and others is to work to identify whether americans may have taken part in this hostage situation in kenya. >> very interesting. great information catherine. we'll come back to you if you learn more within this hour. thank you very much. now we're learning more about the victims in all of this. let's focus in on that. we mentioned off the top of this hour that they came from at least 11 different countries and territories including the u.s., france, canada, china, ghana, the netherlands. of course, kenya. additionally in europe, the united kingdom. we're told the list could grow as they find more hostages, and hopefully people who survived this. kenya's president visited with victims and their family members at a hospital today. sharing the grief of his own nation and talking about his own loss, people, loved ones inside that mall. >> as your president, and as a leader, and also as a kenyan, i feel the pain of every life we have lost and share your grief at our nation's loss. my nephew and his fiancee were among those who died in this attack. these are young, lovely people i personally knew and loved. >> we know at least two canadians died including a diplomat. a poet from ghana who was a professor and former ambassador to brazil, cuba and the united nations. united states officials have confirmed the wife of a foreign service national who worked for the u.s. agency for international development was killed. britain says at least three uk nationals killed. prime minister david cameron reacted. >> well it is an absolutely sickening and despicable attack of appalling brutality. what we know is that three british nationals have been killed. of course, the situation is ongoing. we should prepare ourselves for further bad news. >> victims also included two people from india, one of them 8 years old. a mom and a daughter from france. also among the dead. and it has been a bloody 48 hours not reporting all any connection at all in this. but just note the timing of what's playing out. now in pakistan, a church today, the deadliest attack ever on christians in that predominantly muslim nation. and i want to remind you, that that mall, those attackers were calling out non-muslims and killing them. again, no connection but just the timing of how bloody this weekend has been with this sort of thing. it happened in the city of peshawar. a pair of bombers targeted parishioners outside a church that killed at least 78 people. women, children among the victims. this attack is fueling fear of rising sectarian violence across pakistan. where christians make up only 4% of the population. the country's prime minister is trying to launch peace talks with the taliban, and today's attack could hinder that effort we're told. critics argue the military should face tough military action for this. as we have been reporting, the rescue operation now, that is still under way to pull hostages to freedom from that mall in kenya, let's take a look again at that brand-new video continuing to stream in from the violent scene. cameras inside some of those stores capturing this. american citizens again we know caught up in this. what kinds of special ops does it take to pull this off? this kind of rescue operation? conor powell mentioned israeli experts called in to help. c.a.t. ridge herridge told you the u.s. military giving advice. we'll ask former cia covert operations officer mike baker who knows this part of the world well to take us through the scene of saving [ male announcer ] helping you -- now that's what's important to us. in washington the countdown to a possible government shutdown. republicans and democrats digging in for what could be a long fight over the federal budget and the affordable care act. if no deal is reached by october 1st, now just days away, the government could shutter many services. this week, the senate is expected to take up a house bill that will give the government running power while still defending obama care. democrats say that bill has no chance. and now even some republicans are beginning to agree with democrats, at a gop gathering in michigan this weekend, kentucky senator rand paul said this was about the president's health law, quote, i'm acknowledging we can't probably defeat or get rid of obama care. but by starting with our position of not funding it, maybe we'd get a position where we make it less bad, end quote. still others like texas republican senator ted cruz think the battle over obama care is worth waging. >> i believe we should stand our ground, and i don't think harry reid and barack obama should shut down the federal government. look, the house voted last week to fund the federal government. if harry reid kills that, harry reid is responsible for shutting down the government and he should listen to the american people, open the government, fund the government, but don't fund obama care, because it's hurting the american people. >> house minority leader nancy pelosi is defending obama care, and lashing out at house republicans, calling them quote, legislative arsonists. >> let's be really clear about this. the republicans put legislation on the floor that was intended to shut down government. for them, that's a victory. because they're anti-government ideologues who dominate the republican party. >> that's a lot of name calling. steve centanni is live for us in washington. how will democrats try to derail the house bill? >> well, senate majority leader harry reid will use some procedural moves to dismantle that house bill and restore the