>> maybe that was his attempt but the nba has been very clear that they are not changing his position. and he did at mid that he said what he said. that doesn't change things. people have been discounting shelly sterling and the part she plays in this. >> i think it would be a very hard situation. i will say that much. i think it would be very difficult. i guarantee you every person wouldn't be on board with that. >> everyone has a price. has miss sterling identified her? >> i think cleveland is going to embrace him with open arms. they need someone like this. they haven't had this much excitement since lebron left. >> didn't they sell a ton of season tickets overnight? what needs to happen to fix the va's problems? >> first of all we think that the secretary needs to go. since 2009 he has failed to lead the va in an effective and efficient way. the backlog. he has failed to properly manage and implement new programs and serve veterans in an efficient and timely manner. the next thing the va needs is more accountability. that's why we think it's important that congress and the president sign into law the va management accountability act. >> let me ask you this. senator mccain has not called for him to step down. >> i understand the senator's position that the investigation needs to be completed at the phoenix va, but i also would say that our group and the american legion are not calling for the secretary to resign just because of phoenix. our group feels there has been a long pattern of mismanagement and failure at the senior level and this is not just based on one incident or city. it goes to the backlog. it goes to confirmed deaths from delayed care in other cities across the country. the veiled roll out of the post 911 g.i. bill. again, i understand what he's trying to say that we need this investigation to be kpleeded. we think it is actually time for him to go now. >> you heard that allegation of zeroing out the wait times here. you would think if that is happening, there's a reason that precipitates that. do you think that va hospitals have enough staff to meet the 14 day period which is their official policy for when treatment should be received? is that realistic? >> well, i don't know if they have enough doctors and staff at their hospital but they have been given an incredible amount of resources. the start on the war on terror. they have been given the resources, then it's an allocation issue. >> already. dan, thanks for being with us. we really appreciate it. >> no problem. >> and coming up, a new report from amnesty international. it says that nigerian security forces had more than four hours' warning ahead of the attack where that terror group, bo boko haram, kidnapped the schoolgirls. why didn't they do anything? [ barks ] >> today in washington, house speak egg john boehner awarded seven republicans with highly astute spots to investigate benghazi. democrats are yet to decide whether they want to claim their spots at all. house minority leader nancy pelosi is calling the investigation a stunt. this really seems the decision has democrats in a bit of a pickle. >> it does. there is a split and pretty much everybody you talk to in these hallways admits that. that there is a split whether that is the most effective politically or whether it is the most effective to call it what it is. as this day has been going on, there has been a back and forth between democratic leadership and republican leadership over whether or not democrats can get what they want with regard to some of the process. again, when you say process, maybe makes your eyes glaze over but in this particular case, the process for democrats is what it's all about. what democrats want is promises from republicans that they're going to have -- a real seat at the table and access to witnesses and involvement in subpoenas that go out. nancy pelosi just went to the house speaker and it shows that they are not there yet at all. the latest back and forth was funtmentally unfair. that they are not giving democrats the kind of participation level as they would like and they want to get answers to that before they decide whether they're going to formally sign on and fill the spots. >> it's really hard to escape the politics there. this is a midterm election year. this also plays into 2016 as it relates to hillary clinton. >> absolutely. and so much of this and so much of the discussion that you hear here in the halls from democrats is that they believe this is so much of this is about hillary clinton and about wanting to subpoena her and drag her before this committee. i actually asked nancy pelosi about what she thinks on the subject. >> do you think this is all about hillary clinton? >> no. if they cared about the presidential, they would be passing an immigration bill. this is all about them. i think it's pretty clear. their focus on the affordable care act has run its course and now they have to find something else to talk about. >> of course in the short term there is no question that the idea of even having this committee now just a few months from the november midterm election that probably riles up the republican base is political. no republican with a straight face can say it's not. the fact that nancy pelosi answered that so quickly indicated that she has thought about this and she thinks its all about november. other democrats think it is very much about hillary clinton and trying to woo her for the presidential if she runs. >> how do we know it's about politics? it's 2014. they're not doing anything but politics. >> not at all. >> thanks. >> more than two months after flight 370 vanished, there is another open letter demanding that officials take the search back to the drawing board and reanalyze the information that they have. they question how authorities can be certain that a 777 crashed into the indian ocean since there is no physical evidence and concerns are being echoed in a new report today in the atlantic which claims many experts claim the search could be happening not just in the wrong spot but in the wrong ocean. >> the map of the pings is straightforward. it's like a game of marco polo. so you get these basic characteristics of what you expect the responses to look like. the satellite is not moving relative to that position so you would expect there to be no free onecy shifts. something is off with the original interpretation. >> now joining me now is a cnn safety analyst accident investigator and author of why planes crash. david, can you