tenure this. he was, of course, director of the c.i.a., secretary of defense as well. it's clear that -- and we've heard mr. panetta say this before -- that obama made some mistakes in iraq. now as it turns out he made some real doozies in benghazi as well. listen. >> did you use the word terror attack? >> i used the word attack, that this was an attack by terrorists. >> you said attack by terrorists. all right, so attack by terrorists. i want you to listen to this sound bite. roll it. >> did he tell you, secretary panetta, it was a terrorist attack? >> you know what he told me was, there was an attack on our compound. >> he didn't use the word terror? >> you know, in the heat of the moment, bill, what folks are focused on is what's happening on the ground. do we have eyes on it? how can we make sure our folks -- >> i want to get this on the record. did he tell you it was a terror attack? >> i'm answering your
question. what he said to me was we've got an attack on our compound. we don't know yet who's doing it. >> disingenuous? >> look, come on -- >> disingenuous? >> we told the president there is an attack that's going on, that terrorists are involved in the attack. >> let me stop you there. the audience can make their own determination. >> of course. >> and it turns out the national security advisor susan rice famously goes out and says it was all about a video. when leon panetta was asked about that he said that is what the c.i.a. told him. it is a circuitous trip which brings you to one conclusion, the administration did not want to talk about terror. al qaeda flourishing in a place we took out a brutal dictator. therefore the president was able to run on that successfully in 2012. >> in february 2013,
panetta told lindsey graham that the biggest problem that night, senator, quote, is nobody knew what was going on there. he then went on to say 72 hours later there that he did characterize benghazi as a terrorist attack in a closed door session with that same committee there and then following that. he then said yes this was a terrorist attack. he mentioned that behind closed doors and then susan rice went out even with that information days later on a media tour saying quite the opposite. >> you've got to remember the president was running for reelection and he didn't want the facts to get in the way of him getting another four years. >> he talked about isis, he talked about putin and the pakistani doctor yesterday. the same as with secretary of defense gates and the same as with leon panetta and the same with some other officials -- hillary clinton has done it publicly and in her book. the president does not make quick decisions. he seems reluctant to listen to military advisors and he approaches things
like a law professor rather than the passion of a leader. that is a direct quote similar to what the other two leading officials said. >> last night dana pre-- per ino summed it up like this. >> leon panetta is the third national security official, and this is not low-level people. these are not nobodies writing books that want to become somebodies. these are not people that seek fortune. they don't need fame. the three of them gave clinton and panetta, i counted it up, 90 years of collective experience. they are talking about the history of the world. they are worried about the position of the united states. all of them are saying publicly in their books that they gave different advice to president obama and that he decided to go in a different direction. >> that's pretty clear. we've heard from all these people who have written these books and leon panetta, this is very
embarrassing for the administration, is that they had given him advice and he simply doesn't take it. why would he take it? in the first 15 minutes of his administration he won a nobel peace prize. he's been told by the mainstream media for the last few years he's the smartest person that could be. why listen to those people when he could come up with it himself? as leon panetta made it very clear last night, he's made a lot of mistakes. >> and also too nervous to make a decision. that doesn't sound like the confidence to make a decision that you need. at ten minutes after the hour you wonder if there is light at the end of the tunnel because there is so much at stake. >> coming up, martin dempsey is again speaking out on isis and the president's strategy there isn't working. we'll hear more of that coming up. as well we're going to speak to tonto, one of the security officials in benghazi, his reaction to leon panetta's reaction. >> meanwhile on this wednesday morning there is a big fire in yosemite.
>> yosemite national park in california. moments ago we learned a pilot fighting a fire there was found dead. he was flying alone in his air tanker when something went terribly wrong. look at the flames right here and the black smoke. his plane crashed into the side of a steep cliff near the entrance of the park. witnesses say they saw parts of that plane tumbling down off that cliff. the fire the pilot was fighting was 130 acres. a fierce gun battle leaves a police captain shot in the head. it was a six-hor standoff -- six-hour standoff in chicago that just ended. one suspect dead and another in custody. a 30-year police veteran was shot in the head and in the chest as he was trying to serve a warrant to daniel brown. brown was hiding out in an apartment complex. he was wanted for a triple shooting in indianapolis. the police captain is expected to be okay. brand-new pictures of
ebola doctors. look at these new hazmat suits. they look more like astronauts than doctors. they're getting ready to fight ebola. they are among doctors and nurses who volunteered to treat any ebola patients who may show up at the iewft of chicago's -- university of chicago's medical center and that is their protective gear. >> in spain they're trying to figure out the nurse who was treating that fellow who died, how did she wind up with ebola? she was wearing this suit. they can't figure it out. >> and a dog might have it too. >> not so long. >> they're going to euthanize the dog. there has been a petition. 100,000 people signed it saying you've got to let the nurse's dog live but the country of spain is saying no. >> this is a routine traffic stop ending with this. >> oh [bleep].

