Milestone of 200,000 deaths from coronavirus, President Trump this morning again denies the reality. Were rounding the corner, with or but the a vaccine. They hate it when i say that. Thats the way it is. Were roundingin the corner on the pandemic, and weve done a phenomenal job, not just a god job, a phenomenal job. Its just not true. Its not true. The data belies that claim, and right now look at the map. Thats 28 states across the country seeing a rise in cases. Cnns alexander field, she joins us now with the latest. Okay. So how many states, how bad and what are experts attributing this to at this point . Reporter yeah. Absolutely no evidence that we are rounding the corner here. In fact, experts are saying that there is a clear spike in the number of cases. What isnt clear is whether we can attribute this to labor day gatherings or whether this may suggest a resurgence for the fall and winter months ahead. The data is very clear. If you look at the National Average were seeing an upward climb, averaging around 41,000 new cases every day across the country. The map spells it out as well. Doesnt look good. 28 states seeing an increase of more than 20 just the last week. All that have as the dc issuing new guidance that should make it even more clear just how easy it is to transfer this virus. Previously the guidance from the cdc was to stay six feet apart. They said the virus could spread through droplets, coughing, sneezing and talking and we can transfer it to each other just by breathing. Thats how simple it is, jim, poppy. Really important to the update. People are confused at this point since its been changing. As alex just mentioned the cdc has changed its covid19 guidance again and it now says, as she mentioned, it can be commonly spread through viral particles in the air. Before. With us now is senior medical correspondent elizabeth cohen. Elizabeth, listen, were learning more about this, scientists are learning more about this as we go, right, and theres been many updates to our understanding as we go on. How significant is this one, and what does it mean, i mean, crucially, about all the kind of steps that we take to try to prevent the spread, including masks . Ill tell you, jim, when i first heard about this, that they made this change just in the past couple of days i thought what took them so long. In april, in april the National Academy of sciences, one of the most Prestigious Science groups that there is, wrote a letter to the white house saying this, a letter that was made public. This has been known for months. I dont know why it took the cdc so long to put this on their site, but lets take a look at exactly what the cdc is saying right now. They are saying that the coronavirus most commonly spreads when people are within six feet of each other. This is me, not them saying it. Think of it as a direct hit. Youre standing next to someone. They sneeze, they cough, they spit a little when they talk, it hits you, you get hit. However, they say there is growing evidence that droplets can remain suspended in the air, so, in other words, someone with coronavirus spits a little bit, hangs in the air, youre nowhere near, youre on the other side of the room but then a little while later you walk by that airspace, you could inhale it, and that is why they are now saying, the cdc is now saying, staying at least six feet from others whenever possible. That at least part is new. They have been saying six feet for months and months now but saying at least six feet is new for them, so really the message here is really stay as far away from other people as you can and certainly wear a mask when you have to be near people. Jim, poppy . Before you go, elizabeth. We know the president has talked about wanting and opening for an vaccine before election day. Were 42 days out now, right . Theres been no change. Every expert ive spoken with says theres pretty much absolutely no way that were going to have a vaccine approved and available by election day, including people who are within President Trumps own government. Lets talk a little bit about why. In order to get it approved, thats hard enough. That takes long enough, but, then, to get it on the market and widely available, thats even harder. Lets take a listen to who White House Task force member brett giroir had to say on that point. In front of the center dr. Redfield and i both said that a vaccine widely available in hundreds of millions of doses would not likely happen until mid2021, that is a fact. It takes a long time to distribute a vaccine to the entire country and, remember, this is probably going to be a twodose vaccine so youve got to distribute it not once by twice. Jim and poppy. Were joined by the emergency professor of emergency medicine at brown university. Doctor, always good to have you on. So a spike in cases. I mean, notably were almost right on the nose two weeks out from Labor Day Weekend and we saw spikes after memorial day and july 4th weekend. Is that the most likely explanation for what were seeing now in this country . There are a couple of explanations for why we think that were seeing a spike in cases. The first is absolutely labor day. As you said, we did see those spikes after july 4th and memorial day. We know that people were getting together, having family gatherings and having those Close Encounters that dr. Cohen just mentioned are likely to spread the virus. The other thing, of course, is that many colleges across the country have gone back and we know that that, that mix of students from across the country is also serving to spread the virus, and then the third part is as it starts to get colder across the country people are going