>> first of all would be who gave the order to stand down? now i wanted to make sure that there was an order to stand down so i actually contacted the reporter that initially reported that, and that reporter told me that they personally talked with a friend of ty who was on the ground with him and there were three orders to stand down. now that not only probably would have saved the life of our ambassador had there not been that delay three times, plus the fact if ty was ordered to stand down and told that -- not to -- that there wouldn't be any supporting rescue for the ambassador, there sure would not be any rescue for him. >> so mr. woods wants to get answers how his son died, why his son died, and he has to get them from a reporter. the u.s. government sent these people to libya, we don't know why we were there, he was there serving our interests, he gets killed and the u.s. government doesn't bother to tell the parents what happened. he has to go to a journalist. that's over the top. >> president obama's response was, look, if my family was in harm's way, we would have to respond the same way. we didn't have enough military strength to get there in times. it appears the house investigative panel may confirm that the administration military didn't have the resources to get there. however, that doesn't answer why there weren't military placed in that region in the first place. they want more answers from leon panetta. they're asking the defense secretary to come back in front of congress to get more answer. why was it so chaotic? what has changed that we're giving them $1.6 billion? >> pakistan created and sustained the taliban going back more than 15 years. they hate us. on the other hand, pakistan has a lot of nuclear weapons. it's one of the most volatile track records. i hope every one of these dollars goes to securing these nuclear weapons. instead, a lot of this was humanitarian. do we get a single thing as americans? probably not. >> especially when we were hitting 17 trillion dollars now. unbelievable. >> you look at the countries where we're giving more money. afghanistan, $15 billion. $15 billion. israel, $3.1 billion. pakistan at 2 point poip $8 billion. that's an estimate. iraq, over $2 billion. egypt, 1.6. you look at those numbers and you go, where does that get us? >> that's the point. i don't think anybody is against foreign aid if we get something in return. the last ten years there are a lot of countries and the population still hates us. the government still acts against our interest. what is the point? these dollars ought to be targeted in a way that serves our interests. >> great point. back in the '70s we had a choice. which country became the world's largest democracy? india. which company has aided and abetted terrorists for the past ten years? >> well, i was amazelated to fi out they were captured last night. that nightmare is over. now we begin to put measures in place to make sure this never happens again. >> is this a florida thing or a united states thing? it seems like it's on criminals to sign the forms and hand them over. that doesn't seem right. >> well, what happened in this particular case, someone came to the clerk of the court's office, which is a separate constitutional office, and they filed these documents which was a notion correct an illegal sentence. also at the same time, which is somewhat unusual, an order which granted the motion. the clerk took those documents, processed those documents and transmitted those documents to the florida department of corrections who got the documents acted upon them. >> by registering -- a warrant is issued for their arrest. we know the legislative process can take a long time. is this likely to happen again? can other criminals watch the news and pay attention to what these guys did and do it themselves? >> they can attempt to do it. i doubt very seriously if this will happen again. number one, the department of corrections will be calling to verify that the documents are, in fact, awe thuthentic when yok about early release of inmates. we have put measures in place to make sure the documentthey are department of corrections are in fact verified that they are in fact the real mccoy before they get to the department of corrections so you're going to have two layers. >> that's good. good news. before i let you go, they forged your signature. did it look like your signature? was there an armed guard protecting you? did they do anything to keep you safe or was the onus totally on you to keep yourself safe? >> there is no armed guard, no drawer system to deal with customers after a certain hour, no glass. the counter is open only on one end so, i mean, realistically, yeah, it's fine for them to say, don't defend yourself. don't do anything, give them whatever they want except in a situation where you feel your life is threatened. >> would you go back and change your actions at all? why, thank you, rick. some updates of course this morning on benghazi. something we haven't been talking about. i'm sure the obama administration has been pleased about that given the government shutdown talk and of course what has been going on with obama care. we haven't been talking about benghazi. now there's an update. president obama has responded to a letter from the father of the victim of the benghazi attacks. he wants questions answered. i don't know that the father necessarily got his questions