>> that's the last time he will be on msnbc. the real question here -- the real question here is that jack smith overreached. he engaged in the use of novel legal theories that have never been used before. you saw him loads earlier this week on the interference with official acts statute. and now you are seeing him being curtailed and his theory that no president has any immunity from any act whether official within its core functions or not, it is just not the way the law has been for 230 years of american history. so, you know, these folks that are just like losing their minds over sort of a very common sense approach to presidential immunity, i think, are -- would rather just win the 2024 election than somehow continue this great american constitutional republic for another 250 years or more. >> jason: cnn is saying that alvin bragg's case against president trump could also be in trouble. >> do not be at all surprised if we see in the next couple days a motion from donald trump's legal team to throw out the verdict in the new york state case because some of the evidence that was introduced in that case had to do with conversations donald trump had with his advisers, including hope hix while he was in office. >> chris, what's your take on all this? how many of these cases are going to be in deep trouble? >> you know, it's just -- again, i think people are exaggerating. i think people need to take a deep breath a and, again, this is about the constitution. we are going to be studying in this case in law schools. people are going to be analyzing this case in 100, 200 years. this is about the president, our constitutional separation of power. anybody who looks at this as just being about the trump case has no idea what they're talking about. i mean, the supreme court understands that it's making law for the ages and it doesn't matter. like, who is the president? i mean, this could protect joe biden's hide because he would be subject to prosecution for having failed to enforce the immigration laws if somebody was murdered, many people have been murdered by illegal aliens. they could say well, joe biden, you are criminally responsible for that bell well, guess what? self-imposed by the president alone. this decision today has continued the court's attack in recent years on a wide range of law established legal principles in our nation. from gutting voting rights and civil rights, to taking away a woman's right to choose. to today's decision that undermines the rule of law of this nation. i mean four years ago my predecessor sent a violent mob to the u.s. capitol to stop the peaceful transfer of power. >> we all saw it with our own eyes. we sat there and watched it happen that day. attack on the police. the ransacking of the capitol, a mob, literally sent that mob to the u.s. capitol is facing potential criminal conviction for what happened that day. and the american people deserve to have an answer in the courts before the upcoming election. the public has a right to know the answer about what happened on january 6th, before they ask to vote again this year. now, because of today's decision, that is highly, highly unlikely. it's a terrie disservice to the people of this nation. so now, now the american people have to do what the courts should have been willing to do but would not, the american people have to render a judgment about donald trump's behavior. the american people must decide whether donald trump's assault on our democracy on january 6th makes him unfit for public office in the highest office in the land. the american people must decide if trump's embrace of violence to preserve his power is acceptable. prance most importantly, the american people must decide if they want to entrust the president once again the presidency to donald trump. now knowing he will be even more emboldened to do whatever he pleases whenever he wants to do it. you know, at the outset of our nation it was the character of george washington, our first president to find the presidency. he believes power was limited not absolute, oonged that power always resides with the people, always. now over 200 years later. today's supreme court decision, once again it will depend on the character of the men and women who hold that presidency that are going to define the limits of the power of the presidency. because the law will no longer do it. i know i will respect the limits of the presidential powers that i have for three and a half years. but any president, including donald trump, will now be free to ignore the law. i concur with justice sotomayor's dissent today. here's what she said. she said in every use of official power, the president is now a king above the law. with fear for our democracy, i dissent. end of quote. so should the american people dissent. i dissent. may god bless you all. and may god help preserve our democracy. thank you. and may god protect our children? [. >> president biden will you drop out of the race. >> [inaudible] >> why do you feel confident you should be the president? >> jason: that's addressing the supreme court ruling. let's bring in bret baier. bret, what was your take on that? >> bret: well, as predicted, he cited the dissent of justice sotomayor and said that it's important in his mind that former president trump faced this trial by the special counsel jack smith. but, it's really going to be almost impossible to get that trial before november election. you have to go -- it has to go back, according to the supreme court to judge chutkan. there has to be a determination of whether it was official or unofficial acts and then there is an appeals process that comes from that. it could end up back at the supreme court, which would take a lot of time. bottom line is that he is now running not only against donald trump, but against the supreme court and that is what he laid down, that marker. he did that in front of the small press pool. it wasn't the full panoply of the white house press corps. it was the press pool that is assigned every day. you saw he didn't take any questions as he walked off. did looked tanned more than he did on the debate stage. but, it is interesting that they chose to weigh in today and to cite the dissent of justice sotomayor in reacting to it. >> part of it did seem like he was giving a bit of a political speech there from the white house. i mean, he quickly turned to make it all about donald trump and the politics of the election as opposed to just the ruling. >> bret: right. he talked about january 6th. and he talked about essentially what i think you are going to see if he remains the nominee because it's so tough for democrats to unseat him if he decides not to step aside despite all the calls editorial boards and others circles for that to happen. i think that you are seeing, jason, the making, the