indoors, schools are reopening, and so in areas that already had high levels of Community Spread of covid, were suspecting that going indoors is also leading to the increase in cases, and were worried that its only going to continue. This is the beginning of our second wave. Doctor, can i ask you about something thats changed in the last few days and thats hhs, secretary alex azar, put out a memo on the 15th of september saying basically anything, any new rules, anything that goes through any of their agencies, including a vaccine would have to be approved by him, right . Quote, is reserved to the secretary, harvard epidemiologist called this a power grab and wields power to approve a drug or vaccine with an emergency use authorization. What is your reaction to hearing this . What does this actually mean for a vaccine and the timeline . Yeah. Poppy, this is tremendously worrying to most of us on the front lines, those of us that are scientists and Public Health professionals. It implies that hhs is going to be serving a censorship function. Our science, our approvals have never had to go through hhs in order to get released to the general public. This is suggesting that they want to have first look and have the chance to edit and potentially suppress or promote knowledge that the rest of the Scientific Community doesnt support. So theres no theres no law. Theres no precedent for saying, you know, the public gets to see all of the data on a vaccine once its released, totally unedited, thats not mandated to happen . So the way that it usually happens is that the data on new drugs and vaccines goes to the fda. Theres a committee there that views it and makes decisions about emergency use authorizations or about full approval. I mean in, general that gets released in perreviewed publications and gets available through freedom of information act, et cetera. Whats unusual here is hhs saying that they have the final say, that they get to approve stuff on top of what the fda or the cdc is doing. Listen, we imagine in this country a lot of this stuff is written in stone somewhere. Institutions, rules, et cetera. Its not, and weve seen so many examples of that prior. Finally, is doctor, before we go, im curious, in europe, as europe has seen something of a resurgence recently, European Health officials talk about the importance of young people as a vector for this, particularly as they go back to school. What are we learning in this country as a result that have . Does that mean kids going back to university and lower schools is fundamentally dangerous in the midst of this pandemic, or is it how it is being done from community to community . Its a little bit of both. You know, were watching the European Experience with concern. Ive talked before about how were seeing cases surge in madrid and the uk. Likely due largely to relaxation of rules around big social gatherings, around bars and parties. Yeah. We know that young adults spread this virus efficiently. In other words, College Students serve as victoriaors of spread, and so providing them with safe ways to get together that dont serve as super spreader events is essential. Whether or not kids going back to school helps to spread the virus is still a little bit up in the air. The biggest thing is to not put kids back in School Without universal masking, without good ventilation and only if there are relatively low rates of covid in the community. Were all watching with concern in our country right now as our kids are going back to school, but we think its safe provided that those three things are met. Well, without delay, the president says he will announce his Supreme Court nominee by the end of this week setting up, well, its already under way, a fierce battle on capitol hill as republicans push to confirm as quickly as possible. Cnns lauren fox joins us now. Lauren, im going to keep asking you this question. Does mcconnell have the votes . Reporter well, thats what were watching today. As you know, over the weekend, two republicans, Lisa Murkowski of alaska and republican senator Susan Collins who is up for reelection in the state of maine both said they will not support a vote before the election. Thats important. Now Susan Collins went a little further saying she believes that whoever wins on november 3rd should be the person to pick the next Supreme Court justice, but where does this leave us . Remember, that mcconnell can lose three republicans. He just cant lose four so the question is who would be the two other republicans . We, of course, had been looking at someone like Lamar Alexander but he said he supports mcconnells decision to advance this nomination whenever that vote takes place. Of course, there will be questions about who the nominee ultimately is, but were keeping an eye on two other senators that i want to talk a little bit about. Myth romney, a republican from utah who voted with democrats on one article of impeachment back in january, hes someone to keep an eye out for. The other person that we are watching is cory gardner up for reelection in the state of colorado, one of the toughest states out there. The question is does he feel pressure to put the brakes on this nomination process . Again, you have to have four republicans to block this nomination. Democrats can do everything that they want to slow it down, but ultimately they arent in control, either before the election or after the election during that lame duck period, another time frame that mcconnell could can be eyeing to move this nomination forward. Jim and poppy. Lauren fox, didnt happen in 2016. Likely to happen in 2020. Thanks very much. Jeffrey toobin is here, our legal analyst and our Supreme Court