Theyve been looking for the shooter for 18 hours. They have several hundred agents looking for him. Theyve stepped up security at the Christmas Market in strasbourg and throughout the city and frances border with germany with questioning whether he may have slipped into germany overnight. The police have also identified him. They say he is 29 years old. That he was born in strasbourg. A home grown problem and known to Security Services as a possible terrorist threat. Police say the gunshot wound you mentioned is from one of their own. They exchanged gunfire with him. They say he opened fire at about 8 00 p. M. At what is essentially frances biggest Christmas Market. It attracts more than a million visitors a year. You can imagine how busy it was. Pandemonium ensued and then the police put the historic city on lockdown. Not the first time a Christmas Market has been hit. Berlins was hit two years ago when the assailant drove a car into the Christmas Market killing 12. And this exact market itself in strasbourg was targeted by Al Qaedalinked terrorists in 2000. Were awaiting Michael Cohens sentencing hearing at federal court in manhattan. Cohen pled guilty to charges including lying to congress about a proposed trump real estate project in moscow. We begin first with kevin corke live on the north lawn for us this morning. Any new reaction from the president on this sentencing as we await it . Not yet. But well keep an eye on his twitter feed. If the past is any indication, we figure the president wont miss an opportunity to weigh in on this particular topic. Cohen, as you know, will be sentenced for eight federal crimes he pleaded guilty to back in august as well as a separate charge of lying to congress that he pleaded guilty to in connection with the Mueller Investigation. Part of the plea deal cohen agrees to cooperate with special counsel investigation which could prove pivotal as the probe continues. I want to say what the president about cohens request about no time he said Michael Cohen asked the judge for no prison time. He could do things fraud, loans, taxes, etc. And not serve a long prison term . He makes up stories to get a great and already reduced deal for himself and get his wife and fatherinlaw, who has the money, question mark, off scotfree. He lied for this outcome and should in my opinion serve a full and complete sentence. President s dont usually weigh in on this before theyre properly adjudicated. This is not the usual presidency. I think thats something this president takes great pride in, sandra. Sandra kevin, more fallout from the president s warning yesterday that he would shut down the government if he does not get funding for that border wall. There is no question about that. This man is bound and determined to get funding for the wall or else. And the or else is something we just saw play out yesterday before the nation that dramatic and quite frankly stunning interaction between the president , nancy pelosi and Chuck Schumer yesterday here at the white house. Back to twitter the president talking about this idea of not getting 5 billion for the wall. He tries to draw a distinction here between something the democrats did previously. He says the democrats and president obama gave iran 150 billion and got nothing. They cant give 5 billion for National Security and a wall . Now, we wont get into the fact that was irans money from 1979. I dont want to make people confused. But lets take you through this. The wall was a campaign promise. Many on capitol hill including Lindsey Graham are urging the president to stand his ground, which is exactly what he plans to do. President trump i dont mine owning that issue. Chucks problem is when we last closed down, that was his idea. Honestly he got killed. You know what, rather than us debating who is owning it, ill take it. Ill take it. If we close down the country i will take it because were closing it down for Border Security and i think i win that every single time. Thank you for coming back. What is Michael Cohen up against today, sir . Well, its a very unusual situation where you have two prosecutors, the seventh district urging a long, long sentence saying the cooperation wasnt enough to justify a substantial reduction and then you have the special counsel kind of saying something different. Saying yeah, he did cooperate. My suspicion is that the judge will kind of split the difference and maybe not give him the maximum of four or five years. Unlikely to give him no jail time that his lawyers are seeking but perhaps a shorter sentence of one or two years representing the attempt to cooperate at least with the special counsels office. People cooperate get some reward. Bill help us understand why does muellers office look at him more favorably than the federal prosecutors in new york . I think the federal prosecutors have a deep review of what he has done over the years and looked at his history and financial corruption going back a long time with taxi medallions and other financial corruptions. They look at the whole person whereas mueller only has him for lying and he looks at kind of only a snapshot rather than a video. So its not surprising that prosecutors looking at different aspects of cohens life and cooperation would come up with different recommendations. Now, the judge has to look at it holistically. He has to look at the past, the present, the future. Will he still continue to cooperate . And this judge is a very able judge and i suspect that he will give a sentence that represents both points of view of both prosecutors. Bill cohen could still strike a deal whether its today, a week, or a month, or a year from now. You can strike a deal ive seen deals struck after the person got out of prison in order to get some collateral relief. There is never a statute of limitations on striking a deal. Bill if there is one to be struck. The president gave a couple interviews yesterday, one was in the oval office. He told reuters this when they asked about impeachment. It is hard to impeach someone who hasnt done anything wrong. Ifm owe not concerned. I have think the people would revolt if that happened. You wrote the book on that. What did you think when you heard that comment, sir . Its not going to happen, first of all. He wont be impeached unless massive new information comes out. I suspect the special counsel report will include lots and lots of sins based on political and based on circumstantialall evidence but i dont think he will come up with an impeachable offense. Treason, bribery, other high crimes and misdemeanors. The most theyve come up with is a very Questionable Campaign contribution issue that failed years ago. I dont think were in impeachment land and i dont