[ cheers ] yeah! woho! running up and down that field looks tough. it's a pitch. get way more into what you're into when you stream on the xfinity 10g network. thousands of union workers for the big three auto companies are now on strike. the historic walkout that could have serious impact and consequences for the u.s. economy. president biden is now preparing to weigh in. hunter biden could face more federal charges. we have new reporting on the time line. the cnn reports of a congressional investigation, and the senate is demanding an answer for the cover-up of dozens of sexual assaults at the coast guard academy. i'm kate bolduan with john b berman. this morning, still more federal charges are possible for hunter biden, the son of president biden. we are learning that special counsel david weiss has a three to four-week window the decide whether he is going to file tax charges against biden in california and/or washington, d.c. weiss has decided that he might. all of this is coming after he had indicted biden on three felony gun charges three weeks after the plea deal after the two sides imploded. kara scannell is joining with us the new time line and what might be coming next, kara. >> yes, john. so the federal prosecutors have been investigating hunter biden for failure to pay taxes for several years and uncovering a several year period, and statue of limitations could expire next month, and that is putting a time line issue on whether the prosecutors led by special counsel david weiss is going to seek an indictment on that year and potentially other years with this clock ticking into next month. this is all going to be beginning to snowball, because as you noted yesterday, the david weiss special counsel team announced a three-count indictment around a gun he purchased in october of 2018, and the speed of it is because of the statute of limitations which would have expired next month. and this is around a atf form that he made a false statement on the form saying that he was not addicted to drugs. also, he is charged with another felony account of being in possession of the drug while addicted or using a controlled substance. biden has been public with the use and addiction of crack-cocaine. though he is now sober. this is beginning to build, and they are seer, you and three felonies that potentially he could face as much as 25 years in prison and the statutory maximum of all of the counts and penalty of $750,000, and this is unlikely since he would be a first-time offender, and these are not violent crimes, but it is possible if convicted he would face prison time on the charges, and that would be up to the judge. and the lawyers are fighting back saying that what the prosecutors have done is to have bent to the whims of the maga right republicans, and they also signal they will fight them saying that the charges are unconstitutional because of the recent supreme court and lower court decisions, but it means that hunter biden could be on trial possibly in two different places as his father is seeking re-election next year, john. >> all right. kara scannell, thank you for explaining all of that. >> and laying out the details of the charges past and present and potentially future. and joining us to about this is former manhattan prosecutor daniel horowitz, and starting with the fact that hunter biden is facing three felony gun charges, and more likely that weiss could be seekinged a disal charges? >> one does not have anything to do with the other, but clearly the department of justice thinks that there are grounds to bring the tax cases which were joined in this plea agreement that fell apart over the summer, and so, to the extent that the department of justice was trying to make a deal with biden so that all of the charges could be resolved in one fell swoop is what they were doing. now that the deal has fallen apart, they will have to proceed on different tracks. >> what are the legal implications of the fact that they did have this deal in place? >> yeah, that is huge. it is very simple. i mean, a plea agreement is no different than any other kind of agreement or contract that people make. once you make it, it is held to be binding, and that is what hunter biden is going to argue. strip out the politics, and strip out the maga politics and the political pressure, which i am not saying that you have a relevant factor, and the fact that hunter biden and the lawyers had a handshake deal with the department of justice, and will plead guilty to the two misdemeanor and will we, the department of justice, will we will not prosecute hunter for the gun charges and put him in a diversion program, and very common outcome, and they felt they had a handshake deal, and whatever the court is, district court or appellant court, and hey, we had a deal, and it is a handshake deal, and written deal, and the justice department should be held to that deal. hunter biden held up his end, and the agreement should be enforced, drop the criminal charges. >> does this make it any more or less likely that another deal can be reached? like, we are down this yellow brick road of plea deals and broken plea deals, and what happens now? >> well, again, if you are stripped away all of the politics and the hoo haw with the case, you could get the parties back together to see, look, this is what the case is worth, and this is who this defendant is, and this is how we the department of justice usually behave, but i think that given all of the atmospherics with, you know, presidential campaigns and congress and the politics, i just don't see how these parties get in a room and make a deal. >> so it sounds like the biden legal move, and hunter biden's legal team will try to get it thrown? >> absolutely. >> if it doesn't, what is the argument in the courtroom? >> there are two. first of all, these gun charges, they turn on, you know, a false statement. and false statements require knowledge, willfulness, intent. did he