reporter. So very good to have you both. Okay. Jeffrey, yours was the first piece i read over the weekend making the case that democrats are not powerless, but what power do they have to stop whomever the president chooses . Well, its really more a power of retribution than a power of stopping. It is true that since the filibuster has been abolished for Supreme Court nominations, it really just takes that with 53 republicans in the senate and Vice President pens to break ties, this is really under the control of the republicans, but there are political tools that the democrats have to try to force two more republicans to join with collins and murkowski. The point i was making is that if biden wins and if the democrats retake the senate, then there are real options for the democrats. They can add two or more seats to the Supreme Court. They can abolish the filibuster and granite statehood to d. C. And puerto rico and they can add to the overall total of federal judges which hasnt changed in decades, so, you know, there are hardball options but the democrats need to win some elections before they can exercise them just to put this into context, not sort of an ethereal ivory tower kind of event here, right, Supreme Court has enormous power, particularly over many of the democrats legislative priorities, even if they were to win, right, the senate and the white house, is a 63 conservative court one thats likely to block many of those priorities . I mean, youve got obamacare coming up quite soon, but issues on gun control, Voting Rights issues. How significant from that perspective . Well, its interesting, because while Ruth Bader Ginsburg in this last week was obviously dying, there was an important abortion petition that was pending at the court and the justices obviously still havent ruled on that, so youre looking at an abortion petition coming up in the short term. Youre looking at other emergency petitions on Voting Rights that were going to see, and as you said this term is going to start a week after the election, they are hearing obamacare. We may not know the results by then, jim, but they are going to hear obamacare, and after that a big religious liberty case so its really teed up here. Obviously they are not going to want to have eight justices, but if he gets another conservative nominee, we already know that last term the conservatives on the court, and im not including roberts there said that they wanted to look at the Second Amendment again, theres a big affirmative action case thats pending below as well as issues like roe v. Wade so all of that is in front of us so its a really big deal. Jeffrey, which tees up perfectly the question of a lot of democrats talking a lot about this weekend about packing the court, trying to do something that they would hope successfully that fdr wasnt able to do though you can argue it helped get some of his new legislation through. Joe biden said in a debate he doesnt think its a good idea to pack the term. Can you explain what it means what does that mean and how can you get 14 folks on the Supreme Court and how will that work, and is it likely . Its interesting. As i go around talking about this issue, many people think that the number of Supreme Court justices is set in the constitution and that you need a constitutional amendment to change it. Not true. There have only been nine justices on the Supreme Court since 1869. Before that, the number fluctuated considerably and all it takes is an act of congress signed by the president to change the number of justices on the court, and there are now Many Democrats who believe that if President Trump succeeds in jamming through this nomination at the end of his term or during the lame duck, they will feel like two seats have been stolen from democrats, the Merrick Garland term as the end of Barack Obamas term and now this seat, and they can change it. They can change the number of justices on the Supreme Court and make it 11. They could make however many justices they want, and that they feel would restore a steps of fairness to to the status of the justices on the court. It would be a big step. 1869 is a long time ago. The fact that there have been nine justices is long established in american life, but it is not set in stone and its not even set in the constitution, and it could be changed with an act of congress. Before we even get to legislative priorities, as you mentioned briefly there are Voting Rights decisions. I mean, before you even get to see a bush gore kind of decision. Voting rights decisions moving through the lower courts. Are they i mean, they could make it to the Supreme Court between now and november 3rd with a 44 kind of situation here. You know, what are the most significant ones, and what does that mean . Well, one thing on the other the vote packing. I remember a couple of years ago. I covered Ruth Bader Ginsburg, and she was asked about Court Packing and she said kind of very dryly i think nines enough, so thats interesting on Ruth Bader Ginsburg, but as far as the voting cases, you know, we have already seen some of them. These are emergency petitions that come up to the Supreme Court and think back to last april. There was one involving wisconsin. It had to do with absentee votes. It came out 54, and guess who wrote the dissent there, just in april, it was Ruth Bader Ginsburg, and she said that the conservatives reasoning on this case boggles the mind so we are going to continue to see those as they come up, and as to the question of 44, one interesting thing to look at it, for instance, were seeing the obamacare case come, right, and in the lower court, in obamacare, that judge struck down the individual