think president s ought to be suggesting any kind of nonlegal response to impeachment. If were to be impeached and removed lawfully, wife i dont think is possible, which i dont think is possible the rule of law would apply and people would have to accept the result. If he were impeached and he challenged that and took it to the Supreme Court, in my book i spell out that possible scenario and whether the president would accept the verdict of the Supreme Court even if he didnt accept the verdict of the senate and house of representatives. Interesting hypothetical of the kind i would present to my law students at harvard but it wont happen in real life. Bill hope you stick around later today. So lets stand firm and get it done and i do think nancy pelosi is wrong. I do think there are the votes in the house, House Republicans to pass the 5 billion for the Border Security wall. We should do it as soon as possible. Bill thats a very important point. Will the House Republicans pass it and hand it off to the senate . Because at that point you would have the debate cornered, would you not . Well, we need to have the debate. Thats the fundamental question. We cant say we dont think there are the votes. We have the 60 vote rule in the senate so well forfet and not even try. We have to have the debate and try. If we stand firm we can get it done. After all, this is what the president is proposing is common sense. We need a Border Security wall and need to reform our asylum laws. The caravan issued underscored it. Lets do what is good common sense policy and only one vehicle left to get it done. You have to jump on the train that will go all the way to the station. That train is the appropriation and funding bill. The president said well put it on that bill and stand firm and that is exactly the right thing to do. Bill here is Lindsey Graham saying the following. Here is whats so hypocritical. In february of this year 44 democrats, including schumer, voted for a bill that had 25 billion for a wall. 2013, schumer helped create a bill that i was part of that had 8 billion for a wall. 42 billion for securing the border in other ways. So they want trump to lose more than they want the country to win. Bill what do you think of that . He said he would stick by the president. He said he had had enough of liberal arrogance. Take it on, stare it down, see what happens. Senator graham is right on target. They used to be for common sense policy building a Border Security wall, getting control of our southern border. Now theyre for open borders and abolishing ice. The leader of their party in 2016, secretary clinton talked about a borderless hemisphere. They have changed and a lot of it is about what senator graham said. They are just against anything the president is for. But here is the important thing. The American People are for this. This makes good common sense. So lets put it on the bill and send it to the senate and have the debate and lets win. Bill one more thing. You want to insert 5 billion to wall funding. Catch and release by reforming the asylum laws. How would you do that and why is that important . Its important because the whole caravan issue underscored this is critical. 85 to 90 of the people seeking asylum arent legitimate asylum seekers. Catch and release and they never show up for the hearing. You have to reform that for the caravan concept weve seen unfolding in the country. Those two things, common sense, those two things address the problem. Those two things are what we have to fight for in the bill. The most important is the 5 billion for the wall. I think certainly there is growing disen chan muchment with mays leadership within the conservative party. She is seen as extremely weakkneed in her negotiations with the European Union. She is no Margaret Thatcher. She has cowered before the e. U. And the brexit negotiations and many conservatives feel theresa may is far too weak a leader to take britain down the path towards brexit. So hence this no confidence vote this evening. Sandra its fascinating to watch it all play out. Probrexit lawmakers put out this joint statement saying in the national interest, may must go. They are making the case that her plan fails to deliver on the clean break from the e. U. That they want. How do they see that . How does it break from that . Right. Theresa mays proposed brexit deal she has negotiated with the European Union is a very, very weak agreement. Basically the agreement means britain will be kept inside the e. U. Indefinitely. Britain cannot sign free trade agreements and ruling from the European Court of justice and britain will be a satellite of the European Union. Many brexit people within the conservative party said enough is enough. She cannot lead britain any longer. Without a doubt it is a disastrous deal she has negotiated. There is no prospect whatsoever she will get this deal through parliament. The only course forward for britain, really, is to move towards a no deal brexit. But theresa mays leadership has been incredibly poor. And i think the mood within the conservative party is theresa may has had two years to negotiate this deal with the European Union and has failed miserably and bullied by the e. U. And this is unacceptable state of affairs. Sandra you are seeing a lot of the uncertainty play out. Well see where it all goes with the next vote about to happen. Now i want to turn to the latest on this france terrorist attack and the manhunt that is currently underway at this hour as we learn from witnesses at the scene of that Christmas Market there that this person entered yelling allahu akbar, arabic for god is great. What can you tell us about the latest were learning that as that manhunt continues . A huge manhunt taking place in the area surrounding strasbourg. He is a French National of moroccan descent radicalized in prison. Convicted no less of 27 times and on a terror watch list and still allowed to roam the streets. This is another political crisis for macron following weeks of huge street protests. This will add to the pressure on his presidency. But without a doubt this is a reflection of the fact that as long as terrorism in europe remains a huge threat and this individual should not have been allowed to walk the streets of strasbourg or any french city, a failure on the part of the French Administration and it also, i think, emphasizes the point that france and European Countries need more secure borders, they need tougher measures against islamist extremists. And you know, with a company like google that has 90 of the search taking place in the United States, and youtube their subsidiary has 75 of american adults. 