answered. >> no, he didn't. not according to an interview he did with governor huckabee. watch this. >> this is a father-to-father personal question from my heart. now i don't know about him but i know myself, i would not have checked out for seven hours as the secretary of defense says the president did and not even worry about it. i could not around would not ha checked out and gone to sleep until i knew every effort was rescued. for three hours ty's body was on the tarmac. not only was it not sent to rescue but not pick up his body. when it says, we didn't have time to respond. how do you know you didn't have time to respond? this was almost an eight hour battle. >> that grieving and outraged father says the president tried to offer reassurance, i did everything in my power and charles wood says, absolutely i would not have left my son out there to die as you and your administration essentially did and he's just heart broken by all of it. >> he's also confused because he has a number of questions, such as why weren't planes scrambled to come to the assistance of american forces in benghazi and libya and he can't get an answer. by the way, the only answers he's received so far are from journalists. he's had to appeal to reporters. the u.s. government owes this man, owes all of us, but especially a father of one of the men who gave his life for the united states some kind of answer, adequate answer and they haven't bothered to give him one. >> our own james rosen recording this morning. we haven't heard this from the administration, he heard that they may have come to the same conclusions that the obama administration did about the military response, that it was too far and it wouldn't have helped to get the military there in time. they couldn't have done it. however, that still doesn't answer the question as to why the military wasn't anywhere near this hot zone in the first place. that still hasn't been answered. >> what were they doing there in the first place? >> well, yeah, unless they subpoena her, but it is a curious decision, there's no question about it. obviously -- and you can already see it, even in the mainstream media, that now that the government is no longer shut down there's a lot more focus. i saw the other night nbc nightly news led with the story about the problems with the rollout of obama care. and, you know, i think there's growing concern about this. and so the idea that the secretary who's in charge of it, secretary sebelius, would not testify, this is the first time that a major congressional committee, the house commerce committee, is -- you know, is calling for an investigation, a hearing. she's not going to testify. and what makes it even worse is she said scheduling conflicts, but the night before she has time to go up to boston for a gala for the kennedy library. i think it's wonderful that she's going there to celebrate president kennedy but i don't know why she couldn't make it back to washington for this hearing. interestingly enough, there's a story out that president obama met with his staff and is quite concerned and understandably concerned about the rollout and will have an event monday on which he will supposedly own up to all of the problems that obama care has had in these first couple of weeks. >> chris, earlier, last week you heard a number of high profile democrats say out loud that very thing, boy, this has been a rocky launch and it's embarrassing. has that grown louder, that chorus, or has it stopped? >> no, it's grown louder. it's like the old line about what do you believe, me or your lying eyes? all you have to do is hear all of the horror stories. it's not just fox which has been on this since the beginning, now the mainstream media has begun to catch onto the story and talk about all of the problems. interestingly enough, the administration over the weekend has put out a story that says 476,000 people so far have filed applications on either the federal or state websites, but i still won't say how many enrolled. the application process is complicated. you have to give all kinds of information, then they have to rule that you're actually eligible and then you enroll. yes, application is good. that's at least a number. 476,000. we don't know how many people have enrolled. the government is counting on 7 million enrolling in this first year. >> quickly, chris, to stay with health care for a second. is there any chatter that there will be an extension of the deadline before people start getting fines because, you know, in order to sign up you have to be able to sign up and people haven't been able to do so. >> not so far. there are republicans calling for it. i think democrats are going to resist it and president obama. remember, you take out -- there are various things and some would argue that he's delayed too many things already or not enough. you take away the individual mandates, that's the only way insurance companies can do all the things obama care can do, like take people with pre-existing conditions, they'll get people to pay their premiums. that's money that can go to others. you take away the individual mandate, obama care falls away. >> who is coming up on your show? what is to be done about our spending and who at the federal government should be fired? who better to answer than pollster frank luntz. you sat down with your focus group. what did they say? >> well, all it took was about 3:00, tucker, before they