mandate and punted on whether the rest of the law should fall. Of course, the Trump Administration is here saying the entire law should fall. If they split 44 that Lower Court Opinion would automatically be confirm. The Supreme Court would be left having to do that and setting precedent and you know chief justice john roberts, they all try to avoid circumstances like that, but with an eightmember court, issues like that could come up. And i suppose i should have said 53, right, in terms of conservative, liberal there, and, folks, if you dont think this affects you and your life immediately, think otherwise. Its a big deal. University of michigan is the latest to the cancel their spring break. More colleges and universities doing the same as they strug you goal to contain covid outbreaks on campus. They dont want people on planes and coming back and all those sorts of things. Its been a few more years for me since then than you, and, yes, i do remember. Cnn, senior Level Affairs correspondent Bianna Golodryga who probably remembers, too. Bianna, tell us what this means for students, and i guess, listen, how do colleges enforce it. How do they enforce it for kids not going their way to travel somewhere and spend time together. It is difficult, and its sobering, too, jim and poppy, as we approach 200 deaths in this country to see where schools are focused. Remember where school began and prior to the opening of schools we had focused around thanksgiving that they would close down around thanksgiving so that they wouldnt bring back any illness so they could finish the semester. Now they are looking ahead beyond winter break and spring break of next year and youre right, they are trying to mitigate the spread. They are obviously acknowledging that this disease and its virus will be with us for months, if not years to come, and so what they are doing is eliminating spring break. We saw the university of michigan scrapping its spring break. The schools chancellor said in a statement that they would mitigate the possible risks associated with Campus Community members who may have traveled during the middle of the semester and, of course, the university of michigan is not the only school to do so. The university of wisconsin at madison, purdue university, ohio state university, Kansas University and university of step see and florida, Baylor University and many others, carnegiemellon, are making similar moves. Again, its approaching a disaster that were seeing transpire on campuses right now. Were seeing an increased spread despite the fact that they have ppe and despite the fact that they are having testing, were still seeing children, always children in our eyes, right, still seeing College Students go out and do what a lot of students do, they are go out and party, dont listen and think that they are untouchable and if they dont contract visible signs of the illness they can go back home and spread it to larger areas of the community. Thats what they are trying to do. This semester and next semester will look like for you. I was at college at the library studying during my spring break. I was not out partying, right, but i will say that they acknowledge that this is not ideal for students so they are going to turn them into reading days and rest days. Well see what happens but thats what they are laying out now. Reading and rest, cancun, i dont know. Bianna, thank you. Makes a lot of sense in all seriousness. The battle to replace Justice Ginsburg has sparked a fierce political debate, imagine that, 43 days before the november election. How does this battle over a Supreme Court vacancy impact what happens at the poll, both in terms of the senate and the president . I felt like. I was just fighting an uphill battle in my career. Joining me is senior Political Writer harry enton. Lets go to you because theres a lot of conventional wisdom out there, but you look at the data. Youre a data guy so lets start on the big picture here, you know. T whose side is both both sides are energized by this issue, no question . Whose side do we know from the data is is likely to be more energized by this as a voting issue on november 3rd . Yes. Its really interesting, right. I think a lot of people thought in 2016 the republican side was more energized and in fact our polling shows that, but look at data this year. What do you see . You see in fact its biden supporters who are much more energized by the idea of nominating a new justice of the Supreme Court before the trump voters. Of course, its not that were just looking at the supporters of each of the candidates but take a look at the persuadable voters, those who change their minds. They looked at those voters in three different swing states and they said that joe biden would be better at picking the next Supreme Court justice by an 18point margin so when i look at the data i would say the Supreme Court issue might be better for democrats than is commonly assumed. Thats interesting, interesting, and i always like you for that you look at the data and you dont go with what you hear at the bar as important as that could be. Lets talk then thats in the national race. Lets talk about the senate races here, right, because control of the senate, its a big deal. Youve got a lot of tight races that could determine that will determine the outcome here. Do you have a sense of how this plays into those races . Yeah. This is, again, really interesting. A lot of people remember the kavanaugh hearings from two years ago and that really seemed to move the dial in a lot of seats but the Senate Landscape is so different than it was two years ago, right . Back two years ago you had five democrats defending