95 of 18 to 24yearolds using their service even the mere suspicion they would use their algorithms to influence political bias or promote their products over their competitors raises a lot of issues that need to be addressed. Im glad we held this hearing. We didnt get all the answer we needed from mr. Pichai but he definitely took a lot of questions on a lot of subjects and agreed to get back to us on some there wasnt the time or couldnt go into the depth that needs to be done to look at those things. This is a very important issue and these companies with huge market share either need to do more to educate the public, more to selfpolice, or they will face various reviews in the next congress. I wont be here to do it but i know others will. Sandra some people hear that as republicans talking about regulating business. Are you talking about regulating some of these Technology Giants like google that you just mentioned dominates 90 of the search market, mr. Chairman . I would prefer not to regulate but i do think the application of our antitrust laws, which promotes fair competition, needs to be reviewed and i think that the fact that google, unlike fox news or a whole host of other news organizations that edit their content, determine who gets on their programs or what appears in the newspaper and are subject to libel laws. They dont now its clear that Companies Like google are doing more to edit the content that appears on their platform making them more handson. If it were just here is our platform and put whatever you want on it, that would be totally free speech. If its not free speech why do they get a free pass on protection against libel, for example . There were so many questions asked that we have about privacy issues or conservative bias when it comes to such a big company thats part of most of our lives. We are awaiting Michael Cohen, the president s former personal lawyer. Were awaiting his sentencing. It is expected in the 11 00 a. M. Eastern time hour this morning. So Michael Cohen on his way to learn whether he will go to prison for pleading guilty to tax evasion, lying to congress and Campaign Finance violations. As we await that, mr. Chairman, and finish watching that picture there, i want to transition to the latest words from the former director of the f. B. I. James comey over the weekend said this. Is the president of the United States right now an unindicted coconspirator . I dont know. Not in the formal sense that he has been named in an indictment but if he is not there, he is certainly close given the language in the filing that the crimes were committed at his direction. Sandra now he said that regarding Michael CohensCampaign Finance violations and i just want to sort of get where you are on all of this as we do await that sentencing in the next couple of hours. Well sandra, as you know, the task force that i, along with trey gowdy chairman of the Oversight Committee launched a little over a year ago has stayed away from mr. Muellers work but i will say it would be good if other people like james comey did the same thing. I have think those are very uncalled for comments. Lets see what happens to mr. Cohen. Lets see what the special counsel brings forward. So far i havent seen anything that would indicate that the president is responsible for the kinds of things that other people are suggesting. So lets wait on the evidence before we draw these conclusions that people want to draw about this. Sandra what conclusion can you draw after having james comey behind closed doors and we all got a look at that testimony . Go ahead. What we were looking at was the way that the f. B. I. , which by the way is the most important Law Enforcement organization in the world. Tens of thousands of people every day keep us safe. Theyre great people. But a handful of people at the top of the f. B. I. In 2016 and early 2017 did a number of things that were contrary to f. B. I. Protocol that seemed to favor the investigation of socalled trump russia collusion and disfavored doing anything about the Hillary Clinton email matter. Two of the most important investigations they conducted during jim comeys watch. The fact of the matter is they were treated differently. Its important the f. B. I. Be reformed. Chris wray has cleaned house. Most of these people are gone. Probably a few more that need to go and followed the recommendations of the inspector generals report in terms of making reforms to make sure that investigations are not conducted the way these two were in 2016. The problem we have is in the senate because of their rules and the president was saying this yesterday you need 10 democrats to vote for this bill to get to 60 to pass a border bill. I thought it was fascinating. I love the president in the sense he says lets have an open debate and conversation, let the American People see where i stand about Border Security but also you can see where nancy pelosi and chuck stand. They are talking about Border Security but there is no plan that they have to secure the border because they like open borders. They are okay with people flooding into the country. Bill, we had a vote three months ago on the house floor that said you can only vote in an American Election if youre an american citizen. Illegals cant vote in our connection. Most of the democrats voted no or president. They dont think you need to be a citizen to vote in our elections. Nancy pelosi is in a tough spot. She wants to be the speerk. She doesnt have the votes to be the speaker. If they cave the left wing in her conference wont vote for her. You have two prosecutors, the seventh district urging a long sentence saying cooperation wasnt enough to justify substantial reduction and you have the special counsel kind of saying something different. President trumps former personal attorney and fixer could have faced up to 70 years in prison on all nine charges which including arranging hush money payments for two women that claim to have affairs with president before he took office. President trump called it a simple, private transaction which he considers a civil matter, not criminal. Cohen is facing one count from special counsel Robert Muellers office for making false statements to congress about a russian real estate deal known as the moscow project which he at first said was not in play during the 2016 campaign but later admitted it was. While cohens attorneys have asked the judge in the case for no prison time and mueller praised cohen for cooperating in the russia probe, federal prosecutors with the u. S. Attorneys office are asking for considerable prison time saying he hasnt cooperated fully with them. While the government has downgraded the federal recommendations for sentencing theyre still asking between 3 1 2 and 5 years in prison for