got so angry before it was impossible for me to separate them. the bitterness is deep and it's problematic. i want to focus first on the number one issue that makes americans most angry, and that is wasteful washington spending. let's take a look at what real americans had to say. >> the country spends a small fortune, in fact a large fortune, supporting other countries around the world and we can't take care of our business at home. >> i believe anybody who came up with the idea, let's not pay for things we already bought. you can't -- >> nobody had that idea. i don't understand what you're trying to do. >> the debt ceiling is about things we've already bought and you want to not pay for them. try not paying for your credit card bill and see what happens. >> whoa. >> inzblens out of control. it's intense. those are republicans and democrats. there's an even group between them. everyone thinks that interethero much wasteful spending. >> when was the last time you saw people this wound up. >> 2010 with obama care, angry with the president and not happy with congress. the next clip is how americans feel about their elected leaders. everyone in washington ought to pay attention. this is going to be your wake-up call. let's take a look. >> give me a word or phrase to describe congress. >> dysfunctional, imprick particular call, spoiled, out of control. >> jordan? "psycho" is a classic. janet lee dies in the first 45 minutes in that classic shower scene which took seven days to shoot. it's only three minutes long and is over 50 cuts in the scene. hitchcock had to build a special shower head to get that famous shot so the water didn't drip down on the lens inside scene. the blood was chocolate syrup and the sound of the knife stabbing was a sound of a knife stab ago melon. it was great what he did back in the day. a must-see before halloween. >> number two on your list, stephen king himself than the been a fan of this film, but others are huge fans of this film. >> "the shining" is an absolute master pete piece. i prefer 2001 when it comes to the stanley cubric filmography. coming down that hallway and seeing those two girls still haunts me to this day. the famous baseball scene in that film was shot 127 times. we have a cool clip here of the famous jack nicholson scene. check this out. ♪ >> here's johnny. >> oh, man. >> so classic. so classic. and that movie still holds up today. i honestly think that is one of the scariest movies ever made. check that out before halloween, for sure. >> next up, we have "scream" this was one of in my favorites. i snuck into the theater to see this one because i was being naughty. but "scream," what are your thoughts on it? >> would you rather go to a party or be grilled by congress? >> ladies, it's a symbol of your love, so why would you ditch your wedding ring to get a job? it's more common than you think. your e-mail, tweets on that one, straight ahead. fox & friends" hour four starts right now. good morning. so nice to see you here at "fox & friends." finally, the statewide manhunt for two convicted killers is over. charles walker and joseph jenkys are back in prison this morning. the two gave up without resistance. an interview with one of their associates helped pinpoint their location. the two fugitives were serving life sentences, but duped the system with documents faking their release. >> i doubt very seriously that this will happen again. number one, the department of corrections will be calling to verify that the documents are, in fact, authentic. we are 3 putting measures in place in this circuit to make sure that the documents before they are transmitted to the department of corrections are, in fact, verified. >> more details are expected to be released at a police news conference scheduled for about a half hour from 234now. tragedy in florida as a parachutist falls to his death at a florida air show. authorities aren't sure whether he started his jump or fell out of the plane. hundreds of onlookers at the air show and in surrounding neighborhoods watched the accident. >> instantly, i thought about him just being out maybe on some adventure and how shocking this is going to be to his family. one minute, it was a happy moment, to what went wrong. >> the faa and national transportation safety board has taken over the investigation. and we are learning more about the twitter threats made against senator ted cruz. the fbi now confirms they are helping capitol police with the investigation. authorities have reportedly interviewed the person responsible for posing the threats along with a home address for cruz. now they are keeping an eye out for anyone who might try to take action base odd that information. officials have not said if there is a credible threat against the senator. a purse snatcher in texas is no match for an 8-year-old boy. this is amazing video. take a look. surveillance video shows a man opening up a woman's car door to take the purse, but the woman anticipates two children were inside. the 8-year-old boy tried to fight him off. the boy was able to get his mom's wallet out of the purse before the man took off and he even tried running after that thief. wow. those are your headlines. incredible. >> oh, yeah. we have a counterbalance with the bad news and the human world with what's going on in nature. >> that depends on your point of view. >> we can get out our winter coats now. a lot of poem love that. >> i'm actually kind of excited. we deserve it after a long, hot summer. >> it was that hot of a summer for a lot of people. let's begin. we're going to see demps well below average. it has been a spectacular month, month and a half across the eastern seaboard. this is the cold air that's on its way waking up across parts of texas. 