"fox & friends" begins right now. hey, good sunday morning, everyone. welcome in to "fox & friends." get your coffee and get out of bed. >> do you have a nighttime ritual? >> i get my outfit ready for the day before. >> every night? >> not the night before. >> i go into tucker's room, he likes to hang -- >> it's unusual and elaborate. let me put it that way. >> how about you? >> i just read a little bit. my wife has a 20 minute procedure. can you please just get into bed. we'll have more on that. >> all right. we're going to get right to your sunday morning head lines. finally the man hunt we've been telling you about is over. two convicted killers who escaped the florida prison on bogus paperwork are back behind wars. charles walker and joseph jenkins were found hiding out in a panama city hotel room. they gave up without resistance. an interview with one of their associates helped pinpoint their location. the two fugitives were serving life sentences but duped the system with forged signatures on a document from judge perry. and a 29-year-old man is under arrest this morning after trying to carry a bag full of weapons on to an airplane at one of the nation's busiest airports. cops at j.f.k. airport found more than a dozen knives, cigarette lighters and matches inside timothy sciago's carry on. it was unclear whether he was trug trying to bring this arsenal on board. the united states is trying to quietly bring in aid to pakistan. top officials say ties have improved while others, including former chairman of the joint chiefs, admiral mike mullen, are still questioning pakistan's commitment to counter terrorism. guys, ready for the world series? the world series match-up is set. >> and now they've won the pennant. >> wow. there's nothing like it in all of sports. the boston red sox coming from behind to beat the detroit tigers 5-2 last night winning the al pennant last night. shane victorino, grand slam over the monster the bottom of the seventh. former philadelphia philly breaking some hearts. boston's third trip to the world series in ten seasons. they will face the st. louis cardinals, game one wednesday night. the october classic at fenway v classiest guys. >> we should talk about this this morning because now that we've seen the rollout of obama care, congress wants some answers as to what exactly has unfolded and gone wrong with the way in which obama care, health.gov has been implemented. we know that kathleen sebelius had been asked to testify before a congressional hearing. she is now not going to do that. >> no, she is going the night before to a gala. this is a scheduled conflict the white house says. she'll be in boston, massachusetts. they're refusing to let lower level officials available. >> can they do that? >> so rocky? >> can they do that? >> he why, thyes, they can do t >> if you're asking a constitutional law question? you may get a different answer. >> she did not ignoring the request of john sturn stewart. we saw her on "the daily she has to go to a gala event wednesday evening, wine and cheese. she can't go to congress to testify about her job, the very thing she's been focused on for the past few years. she can't go in front of congress. >> here's what we're hearing from a spokesperson. we are in close communication with the committee and have expressed our desire to be responsive to their request. meanwhile, we're learning that the administration is saying some 476,000 obama care applications have been filed. one of the biggest problems is that people simply can't log on. let's hear from ann coulter who was on judge jenny's show last night. >> looking at the numbers, i think maybe they were pulling our legs on 40 million uninsured unless they were including all of the illegal aliens coming in through amnesty and their relatives. 36,000 have signed up. we're about 25% through the signup. i think you have to understand that obama care designed to fail is doing a great job so far so they can move to single payer. >> i'm not surprised at all. reorganizing america's entire health care system to help a relatively tiny number of people who didn't have health care but who wanted it. most people had helts care they liked and in fact the number shows pretty good health care. >> that number, that 476,000, that's the number of people that have applied, not enrolled. we don't know the number of people that have enrolled. charles krauthammer earlier friday said that's because they don't know how many because there are issues with the website or they're embarrassed and don't want to say. >> another big story that didn't get headlines because of the obama care, benghazi is not on the page one of any newspaper, now we know the father of one of the victims from the benghazi attack had written a letter to president obama with a number of questions he wanted answered from the administration. charles woods, he's the father of ty woods, one of the special forces men who was killed in bengha benghazi. he has gotten a response from president obama. take a listen. >> the two most important questions he did not answer. >> and what were those questions? >> first of all would be who gave the order to stand down? now i wanted to make sure that there was an order to stand down so i actually contacted the reporter that initially reported that, and that reporter told me that they personally talked with a friend of ty who was on the ground with him and there were three orders to stand down. now that not only probably would have saved the life of our ambassador had there not been that delay three times, plus the fact if ty was ordered to stand down and told that -- not to -- that there wouldn't be any supporting rescue for the ambassador, there sure would not be any rescue for him. >> so mr. woods wants to get answers how his son died, why his son died, and he has to get them from a reporter. the u.s. government sent these people to libya, we don't know why we were there, he was there serving our interests, he gets killed and the u.s. government doesn't bother to tell the parents what happened. he has to go to a journalist. that's over the top. >> president obama's response was, look, if my family was in harm's way, we would have to respond the same way. we didn't have enough military strength to get there in times. it appears the house investigative panel may confirm that the administration military didn't have the resources to get there. however, that doesn't answer why there weren't military placed in that region in the first place. they want more answers from leon panetta. they're asking the defense secretary to come back in front of congress to get more answer. why was it so chaotic? why were they scattered in the wind. >> mr. wood spoke to huckabee. really, that's what you would have done if your family was in harm's way? if that was me in your position, i would not have left my soon out there to die. first, rick is standsing by over in the weather center. hey, guys. >> do you have your winter coats? >> so people are saying that this would be a stretch that, yes, their parents may have had a tough go at it with the kids or that the apple doesn't fall far from the tree, but can you prosecute and charge a parent for being a bad parent? >> well, yes, you can, and absolutely understand some circumstances you should. but that's not to say that erchblt a child does something online a parent should be responsible. let's face it, even the best parents can't control their child's behavior on all occasions and some children took out to be bad seeds despite bad parenting. however, we have laws that make parents responsible for the actions of the children. truancy laws, for example, where the parents are head lible for their child's going to school. parenting is more than just being the donor of genetic material. it involves supervising your children. parents can be held responsible for child neglect when they don't parent. it's not that much different to say you're responsible for the safety of your child and you're responsible for the safety of other people when you know or were you not grossly negligent would know that your child is a risk to others. in this case, that's a good example of where parents should be looked at. they knew their child was bullying. the school had already taken action. the victim had to be moved to another school. and then the bullying goes on for a year? we saw that the mother of one of these alleged cyber bullies was charged in an unrelated case for essentially beating the stuffing out of two other kids and cursing at them. so what type of evidence would be taken into account? >> well, the kind of evidence that you would need is evidence that they did not do their parenting, that they were not supervising their child or that they were unnoticed that the child has been at risk or they should have been unnoticed that the child was creating a risk. we have laws involving children with cars and guns. wa we're talking about here is writing a law that says, you're a parent just like truancy laws. you're a parent, you have an obligation to get your child to school, make sure they attend school. you have an obligation to make sure your child is is not online bullying another child, encouraging them to kill themselves for a year. that is clearly stalking. under florida law, that's aggravated stalking. if you're a parent and you don't know this is going on, you really should or you're not doing anything to supervisor your child's online behavior and now it's resulted in a death. >> judge alex, thank you so much for your time today. point your sunday. >> 18 minutes after the hour now. coming up "fox and friends"" that guy in the crane escaped without a bruise when this building comes crashing down. the whole thing caught on camera, we'll show you. and if you have a kid, you know about these bracelets, right?
