>> yeah. >> one thing we want to be careful about is, you go into the police station and give your fing fingerprints, but with your iphone, you have to put your fingerprint on the phone in a certain way. you are testifying to police which if i thinker is the one that unlocks your phone. it's a little bit different than going into the police station and giving all your fingerprints. >> but the police have always had the ability to take fingerprints. it's an area we need for safety and i don't think we want law enforcement to suddenly feel like fingerprints are protected. and facial recognition will be on the phone in a couple years. >> then you have one thing after another. >> beyond the recognition of getting into these devices, the idea that this is my personal information. it's a phone. we shouldn't call them phones anymore because who is using them to make phone calls anymore. we have all the data, birth records, we have all sorts of things we keep on the personal devices. how can the police department just say, use your fingerprint, i want access to all that right now. >> they do say, over the summer, the supreme court said you must get a warrant to access data on the phone. but there are exceptions. and in this case, we are talking about a case where a man allegedly killed his girlfriend and they believe there's video on the phone that could provide them with enough evidence. so in cases where they think that evidence could be damaged, there are always exceptions. and that's kind of what we are seeing. the facts of this case, i don't think we know if there was a warrant, i don't know if eric knows, but the fact of the matter is you want law enforcement to always have the ability to catch a criminal. and that is the thing, that's the thing, we don't want to overwrite that. >> where does it stop? especially she was talking about facial recognition, you know, you use fingerprints to open your house and car, everything like that has happened. look at the police -- >> laws are far behind technology and will continue to be. great to see you both. let us know what you think about that. friends@foxnews.com. weigh in on that. for the first time, new secrets about the prince of camelot. how jfk almost derailed hillary clinton's career. and a kidnapped infant saved by a teen and her father by quick thinking of a cell phone. we'll have that story, next. sensitive bladder? >> good, how are you? >> cameron, i want to ask you about this. take us through exactly what happened. you saw this amber alert on your cell phone. what did the amber alert say to you? >> the amber alert said basically the descriptions of the car and a license plate number. >> and you looked up and realized that the car was right in front of you? >> yeah. the car was turning just around the corner. >> and what did you say to your dad? >> we both kind of looked at each other, noticed that it was the right car and right description. so we just got behind the car. >> and chad, how did you decide to get behind the car and follow it? what was your thought process? >> it was just automatic. once cameron said, yeah, i think that's the right license plate. we were in the lane forcing us to go straight and she was turning left. so we went up a half a block, whipped around and got right behind her, sped up and caught up to her. and that point cameron was on the phone talking to 911 and we verified it was the right vehicle. >> cameron, this was a real team effort between you and your dad. did you have any second thoughts as to what you should do? >> no, it was just kind of an automatic reaction. what the 911 operator was telling me was just basically to say what street we were on, what direction we were going, north or south, and just that's kind of automatic. >> and in the end, within, what was it, ten minutes of this amber alert being issued, they had the child back in custody. how did that make you feel and have you been able to speak to the father? i understand it was some sort of custody situation, the mom went over, she took the child, she had been ordered to stay away from the child and the father. how did it make you feel? were you able to speak with the family after this was resolved? >> i was just really happy the baby could be with his dad. and i haven't been able to see his dad but i would like to one day be able to do that. i know that would xave really impacted my family if that was us, so i'm just really happy that he can be with his dad. >> you made a huge impact on this family. and your quick thinking, chad, as well, thank you so much. were you able to speak with anyone? what did law enforcement have to say to you and your action? >> oh, at the end of the chase when the child was, when mason was secured by the police, we had one detective and another city police officer come over to give us a fist bump and some hugs and tell us that was awesome. it was pretty cool. and i have not spokesen to the dad yet but just thankful to do our part to help out mason. >> thank you for joining us and sharing your story. it definitely shows people to pay attention. thank you. >> absolutely. >> coming up, caught on camera. an elderly woman being attacked by a purse snatcher in broad daylight, but a veteran soldier was not about to let them get away. and remember this bikini shoot using military vehicles in the pentagon now knows who let it happen and they are in big trouble. stay with us, we'll be