47 across parts of san antonio. this is a front that moves through. everything behind it has some cooler air, but there's some snow here across parts of the northern plains. a couple of systems will continue to pull through here, bringing the next three to four days some scattered snow showers. but the western u.s., you're looking absolutely fine and you'll continue to do so. the snow track will remain to the north. as it does, it's going bring in much cooler air. the coldest air is here by tuesday. by wednesday evening, it gets in towards the eastern seaboard and stretches farther towards the south into thursday and friday. those temps are going to be around 10 to 15 degrees below where you would normally be this time of year. tomorrow and tuesday across the eastern, it's going to be nice. kansas city today, 71 degrees. you're going to drop quite a bit tomorrow. there you go. cold coming. but it's not horrible. it's not horrible. 50s. we'll take it. >> ann coulter is here. do you mind the cold? >> well, it's very surprising and then you wonder, well, why don't they subpoena her? and i suspect they are afraid that the subpoena would not be enforced. you would need the police to go arrest her if she refuses to respond to a subpoena. it sdut show you a government completely out of control where you can't have enforcement of a subpoena because otherwise i don't know why they don't subpoena here. >> here is the hhs statement on this. quote, we're in close communication with the committee, that is the commerce committee, and essential expressexpres expressed our desire to be responsive to their request. now, you've been around a long time. what does that mean? >> no, i think there are upsides to obama care. they caught those two fugitives in florida because they were trying to sign up for obama care. they were sitting on theng -- w have them. we'll be there in about an hour, but they're still on the computer. >> and it's wild, too, that the "wall street journal" is reporting low level officials aren't going to be available to talk about this. brit hume went on the record and said where is the accountability from the obama administration? >> normally when something goes terribly wrong inside a department, the buck stops where? it stops at the top according to the old tradition. presumably, there would be consequences. but as i say, that's an old custom. you see it in a place like japan, but you don't see it here. you don't see it in this country. >> so this is the president's signature program here. what kind of damage control are we going to be seeing? >> well, luckily, democrats have the media. i do think it's worse now, but it wasn't -- you know, there wasn't a lot of responsibility taking during the clinton administration. there was the greatest murder of american civilians by the u.s. government at waco. and remember, janet reno went around giving speeches to get standing ovations by announce, i'm taking full responsibility. what did that consistent of other than those words coming from her mouth so she could get a standing ovation. and i think what this shows is, meanwhile, after abu ghraib, remember rumsfeld offered his resignation. so you get plenty of responsibility from republican administrations, none from democrats. and i think it's, once again, a problem of a bias mainstream media. >> abu ghraib, 20 years ago, all those children killed, what does this mean? never trust a liberal over three dash especially a republican? >> it's kind of a joke reference to remember the hippies had the -- never trust a liberal over on 3. joshua did not but i asked him if he liked the title, anyway, and he liked it so i stayed with it. especially republicans. i wanted a particularly good column comparing attorney generals. remember they were hysterical about alberto gonzalez? and i wasn't a big fan of his, but i went through number of civilians killed by this attorney general compared to other attorney generals. number of innocent boys, number of innocent men sent to prison. janet reno provided over one of the -- remember the child mow le molestatition case. there were hysterical soccer moms putting four people in prison not only for crimes they didn't commit, but for crimes that never happened. janet reno did that and they have the you a das toy to complain about gonzalez? >> so people are saying that this would be a stretch that, yes, their parents may have had a tough go at it with the kids or that the apple doesn't fall far from the tree, but can you prosecute and charge a parent for being a bad parent? >> well, yes, you can, and absolutely understand some circumstances you should. but that's not to say that erchblt a child does something online a parent should be responsible. let's face it, even the best parents can't control their child's behavior on all occasions and some children took out to be bad seeds despite bad parenting. however, we have laws that make parents responsible for the actions of the children. truancy laws, for example, where the parents are head lible for their child's going to school. parenting is more than just being the donor of