a key city in the turkish syrian border area teetering on the verge of collapse and general martin dempsey chairman of the joint chiefs of staff now saying this is one battle that may be lost to isis as early as today. >> i am fearful that kobani will fall. we have been striking when we can. isil is a learning enemy and they know how to maneuver and how to use populations and concealment. i have no doubt that isil

top of the hour, we have quick headlines for you now. happening today, an appeals court will decide whether the f.b.i.'s national security letters into obtain ntion on customers -- obtain information on banks and other business violates free speech rights. twitter is suing the f.b.i. and d.o.j. to release information about government surveillance. the social network is asking the feds to publish their requests for user information saying it is their first amendment right.
the supreme court to rule whether hourly workers should get paid for waiting in line to pass their security checks. staffing solutions says extra pay is not required because it is not related to jb -- job duties but workers want to be compensated for spending up to 25 extra minutes waiting there. >> let's see what the public thinks about this. fears of an ebola outbreak steering panic across the country but as the president and other officials try to reassure the nation, are they doing more harm than good? let's ask this woman. she took the pulse of the people with her focus group. thank you, leigh. we're going to roll the clip, see what the public said and get your analysis. first here's tom frieden. he was on with us and he talked about what is at stake now that we have one case over in dallas. >> i understand that americans are scared about ebola, but you have to put it in perspective. there will not be a large
ebola outbreak in the u.s. we stop it here by public health measures that track patients. that is being done in texas. by hospital infection control that if done right will prevent any health care workers from getting it. we're not going to have the kind of outbreak here in any way, shape or form compared to what is happening in africa. >> your group gave him an f. >> they did. i think what happened here is two things. first of all, he's tried to empathize but he did a really poor job of it. he said i understand people are scared but you have to put it in perspective, being dismissive of the whole thing. then he said something else that the group last night didn't like. that is we're not going to have it as bad as it is in africa. people say i hope not. we've got a better infrastructure. let's talk about what we're doing here. >> it is like saying we didn't think it was going to be as bad. that's not the ground we were hoping for. here's another official also talking about this on monday on our show.
same situation. watch the dials. >> well, from a public health standpoint, that really doesn't make any sense. it's understandable how people can figure that that might help, but when you completely seal off and don't let planes in or out of the west african countries involved, then you could paradoxically make things much worse in the sense that you can't get supplies in, you can't get help in, you can't get the kinds of things in this that we need to contain the epidemic. and the best way to protect america is to suppress the epidemic in west africa. >> should we just seal the border? your group gave him a d-plus. that's his answer. >> the point here is that he really didn't do a whole lot to inspire confidence but he did two things people really liked. one, he made a distinction between commercial flights and rescue flights and that helped put things in
context. the second thing he did really well was to say that what we must do is protect america. we must do all that we can to protect america. and that inspired some confidence in folks we spoke to. >> let's talk about the president of the united states now. on september 16, he went down to atlanta to find out where ebola was going, and then he spoke out about it on monday. did he reassure the american people? let's listen and monitor. >> it is important for americans to know the facts, and that is that because of the measures that we've put in place as well as our world-class health system and the nature of the ebola virus itself, which is difficult to transmit, the chances of ebola outbreak in the united states is extremely low. >> democrats gave him much more, almost double the republicans. >> this is the biggest divide we saw all night. >> they graded him a d-plus.

[screaming] >> the officers then used a taser on the man. it started when police pulled him over for a seat belt violation. the man you can see struggled to find his i.d. officers, they became nervous when he climbed into the back seat to look for it. that's what they say. and then the man refused to open the door. during that time his girlfriend is on the phone with 911 saying that she fears for her life. >> what was the purpose of a gun? and now they asking me to open my door so i can get out.
i'm scared. if you pull out a gun, it's two kids in the back seat. >> the hammond police department defending the incident saying police were, quote, at all times acting in the interest of officer safety. but an attorney representing the victims says that's not the case. >> we also know that the two children involved that were in the back seat, you could hear them screaming, they were 7 and 14 years old. back to you. >> it was a seat belt violation they got pulled off on. they were asking for i.d. the passenger was not going to give i.d. one of the questions was do you want to be dragged out of the car in front of your kids or do you want to just open the door? the next thing you know, they smashed the window. >> apparently as well, adults in the car refused to follow what the police officers said. apparently when the driver was going back to get their i.d. in the back seat, the cop thought he was going for a gun or something else. and that's, according to

into the united states. >> we caught them at the border. we know isis is coming across the border. if they catch five or ten of them, you know there's going to be dozens more that did not get caught by the border control. they are flying b-1 bombers bombing american cities. they are going to be bombing american cities coming from mexico. >> the common says at least ten isis fighters have been caught at the border so far. angry parents at a new jersey school board meeting last night after the district canceled its football season. officials at a high school canceled the season after allegations of harassment, intimidation and bullying. listen. >> i'm so heartbroken. >> why is that? >> because i like football. i don't think we should cancel it because of somebody's mistake. >> the district superintendent said the bullying was pervasive and widespread and they have zero tolerance for it. a criminal investigation is underway.