cohen. Were most likely going to see Michael Cohen go home today and have some time to get his affairs in order before turning himself in. Legal experts say it could be between 30 and 60 days. He still has some negotiating power left once he goes to prison. If cohen is sitting in jail he may decide maybe i should tell them about other thing i didnt tell them about. If he provides that information he can get additional credit and get a reduction on his sentence. For what its worth, President Trump weighed in on all of this tweeting he lied for this outcome and should in my opinion serve a full and complete sentence. The other very minimal sentence. How can they be that different unless nobody really knows exactly what Michael Cohen is saying and whether or not its true . Thats the fundamental issue with him and remains that case even with the sentencing today. Michael cohens crimes are personal to him. They are not in connection with anything that has in my opinion liability for the president. Let me put on my lawyer hat a second. Client goes to the lawyer and says i want you to make a settlement. The same kind of settlements ive made when i was a private citizen. Now running for president. He asks Michael Cohen to make a settlement, the same settlements he made before. Cohen makes the settlement. If he thought the settlement was improper or illegal he should have said to the client you know what . Its a different time. This may be a violation. Im not going to do it. The fact is Michael Cohen did it. And now he admits he did something he knew was illegal. You cant pin that on the client. I think trying to have guilt by association or guilt for the bad acts of one on another, there is no allegation that the president knew it was illegal. I happen to think it was not illegal. Cohen pled to it. I dont know why he did. I think it goes too far to have guilt by association saying the president somehow is liable for the bad acts of a bad lawyer. Ill take it personally and professionally. Personally, you know, when we saw his children around him come out of his house this morning, cohen, you just feel sad as a father that you are seeing this. In one respect i hope theyre lenient. On the other aspect i depended on my lawyers to be the sheriff. The hard line in the sand. There is no gray area. Its black and white and you tell me right from wrong. If i think im doing something wrong. And he did not do a very good professional job for his clients and it is coming home to roost. Therefore he is screwing with the wrong group. The Southern District. They are a take no prisoners office. I am not feeling really that good where this outcome will be for him. What do you want to believe . Even the prosecutors cant agree on whether he was helpful or not helpful, which means they cant agree whether he was telling the truth. If he is sentenced to years in prison, what that looks like to have the president s former personal attorney sent to years in prison. His sentencing hearing starts at the top of the next hour. President trumps former personal attorney could be facing some serious jail time. Well see, a federal judge deciding his fate today taking into consideration his cooperation with the special counsel robert mueller. Cohen entered guilty pleas in two separate cases, one brought by mueller, the other pursued by federal prosecutors in new york. Bill want to bring in our headliner Andy Mccarthy, former u. S. Attorney. Nice to see you, sir, a lot of notes for you. Law 101. What do you expect in 30 minutes . Usually what i would expect is that the judge will give roughly the sentence the prosecutors have recommended, which the defense isnt fighting that hard, about 42 months, less than what cohens sentencing guidelines would have been for the array of especially fraud charges that he pled guilty to. But is a recognition of his cooperation, limited as it was, with the Mueller Investigation. The Southern District said normally 51 to 61 months. We wont make a motion for him as if he were a full cooperator would require Global Cooperation on his part. Everything he possibly knows about himself and anyone else. He wasnt willing to do that. They did want to give him credit for what he gave to mueller so he gets a shave of a few months. Bill here is what the a. P. Writes. He dodged taxes, pled guilty in august, pled to cooperate and mueller is looking on him favorably from what we read and understand and he changed his Party Registration from republican to democrat. I dont know why thats relevant. When you are said to be a cooperating witness and then the prosecutors say your cooperation has ended, what does that mean . What is he led to understand when he says ill give you this and ill give you that if you give me x, y, z. Let me break it down two ways because the timing thank you raise is important. Ordinary if a prosecutor had plans for a big case that was upcoming the last thing you would do is let a cooperator get sentenced. What you want is the cooperator to testify first at the big trial and then sentence because the testimony is going to be the most important part of the cooperation. That obviously didnt happen here and hasnt happened with any of muellers cooperators, which leads you to think he doesnt have anything very big coming down the pike because you wouldnt let these guys get sentenced first. You would make them testify first. In the Southern District of new york, my old office which is the office thats prosecuting cohen, to be what is known as a term of art in the district as a cooperator, you have to agree to tell the government everything, everything youve ever done from cradle to wherever you are in your life. Bill at some point they concluded that cohen is hiding something. He told them he wasnt interested in being a full scale cooperator. Bill we cant say whether or not he is keeping information from them that would implicate him or someone else. The suggestion in the sentencing memo is its about himself that he doesnt want to speak. He doesnt want to go through his entire history. Sandra based on the sentencing it doesnt sound like its the president. They know an awful lot about the president. Be difficult to think of an area sandra since the sentencing is about to happen in the next hour, what conclusions will we be able to draw about implications based on the sentencing . Sandra, i dont think you get anything more from the sentence the judge imposes than what weve gotten from the sentencing memoranda that were submitted particularly by the prosecutors. Thats really our window into where their investigation is going and how they evaluate cohen has a cooperator. The sentence the judge imposes is going to be a measure not just of what he thinks of those