are disappointed president xi wasn't able to show up. the prc will be represented at some leader level. there's a lot at stake for china in this meeting. they should have interest in some of the international investment opportunities, climate change issues we will be pursuing. >> reporter: a big thing on the agenda reforming the world bank. the us wants to get 70 plus developing countries a place to go for loans so they don't get high interest chinese loans. i asked kirby if he agrees with the characterization that the us is just trying to buy off these developing countries. he said absolutely not. back to you. pete: we are hearing the press doesn't have as much access as in years past. some these trips have not gone well for the president. what is the white house saying about press access and how the president is doing? >> reporter: they wish they had more press access. each country's decision to limit it like this, there's nothing we can do. i don't know that it helps the perception back at home, poll after poll after poll showing that voters are thinking of president biden might be too old for another term. i had a chance to ask john kirby about that as well. >> he is already up and at it and he will be until the end of today. look at the agenda for the rest of this trip. he is engaged in the world stage, acting in the best interests of the american people and our national security by being here at the g 20 trying to advance opportunities for better prosperity and security and that includes vietnam. he will make that stop in alaska. he is on the move. >> reporter: the schedule has a lot of stuff in it. the hours are wacky. in new delhi you have to start your day at 11:30 p.m. eastern. people back home are not seeing that in action because the access is so limited. there will be another stop tomorrow in hanoi in vietnam. another press conference with president biden but in terms of this over the weekend g 20 stop, we are not seeing very much. rachel: is hunter biden on the trip? >> reporter: hunter biden on the trip? he is not, that we are told. rachel: thank you so much. glad to see that the president is in india taking care of climate change because that's the most important thing right now. will: meanwhile, this is a big decision, the fifth circuit court of appeals, the affirmation of lower court ruling that the biden administration violated the first amendment of the united states when they pressured big tech companies into censoring americans. jeff landry said the fifth circuit unanimously affirmed the injunction, freedom of speech a major win against censorship, totalitarianism and biden. pete: remember that moment, who knows? on what topics and the way in which the federal government use powerful agencies to strongly suggest pressure/tell tech companies to censor certain speech, certain individuals. the court in retrospect. will: this is important because this is the fifth circuit court of appeals. three levels of appeal and the court system. theoretically you could find a federal judge at the district level, and to one side or another. now you've gone up and there's nine districts. that is the supreme court of the united states. he rachel: you think it would go there? >> an injunction to coordinate or influence big tech censorship. you have to think the administration would appeal. a white house spokesperson says the administration has promoted responsible actions to protect public health, safety and security when confirmed by challenges like a deadly pandemic. consistent view remain social media platforms have to take effect, account of the effects of the platforms on the american people to make independent choices about the information they present. rachel: this is a big win at this level for free speech in america but can't forget how many people actually died because they were censoring because they wouldn't let people talk about other ways to treat covid. they wouldn't allow you to talk about ivermectin, or doctors who said lockdowns were a bad idea or shouldn't ask kids, kinds of things that happened and i think that has to be accountable, people have to be held accountable for what happens because of censorship. pete: they want to promote responsible actions can you can drive a truck, who decides what a response of election is? they want to do that. they certainly believe it should be within their purview to influence social media companies which i would bet it does get appealed. it is nice to feel when things get appealed you get a sense of the ruling from the supreme court. to go back to some people who revealed want went on in this process, remember mike taibbi and the twitter file hearings about what happened with censorship throughout twitter based on what was revealed to them by you on musk. march 9th of 2023. watch. >> twitter files, state attorney general lawsuits, investigative reporters revealed a large and growing network of government agencies, academic institutions and nongovernmental organizations actively censoring american citizens often without their knowledge on a range of issues. they aren't asking for a national debate over the first amendment. they are creating blacklists of disfavored people and pressuring, cajoling, demanding social media platform sensor and band the people on those lists. the original promise of the internet was it might democratize the exchange of information globally. a free internet would overwhelm all attempts to control information flow. its very existence a threat to anti-democratic forms of government everywhere. what we found in the files is a sweeping effort to reverse that promise and used machine learning and other tools to turn the internet into an instrument of censorship and social control. unfortunately our own government appears to be playing the lead role. pete: to keep the story going throughout the morning, the take away is when a government declares an emergency, it absolves itself of having to live up to its constitutional limitations. you have a right to free speech until there is a public health emergency. watch this happen over and over again and we will talk about it as we speak. new mexico declared an emergency suspending the second amendment, if you declare an emergency you can suspend any institutional right. that is the door. if it was already tracked, it was busted wide open. it has not been shut. rachel: the interesting thing is those were two journalists