explain this new report to us? what led to this different conclusion? >> they're not questioning the data. what they're questioning is the analysis of the data. that's very important to point out. i spoke to one of the scientists quoted in the article. it is something that they are re-evaluating within themselves. it goes to the complexity of the information. right now there is very good reason to believe that according to the report that this information was analyzed improperly and did not consider the delay that happens from the satellite to the earth's station it also doesn't consider that the aircraft itself can off set and anticipate where the signal would be. it anticipates that and does that change. so that's the things they're looking at. they still need one piece of information to make this stand and take that from the questioned analysis and turn it into real data as far as where that aircraft would or wouldn't be in there's a big question as to where this aircraft is and if we have been looking in the wrong place all along. >> this report compares the pings to a game of marco polo. but the article says the pings only tell you how far away the pings are, not what direction. what do you think led searchers to this southern area to begin with. if we talk about handshakes, once the handshake was made, the communication that went through that connection take astern amount of time. not only do they know how far away it is from the satellite but they can also learn from that how quickly it's moving away from the satellite while your hands are connected. once the handshake is done, they can measure that through doppler and that is what this doppler term is all about. if the satellite was stationary it would be so much easier. we would know that we had a fixed place in space but that is not the case. it's unable to stay in a continuous earth or bit so it's doing this elliptical movement moving north and south in a number of miles. not just a few feet. it's going two or three miles so it depends on what time and wear that doppler was received as to whether or not it's accurate. and that's what this report is partially pointing out. i think that's the most critical change is how it's related to the location. they don't think that was considered properly. >> we have more questions to ask you and we will get to that right after a quick break. cut! [ female announcer ] the x1 entertainment operating system. only from xfinity. tv and internet together like never before. >> we're going to continue our conversation with cnn safety analyst, also an accident investigator and the author of the book why planes crash. a lot of satellite experts believe that it's happening not just in the wrong spot but entirely in the wrong ocean. this is the crux of what we're hearing from families. they say they want all of the original data handed to the groups that found the remains of the missing air france flight two years after it crashed. do you think that's a good idea? >> yes. these are not just some hat group out there trying to look at things, throw out tweets and become famous. one of them lives in boulder, colorado. i have heard of them. we have talked before through cu, university of colorado. this guy knows what he is talking about. i trust him and believe him. i just got off the phone with him and he has some questions even about what was published but that's not a prop. it's something that you would expect because of the highly technical nature of this report. this is way above my skill level. these guys are really the real deal and they have very good reasons to question. the families keep the pressure on. the voice 370, i read the letter that was sent forward begging and pleading for this information. it's reasonable. it's not protected or intellectual property. it's simply a piece of data that is missing. >> as you talk to these experts, what would they say needs to be done differently by this other team that found the other plane after a really laboreous search? >> what was missing was this base frequency offset, which is the amount of time and the relationship. something about the relationship between the satellite and the airplane. >> two moving objects. >> exactly, and then you have this air to earth satellite frequency adjustment. we're going to pretend that we're not really where they are. that identification is kind of what is missing now. this is called the aes. that is still the piece of information that we need. and from there they can do a whole other analysis and make sure. we don't know that the inmarsat didn't consider this information until you start looking at the results that they did publish. that is why this is so important. there is discrepancies between their output. they say here is where it was and you compare that to calculations, and they don't line up. they really don't line up. there is something that wasn't considered. we don't know what it was but we can speculate that what was missing was this compensation for the fact that the doppler is also being transmitted, the time that it goes from the satellite down to the earth. that relationship is moving, too. so this is really complicated extremely high math, we will call it new math because it's new to me. >> and there's nothing the matter with asking more very informed and smart people to take a look at it. david, thank you so much. >> thank you. >> u.s. military advisors arrived in nigeria to help find kidnapped schoolgirls. this rescue attempt happening as an explosive report surfaces, how much did the nigerian government know or when? amnesty international claims it has evidence that the security forces knew of the impending attack hours ahead of time but failed to act as the girls were being herded out of their beds into the jungles of northern nigeria. several managed to flee and one is sharing her escape. cnn cannot independently verify the authenticity of this video. >> joining me now, john campbell. ambassador, thanks for joining us. i want to talk to you a lot about this report. it claims that nigeria did not act on intelligence because apparently commanders could not raise enough forces to respond. cnn has reached out to the nigerian government but we do not have a response yet. what can you tell us about their military's abilities or inabilities when it comes to destabilizing. >> the security services are overstretched. it is frequently said that boko haram outguns military forces. boko haram is unbelievable murderous when it comes to the security forces. any