funding for obama care. it's not unexpected and there was little chance the house bill would actually pass the senate. but some are not giving up the fight against obama care. how many more people will have to lose their jobs or have their wages cut or lose their health care benefits before congress acts, before congress does something to protect the american people? how many more states will have to announce that premiums are going up, the american people are calling for this, and the house is active, the senate now needs to do its job and follow suit. >> but other key republicans are not on board with this defunding effort. senator rand paul of kentucky, and oklahoma senator tom coburn are -- acknowledge that republicans don't really have the ability at this point to stop or defund obama care. harris? >> and what are democrats saying about this effort to link government funding with obama care, just in general? >> well, they say it's a cynical political gain republicans can't win. the president said yesterday that defunding his health care law simply won't happen. this, in spite of the fact, that a majority of the american people are opposed to obama care. >> i'm not surprised there's a lot of confusion. these guys have been running around the country demagoguing, scare mongering, on this issue. they're not afraid that it's going to be unsuccessful. they're afraid it's going to be successful. >> now the senate takes up this house bill this week, and will likely defeat it. leaving the next move up to house republicans with that clock ticking toward a government shutdown. harris? peter ducey takes a look from washington. peter? >> harris, the white house says they are open to the idea of a meeting between president obama and iran's new president hassan rowhani, if iran takes steps that prove to the world they aren't building a nuclear weapon. the white house national security adviser ben rhodes says the administration is open to this kind of diplomacy if it can advance american objectives but some experts are now warning that this president of iran won't be any different than the last. >> rowhani is bringing with him the p.t. barnum doctrine and that is there's a sucker born every minute and he's hoping there's one in the white house right now. >> so far president obama and iran's president rowhani have communicated by writing derts to each other, but before things advance any further, lawmakers here in d.c. want to make sure the safety of israel is a priority. >> we need to make our decisions and consultations with israel. it is, in fact, israel that they have threatened to wipe off the globe. >> meanwhile the former israeli ambassador to the u.n. is calling president huenny's rhetoric part of a charm offensive, and he is pleading with the white house to remain firm in their position that a nuclear armed iran is unacceptable. >> words and talk are very cheap in the middle east. and this iranian president is trying to create the impression that following ahmadinejad, mother teresa was elected to preside over iran. it hasn't. >> the white house says president obama is not scheduled to meet with president rowhani this week in new york. harris? >> harris, this is newly released cell phone video of the moment the attack began, and the situation in nairobi is still extremely tense now. 37 hours later. a kenyan government spokesman came out a short time ago to say most of the hostages have been released but the spokesman went on to say that the siege is not yet over and there is no news as to the fate of the remaining hostages. more than one source tonight is claiming the u.s. has sent fbi specialists to work with kenyan authorities and israeli special forces to bring an end to the siege at the mall. based on past precedent of fbi involvement in africa, sources say any u.s. involvement would be limited to members of an elite fbi hostage negotiation team. tonight, the fbi told fox news they cannot comment on whether they are or are not involved in kenya in this situation at this time. officials are also investigating reports that americans are among the gunmen. al shabaab, the al qaeda linked group which has claimed responsibility for the attack purportedly has also used its twitter account to say it will not negotiate. some sources say israeli special forces have entered the partly israeli-owned mall, and, indeed, some hours ago there was intermittent small arms fire, and a loud explosion but it's been quiet since. within addition to the 68 dead, nearly 200 reported to be injured, thousands of kenyans turned up at red cross centers today throughout the country to donate blood. this is the largest terrorist incident in kenya since the bombing of the u.s. embassy in nairobi in 1998, in which over 200 people died. today, the embassy warned its staff to shelter in place, and avoid demonstrations or large gatherings. sources say the u.s. is nervous about the possibility of further attacks on u.s. citizens in kenya. one note, it is hard to believe that the operation to end the siege, which the kenyan authorities say is under way, will not be completed without further bloodshed. sources say it will be unwise to end the siege until, with listening devices and infrared cameras, those wishing to end it know where every single terrorist and hostage is exactly in the mall. harris? >> you know, a couple of things from what you just said, paul. first of all, i can confirm for catherine herridge is reporting tonight that the fbi specialists are, in fact, working with the kenyan