but those journalists revealed this and talked twitter files and been on this side of censorship. they are not accepted. what does this say about our rest of the journalists in our country? what does it say about the state of journalism that not every journalist, no matter what outlet they are or what their political leanings are that they aren't supporting those two guys and this issue of trying to get the government out of censoring people. seems like that should be something journalists would care about. pete: and have things go the way they want. rachel: a really weird coalition between government and big journalism. pete: and without elon musk. rachel: we turn to your headlines. authorities revealed another sighting of the convicted killer who escaped a pennsylvania prison more than a week ago. someone saw danilo kavalkante running outside of philadelphia. the prison tower guard on duty during the murders escape has been fired. he is an illegal immigrant found guilty of killing his ex-girlfriend. now to a fox weather alert, hurricane lee is forecast to remain a major cyclone in the atlantic even though it has been weakened since yesterday. the us air force filling this footage from the higher by hurricane thursday after the storm escalated from category one to category 5 overnight. it is still not entirely clear if lee will make landfall in the us but it could still bring very dangerous rain, wind and serve to the eastern seaboard over the next week. for more on this, you can download the fox weather apps or stream fox weather on any of your connected devices. teachers in one school district will be seeing double as 17 sets of twins are due to start kindergarten this monday. the twintergartner will go to school in the philly suburbs. the highest number of twins ever welcomed. one of the students is excited to hug her twin brother anytime she wants. will: that is what i was blown away by. it is all around philadelphia. is it one school district? you talk about the effects that happen if you start at a young age which is what we are seeing. it is a gateway drug to other kinds of drug use? also what will it do to the population with this many people checked out and high on marijuana? >> not much. from what i've seen on this report it demonstrates how politicized this georgia prosecution has been from the start and how they were trying to pool in everybody that bought a plane ticket to atlanta during and after the election. i campaign down there a couple weeks, i'm surprised my name wasn't on the list because it was that broad, how they were trying to pull in everybody and anybody who supported donald trump or questioned the election outcome. will: what is it? lindsey graham and kelly leffler and david perdue were not charged, is it some conspiracy to commit election fraud which would have run headlong into the first amendment? >> that's the whole problem with this rico conspiracy that is pending. it is overly broad, rubs up directly against political speech and the first amendment rights that individuals half. is going to be very interesting as the case twists and turns and find its way to the court as to what the appeals court and other judges think of the case and how it ultimately is determined. will: you are here from iowa, today is a big rivalry game, the iowa hawkeyes as you play for iowa and you will be there today as well donald trump and ron desantis, they will all be at the campaign today, what can we expect? >> i invited donald trump to the tradition of the rivalry, two conferences, the big 12 and the big 10 super conferences as we do realignment in the united states college football but it is such great pageantry, such a great tradition, it is going to be just north of one area and this is, people come to the state fair to do politics and understand iowa and this out-of-state game is so many people coming up to be part of the tailgate and part of the experience, two teams that really take the game seriously and want to prove what they have this season. it is always early in the year the weather is gorgeous and perfect. will: out of curiosity, since you invited donald trump what is it going to entail, tailgate, sitting in a sweet? >> that is a secret plan but donald trump does best when he's meeting folks and sharing his vision so i think we will have a great chance to see a lot of people. i've got more invitations to tailgates this year than i ever have. it's going to be a lot of fun. i know donald trump is looking forward to it. will: i don't think you're an unbiased and objective opinion on this game. >> it will be a close game, great defense of iowa about offense to prove itself, it will be a close game, last year's 10-7, iowa pulled it out. will: a typical offense of explosion, 10-7. >> despite the phone booth. will: i love regional rivalries in-state. it is what college football is about. that regionalism is more generically what it is all about. it is a little broader. it is the game of the century. all right, we will be watching along with you and donald trump in iowa state, thank you. over to you. pete: game of the century? >> not really. i have been doing this for 22 years now, watching free speech on campus my entire career and elite schools always do badly. it's always a question of which one is on the bottom of the list. last year was colombia. in some ways may be expecting gail to be worse than harvard but yale was not. harvard has a bad record the last 10 years when it comes to defending academic freedom and free speech. pete: is that students? professors? everybody? how do you get a negative score? >> harvard got a negative 10. the bottom three schools were georgetown, university of pennsylvania, philadelphia, harvard, university of pennsylvania got 11. harvard got 10. every time you don't stand up for student rights you get a-or don't stand up for professors rights. we weren't expecting anyone to get a negative score so we rounded them up. the main thing about the survey, harvard people are trying to dismiss it. it is the largest survey ever conducted of what students think about the environment of free speech on the ground, rely on four additional databases. not likely have it out for these schools. uva finishes in the top 10, university of chicago always does well but schools like yale, columbia and harvard earned their spot. pete: how do they explain it. do they know how authoritarian one viewpoint is?