right back. king to your rheumatologit about a biologic... this is humira. this is humira helping to relieve my pain and protect my joints from further damage. this is humira giving me new perspective. doctors have been prescribing humira for ten years. humira works for many adults. it targets and helps to block a specific source of inflammation that contributes to ra symptoms. humira can lower your ability to fight infections, including tuberculosis. serious, sometimes fatal infections and cancers, including lymphoma, have happened, as have blood, liver, and nervous system problems, serious allergic reactions, and new or worsening heart failure. before treatment, get tested for tb. tell your doctor if you've been to areas where certain fungal infections are common, and if you've had tb, hepatitis b, are prone to infections, or have flu-like symptoms or sores. don't start humira if you have an infection. talk to your doctor and visit humira.com this is humira at work crest 3d white whitestrips vs. whitening trays. these trays feel a little loose. it's kind of hard to talk. the whitestrips really grip. i can't even move these. look at that. ugh. i feel like the gel is oozing out a little bit. i'm not sure how this is going to work. hmmmmm... crest supreme flexfit whitestrips grip securely around the curves of your teeth to safely whiten below the enamel surface for dramatic results that last up to 12 months. it says it whitens like a $500 professional treatment. oh, nice! that is awesome. crest 3d white whitestrips. the way to whiten. mr. clean's grandmother wpeople twice her size. and that strength inspired his liquid muscle cleaner. it lifts tough dirt so you do less scrubbing. and it's nozzle stops by itself so less is wasted. sure made grandma proud. mr. clean liquid muscle. and good morning. it is sunday, november 2nd. i'm heather childress in for anna kooiman who is running the marathon, if you can believe it. we are talking about the shift of balance in washington. a live report, straight ahead. and a marine jailed in a new mexico prison for seven months is free and back on u.s. soil. what is the president saying about this? after all, the president's policies don't seem to be favoring them lately. look at the youth unemployment among blacks, the highest in history right now. >> well, it's a difficult situation the democrats particularly in red states find themselves in. and with all the negativity out there, the only hope is to try to make a race about local issues or about the two candidates and not so-called nationalize the race because for a variety of factors the president's approval rating is very low, particularly in more republican states. and with general disgust about the negative ads, people throw up their hands and say, i don't like any of these and fall back on their affiliations. when you look at the races, more of them are red states so nationalizing them, making it about the president is not helpful in this place. >> but it is about the president, t.w., he acknowledged to al sharpton, yes, they may try to run away from me during the election and my policies, but push comes to shove, thatly vote with me on my policies. >> i call it the ebola effect. you see democratic candidates running from the president because most of them, you look at the races where we are competitive, like louisiana and iowa, we're there because the democrat senators have voted with the president 95% of the time, like senator hand drlandr. even the senator from new jersey said that the president doesn't need to come there because of the low voting record that the president has, the low numbers. and it's because they voted with him, not only have they supported his policies, but they support the incompetency of this democratic administration. i think that's why we're going to be successful on tuesday night. >> senator, is the president right that for this election season they will try to distance themselves from my record right now, they have to run locally and all politics are local, but when the dust settles from the election they will be back voting with me? >> you have to remember the senators are running this time. they will serve most of their terms after barack obama has left office. so by definition it's most of their term that is not about the president but ability where the country is going and where the policies are going for their constituents. each of the races will be individualized and the president weighs on democratic candidates in the more republican states and they need to make it about themselves versus their opponent and what they can do for their local states and deliver. if they can successfully do that and focus to get out the vote, many have a chance to pull the races out although they are very clearly close. >> evan bayh, t.w. shannon, thank you for being here. just getting over cancer. another blow to his health could keep him down a lot longer, this is jim kelly. and the for the first time, how j.f.k. jr. almost derailed hillary clinton's career. that's coming up next. i told my dentist about my sensitive teeth, he told me there's a whole new way to treat sensitivity. he suggested i try new crest sensi-stop strips. >> i have been on the kennedy story for 30 years but one explored the relationship between john and jackie. he was more of his mom's son. he wasn't a natural politician, unlike all the other candidates, even his