ongoing right now. many people across north america could potentially see it if it is not chowedy out. one of those clays it is not cloudy is -- one of those places it is not cloudy is in northern wyoming. we have a photo to share with you. there is this image, beautiful shot. that was earlier in the overnight hours when you could see the moon starting to move into the earth's shadow. that is what a lunar eclipse is. across the northeast we do not have a good view at all. we have a storm system moving through and it is producing areas of rain across new england. that is why you have so much cloud cover out there. across the midwest things look good. you have clear skies out there. wyoming, you have good conditions and across parts of the west good conditions as well. one of the states that typically you would think you would have clear skies, arizona. we have tropical moisture moving in. we have a lot of clouds and areas of rain. a little unusual but that is what is going on out there. you can see on the radar, that rain moving through parts of new england and

the guy who could be a spoiler in the race for the u.s. senate. joining us is sean haugh, north carolina's libertarian senate candidate. good morning to you, sean. >> good morning. thanks for having me. >> that's one of the things you're hearing. if the balance of power in the u.s. senate is hanging on north carolina, if you're able to, and if you look at the latest poll, according to maris, kay hey gan is at 46%. you've got 7%. you could be a spoiler. what do you say to people who say he shouldn't be doing that. >> i think it's very important to have an alternative voice in this race. both of my opponents are for perpetual war and unsustainable debt. my campaign is about stopping all war and stop spending more money than we have. i think this is a message that people all across the political spectrum want to hear and are responding to very well. i'm happy to give people an
alternative to the candidates offered by the democrats and republicans in this race. >> you see both the republican and democrat as pretty much the same person? >> well, there are differences between democrats and republicans, and in this race as well. but they're united on more war and continuing to raise more debt from people. and i found that as far as my effect on either of them in this race, it's actually fairly even. it depends on which poll you look at. if you look at it as me drawing from either of them, it seems to be about equal, and some polls even disagree that i might be drawing more from kay hagan than from tom tillis. i'm not concerned about that. >> maybe people who would not have voted may have picked up the phone and answered the poll. the main reason you're in is to get your message out that the united states

