On the one hand, yes, no evidence of collusion. On the other hand please leave the room i want to have a private discussion to maybe push things in a certain direction. What did he do with those memos . What actually took place with those memos . Did he walk in his office and throw them in the drawer . Clayton thats the question. Memo to dear diary. We know what came up in the desk drawer because Susan Collins asked that very question document whom did he give it outside of the department of justice. This friend that he showed it to. I didnt do it myself for a variety of reasons but i asked him to because i thought that might prompt the appointment of a special counsel. I asked a close friend of mine to do it. Who was that . A good friend of mine who is a professor at columbia law school. Pete it doesnt make sense. Have your friend leak it out. Show what is a Political Animal sort of james comey really is i didnt want to do it myself. I had him do it. He is the one trying to find leakers. Often did he leak and what else did he leak . Why did he take memos only with visits with President Trump i thought he might be a liar. He was asked bylor let that lynch to not call the clinton investigation an investigation no memo there. Remember he said at the beginning of that statement that there was just one issue, that he couldnt talk about openly. Something that concerned him greatly. Many of them felt there was enough to take it to the attorney general for an indictment. So, theres going to be a lot of questions here as to, one, why did she ask former director comey to call it a matter and why in the end did director comey decide not to go forward with that you know, to the attorney general . And in the end say well, there was no intent when that really isnt the law. I think there is a lot of questions on everybodys side and comey revealed that. Under oath, in front of the committee, he said things which we know to be factually inaccurate not just in tis testimony this week but when he was the director of the fbi, he has had to come back and recant staples that he has made and make misstatements because jim comey is a liar. When you are under oath, you should be very, very careful about what you say and we learned that this week when jim comey once again was not telling the truth under oath or he couldnt remember. Jim comey is a person who has made a very good career living in washington and what we saw this week, im shocked by this news is jim comey is about to sign a 10milliondollar book deal, right . The people who are in washington, who are holdovers from the Previous Administration have zero desire to help this president get his agenda done and they should leave office. The question these republicans should be asking, demand of jim comey under oath is how many times did you leak information . We know publicly now he said he didnt have the courage to leak it directly so he leaked it to a law professor. But how many other times did he ever leak information when he was a director of the fbi . The answer is probably yes. Because, what he said on february 15th was that he knew under information that he had, that attorney general Jeff Sessions was going to recuse himself from the russia probe. Jeff sessions didnt recuse himself until march 2nd. Which means jim comey was probably the individual leaking information from the Justice Department which required jeff to remove himself from this. How many other times did jim comey use information that he had access to that nobody else did to leak tote New York Times. The wall street journal, the Washington Post . Clearly he is the leaker r. Leaker. Clearly is he the problem. The republicans in congress should demand an investigation into this. Imimmediately. Clayton one of the things that came out of james comey item that he admitted to waking up in the middle of the night out of a cold sweat that the president had perhaps tapes of the conversation therefore, thats what prompted him to release this memo to his friend. Lets talk about the tapes for a second. Are there tapes . He has met with the president , i think, nine times, three of which were at trump tower. Were they recording guys there . What do you know about this . Are we going to see tapes or was this all a charade . Look, i dont know the answer. I dont work for the white house as you know. I dont know of any informations i have ever had inside of trump tower that were being taped other than probably by our government. As you know, they were spying on everybody, it looks like under the Obama Administration and unmasking everybody for political purposes. Lets get to the bottom of that situation. Look, i dont know if there are tapes inside the white house. I dont work there. What i do know is i know the president. I know him well. I believe him unequivocally when he says he never asked for anything. Jim comey had to testify that the president never asked for anything to obstruct justice. Thats been very, very clear. The question is what did jim comey leak to the media because we know he is the leaker. Clayton maybe thats the point then. Maybe that is what he is referring to. Maybe thats what the president is referring to with these tapes. It be that he thinks there are tapes from the nsa secretly monitoring trump tower and thats where we would get these recorded conversations . Asked for names to be unmasked which she had no reason to be doing. She woe that the former National Security advisor in the Obama Administration was asking for names to be unmasked for political purposes, which she had no reason to do. There has been no investigation into this whatsoever. When are those individuals, when is susan rice going to be called to testify in front of congress and answer the questions of why she was asking for individuals to are being monitored by the u. S. Government to be unmasked for political reasons . Where is the investigation into the Previous Administration . Do you have anything on the cover of the New York Times after what we learned this week . This is amazing. Lorreta lynch, jim comey just testified under oath that his boss the attorney general of the United States specifically instructed him not to talk about an ongoing active criminal investigation into the hillary Clinton