father liked the process of meeting regular people. but john walked away feeling like a regular guy. he would have been perfect out there on the stump. but getting back to the relationship with his mom, it goes back to the days right after the assassination when she was shattered, people didn't see behind the scenes she was drinking and taking pills. she told her friend that she considered suicide and said i have enough sleeping pills but won't because of the children. and she leaned on this 3-year-old boy for emotional support. on the third anniversary of the assassination, she goes to pick him up at school and all the other kids are shouting, your father's dead, your father's dead, a cruel way the kids behave, and he reached up and took his mother's hand. at that moment she realized as much as she was worried about him, he was worried about her. that was the source of this incredible mother/son bond. >> as he grew older from that child that we see in that picture there, she was concerned about him and his many relationships. >> sure. well, i write about the torrent affair with madonna in 1988. and a lot of interesting details about that. jackie wasn't too thrilled because she was at the peak of her material girl/marilyn monroe period. but she head it known to him, she didn't want to kind step on his adventurous spirit. so she encouraged him to take risks, but she doesn't want him to flop. >> the book runs the gamete from political inply nations to hollywood thrown in there. thank you for joining us. >> thank you. coming up, the life of a young american cut short by a drunk driving illegal immigrant. today their loved ones are rallying together demanding tougher laws from washington. hear from one mother up next. and in just a few hours, anna runs the new york city marathon. hey, anna! how are you doing? >> oh! >> oh, i'm sorry. you were eating donuts in the studio and i had to do that, too? >> is it a croissant donut? >> no, it is sprinkles. do i have some on my face? i do. >> are you ready, anna? >> reporter: it's so cold and windy out here. everyone has on their heat blankets and gloves and mittens. i woke up this morning and had a lovely e-mail from the new york city road runners. and it says, important message regarding high winds. due to high winds, we are reducing the amount of directional signage at the staging areas. at the start, we'll have people directing you instead. so we're going to be facing strong head winds. rick warned us about this yesterday. they said wind gusts are up to 45 miles an hour. real feel temperatures are in the 20s. so it's certainly going to be a wild ride today, but there's going to be 130 vans keeping all the 50,000 runners going through the five boroughs of manhattan interchange. we'll run over three bridges and start here on staten island with the verazano bridge behind us. then we'll end in central park, which is amazing. i don't think i'll be winning the race with a 2:20 time expected and winning the $100,000 purse that is going to be offered. i don't think we are anywhere near that, but i'm just super excited to run for folds of honor, the military charity for -- major dan, come over here. he's giving me one of these. come on up, come on up. we set out to raise, what, $5,000. we are almost at $15,000. >> north of $15,000, amazing. >> amazing. we have decided to run together. actually, caroline, come over here, too. this is my cousin. come on down like this. we'll put you up here. i was a little nervous, heather, clayton, tucker, i was nervous and wanted to get my best time of 3:27. there's nowhere i'm going to get near there, but we are aimed for 3:55. >> that's the goal. >> you have done a bunch of half marathons, right? >> we grew up together and she's my little cousin. so i'm happy to have you here. anyway, back to the studio. >> the more important number is the amount of money you're raising for the wounded veterans who certainly appreciate it. a great job you're doing. >> reporter: i want to remind everyone to head to foxandfriends.com. also head to my facebook and twitter page and we'll blast out social media pictures, videos and fun stuff all morning long. >> did you get a proper night's sleep, anna? >> reporter: how nice is it to have daylight saving? we got the extra hour, so yeah, i'm feeling hydrated and good. i had a couple donuts. we're good. >> the breakfast of champions. >> we are rooting for you. every viewer is at radioing for you. you are in many people's prayers this morning. good luck. this dog may not be man's best friend anymore, but how he got his owner bubusted by the cops. that story is straight ahead. and the wife of a gop gubernatorial candidate takes her husband's opponent to task for his dirty campaign tactics. >> he used a rival safety program in a rural upstate county to make it sound like he could threat up safety of schoolchildren. how dare you. >> the candidate is rob astorino and his wife, they are up next. i've always loved exploring and looking for something better. that's the way i look at life. especially now that i live with a higher risk of stroke due to afib, a type of irregular heartbeat, not caused by a heart valve problem. i was taking warfarin, but wondered if i kept digging, could i come up with something better. my doctor told me about eliquis... for three important reasons. one, in a clinical trial, eliquis was proven to reduce the risk of stroke better than