lure westerners to isil's cause. there is also a web site seeking information, f.b.i..gov/isiltips and follows a campaign by minneapolis area f.b.i. agents trying to capitalize on their proximity to the places so many of these wanna be jihadis grew up. the agents gave special business cards with a phone number on them to community leaders in the city with a plea to please call if they ever hear anything about an american trying to join a terror group. the fact that the f.b.i. is putting a modern day wanted poster out suggests that initial leads have not been very successful. back to you. >> peter, thank you very much. and if you look at isis or isil, they have so effectively used twitter and social media and now essentially the f.b.i. is using the same stuff to try to catch them. you live by social media, you die by social media. >> hopefully they will. the president of the united
states had two fund-raisers yesterday. will go to the pentagon today before he goes to two fund-raisers tomorrow and then one on friday. he's going to be heading there to see how the war is going. so far it doesn't seem to be going too well since we engaged against isis. they seem to be expanding their thrust from syria to iraq. what also stood out over the last week has been the release of leon panetta's book and his criticism of the president's leadership, style, his ability to govern. >> right. he actually comes in, we heard him criticize in all those areas as it pertains to iraq and now isis. now going back to benghazi where he's saying, wait a second. we actually -- i told him that this was an attack that involved terrorists. this will actually weaken us moving forward far -- go the distance after this presidency, panetta sat down with bill o'reilly ask said we're -- and said we're getting mixed messages. >> the pakinstani doctor that
helped you, where is he? >> he's in pakistan. >> yeah. where? where? >> in prison. >> why hasn't our president gotten him out? why? >> we have made a lot of requests to the pakinstanis to do the right thing. >> yeah. are we still sending them money? >> yeah, of course we are. >> why? that doctor is in jail. we shouldn't be sending a cent until he's out. our enemies throughout the world, and this includes china and russia do not fear the united states now. do they? >> it's very important when president says something that we do it. i think that's one of the problems with taking the position on chemical warfare in syria. we drew a line and we didn't -- >> give me a straight answer. do our enemies throughout the world fear us? >> i think they're getting a mixed message as to whether or not the united states will stand by its word. >> i'm taking that as a no. >> he's being very political. diplomatic as well, saying well, we sent out a lot of mixed messages. essentially what he has
depicted, mr. panetta and also mr. gates and the other people who have written books who are insiders in this administration, is the president has gotten some great advice, but he's made the wrong decisions and now panetta spins it as we're sending out mixed messages. he was also asked by mr. o'reilley, and apparently they've been friends for a number of years even though it was a really tough interview, he worked for a couple of different presidents. who is the better leader. listen to this. >> who is the better leader, bill clinton or barak obama? >> they're both bright, they're both able. they both want to do what's right for the country. i think the difference is that bill clinton likes politics, likes the engagement in politics. barak obama does not like that process of engaging in politics. it hurts him in terms of getting things done. this country cannot stand another 2 1/2 years of stalemate. >> i get the sense why he wrote the book. on top of that, leon panetta said, i would have gotten a deal out of iraq and not taken the troops out. on top of that, he said i would
have given the ukrainians weapons, not mres and would have really given them back and reinforced nato and taken some stiff action. so this is not karl rove. this is not dick cheney. this is his guy. >> you have the gates book, right? you have hillary clinton's book. now you have leon panetta's book. this is a team that the president assembled of really bold thinkers who at one point were his rivals. now they're actually coming out with this information that is working quite against him and who put them together to help him. it's interesting because they -- they don't have to come forward with any of this. >> they don't need the money. >> they don't need any popularity contest. the irony is, this is the team the president put together who he trusted to get the job done and then didn't listen to their advice as it says from there. >> right. and usually books like this come out after the guy has left the white house. not this time. maximum sales for books, but
unfortunately, maximum pain for the white house. >> maybe hoping something will change before the end of this term. >> as we just heard him say, stalemate right now. news time now and heather nauert joins us with some sad news out of yosemite. >> good morning to you. while you were sleeping, learned a pilot fighting a fire at yosemite national park was found dead. he was flying alone when something went terribly wrong. >> we saw sparks down the whole mountain side and a huge black cloud of smoke and watched all the parts of the plane roll off the mountain and down into the highway. >> the pilot -- the fire the pilot was fighting was considered small at 130 acres. a fierce gun battle after six-hour stand-off in chicago just ending leaving a police captain shot in the head. the suspect dead and another in police custody at this hour. a 30-year police veteran was shot in the head and chest as he was trying to serve a warrant to daniel brown. brown had been hiding out in an
apartment complex, wanted for a triple shooting that took place in indianapolis over the weekend. he is now in police custody. the police captain is expected to be okay. isis targeting military families on social media. a defense official confirming that isis sympathizers targeted an air force officer and his son after the father posted pictures of planes refueling over iraq. we will keep following that story as it develops. and the newest member of the utah jazz coming in at just three feet, four inches and under 40 pounds. he's a little five-year-old free agent who signed a one-day contract, with a blue crayon, of course. the little guy has been battling lieu team i can't since he was two years old. for one night he got to live his dream and score a slam dunk. >> working through the -- he goes by. go, bears. he slides by. he rises to the rim and hammers!

three security contractors who were in benghazi the night our consulate was attacked claimed they were given an order to stand down straight from the station chief, the c.i.a. many in the government and the press have called them liars. last night something interesting happened in this exchange between bill o'reilly and president obama's former defense secretary, leon panetta, who was there that night. >> i have no reason not to believe them. if in fact there was a 30-minute delay, i think that it is important for the congressional committee to look into that. >> find out why. correct? >> and determine what happened. >> right now to react is one of those three security contractors who wrote the book "13 hours." big best seller. good morning to you. >> hi, how are you? thanks for having me on again. >> great to have you as well.

that's what -- when i was watching that. again, we're getting into spin. there is always some spin. if somebody can just come back -- in our leadership and in our government and say this is what happened. this is the truth. not spin it, not try to church it up with words. just say hey, did he say terrorist attack? if he didn't, then did somebody say it? if obama did hear that from leon panetta, why didn't he answer the answer correctly? it's a cover-up and people not telling the truth. >> you know what, it's curious because so many people in the administration have been surrounding the president trying to protect him. there you got leon panetta last night essentially saying if there is a 30-minute timeout, there needs to be an investigation. if you had a chance -- this is it -- to say something to leon panetta what, would it be? >> i would ask him why did he allow the state department, hillary clinton's state department take over the rescue operations for us. and why were assets turned around or told to -- i won't use the word stand down because it's