i member of the army or police who fall into their hands is liable or even likely to have his throat cut. >> so they're afraid. they're very afraid. security forces are afraid. do you think they might not want to gather to address the situation? is that how bad it is? >> they are afraid but there is also the question of actual resources. the amnesty report implies that military could not gather sufficient troops fast enough to respond. by the way, in my own experience, amnesty international in nigeria is quite credible. >> that is good to know. you have military advisors in nigeria. what should their plan be now? have you ever seen something like a kidnapping like this probably not on this scale but resolved in a way that you don't have deaths? >> yes. it happened during the insurgency in the nigerian delta and what is going on now. it was finally all about money. when you're talking about money you can do deals. the insurgency in northern nigeria, at least if you pay attention to boko haram rhetoric, their goal is to establish god's kingdom on earth with justice for the poor through the imposition of islamic law. i would submit this is not a political program and it's also not about money. that means it is extraordinarily difficult to deal with. you are asking what essentially the next step should be. the first thing is to consult with the nigerians about what they want, what they are willing to take, and then together figure out what the next steps are going to be. it's the nigh yearians who will have to take the lead in this. it's the nigerians who will have to find the schoolgirls. all outsiders can do is try to facilitate their efforts. >> let hope that there is progress made on that front. ambassador, thank you so much. >> thank you for having me. >> definitely. and we mentioned that amnesty international's claims about the government knowing ahead of time. and you heard our guest say this is a very credible group. and coming up next, police in georgia are scrambling to find clues to a gruesome crime. an 88-year-old man murdered in his home. the man was decapitated and his head is missing from the scene. >> mr. berman's head was decapitated and we do not know the where abouts of his head. >> more on this chilling story right after the break. you think you take off all your make-up before bed. but do you really? what does this mean for the team. here is more. jason. >> it could mean a lot of things. first of all a man that is highly respected. he's an african-american. also what you're seeing here, pamela, is more evidence that the nba is move iing forward. basically saying that they were moving forward with the search with the clippers new ceo. this announcement today is further proof that they are doing just that. also when you think about this, remember what sterling's wife has been saying that she wants to remain in control of the clippers. she has 50% ownership of the clippers. she wants to be a passive owner. the nba is moving forward without donald sterling, without shelly steriling and trying to get the clippers back on track. >> the ceo stepped down last week. here we are with the new ceo. thank you. i'm going to talk more about this with hln legal analyst and joey jackson. branding and social media consultant peter shankman. tell us, the nba has said, you know, very little time appointing the new ceo. what do you make of this pick in particular. richard parsons is a high profile man. what do you think about it? >> richard parsons is a phenomenal choice. they are going to use him for a while. the bigger picture is that the nba is making a statement saying you know what? we're not going to wait for this to blow over and to handle the situation as needed. the best thing they could have done. parsons was responsible for the aol time warner merger back in the late 90s. very well respected in the community. this is a brush off of sterling. this says we don't care what you're saying. we don't care that you want control and you want a lawsuit. we're moving forward because we have the power and because we can and we want to focus on basketball. the buzzer is sort of winding down here. this is a very strong move here. >> but the controversy resolving around sterling continues. we will get to that with a new audio recording today. i want to go to you first talking about the new ceo that we're just finding out about. do you think this is a legal move to help the nba gain control? >> the train has left the station and the reality is that the nba, they have dual spobl responsibility, right? first and foremost they have legal obligations that they have to tend to. but they certainly have a fan base and they have players and other people that they have to insure, you know, feel that they're respected and working hard, that those efforts, you know, that they engage in to win championships, that they can do it in an environment that is respectful. i think what the nba is doing is they're saying listen, we have an obligation to fans and community. this is in the future to disassociate their self with them. silver said that this is serious about irradicating any thoughts of racism on this nba community. >> this is something that goes along with that. you didn't mention the advertisers. there was talk of pulling ads and spoon snsorship. they said you know what? >> it would be a logical deterrent and the numbers show that we have a very bad smart phone theft problem. the reason they're stolen is because they're so expensive and there's clearly a black market for the stolen phones. i'm sure there are places that you can go and find them for a lot cheaper than they are supposed to be sold. they are not officially real new phones that have not been owned by someone else. the kill switch opens up an access lane for hackers and who knows what they can do with it. imagine if they put an e-mail attachment and it activates the kill switch and now you have a $700 kill switch. i think some of the software kill switches, these pass codes that are required to activate the phones or e-mail addresses and passwords that are required to get the phones to work once they are stolen that you can activate on the iphone. i think those are great steps as well. this is useless to me. there are still plenty of valuable parts here that can be taken out. i think a good solution would be a nationwide data base of stolen phones and their serial numbers. the cell providers. >> we will see how all of this plays out in other states. thank you for offering your