really intend to mislead anybody? clearly he had and was suffering from a serious drug addiction, and how self-aware was he when he filled those things out, and that a legal argument that a jury would have to accept that he actually understood and consciously decided to make a false statement on a gun application, and the second is that in the totality of the facts, how sympathetic is somebody who struggled with addiction who clearly had some mental health issues, and whose sister-in-law found the gun and said, i took it away, because i was afraid he would kill himself, and these are all wildly sympathetic arguments that the jury may find, and listen, i am not going to convict this guy. so there are two key facers to, john. >> you have talked about stripping away the politics, trying to, right? and just as a pure legal case, but is there an intersection of the charges that he faces and the inquiry that president biden is facing with the house republicans, and separate and yet related, because it is involving his son, do you see any? >> i think that it is all unfortunately going to come together, because if you think from the beginning, would the department of justice have brought these gun charges under these circumstances? i think that most commentators and i agree, absolutely not. statistically the department does not bring these kinds of charges, but i don't think that you can unpackage it at this point, and you cannot decouple it at all. >> as thought exercise for all of us when we are looking ate, it is able to strip away the politics, and in reality, it is what it is. >> and then when you goat the jury in the courtroom, can he get a fair trial given all of the politics. >> yes, great discussion. thank you. >> and for the first time ever, the united auto workers have launched a strike against the big three automakers for the first time, and it is a targeted strike for all three locations based on three companies and based on system of the best selling vehicles. more than 13,000 workers are on the picket lines total. we go to vanessa yurkevich who is there and the picket line. what is the status? >> yes, all three eyes are on the plants as the workers are now out on strike. the automakers are saying that they were disappointed that they could not come to an agreement with the uaw by midnight, and the president of the uaw shawn fain says shame on them to wait until midnight to try to come to a deal. i spoke to mary berra about a key issue that the union is pushing, because they want a 40% wage increase for four year, and the union is tying it to the amount that the ceos have made. and mary berra has seen a 34% pay increase in four years and she is making $30 million and i asked her if she believes it is fair that they are only offering 20%, when she, herself, has seen a 34% wage increase. listen. >> my compensation, 92% of it is based on the performance of the company, and one of the strong aspects of the way that the compensation for a representative employee is designed is not only are we putting a 20% increase on the table, we have profit sharing. so when the company does well, everyone does well. for the last several years that has resulted in record profit sharing for the represented employees, so you have to look at the whole compensation package. we think that we have a competitive offer on the table, and that is why we want to get back there and get this done. >> reporter: general motors recorded record profits in 2022 and the union wants a piece of that for the members. the contract negotiation centers around the fact that the union members gave up a lot in 2019 when gm was bailed out, when they filed for bankruptcy. they want to reclaim a lot of the money they feel like they lost, and a lot the concessions that they say that they gave up in order to save their jobs and save general motors. we know today that the big three are not going to be meeting with the auto workers union despite that mary berra says that she wants to get back to the negotiating table. later today, we expect to see the president of the uaw shawn fain with bernie sanders at a rally in detroit. he is going to be rallying the crowd around his message. we know that mary berra spoke to the president, president biden, yesterday, and keeping him abreast of the negotiations, and she made it clear that she wants to go back to the negotiating table, but they have the wait at least a day to make it happen. john? >> the tropical force winds and the heavy rainfall. the concern is that it is going to hit us around midnight when we have high tide, and we are worried about the flooding and the high surf and coastal erosion as well. we have a lot of the low lying roads, and worried about the trees and cutting off, you know, in and out to some of our coastal town, and of course, the power outages. >> do you think that mandatory evacuations or any of the evacuations or any of those are going to be necessary? >> we have not talked about the evacuations, and i am sure that mema is going to prepare for that if it comes, but we are warning the citizens to batten it down, and pick up everything, and we are talking to the fishermen to bring in the boats and boaters to making sure that everything is secure that way. so, i am not sure about the evacuation at this point, but of course, it is always a possibility, and everybody should be listening to the radios and news in case that is a possibility. >> yes, because we know as with these storms so often, they can change, and the conditions can change really quickly, especially as you importantly note if it is supposed to be hitting you guys in the middle of the night, it can be a huge concern as the folks, the moment that it is the most scariest and dangerous to be out. it has been years since maine has been hit by something that it looks like you could be facing here. are you concerned about how seriously people are taking it or about preparing for it? >> i mean, i think it is always