the turkish border and experts are predicting massacre. joining us is rear admiral john kirby. good morning to you. >> good morning. thanks for having me. >> it seems like such a dire situation. isis has been marching toward kobani for the last two weeks. how did we miss them? >> we didn't miss them necessarily. we've been tracking these guys. we've been trying to hit them from the air. just night before last there were five air strikes to try to get at them. i think what you're seeing here -- we've been very honest about the limits of air power. there is just so much you can do from the air. these guys want to own territory. they want infrastructure. they want ground. they want this town. and there is just so much you can do from the air on this. you got to have willing partners on the ground. you got to have ground forces to push them back. >> the kurds are complaining you have not gotten them the equipment they need to fight back. and to allow this three weeks in is something i think the american people are a little shocked at. when we get involved with 50 coalition partners to think that we can monitor them for three
weeks, come and take this major city while the turks watch it happen behind chicken wire is just unthinkable. >> well, we certainly are in discussions with the turks about what they can or will or may do here. obviously this is a decision the turkish government has to make. we can't make it for them. and for the kurds, we have been trying to refly kurdish and peshmerga, but that's been in iraq. most of what we're trying to do inside syria is not dynamic targeting. it's not going after vehicles or convoys. it's about trying to get at this group's ability to sustain itself inside syria. >> i want to ask you this, leon panetta obviously with his book out, saying that the president misses opportunities, also quoted as saying that he's ambivalent at times. you were the former spokesperson for him as well. he also said that the president needs to be open to boots on the ground and is hesitant instead. i want you to listen to this and
then we'd love your reaction. >> you're dealing with a very dangerous and fanatic enemy in syria and frankly, it's not going to work just to do air attacks without having -- >> not going to work, right. >> -- who know where the targets are and what's going on. if the military thinks we ought to have special forces boots on the ground in order to do what's right, i think the president ought to be open to that kind of thing. >> once again did she it did she. >> is the president in fact open to that? >> the commander in chief has been pretty clear. there is not going to be a return of u.s. combat forces on the ground in iraq. that's been pretty clear all along. that said, and you've heard general dempsey say if he gets to a point where he needs to get other recommendations, he has the freedom and flexibility to do that. secretary hagel i know wants chairman dempsey to have that freedom and flexibility. but the decision we're not going to put boots on the ground. i would agree with secretary panetta about the need for
ground force. we've been saying that as well. you have to have competent, willing partners on the ground. but we believe, and especially after 13 years of doing this, we believe the best forces are indigenous forces. people that live there know the terrain and culture. >> on that word believe, i want to ask you something. it seems leon panetta and the president of the united states are on opposite ends in terms of what happened in benghazi. panetta claiming he did say it was an attack that involved terrorists or terror, and the president saying that was not the case. who do you believe? >> i think you can understand i'm not going to get involved in the debate and discussion. >> oh, come on. >> i think i'm -- you can understand i'm not going to get involved in that. we said all along there was nothing that the military could have done to prevented the deadly attack. >> let's just go back to this for a second. do you understand how bad it looks? america has been involved for a month now and a massacre is about to take place and we seem as though content to let it happen. do you understand how unsettling that is to people in this
country and how bad we look around the world? >> i can understand the frustration and the concern clearly. we understand the concern by those that are in and around that town as well. we understand that. but there is a limit to what air power can do. there is a limit to what you can do militarily against these guys. they want to hold ground. they want to hold territory. we know that and we've been watching that. what we're trying to do in syria, and everybody is focused on kobani and i understand. but we do believe inside syria, we have done good work to degrade and destroy some of their capabilities and ability to sustain themselves, hitting their finance centers, taking away some of their revenue, removing some command and control from them. that's really the focus inside syria. it's not the same kind of focus as closed air support that we're sort of doing inside iraq. >> all right. we know you got a busy day because we know the commander in chief is coming for the second briefing of his administration, only second. rear admiral john kirby, thank you for joining us live from the pentagon. >> thanks for having me.

this and it's messy. it drudges up all the dirt from your life. that's good. >> if i have any clean dishes, i can't get any rest. i don't know if that is the inverse. here is e-mail number two. >> it is. >> my eight-year-old granddaughter always insists on having someone by her side. she can't play by herself for more than a few minutes, and her twin brother can spend time alone. is this normal twin behavior? >> here you go, no. it's not normal twin behavior. we don't want to call an eight-year-old nuts, but it's nutty behavior. what it reflects is an anxiety problem. this is almost a little study in and of itself. two twins, lots of things in common, but one of them is quite anxious and treating it early because there are medicines that can help, psychotherapy can help. treating it early let's her not be hostage to this exaggerated fear, be independent, that's what we want. >> there is time there. >> i wonder -- >> late for brian.

lure westerners to isil's cause. the f.b.i. says if you recognize this man's voice, go to f.b.i..gov/isiltips and leave the most minor piece of information. it will help. this digital tip line followed the campaign a few months ago by agents in the minneapolis field office that included giving business cards to community leaders featuring a special number to call if they got wind of any americans planning to go join foreign terror groups. during that effort, f.b.i. agents explained to these leaders that isis recruitment follows many of the same guidelines as gang recruitment here in the states. back to you. >> good point. peter doocy live in dc with the very latest. yesterday we told folks about how the 19-year-old from illinois was about to get on an airplane and fly out of o'hare to join isis because he talked to somebody on line and they said yeah, get to istanbul and then we'll get you to the front line. he's in jail right now.