investigations and cohens value to them and what he thinks of cohens crimes, but anything on the Positive Side of the ledger that there is about cohen that comes from, you know, his family, his friends, people who would speak in his behalf. Bill this is what the president said on cohen. Number one it wasnt a Campaign Contribution. If it were its civil. If its only civil there was no violation based on what we did and add Michael Cohen is a lawyer supposed to know what to do. Thats what you rely on people for and pay lawyers for. Bill i think two things are going on. One is the Southern District is trying to make a case on the president as far as the Campaign Finance violation is concerned. They would not have elicited from cohen he was directed by the president if that were not the objective. But i think the president is right. I dont think this is a Campaign Finance violation and what i would say is turn it around. Suppose the president said yeah, i think thats a campaign its a Campaign Expense these payoffs to these women. You know what ill do . Ill take Campaign Funds and im going to pay hush money to these women. I think if he had done that, which is the assumption of the Southern District is that this is campaign matter, i think if he had done that the same people who were screaming felony, you didnt disclose under the Campaign Financing clause. Felony, they get him coming or going. And you dont want your criminal law should be clear law that Everybody Knows exactly what it is that theyre obligated to do exactly what is illegal. You dont have the criminal law intrude in a regulatory type situation where they can get you coming or going. Bill we want to get to flynn, too, right . Sandra yes. The fox headline if we want to throw it up flynn says f. B. I. Pushed him not to have lawyer present during interview. You have strong feelings on where this is. I think this is the biggest saint of all time, i really do. I cant believe that its that people arent screaming about this. General flynn is going to get a no jail sentence. If mueller had said nothing, right, general flynn was going to get a no jail sentence. He committed a process crime which has sentencing guidelines of 0 to 6 months but he is a first offender and on the Positive Side of the ledger he has a 30year history of courageous decorated service to the United States. There is not a federal judge in america that was going to put him in jail. What does mueller do . Mueller files a cooperation motion saying he has provided substantial assistance to our investigation and what is the result . Mueller asked for what the judge is going to do anyway. And then when the judge walks flynn, as Everybody Knows or should know that he is going to walk him, what will be reported is that he was given a no jail sentence because of the great cooperation that he gave to muellers investigation. And then everybody will look again at the sentencing memo i think seven pages and it is blacked out. You have two or three bill you say mueller is doing a head fake for the court, public or both . What im saying is i think there is no there there but theyve orchestrated it in a way that makes it look like there is explosive cooperation in there and its fortified by the fact that you have these black lined pages in the sentencing memo which makes everybody think who knows whats under there, must be some explosive stuff. Bill why would he do that . In order to generate the idea the investigation is making progress. Sandra to make it look like Michael Flynn heavily cooperated and there are the bombshells there with the redactions. What the secretary of state has called for along with secretary mattis is a ceasefire so that all parties to the civil war can arrive at the negotiating table in good faith. Now, ive been working on this matter since march of 2017. Ive authored resolutions and legislation, held hearings, given speeches, even put a hold on a nominee when secretary tillerson was finding his sea legs on this issue. Negotiations are going on but we need to apply more pressure that we can do on the u. S. Senate today so the saudis negotiate in good faith. Sandra the latest word from the president on this via a statement he says well, im much more open to yemen because i hate to see whats going on in yemen, he writes. But it takes two to tango. I would want to see iran pull out of yemen, too. How specifically is President Trump doing on this issue . Well, President Trump and his National Security team, as i indicated. Have called for a ceasefire on october 30th. They called for a ceasefire within the next 30 days by all parties. Now, our security partner, saudi arabia, has not honored that request. And so i guess my question would be why . And i think the answer is we in congress have not helped this administration apply enough pressure to our saudi partners so that they can be at the negotiating table in good faith. Again, the only way to reduce iranian influence in yemen over the longer term is to make sure the civil war destabilizing that country comes to an end and then iran can leave. Right now its unstable and iran and al qaeda and isis will continue to threaten not just their neighbors but even the American People if this continues. So today these votes will be important and i will be if given the opportunity, offering an amendment to the legislation were voting on today that will put refueling assistance away from saudi aircraft which have been targeting indiscriminately men, women and children in the country of yemen. That is inconsistent with our values and National Security interests and thats why folks back home understand this thing needs to be brought to an end. Bill final topic on the military budget. The president s tweet from a short time ago. Democrats do not give us the votes to secure our country the military will rebuild the remaining sections of the wall. Is it 730, 750 billion in the budget . What would you support . Would some of that money go toward Border Security and would you be okay with that . Alan dershowitz two hours ago saying this. Its a very unusual situation where you have two prosecutors, the Southern District urging a long, long sentence saying the cooperation wasnt enough to justify substantial reduction and you have the special counsel kind of saying something different. Defense team will get their turn in front of the judge and the chance that Michael Cohen could address the judge himself before he learns just how much time he may get behind bars after pleading guilty to all the charges against him. President trumps former personal attorney socalled fixer could have been facing a lot of years. 