their seats in red states. Now you have only one democrat, doug jones, in alabama who is defending his seat, and the truth is that seat was already vulnerable and probably going the republicans away anyway. Take a look at the top five closest senate races right now that dems have a pickup opportunity in, arizona, colorado, iowa, maine, north carolina. Those are all purple states, not overwhelmingly republican states and right now when you look at it the democrats are either tied in those states or actually somewhat ahead, and when i look at the data given everything that we know im not really sure that the Supreme Court nomination fight that we have coming up will necessarily help republicans. If anything, it may help democrats and they need four of those five seats and they are in a pretty good position at this point to get that. Interesting. Well, were going to keep on top of that. In my lifetime are expect to see three, four, perhaps even more women on the high court bench, women not shaped from the same mold but of different complexions. What a time, i mean, and to be confirmed, 963, unthinkable. Unthinkable today. Julie, let me begin with you. You spent three years with her making this film. What do you think about this week . You know, it its a sad week. Rbg was such a presence and such a life force that even though she was 87 years old that had been struggling against really serious cancer for quite some time, i still found myself absolutely shocked that she passed away. Hearing her now sort of in that clip talking about a wish for more women on the court is theres some irony there, trump having announced that hes planning to appoint a woman, certainly not the pick that Justice Ginsburg might not have had in mind. Margot, to you. You were one of her first law clerks. You were 25 years old. I dont remember what i what is doing at 25 but what an immense amount of responsibility at that young age and you recall specifically the first phone call that you had with her. What did she say . It wasnt the first phone call after her confirmation as she and she called me, so before that she had been judge ginsburg, and when she called me she would say its the judge, and this time she called and she said, you know, hi, margot, its the and then she sort of laughed, and then she finally got out the justice, like she found the whole thing such a hoot. She couldnt believe it. There show was. It was adorable. Aside from all she taught you about the law, you ended up marrying a fellow clerk, and there is a lot that she has taught all of us about a successful marriage, one of my favorite quotes sometimes its good to be a little deaf, right, but on a more serious note she taught you about what a real sort of feminist and equal marriage could be. Yes, she did. It was really an amazing model to see up front. You know, Marty Ginsburg was one of the best tax lawyers in america. Its not like he was some kind of a slouch professionally, and so the two of them had this they were highpowered professionally and they were committed to family personally and they had this equal marriage in a way that was just a great model as i was, you know, building my own marriage. What are your thoughts on that, julie, documenting her, talking about her personal life and about her marriage because it ties directly to her professional success. We know that he lobbied hard for bill clinton to to consider her for the position and that he he moved, you know, for her career to thrive and flourish. Yeah. Thats right. I mean, you know, by the time we were spending time with Justice Ginsburg, Marty Ginsburg would have been dead for a number of years, we were timid about approaching the subject thinking this must be so painful because her husband passed away and every time his name came up it was the opposite. There was a twinkle in her eye. She loved to talk about him and thats because she knew how much of a role he had played in her personal life and professional life. Do you know how unusual it would have been in the 1950s for a husband to like care as much or more about his wifes career than his own. Like frankly its pretty unusual today, imagine back when they first got together its its a really inspiring story. She said he was the only boy, they were teenagers when she met, who cared that she had a brain. Ill never forgot that line. Margot, in all seriousness, when you talk about who is going to replace her and when you look at the justices that are on the court now, you think theres a real importance to having civil rights, plaintiff side civil rights attorneys on the high court. I do. Justice ginsburg was only the second time we had a civil rights lawyer on the court. The first was thurgood marshall, and i think nothing can replace the experience advocating for working for equality in your professional life before you become a judge and so i think that it was her absolute highest priority that she thought that democracy depends on expansion of we the people and and we as a people deserve someone who shares that commitment . Before we go, obviously this happened on rosh hashana, on the jewish new year and margot i understand you red a poem that said, i know you ache and i know you wish the work were done and you with everyone you have ever loved were on a distance short safe and unafraid. Remember this, tired as you, are you are not alone. Why those words . Yeah. I it was actually our rabbi who picked out that poem and just really resonated with me because its about carrying on the fight for justice in the space of loss and remembering that we personally can commit and can can further that, and in a moment of such loss it was just it was really important to hear it.