whether or not he will be open to boots on the ground. >> the commander in chief has been pretty clear. there is not going to be a return of u.s. combat forces on the ground in iraq. that's been pretty clear all along. that said, and you've heard general dempsey say if he ever gets o a point where he needs to give other recommendations, he has the freedom and flexibility to do that. secretary hagel i know wants him to have that freedom and flexibility to make that advice. but right now the guidance is we're not going to put u.s. troops on the ground in this fight. i would agree with secretary panetta about the need of ground forces. you have to have competent, willing partners on the ground. but we believe and especially after 13 years of doing this, we believe the best forces are indigenous forces, people that live there know the terrain and culture. >> the local people be the boots on the ground. unfortunately, we're just not getting any help right now. >> there are no local people. we have to take a year to train 5,000. he's saying if i had my druthers, i would do it
differently, but the commander in chief told me to do it this way. so therefore, whatever happens, it's not my fault. >> what's curious about the books that have come out, it's pretty clear that in this administration, the president of the united states ultimately decides what to do. but we've heard from gates and now heard from panetta. they've given him great advice and he doesn't take it. you got to figure if you're them and you're sitting in the meeting and you make the case and hillary clinton had a book that came out, too, you make the case why you should do certain things a certain way and then he says no, we're not going to do it that way. you just got to figure they're sitting around the table going, not again. >> why do they sit around the table? they should put their stars down and walk out. >> fear that america will be weaker after this administration. >> it's better to have them try to convince him the right thing to do. pianette is a said to bill o'reilly is that one of the problems with these mistakes is it's sending mixed messages to the whole world. >> the doctor, the pakinstani doctor that helped you do that, where is he?
where is he? >> he's in pakistan. >> yeah. where? where? >> in prison. >> in prison. why hasn't our president gotten him out? why? >> we have made a lot of requests to the pakinstanis to do the right thing. >> are we still sending them money? yeah. >> of course we're sending them money. >> why? that doctor is in jail. they shouldn't be sending a cent until he gets out. our enemies throughout the world, and this includes china and russia, do not fear the united states now. do they? >> it's very important when president says something that we do it. that's one of the problems with taking the position on chemical warfare in syria. we drew a line and -- >> give me a straight answer. do our enemies throughout the world fear us? >> i think they're getting a mixed message as to whether or not the united states will stand by its word. >> i'm taking that as a no. >> he goes on to say that with this isis the president might be able to get it right over the next two years. what indication do we have now that the president is getting it right when it comes to isis? they're getting bigger,
stronger, and they continue to massacre everyone they see. we have not stopped one inch of their expansion. in fact, baghdad, according to the pentagon, could fall. >> right. they're recruiting tool is way beyond what it could have ever been years ago thanks to our internet capabilities and their ability to reach globally anybody who wants to jump on twitter or facebook. >> and given the fact that leon panetta is talking about we're sending out all these mixed messages. okay, so let's say you sign on for our coalition to help get rid of isis. okay. we're there right now. what's to say we're not going to cut and run, because we're sending mixed messages. although when asked the question, since mr. panetta worked for both william jefferson clinton and barak obama as well, who is the better leader? here is his answer. >> who is the better leader? bill clinton or barak obama? >> they're both bright. they're both able. they both want to do what's right for the country. i think the difference is that bill clinton likes politic, like
the engagement in politics. barak obama does not like that process of engaging in politics. it hurts him in terms of getting things done. this country cannot stand another 2 1/2 years of stalemate. >> unfortunately -- okay, so he's not going to pick one. unfortunately, barak obama got elected with the promise that he was going to change things in washington. they're worse than they were before. >> right. is it for worse? >> he clearly likes the clintons and thinks hillary clinton is the next coming. meanwhile, heather nauert, you have the other breaking news. >> yes. we've been following this story out of yosemite national park in california. now we are getting a firsthand account of what happened when a pilot of an air tanker lost control of his plane, crashed and died. >> we watched the whole thing. we saw sparks down the whole mountain side and the huge black cloud of smoke and then watch all the parts of the plane roll off the mountsen and down into the highway. >> the fire, he was fighting was at yosemite national park, considered a relatively small
fire at 130 acres. a fierce gun battle leaves a police captain shot in the head and chest in chicago. the 29-year police veteran was shot trying to serve a warrant to daniel brown. brown was hiding out in a an apartment complex south of chicago. he was wanted for a triple shooting that took place in indianapolis over the weekend. he is now in police custody. the police captain is expected to be okay. brand-new developments in the fight against ebola. we got word overnight that the cameraman will get an emergency transfusion of blood from the ebola survivor, kent brantley. experts hope the antibodies will help kick start his immune system. brantley had also donated blood to dr. rick sakra who was released from the hospital. that was believed to have helped him as well. this is a nice story to put a smile on your face. a police officer in michigan pulls over a woman because her five-year-old child is not in a booster seat.
but instead of giving her a ticket, the officer takes the mom to wal-mart and he buys her a car seat with $50 from his own pocket. >> she admitted she's wrong and she explained to me that she recently fell upon hard times. ticket doesn't solve the situation. what solves it is the child being in a booster seat like she should be. >> he did his job and above and beyond that just to protect a little girl and help the family. >> the mom says that she now plans to pay it forward. she says the officer changed her life. this all came out because a wal-mart employee took a picture of that, posted it on line and then everyone started hearing about it. >> how great is that? >> so generous. >> thanks. coming up on this wednesday telecast, the v.a. announcing it has just fired four executives over the patient wait time scandal. that's good. but we just learned at least one of them was already retiring. so is actually anything changed? we'll take a closer look coming up. and they're supposed to be