authorities there and investigating and in helping them in advisory roles there on the ground. they're also looking to see whether or not americans would have come from areas in america like minneapolis, and other places where we know that there are enhanced large somali populations that might have been a feeder for al shabaab. so you're absolutely correct in that. and fox news can confirm it. but you said something i had not heard. and that is this warning about other americans at that embassy. which was the last time they saw anything this bad was when our embassy was hit in nairobi in 1998. tell me a little bit more about what they're wanting americans to do tonight inside that country. >> they've basically told them to stay indoors, harris. they have posted a large notice right on the top of their website. the embassy website telling all staffers, because, of course, it's quite late there at the time. but they've been warning all staffers to use this strange expression, shelter in place, to stay indoors, and to stay away from any demonstrations or large gatherings. some sources i've been talking to say that they are extremely worried about the possibility of other sleeper cells of al shabaab being activated in the kenyan capital, and possible further attacks on u.s. and kenyan citizens in nairobi. >> all right. paul tinsley reporting live for us in south africa johannesburg tonight thank you very much. now i want to get a better idea of what that operation might look like from the inside from somebody who would know a former cia covert operations officer mike baker. he's also president of diligence llc a global intelligence and security firm. he joins us now by phone. mike you're with us? >> yes, i am. thank you. >> all right. i know you're following this. reports that this is a major assault by kenyan special forces, what does that mean? >> well, you have to hope for the best. because i hate to say this, but typically some of the operations like this don't end well, and you have to look at recent examples. the mumbai attacks that was done, you look at the algerian gas plant attack even going back to the moscow theater tend to be a lot of casualties among the hostages when you start talking about taking groups like this. they just don't care. they have nothing to lose. they're not interested in negotiating. and at the end of the day what they're looking for is the biggest media splash possible. >> well, we heard from very early on that they would not negotiate. we heard that reporter out of south africa say that they took to twitter to tell everybody that. a question about how the kenyan authorities are carrying this out with the help of the israelis, why particularly the >> well, in part because israeli special forces were on the ground already. and so there was proximity. and they've got a great deal of experience, unfortunately, in having to deal with operations. they tend to be very good at -- at dealing with these groups. not necessarily al shabaab, but in general, radical islam mind-set. and so, that is probably the proximity was number one point. and, you know, the kenyans are very proud. the military tends to be very good. and they've shown how good they are in recent work in somalia, which is one of the reasons why al shabaab has undertaken this operation. in part to get back at the kenyan military that's been so successful in fighting al shabaab in that war they've been waging against the government of somalia. >> tell me a little bit about what it's like to go in to a situation where you have terrorists hiding and choppers hiding, because what we're finding out is that people were going down to the parking lot and hiding underneath cars and now the terrorists know that the kenyan forces are on the roof, and helicopters and they're hiding along with wshs how do you protect the hostages and take out the bad guys? >> well, part of the problem has been trying to clear that large facility. westgate is a very large shopping center. >> four stories? >> yes. and so, so they've had to go through while this attack was under way and while it was developing into this longer-term hostage situation and try to clear as much of the center as possible. because you're absolutely right. what you can't have and part of the problem is trying to separate and identify and control the situation where you go in to try to take on the terrorists. the hostage takers. is trying to separate, you have to make split second decisions. i mean in terms of shoot, don't shoot. so they want to clear the scene as much as possible before that final assault takes place. the problem is the more time you give the hostage takers, the more time they have to secure their perimeters, secure their operations and make a determination as to how they're going to take on that last and final stance. >> and that makes a lot of sense. because what i'm reading is that from the very beginning of this assault on that mall by the kenyan forces now a few hours old, they said, this will end tonight. our forces will prevail. they know time is against them. before i let you go, mike, joining us by phone, mike baker now, former cia special ops giving us his perspective on this. we learned from paul 'tisly our reporter there in south africa who said you know, other americans are in harm's way. they're having people shelter in place inside our u.s. embassies. u.s. embassy in nairobi, kenya, has been hit before. protecting those people. do we have people on the ground in that country who can protect that embassy?