70 in prison, the maximum on nine charges. Eight counts from the Southern District of new york, tax evasion, Campaign Finance violations and hush money payments for two women who claim to have had affairs with the president before he took office, he denies it. Stormy daniels and her lawyer avenatti plans to speak after court. This week President Trump called the payments a simple private transaction that he considers a civil matter, not criminal. Cohen is facing one count from special counsel Robert Muellers office for making false statements to congress with a russian real estate deal known as the moscow project not in play during the 2016 campaign but later admitted it was. The attorneys have asked for no prison time and mueller praised cohen for cooperating in the russian probe federal prosecutors with the u. S. Attorneys office are asking for considerable prison time saying he hasnt cooperated. They still want the judge to give him roughly 3 1 2 years to a five year sentence. Cohen will most likely go home today and have time to get his affairs in order before turning himself in. Legal experts say even if he gets a hefty sentence he still has some negotiating power left once he goes to prison if he gives up any more information he could get time knocked off of his time. You can bet that he is watching this closely and yesterday in an interview with reuters he tried to distance himself from anything that might happen to Michael Cohen in court today on the issue of the illegal Campaign Contribution saying number one, it wasnt a Campaign Contribution. If it were its only civil. Even if its only civil there was no violation based on what we did. To add something to it. Michael cohen is a lawyer and supposed to noef what to do. Thats what you rely on people for. Thats what you paid lawyers for. As laura was mentioning the u. S. Attorney for the Southern District of new york thinks cohen should serve substantial jail time, a modest reduction from the guidelines. The Mueller Investigation, though, citing substantial cooperation cohen gave the office of the special counsel. Maybe the judge will see leniency after the plea deal. Mueller thinks he might be able to get good information from cohen and the best way im told by people who have done this before to get good information from people is to show that you can be lenient when their back is up against the wall. Bill well watch for that. What about the meeting and the fallout from yesterday with Chuck Schumer and nancy pelosi . I think we can safe life say that the honeymoon is over. There is no question about that. Real contentious meeting in the oval Office Yesterday in the back and forth over funding for the wall. The president s strategy yesterday was to have the media present while everybody in the room illuminated their contrasting points of view to let the public decide on who has the high ground. President trump yes, if we dont get what we want one way or the other, through you, military, anything you want to call, i will shut down the government. The wall is a part of board are security. You cant have good Border Security without the wall. Thats a political promise. This spirals downward when we came at a place to say how to meet the needs of American People. Bill nancy pelosi insisting the president doesnt have the votes in the house of representatives to get his 5 billion for the wall. The president said he has no problem shutting down the government on the 21st of this month if congress doesnt give him the money. The last time the government shut down was in february over daca recipients. Chuck schumer got blamed for it. He have is in there. Now all we have left to do is wait. The sentencing could come at any moment now. What are you anticipating . The Southern District of new york was pretty stringent in its recommendations for sen tnsing for cohen. The special counsel a little less so. Essentially agreeing that whatever he faces is what he should face. They felt he lied to them at times. Was not cooperative at the beginning and then eventually came around. I think this will be interesting to see what exactly he faces. All of the focus on the Campaign Finance violation is really coming into question and whether whether this is a real element that can be battled by this president. There are a lot of people pointing to john edwards and the court battle that said essentially that it was not a Campaign Finance violation to pay off a mistress. Other people are pointing to the fact that the prosecutor said that the president and the candidate at the time directed him to do it as an indication that goes the other way. Sandra Andy Mccarthy joined us last hour and he said this. If the prosecutor had plans for a big case that was upcoming, the last thing you would do is let a cooperator get sentenced. That didnt happen here and hasnt happened with any of muellers cooperators which leads you to think he doesnt have anything very big coming down the pike because you wouldnt let these guys get sentenced first. You would make them testify first. Sandra that was the conclusion he was able to draw based on what we know at this point, bret. He has a great point. The witness potential for mueller is pretty poor if you look at it. Youve got guys that have all either pleaded to lying or are getting sentenced for doing so. And i think that he is right. It is interesting to look at the big picture who are the witnesses that will come forward once this eventual big report comes out . Sandra we know the president maintains as he wrote on twitter on monday the payments were a simple private transaction that did not violate the law when it came to the hush money payments. Have to ask you about the Oval Office Meeting yesterday. People are still talking about it. It was something to have the cameras rolling with Chuck Schumer and nancy pelosi and President Trump trying to work something out. What was accomplished in that room yesterday . Well, it was accomplished in front of the media. I thought one of the interesting a couple of Interesting Exchanges. One was when np said get the cameras out of here and lets talk. And the president turned to her and said its about transparency, nancy. And then when senator schumer said after the president said after nancy pelosi said we just won the house he said i won the senate and Chuck Schumer said yes, but when the president is touting wins in indiana and north dakota, he is losing. Well, if you are a democrat in indiana and north dakota and the Senate Minority leader is saying you really dont matter. That was an Interesting Exchange there. I think you are seeing divided government 2019 style right now. I bet they make a deal and if the president gets any more money, maybe not the 5 billion but gets towards the wall money, i think he wins on this. Sandra