Campaign and call it an investigation but to call it a matter. That directly lines up with the talking points that the Clinton Campaign was using for political reasons to discuss it as a matter. Number one it, goes to show how weak jim comey was as fbi director and further tells us why he should have been fired. But, number two, there is clearly something wrong here where the attorney general is directing the fbi director to not talk about something that he should be talking about and using specific language. There needs to be an investigation of when Lorreta Lynch had that conversation. Was it directly after the tarmac with bill clinton . Was it because she spoke with john podesta from the campaign . Who gave her that information. And then when did she relay that to the fbi director and why did he follow what should have been an unlawful obstruction order . I think jim comey is in big trouble because under oath, in front of the committee, he said things which we know to be factually inaccurate not just in the testimony this week but when he was the director of the fbi. He has had to come back and recant statements that he has made and make misstatements because jim comey is a liar. So, you know, when you are under oath you should be very, very careful what you say. I think we learned that this week when jim comey again was probably not telling the truth under oath. Pete when Chris Matthews himself admits that the russian collusion fell apart with the comey testimony, you know that it really did fall apart. Well, but this memo thing tips to be a big issue and a big question. The Senate Judiciary committee now demanding james comeys leaker pal, the professor richmond, hand over the memos. Clayton ellison barber live in washington, d. C. With the latest on that side of the story. Good morning. Good morning to you guys. The Senate Judiciary committee is asking a columbia law professor to turn over the memos comey wrote after his meetings with President Trump. Chuck grassley and Ranking Member feinstein sent the letter to rickman and ask that he release the memos to the committee no later than june 9th, writing, quote mr. Comey himself has encouraged you to he radio lease them. The contents of the memos have been widely reported but until thursdays congressional hearing, the source behind the stories remained anonymous. Then, comey said this. I asked a friend of mine to share the content of the memo with a reporter. I didnt do it myself for a variety of reasons but i asked him to because i thought that might prompt the appointment of a special counsel. Comey told senators he does not have the memos but said he would encourage that friend to hand them over. Rickman told fox news he was the middleman between comey and the press. A number of congressional committees requested copies of these memos before the hearing took place. But didnt get them. According to politico richman is now in contact with the judiciary committee, guys . Pete here to react we are going to bring in George Washington University Law photographer Jonathan Turley to break it down. We have to ask did the former fbi director comey violate any laws in being a leaker in leaking this memo . Well, what he did was, i think, facially unprofessional. There are rules in the fbi that clearly state that you cannot disseminate fbi information. I believe this was fbi information. He signed the form as all federal employees do that states clearly that material like this generated as part of an investigation is presumed to be fbi information. You cant just hand it to the media to leak it to the press i think its professionally and ethical problematic. There is even a federal law that makes some forms of theft of documents to be a crime. I dont think he would be prosecuted under that. But when i heard him say that, i was floored. I actually respect james comey in a lot of respects, in a lot of what he has done. But, this was really tarnishing of his reputation. I think that what were seeing is that the coverage of the hearing has been very distorted. You can accept many things that comey says but you need also to recognize when he himself has crossed the line. If the president said these inappropriate things to him. Comeys response was equally inappropriate. He said he got up in the middle of the night on monday, which by the way is not a great time to make big decisions. And decided to leak to the media damaging memos about a president who had asked to you try to stop leaks. Now, if that doesnt bother people, i dont know what would. Sandra its amazing its not getting more attention than it is this morning, professor. First of all, who owns those memos . Well, this is a rather bizarre thing. People are treating this like its some type of diary entry that he is doing. He wrote this on fbi computer about a pending, sensitive investigation. On an issue that he thought was material to the investigation. Pete on a meeting with the president. Right. He then gave that information to his top team. Under protocols that existed a long time, he has to go to the department and say can i release this . They review it. Not just for executive privilege as people have been saying but for other privileges. If i had asked for these documents under freedom of information act, i assure you, because i have done these cases, the fbi would have refused and said this was under the deliberative process privilege and other privileges. And i think that comey probably knew that. Clayton its amazing. Another huge bombshell that came out of this was the story about attorney general Lorreta Lynch his former boss. We learned that she had pressured james comey to down play this Hillary Clinton email investigation instead of calling it an investigation, calling it a matter. Simply a matter. Matter. What do you make of that . I actually remember him saying that and turning and saying whats that i have been a criminal defense attorney for a long time. He is not the federal bureau of matters. He said, you know, to the attorney general, basically what is that . Why would i say that . Again, comey doesnt come off particularly well in these moments. Critical scenes that he describes where he faces ethical dilemmas, he actually doesnt sort of step up to the plate. Clayton yeah.