blueprint of what this race is going to look like he is going to say giving trump the white house again would be worse because of what the white house did and the ruling they made today. bret baier, thank you. appreciate you joining us. we want to bring back in senator tim scott. senator, you saw this the comments from the president. what's your reaction? >> president joe biden just put a political target on the back of the supreme court. remember, the democrats have been talking for years about packing the court with 15 justices. >> the democrats have been talking for years about making puerto rico and d.c. states. this is a political decision to put a target on the back of the united states supreme court in order to win an election. i can't think of anything more misleading and disgusting than president biden bringing in to politics the supreme court of the united states. you will hear ads coming forth about more justices united states of america. you are going to hear ads about having more states in our union senate with more democrats so that they have a chance to make their voices seen on the supreme court for more liberal justices. this election has just become more important. the greatest threat to american democracy today has just become joe biden. position of weaponizing the justice system and now weaponizing the supreme court by making them a target for this upcoming election. we need a day of reckoning. we need four more years of donald trump. we need a justice system that we can count on and that means every single conservative and independent. we must vote in large numbers starting in september in north carolina and taking it all across this country. the time is now and we must act. >> jason: senator tim scott from the great state of south carolina. thank you so much for joining us. all right, we want to bring in victor davis hanson now, senior fellow at the hoover institution. what's your take on what the president did there from the white house. >> it was pretty rich. because this case would have never got to the supreme court had his own department of justice not appointed a special counsel that had a history of bias and went after the leading presidential opposition candidate to the president. and it wouldn't have come to the supreme court had fani willis not met with the white house counsel to strategy. it wouldn't have happened if the highest attorney in doj suddenly and at alvin bragg's prosecution. this was in response to the weaponization of the doj by none other than joe biden. second, it's very ironic jason because you see the special counsel, robert hur said that joe biden himself, while he was president, faced criminal liability. he had classified filings, which is a felony to be in his possession. he didn't notify anybody that he had them until he selected the special counsel to go after donald trump. and then he had a speech writer that had no security clearance that admittedly was looking at those files in the presence of joe biden. the only reason he wasn't prosecuted was robert hur determined that he was too infeebled and win the sympathy of a jury. you know, finally, they have been going after the supreme court. chuck schumer went out to the doors of the supreme court and called out by name justice gorsuch and kavanaugh and said you're going to weep the whirl wind. you don't know what is going to hit you then when protesters a year later started showing up including a potential assassin at the homes of the justices, merrick garland didn't enforce the law which was a felony to do that for political purposes to influence the supreme court decision. this was very tragic what joe biden just did. it was ironic, it was wrong and highly partisan and it's dangerous. >> jason: i think i would agree with all of that it is tragic. we need a supreme court with its independence the democrats are doing everything they can to make them dependent on whatever the political whim of the party in power and it's just disgusting. democrats have run out of things to run on. they can't run on the economy. this they can't run on the border. they can't run on protecting us oversays and all these wars that are going on. the mental and physical demise of joe biden is on display. so, they are going to pick, i guess, the supreme court. but a 6-3 ruling in this particular case is pretty convincing 6-3. >> yeah. especially when you seen what they have done to donald trump and what they will do to him again when is he probably going to be elected. and again, the irony is that joe biden violated his oath of office when he destroyed the southern border and allowed. illegally to enter the united states. a lot of people who felt that was a violation. as i said earlier he broke the law when he had his possession as president a classified file. >> jason: victor davis hanson thanks for joining us. i want to bring in ned ryun, founder and ceo of american majority. ned, what's your take on what the president said a few minutes ago from the white house? >> i saw a senile old man ranting that the left super majority, ie scotus is no longer under the control and actually doing constitutional -- fulfilling their constitutional role. i saw a bitter old man frustrated that his prosecutors can't continue their political lawfare against his chief political opponent because what the scotus majority said, jason, was just because your chief political opponent when he was in office in his presidency did things that he didn't like, that's not a crime, and then you can't throw your political rival into prison simply because you don't like him. and in the face of that and as response to that biden basically made the court a political target. >> the judicial prank stood up and said you can't do this executive branch and target your chief political opponent. that's what we just saw play out. >> well, this is the problem. and they are trying to grasp at anything. but i am really glad that chevron deference was taking down. if you want to get rid of the swamp that chevron deference is probably the most deficit san diego state to the swamp. >> exactly, no. the crack in the foundation of the administrative state began with their rejecting chevron deference, jason. and if donald trump wins and i hope that he will, day one, he continues to dismantle the administrative state. he says he wants to drain the swamp. the foundation of the swamp is the state. break the state, you drain the swamp, you get a chance to restore the republic and the chevron deference rejection is a massive step in the right direction. >> jason: ned ryun, thank you so much for joining us. all right, that's it for us tonight. i'm jason chaffetz in for laura ingraham. it's been a pleasure doing this. i hope you have a wonderful fourth of july weekend. i hope can you check out my book "the puppeteers."