a concern, and that is why we are trying to reach out directly to the towns and calling them, and why i am also talking to a lot of the local radio stations, to make sure that people are taking it seriously, and it important to take it seriously, and if nothing happens, and it is not as bad as we think it is, then, great. no lives will be lost, and we want to make sure that everybody is safe adds possible. >> in maine, the area has not seen a storm like this in some time, and are you concerned about the power grid to handle this type of storm, and is that concern in terms of the winds and what that could do in terms of the infrastructure? what does the day and the history tell us? the senior data analyst harry enten has the answer. what do we stand right now on the whole impeachment inquiry? >> well, this is the only poll that asks this question, and it is last month with the abc/ipsos poll. it is related to hunter biden and the dealings. this is a tie, 38% opposed and 39 in favor, and some americans put no, because i would have thought that the opposed was significantly higher, but basically here, it is an equal race within the margin of error. >> and so, it is basically the same but different in the past. right now, we have within a point of error. going back to trump 2019, and there because clear plurality of plus nine points, and back in clinton, we saw a clear plurality with the inquiry at falling it right in the middle, and we are much more in this a wait and see mode than in the past. >> but in the past, people did have a direction, and as i said, the republicans seem to be some impeachment in the past? >> looking at 2019 and 2021, and this is voted against one article of impeachment, against. this is against clinton and 81 votes against and at least one article of impeachment. democrats were far more united in 2019, and three democrats voted against one article of impeachment, and the republicans are fearing this example of 1998, and in 2019, the democrats were quite united here. >> what happened to the republicans in this impeachment in terms of what happened to the numbers after they did launch the impeachment? >> looking at 1998, and this the big fear, there was a massive backlash against the republicans in terms of the launching the impeachment inquiry against bill clinton, and historically well is how the democrats did, but you bare lever seen, we need you at the restaurant, and fa, we agained five seats, and there was a backlash, as the ball isle rog down the hill, and if indeed there is a backlash, we it happening all of to time and why perhap ps throw in another variable, because you don't know what might necessarily happen. >> thank you, harry enten. i want to talk to someone about this more about this with bureau chief susan page who was there with bill clinton as the whole impeachment thing was happening. what was his reaction to it, and what can be learned from that applied to now? >> well, inexplicably, my husband i were invited to a white house dinner, and i was seated next to bill clinton, and even though there were much more interesting and intelligent people at the dinner, he wanted to talk about politics. he was delighted and surprised by the findings of the midterm election. it was the first time in decades that the president's party has gained seats in the house. he thought that it would prompt the republicans follow through in the impeachment trial, and it is interesting what has and has not been forgotten. >> there is an impeachment inquiry by kevin mccarthy, and his party, and meanwhile, 4 is k -- 41 criminal indictments against donald trump and he is talk, and my wife says mouth sound, and she says that about me, and saying a lot of things out loud, and one thing that he is talk about is the mar-a-lago documents case. listen. >> a new charge suggests that you asked a staffer to delete security footage so it would not get into the hands of -- >> false. >> you would testify to that under oath? >> fake. yes, i would. it was not deleted, and they were my tapes. i don't think they would have had to give them the tapes, because i could have fought it in court. when they asked for them, i said, sure. i could have fought this. >> to what extent, susan, is this a legal argument, and to what case is this the political case for re-election? more about the substance or that he is talkk the about it? >> well, he is talk in a political way, and the problem is that once he is in a court of law, the law is going to prevail. those were his surveillance tapes, but they were subpoenaed, and he had the obligation to turn them over. and he says that he would testify in court, and we would all like to know what he says under oath. we will see if the lawyers permit that to happen. this is a thoroughly lit cal time. sgll and it is not good for him to be impeechd, but he is the least threatened of the parties. >> as you say, biden, mccarthy and trump, you say biden the least? >> yes. >> why? >> because the republicans can't say what they want to impeach him for, and that is what they will have to figure out with the impeachment inquiry. donald trump has 41 counts, and it is not clear how kevin mccarthy can avoid shutting down the government, and so that is most likely politically challenging and so none of them are having a good week, but biden is having the least bad of the three of them. >> and that is even with his son facing the criminal charges. kate bolduan likes to point out that another thing that donald trump said is that biden would not be likely facing this impeachment inquiry if he had not been impeached. and kate says he is saying the unsaid out loud. and if it is about politic, does that leave a mark? >> yes, and there a lot going on and a hearing on the hill, and the i.g. investigation, and the coast guard called for a 90-day investigation. and the coast guard commandant linda feigen even called for her own report. >> what are you hearing from the victims about this?