genetic material. it involves supervising your children. parents can be held responsible for child neglect when they don't parent. it's not that much different to say you're responsible for the safety of your child and you're responsible for the safety of other people when you know or were you not grossly negligent would know that your child is a risk to others. in this case, that's a good example of where parents should be looked at. they knew their child was bullying. the school had already taken action. the victim had to be moved to another school. and then the bullying goes on for a year? for a year you don't know what your child is doing online? what if your child was talking to a predator for a year? >> you're saying you would have to prove a failure to act and then there are laws on the books that would allow these parents to potentially be prosecuted or not? >> i'm not sure that the laws that are on the books right now are really intended for this, but they certainly could be written. my poirnt was that there is press debt. there is a legitimate state interest in preventing bullying and in holding parents responsible for something like chronic bullying. not something that just happens occasionally, because as i said, parents can't control every act of their child. but in a case like this, you certainly could write a law that is constitutional and that is geared towards a situation where parents totally abdicate their responsibility as parents and let a child run amuck. >> and what type of evidence would be taken into account where the parents would potentially be prosecuted? we saw that the mother of one of these alleged cyber bullies was charged in an unrelated case for essentially beating the stuffing out of two other kids and cursing at them. so what type of evidence would be taken into account? >> well, the kind of evidence that you would need is evidence that they did not do their parenting, that they were not supervising their child or that they were unnoticed that the child has been at risk or they should have been unnoticed that the child was creating a risk. we have laws involving children with cars and guns. wa we're talking about here is writing a law that says, you're a parent just like truancy laws. you're a parent, you have an obligation to get your child to school, make sure they attend school. you have an obligation to make sure your child is is not online bullying another child, encouraging them to kill themselves for a year. that is clearly stalking. under florida law, that's aggravated stalking. if you're a parent and you don't know this is going on, you really should or you're not doing anything to supervisor your child's online behavior and now it's resulted in a death. >> judge alex, thank you so much for your time today. point your sunday. >> 18 minutes after the hour now. coming up "fox and friends"" that guy in the crane escaped without a bruise when this building comes crashing down. the whole thing caught on camera, we'll show you. and if you have a kid, you know about these bracelets, right? >> it's absolutely ridiculous. i hope the educators are watching the show because there is no reason to ban this. these children, they're sitting here, using their imagination, their creativity. their math skills. they're doing on something, sharing one-on-one. they're using so many skills that they should be using in school and maybe the school should put this into the curricul curriculum. >> it reminds me of when i was goig up we did the bracelets with the broid thread. here is what the principal says. the children are playing with the bracelets during class without permission from teachers. they are playing with them at recess and it is causing conflict between xhirn. therefore, starting immediately, your children are no longer allowed to bring any rainbow loom bracelets or kids to the school. is the principal of this school and the other school, do they have a point there? >> so here's what i think. i think if they feel that in the classroom -- every classroom is different. and if they feel that in the classroom that it's taking away or distracting, maybe the teacher should set a reminder and say, you know wa, guys? today i don't want you to talk about your bracelets during school. if they are, she can go over quietly and remove the children and say, you know what? now is not the time. i don't think to ban them is the way to go. i think the way to go is to talk to them at the beginning of the class. >> but kids are learn ago valuable lesson about authority, aren't they? the complaint is they're doing this without permission. it's a totally you a authoritarian response. i have three girls and all of them make these bracelets. but are there tom toms in the night that we don't hear? >> i thank you they were totally classless and inappropriate. in the history of the national football league, i have never known an owner to shout out on his quarterback or any player he had. peyton manning may be the best football player that's ever played. certainly considered one of the greatest quarterbacks to play. while they were at indianapolis, they went to the playoffs 11 years. the year he was hurt, they finished last. they won two games. he's a classy guy. the whole family's classy, and this irsay guy, this is not his first rodeo. he goes and called peyton out and said that we've moved to a new model. we don't miss peyton manning. >> what's the new model?