perspective. >> can you believe it's been nearly 20 years? >> we went there and none of them were there. only the parents. we enter the bush almost 86 kilometers from the area. we were over there. but you people, you will lose your life. >> and we are now learning about an explosive report from amnesty international claiming it is evidence that the government knew boko haram was going to strike four hours ahead of time. apparently they couldn't scramble together enough forces to respond. so, if you would, just starting off here, tell us where did you intelligence come from and the evidence come from to support this report? >> absolutely. amnesty international spoke with senior officials and local officials in the region to gather evidence that we released this morning that the nigerian government knew up to four hours in advance that these attacks would happen and did not take adequate action to prevent them. >> you said they didn't take adequate action. did they not respond at all? did they try to respond? what happened? >> we have evidence that there were a little more than a dozen nigerian military troops if you will that attempted to repel the boko haram attackers but were unsuccessful in that and given that they knew many hours in advance that this attack was going to happen, indeed we found evidence that a boko haram fighter had gone through the town asking where the girl's school was and the nigerian military forces did not take action to get reinforcements and do what they needed to do to protect the civilians. >> we have reached out to the nigerian government. how about amnesty international. what is the response to this explosive report? >> none that we have been able to have from them. we reached out to the nigerian military and no response. >> christine, the nigerian government first told the world they had rescued the girls when we learned they haven't. the girls are still kidnapped. what do you think this all means, the way this is played out, the way the government has reacted. do you think it's a reflection of them trying to save face? >> that's certainly what it looks like. our first and foremost concern is the safety of these girls. the fact that they have been inactive for several weeks. >> all right. thank you and of course we will be awaiting a response back from the nigerian government on this. we appreciate it. >> thank you. >> more than two months after flight 370 vanished, the heartbroken families sent another letter demanding they take the information back to the drawing board. they question how authorities can be certain that the boeing 777 crashed into the indian ocean since there is no physical evidence. many satellite experts believe the search could be happening not just in the wrong spot but in the wrong ocean. >> the math is somewhat straightforward. i describe it as being a game like marco polo. you have got the satellite sending pings and you have got these basic characteristics. one of those, for example, is that the plane is stationary on the runway before take-off and the satellite isn't moving relative to that position. you would expect there to be no frequency shifts. if you look at the beginning of the graphic, it's up to 85 hertz. something is off with that interpretation. >> joining me now to discuss this is an accident investigator. so how exactly did they come to doubt what this investigation has hinged on. >> we have been hearing from scientists who are very legitimate scientists. they have been asking us to communicate as much as we could to inmarsat and malaysia did release that information. when they took a look at that information, they said wait a minute. this doesn't make sense. the analysis is wrong. the data is not incorrect. that inmarsat provided the correct data. what they tried to figure out is how are we going to figure out where this came from? there's still one piece of information missing. they want more information for the scientists. >> david, this report compares the pings to a game of marco polo. but the article says the pings only tell you how far away the plane is, not the direct. so in that light, what do you think led searchers to this southern ark? >> what it's telling you is that the relationship between how far away or how close the handshaker is to the satellite. as it goes further away it can be further away south or to the north. and then the ones flying in the southern route and let's compare the two together the ones that they received from the north were different from those in the south. what this report questions is there is a relationship between the movement of the satellite and the receiving ground station. the question is, is the relationship different than the relationship between the ground station and the aircraft in the south? that raises more questions and it goes right back to where is this information not being shared and why is it not? that needs to come out. >> this is a communications company. this is a new technique to old technology and here we are two months out and no plain. no surprise that people are questioning this. david, thank you. >> we told you about two brothers about to star in their own tv show that was cancelled because of their beliefs. hear what really happened to cause them to lose their show. democrats are not so sure they want to take part. the latest from washington after a quick break. i could feel the shock in my back and it was like "wow its got to get better than this or i'm in big trouble." >> several republicans with highly soft spots to investigate benghazi. democrats for their part are yet to decide whether to claim their spots at all on this committee. the benghazi attack already has been the subject of eight congressional probes. nancy pelosi said naming the special committee is a stunt. the big question is what are the democrats going to do? what's the calculus here? >> well, the question right now is it hasn't quite come to a boycott. democr democrats -- i just got off the phone says they are not willing to participate. there concern they say is that there have been abuses by the house committee on the reform and oversite committee. and they want the democrats want to make sure this is fair. that they have the same access to withins that the republicans have. they are no longer still pushing for equal representation on the committee but they want to make sure it's fair. but it really seems to be touch and go. >> it seems that they would have a lot to lose if there was not a voice from a democrat on the committee?