16 minutes after the hour. whatever happened to the corrupt government officials responsible for the v.a. scandal? >> if you engage in an unethical practice, if you cover up a serious problem, you should be fired. period. it shouldn't be that difficult. >> all right. so when the cheering stopped, what happened? this week they announced four senior officials are fired. but it turns out at least one of those people was set to retire anyway. does that really count? congressman jeff miller is arguely more responsible for exposing this than anybody else. congressman, you feel better that four are fired? >> no. i think there is some accountability that has started, but the unfortunate thing is these folks were given the opportunity to retire in lieu of
being fired. so they get their full benefits. >> so john goman, this guy is already checking out. you said they wrote a glowing article about his four decades in government? >> yeah. that's what happened. he knew he was going to be fired, so he went ahead, put in his retirement papers. they put a press release out saying he was retiring, got a glowing report in the local paper and the tv and radio and of course, he was on his way out and v.a. then decides they're going to put out a press release and say, no, no, he was going to be fired. the problem is the american public wants accountability at v.a. and they want people to be fired. they tonight want them given a five-day notice so they can retire at full benefit. >> for example, susan taylor, deputy chief of procurement officer, she was set to start a new job anyway, which is equally as important for the department of energy. >> this is a person that knew she was under federal investigation, knew that she was going to get disciplined.
she went ahead and went to the department of energy and applied for a job, was accepted. got a job offer. and of course, that's now been rescinded. she's back at v.a. and v.a. has given her notice. but the problem is the v.a. is interpreting the law that we passed much differently than i would suspect most people think. we don't need them to be given a five-day notice that they're going to be fired because that gives them the chance to retire with their full benefits. >> it's missing the whole point. we're trying to stop future action. you got to scare people straight for lack of a better term. terry gehrig wolf is director of the pittsburgh va health care center. she's been on paid leave since june over a contract conduct during the 2011 disease outbreak. so she was already on hold. >> the problem there is you have people that actually died on her watch. it was found in the system. this has been going on for well over two years and just now they're holding her accountable. >> james holton, director of

restricts what unions can use the fees for. 30 big ones. next, 78.8 years. that's how long the average american now lives. that's a record high. bad news, fellows. the ladies are still outliving us by four years. darn it. one million. that's how many copies fox news contributor charles krauthammer has sold of his "new york times" best seller "things that matter." it is a wonderful book and he's a wonderful guy. all right. elisabeth, over to you. >> you are right about that. how about this? a north dakota high school under fire for using clips from "pretty woman" to teach girls a lesson about dressing properly. some parents are outraged by the comparison. should they be more upset about their kids dressing like this in the first place? joining us to debate it, host of the moms of dee -- liz stern. thanks for joining me for this debate. the principal of the school actually claims we're just trying to send a message. you're in charge of your image
and people will perceive you and who you are based on practice you're wearing. is this outrageous to show a "pretty woman" clip to high school girls? >> i think it's totally fine. i think at high school, if you haven't seen the movie, then you don't know what they actually saw in that scene. you just see a woman dressed a certain way. if you have seen it, then it's not surprising. personally i wish that they were spending their time in school talking about things that really mattered than about girls clothing. but i really don't have a problem with it. i think they were trying to prove a point and made it. >> even though it is a prostitute in the school -- you have a problem with it? >> yeah. i don't think it's appropriate. >> why. >> there are a million other movies to show these high school students about how to dress appropriately and how not to dress appropriately. "pretty woman" is one movie that just shows children it's about a prostitute, first of all. second of all, it's not sending the right message. it's showing women, okay, now what? you can marry that prince and be taken away. instead of women like work hard, have a career. that's one whole side of it.
>> they weren't showing the whole movie. >> the clip is, why even show a clip about prostitution? show a john hughes film. show a movie that really goes back to classic, how children should dress classically or in ways not to show a prostitute. i just have a really big problem with that. >> is it worse to have kids dress not guilty a way that no one is telling them might send a poor message about who they really are and incorrect message, or is it worse to show something, even if it's a little edgy, to really drive the message home? >> look, this is i think the most popular romantic comedy of all time. it's a part of american culture. to say that you can't show it in the school to me is -- it's part of our society. it's what we all grew up watching. >> this is how you should work? this is a prostitute. >> this is -- you do mott know what she does for a living. >> it doesn't matter. you know she's not dressed
appropriately for high school students. >> i'm wearing high boots and a dress. that doesn't mean i look like a whore or prostitute. >> there is a need to get our message sent across. the teacher is upset -- i was just trying to tell them, because no one else is. if they're not going to get the message, that's actually worse. if the choice was to not see this film, not see the clip and see julia roberts, cute as she is, dressed inappropriately as the school would deem, is it worse to not see that and go on dressing a certain way no one telling you? >> i think it's okay to tell kids if they're dressed really inappropriately. i'm also a big believer in expressing yourself and look, i want my kids to dress appropriately for school, but if they have a certain style that they like, i let them go for it. i really don't monitor that. >> yeah, but if you had a girl and i have a baby girl, i know that i don't want her dressing a certain way. and in school. there is a certain way, a certain protocol and i'm sorry, there is just a certain way. when you're adults, it's a different story.