warfarin. two, eliquis had less major bleeding than warfarin. and three, unlike warfarin, there's no routine blood testing. don't stop taking eliquis unless your doctor tells you to, as stopping increases your risk of having a stroke. eliquis can cause serious and in rare cases fatal bleeding. don't take eliquis if you have an artificial heart valve or abnormal bleeding. while taking eliquis, you may bruise more easily and it may take longer than usual for any bleeding to stop. seek immediate medical care for sudden signs of bleeding, like unusual bruising. eliquis may increase your bleeding risk if you take certain medicines. tell your doctor about all planned medical or dental procedures. those three important reasons are why eliquis is a better find for me. ask your doctor today if eliquis is right for you. the girls and i need... a new activity. you can't be serious. you used an extra curricular gun program in a county to make it sound like rob would threaten safety of schoolchildren. how dare you? >> she is speaking out one of the gun safety ads painted astorina as an ultraconservative calling him dangerously wrong for the state and suggesting he wanted to give guns to children in schools. the two of them join us right now. thank you so much for joining us. >> thank you, tucker. >> i thought that was great. that was totally real. you looked right at the camera, are you serious? was that your response when you saw his ad? >> yeah. every time i turned the tv on, it was another ad about rob. so i felt like i had to speak out. >> so i should say, by the way, we have called the governor's office and asked him to come on the show for equal time and so far they have not gotten back to us. look, new york is a pretty liberal state, you're a republican, he's a democrat, rob ast to, are astorino believes in this and that, but giving guns to kids? >> sheila spoke out, she's a teacher, we're parents, our kids have to see this junk on tv. he's running the ads, he's trying to scare seniors, women, he called me a racist. when a desperate politician goes to the bottom of the deck and calls somebody a racist, it's because they are panicked. that's what is happening. he's seeing this slip through his hands because we are going to win on tuesday. he's thinking back to '94 when his father ran for re-election and his father was going up against somebody who nobody thought could win and all of a sudden new york spoke very loudly. >> so his suggestion is that somehow you favor giving firearms to children in schools. he's referring to a gun-safety training course in some upstate schools, is that correct? >> there's a rural upstate class that parents voted for, they have done this for a long time. and somebody asked me, are you okay with that? i said, yeah, if the school board and the parents want that, that's fine. it's been there forever, but taking that to say i'm going to put a gun in every kid's hands to go into school is nonsense. >> sheila, you're a teacher and mom of three, what is it like when you go to your school, your neighborhood, your neighbors are seeing all this stuff on television, what is it like? >> well, i just talk about how well rob has done in westchester and how well he'll do for the state. everyone seems really supportive in our neighborhood. >> have you gotten a good response to the governor? >> i have, yeah. that's why i'm here. >> she's the star everywhere we go. in the last couple of days, it's tell sheila she did great! >> do you think people respond to this when negative campaigning is counter productive? >> definitely. there's a line you draw. he's in the gutter. it's so beyond the tale of trying to scare everyone, seniors with the soup ad, even "the new york times" said was over the top and misleading. saying we are going to cut everyone's medicaid and medicare, which is nonsense. the gun stuff and the racist stuff, he hasn't talked at all about a second term because he's under federal investigation for corruption and raised taxes. we have one of the worst economies in america in new york and he's trying to defend the indefensible and won't debate me. so we've got a great plan to cut taxes and lift the economy in new york. and if republicans and independents and reformed democrats come out to vote on tuesday, we're going to win. >> it seems like half the state is moving to florida. >> they are. >> we did ask and will continue to ask the governor's office to come on. we would love to talk to the governor to give him equal time. thank you for joining us. >> thank you. a woman with a terminal illness made headlines for planning her own suicide. she changed her mind now, but was her plan the right way to deal with her terminal illness? >> those are the winnable seats, i would say. i don't know, they seem balanced on the ninth edge, but the enthusiasm seems to be for republicans. that's one of the reasons you have not seen the president out on the campaign trail much. this election is about him, he's very unpopular at this moment, but he did make his first appearance for a senate democrat yesterday in detroit of all cities. here's what he said. >> a tight race there. >> if you're going to strengthen the 21st century economy, you've got to be in the 21st century. you've got to understand that women now make up an increasing part of the workforce. they are bringing home more of the bacon. they need to be paid fairly and treated fairly. and