wow. Both sides have leverage because trump is the president. He has the pen, veto pen and the signing pen. The democrats have leverage because they have the power of the purse going into the new congress. Whats insane here is that the democrats they have something that trump really, really, really wants, which is money for the border wall. He desperately wants it. Only they can give it to them. In classic negotiating strategy its called leverage. When you have leverage you use it to extract what the expert call concessions. When both sides do this the experts say in negotiations the result is compromise where both sides get something they want and give up something they dont want to give up. Thats how the world works. Whats insane here is the democrats are unilaterally given up their leverage saying under no circumstances will they fund trumps border wall. Thats insane. That is the giving away the chip they have. The thing that trump wants that they could use to get all sorts of concessions from him on any range of policies. And they are just unilaterally giving up that makes no sense. Sandra jim jordan was on earlier and said this. We need to have the debate. We cant say oh well, we dont think there are the votes. You have the crazy 60 vote rule in the senate. We have to try. We have to have the debate. I think if we stand firm we can get it done. After all, this is what the president is proposing is common sense. We need a Border Security wall. We need to reform our asylum laws. The whole caravan issue has underscored that. Sandra passionate thought from jim jordan there. Yeah. Trump is right that they can pass it in the house probably especially now that pelosi has challenge trouble and the republicans will snap in line. But unless you get 10 democrats to go along with it it wont happen. This is again not this is not like 2009 when obama said elections have consequences when he controlled everything and had a filibuster proof majority in the senate. Trump has the white house and the expanded majority in the senate. Democrats will have the majority in the house. They need to Work Together and both sides need to give up something that they dont want to give up. I understand that nancy pelosi opposes the border wall. But if there is nothing inherently wrong with a wall. 26 Senate Democrats voted for the secure fence act including schumer to put 700 miles of fence along the border. No difference between a fence and a wall. Why not use it to get concessions . For example. Democrats could say well give you the 5 billion in exchange for a path to citizenship for dreamers and next year they could say you want another 20 billion for the wall . Lets do immigration reform. Trump would cut that deal in a heartbeat or do it for something unrelated to immigration. They want medicare for all, strengthen dodt frank, raise the minimum wage. The possibilities are endless. If you say im not going to negotiate on the wall and you give up your leverage you are more interested in resisting than governing and they arent ready to become a governing majority. Lets see what the special counsel brings forward and so far i havent seen anything that would indicate that the president is responsible for the kinds of things that other people are suggesting. He has pled guilty to charges in two separate matters including lying to congress about a trump real estate deal in moscow. Cooperating with the mueller team but faces substantial prison time. What does it mean for the president , if anything . Jonathan turley, constitutional law professor at George Washington university. How are you . Great to have you in today here. Good morning to you. Here is how i want to get a sense of what happens in court. The judge brings everybody in the courtroom. Does the state begin . Does Michael Cohen follow . Whatever witnesses speak in his behalf, what happens . Theyll hear the statements of both sides. Ive never been convinced the judges materially change their intended sentences during these periods. It is more likely when you see a change in the sentence it is because of the bad behavior of the defend dant. You can see a judge will creep up the sentence. The problem for Michael Cohen he is the least credible and compelling person to ask for a lower sentence. He has betrayed everyone. On everything. He has betrayed his bar, officer of the court, he betrayed the court, lied to the public, lied to congress. He is coming forth and saying but i had this redemptive moment where im helping the prosecutors. Even the prosecutors are divided. The Southern District of new york prosecutors dont believe he has fully cooperated while mueller believes he could be useful. So when you are faced with that if i was the judge i would put him at the top of the range. If i was the judge i would say look, you got a deal. You were allowed to plead guilty to fewer counts. You could have been looking at decades. You are looking at a maximum of five years. Consider yourself lucky. Bill the prosecutor has recommended four to five years, mueller says he has been cooperating. The prosecutors dont agree with that. Alan dershowitz if you cooperate a little bit youll get a year and a half. Is that what cohen gets today . He could. That would be the max but the problem is he already had a substantial cutdown in my view on the counts. But more importantly the prosecutors are divided. I think that rule of thumb may not apply here. The most important thing is he is an officer of the court. He violated his oath as a lawyer. Usually judges dont treat such individuals lightly or generously. Bill here is one of the comments the president made. He did an interview yesterday with the reuters news agency. It wasnt a Campaign Contribution. If its only civil there is no violation based on what we did. Michael cohen should have known what he was doing. I hope he did. My lawyers say everything he did was fine. How do you respond or analyze that in a legal sense, professor . Well, part of that is true. You are allowed to rely on your lawyers. I think the president is kidding himself if he doesnt view this as a very serious matter. He was just implicated by the department of justice in what is essentially a felony. And they detailed acts committed to conceal this type of federal election violation. Now, do most of these violations end up in civil fines . Absolutely. Is this a difficult type of case to prove . Sure. But the most dangerous thing is not the alleged felony, it is if mueller has evidence that there was later an effort to encourage false statements, to influence witnesses, to talk about perjury. All of those things are extremely sensitive felonies. You have to look at this allegation not in terms of its actual election