(scream). >> police in hammond, indiana, they pulled the car over because they say the driver was not wearing a seatbelt. she had her license, but her passenger, right there, did not. the passenger refused to get out of the car for 13 minutes. he kept reaching into the back seat, leading police to think he had a gun. after he wouldn't show his hands, the officers broke the window and tasered him. the couple is now suing, claiming police used excessive force. their 7 and 14-year-old children, you can hear them screaming, they were in the car. one of them recording what happened. the hammond police department defending the incident, saying this, they're also defending the officers involved and saying, quote, at all times they were acting in the interest of officers' safety. the e-mails are pouring in and i know that you guys have some of the response from some of our viewers. >> thank you very much, heather. penny says, quote, that man should have known that it is
always better to follow police orders than to give them a reason to be suspicious. >> darryl said, as an american who strongly supports law enforcement, i am disgusted by this governmental police excess. >> rick says this, i don't understand why people refuse to comply with requests from police officers and then try to make themselves out to be victims. his actions got him into this situation that occurred and the police were only trying to do their job. >> well, i tell you what, when you just look at the video without reading the whole story, you think, clearly it's one thing. but then you read all the other stuff and then it's like wow. obviously the family thinks they've got a case because now they are suing the police officers. >> right. just feel so terrible to hear the kids in the back. >> they had to witness it. one of the lines from the cops was, do you want me to smash this window and drag you out in front of your kid? and he did. >> well, the guy in the passenger seat was not following the police directions, is what the police say. keep the e-mail coming.
we'd like to hear more. we turn now to heather. >> good morning to you. we reported on this story about military members being at risk as a result of isis. now we have just learned why the u.s. army warned about isis tracking down military families on social media. it all started because of an air force father and his teenage son were targeted on facebook. this happened after the dad posted pictures from a flight over iraq during a recent bombing campaign. last month's bulletin warned that isis wanted to use social media to find members of the military and their family members and murder them. this is a story that we've been following for some time now. angry parents and students swarming a school board meeting in new jersey after the school district canceled the football season over allegations of widespread bullying. >> i'm so heart broken. >> why is that? >> because i like the football team. >> everybody makes mistakes. i don't think we should cancel it because -- it's because of somebody's mistakes.
>> this is sarahville high school in new jersey. the superintendent of that district standing by his decision, saying there is zero tolerance for bullying there. police are investigating. he made a movie exposing problems with obamacare. now he's starring in his own real-life drama. >> hi, i'm logan clements. i produced a movie against obamacare called "sick and sicker." then the irs hit me with an audit. >> clements says he has never been audited before he made that movie. this comes one month after the breitbart news announced it, too, was being audited. this story is getting a lot of attention on line this morning from folks who follow us. a pop quiz, who is a greater threat to world peace? is it america or is it isis? what students at harvard university said is going to surprise you. >> in many ways i have to think it's america because america is making decisions that are much more likely to affect the world. >> american imperialism and our protection of oil interests in the middle east are destabilizing the region.

you look at the exposure in terms of health workers already. many of them that don't have proper equipment, but there have been fatalities. there have been illnesses in terms of ebola. then on the customs issue in america, people when they come to the united states, they get a form. let's show the form that they get. they sign a customs form from the border patrol. >> declaration. >> and the declaration is, have you got any money? you got any vegetables? you got any fruit? you got any seeds or insects? you've been ex pokessed to farm animals? you got any commercial merchandise? are we saying if you've been exposed to ebola? have you been exposed to ma irrelevant layer i can't? or yellow fever? what have you been exposed to? so on monday the president said, we're going to have more effective screening measures and the people at the customs and border protection are working at it. the cdc is working at it. but ebola has been around for 40 years. so how long do we work on it? all i'm saying is no hysteria, no panic, no condemnation of the