just like gary talked about, we've got to make sure women control their own health care choices, not their boss or insurer and certainly not any politician. >> not exactly a republican stronghold going to cities and town where is the clear winner is gary peters with 47% in a recent poll over terri lynn land. it doesn't seem that it will swing to the republican side. >> how selfless is this guy? detroit has not had more liberal ideas imposed on itself. those people who have jobbs in detroit are women. they are literally shutting off water in detroit. if i am a politician and standing in the hall of liberalism collapsing around me, don't i ask, will those ideas work for me? >> 8,000 homes are auctioned off. >> 8,000 homes. you can buy one home for $500 if you want to. >> i'm rooting for the city, but just saying don't you think that people who thought up the ideas have destroyed detroit ever wake up in the middle of the night and think, maybe my ideas don't work as well? >> he stayed away from the economic issues and hits on those that the democrats seem to be following with his lead and hitting across the country the tight races with the war on women, back to racism. the things they fall back on, they did it in the last election and it seems like they are doing it this time around as well. will it work? >> it worked last night but two days are left until we find out. >> we'll find out and keep talking about it in our next couple hours. first, the headlines for you. five people dead after a fire tore through an apartment building near the university of southern maine saturday morning. it happened after a halloween party the night before. a cop says that most if not all the residents were students. but so far there's no indication students were killed. one victim is in the hospital with critical injuries. it is maine's deadliest fire in 30 years. the investigation ongoing. also overnight for you, a brand new disney world attraction going up in flames with passengers on board. look at that, there were people on board that at the time. emergency crews rushing to the seven dwarfs line train ride after it caught fire. the passengers on board were able to safely exit the ride. the blaze was quickly extinguished and ash from nearby fireworks is said to have ignited decorative materials on the ride. and the investigation into the virgin galactic spaceship two could take up to a year. the pilot is up and talking this morning, that's good news, he parachuted to safety as the spacecraft plummeted to earth. his co-pilot was not as lucky. michael alsbury was killed. safety officials say virgin galactic ignored safety issues. and just as the mother of a jockey thinks she couldn't be prouder, this happened. >> i wanted to tell you in person that my retirement starts on sunday and joe and i are starting a family. >> they are getting a big hug. rosie is the first female rider to win. she's going out with $2 million. that's some baby shower. good for her. >> that's so great. >> you have been fired up on facebook, twitter and e-mail this morning about this. and we'll read more here on my computer in a moment. chris rock last night on "saturday night live," did you see it? joining us now to discuss is the host of "fox news sunday," chris wallace. thank you for coming on this morning. >> good to be with you guys. >> at lot of us were surprised by "the des moines register" poll that showed joni ernst up over bruce braley. >> it's the reliable poll. it shows two interesting things, ernst has a seven-point lead and is over 50%. so if she can hold on to that, she is the next senator from iowa. interestingly enough n the last 24 hours, harry reid who is the senate majority leader had a conference call and said, iowa is going to be a bellweather and if democrats can hold on to iowa, they will be fine, but if joni ernst wins it, they will take the majority. if he's right, he will no longer be the majority leader but the senate minority leader. >> you were mentioning this earlier with other tight races we are following, specifically north carolina, kansas, do you think this race in what has happened in iowa, that those races in the other one or two points we have seen will follow suit and the lead will be extended? >> you don't know. not necessarily, but it is interesting, historically when you've got a bunch of toss-up races up one or two points, they all tend to break the same way. it is not 50/50 as you would think mathematically would be the case, but politically because the same trends end up affecting who decides who they are going to vote for, 75% of the races break one way. in 2012 they broke for barack obama in his race against mitt romney. if iowa is a bellweather, maybe it will be a great race for republicans on tuesday. >> what is coming up this sunday? >> i think that is an underpinning issue. you are right to also hesitate to even talk about somebody else's decision like this publicly. the reason why i'm doing it is because she has decided that she wants to do this very publicly and she wants to team up with organizations, activist organizations that are pushing to allow doctors to be involved in somebody's premature death. doctors. and that is my big concern here. a doctor not living up to the hippocratic oath of protecting life and defending life and healing, but rather saying, if you're sad, if you're depressed and don't feel like continuing to live, guess what?