prosecution potential, but the potential to have these other crimes that follow it, secondary crimes to conceal it. Bill it has been argued that if the president made the payment from his own pocket thats not illegal. If it came from the Campaign Funds that would be a different matter. As far as we know it was a and not b. Is that significant to you . It is significant. This could have been done so much better and easily. The problem is Michael Cohen is a dreadful lawyer. I said last year that the president should have severed him early on in the administration. That this daniels and mcdermott business would be more serious than the collusion allegations because of these miss steps. This was made far worse by a plan that was too clever by half. So we have to look at the reality of what happened and the reality is yeah, they could make out a federal election charge out of this. I would be much more concerned with what they have that followed the president coming into office. What mueller suggested is that cohen was brought closer to the white house, which is just absolutely unbelievable. That he coordinated with people in the white house. I came from a breakfast with the chairman of the Senate Armed Services committee. There is support to block the president from sneaking border wall funding into the budget. They see the call for a 750 billion Defense Budget as a negotiating strategy in the showdown with democrats over border wall funding. The president made clear his intent in a tweet yesterday quote, if the democrats do not give us the votes to secure our country, the military will build the remaining sections of the wall. They know how important it is. Just last week President Trump announced his top line budget for the pentagon was 700 billion for the 2020 Defense Budget, which would have cut defense by 5 from the current 716 billion. Now he says he wants 750 billion, the turnaround came after having lunch with jim mattis and both republican and senate House Services chairmen last week. If the president comes in at a low number it is guaranteed the Congress Wont increase that number if you have people in the congress who expressed doubts whether or not they can fund the full request. The pentagon reacted to the suggestion the military would build the wall. To date there is no plan to build sections of the wall. However, congress has provided options under title x that could permit the department of defense to fund border barrier projects such as in support of counter drug operations or national emergencies. Congressman adam smith, the democrat leading the house Armed Services committee starting next year did concede the military has been used to build parts of the wall back in 2007, he said. If it is determined that President Trump has committed those violations of law that would require or encourage the house to go forward, thats another story but were not there. So as of right now as you know there have been lots of contacts with the russians but in terms of criminal collusion, meaning that there was actually active discussions between the Trump Campaign coordinating activities with the russians, to my knowledge the answer is no. Thats the whole purpose of this Ongoing Investigation and i think its right for that investigation to conclude. Lets see what they come up with. And so were getting ahead of ourselves in terms of talking about impeachment. Bill if you are right and if it comes back to the Campaign Finance violation, how do you think that should be remedied . Well, there are a couple of things there. As the incoming chairman of the house Judiciary Committee jerry nadler indicated the other day, you could have grounds to move forward for impeachment on that but whether thats grounds to do it and whether you actually pursue impeachment is a whole other question with respect to threshold and thats why really the other issues that are being part of the Mueller Investigation are really important to get to the bottom of. In terms of how do you deal with it . Look, if its determined that the president knowingly instructed Michael Cohen to violate the law, to engage in a criminal act, then the recourse right now under the current Justice Department policy would be the president would be able to be held liable for that after his term in office. With respect to the campaign violation, look, Michael Cohen pleaded guilty to knowingly violating the Campaign Finance laws of the United States, which are designed to provide transparency to voters. We have Campaign Contribution limits. We have a law that says the public is entitled to know who is directly funding these campaigns. If the House Republicans have the votes and pass it, what would democrats in the senate do knowing youre up against the clock and a partial Government Shutdown that looms . We agreed to 1. 6 billion for Border Security. Senator mcconnell, the republican leader, serves on the Appropriations Committee and supported that. The issue here is not Border Security. Everyone wants Border Security. Its making the best use of american taxpayer dollars and building a huge wall along the entire border doesnt accomplish that goal according to the experts. Bill if you get the votes in the house were headed for a shutdown then is what youre saying because you wont have the votes on behalf of 51 republicans. We have the votes in the senate to do what the Senate Already agreed to do, which was to provide the 1. 6 billion. Look, youve heard the president the other day. I would remind people that the president told us all in the country that mexico was going to pay for this, right . Unless people thought that was a big joke, including his supporters, the reality is we wouldnt be in this situation today if the president , his promise had come true. What explains the mysterious phenomenon known as the Havana Health attacks . University of miami treated and studied almost all the patients here in miami just as soon as they flew out of cuba. Starting in 2016 and 2017 two dozen staffers stationed in havana started complaining of things like dizziness, headaches, weird sounds and the sensation of pressure changes. Initially doctors identified their symptoms as similar to that of a concussion. So here in miami 25 of the patients as well as 10 of their roommates who did not suffer the symptoms were treated and tested. They tested their inner ear performance. 92 had dizziness and ear pain. Doctors tested their cognitive performance with goggles measuring eye movements and reaction speed. 56 , about half had cognitive complaints. The researchers now dont describe the enigma as a concussion but more like ear damage. It is still a puzzle. We have objective evidence they had abnormalities. When they presented.
