with vladimir putin. new moves in court. late night motions filed, donald trump trying to get one judge taken off his case and asking another judge to toss out some of the charges against him. i'm kate bolduan with sara sidner and john berman. this is "cnn news central." ♪ this morning a dangerous escalation in the search for an escaped convicted killer. police now say dan elo cavalcane the inmate who escaped from a pennsylvania prison two weeks ago is now armed. sources tell a cnn affiliate that a man who fits the description of cavalcante stole a gun and that shots were fired last night. this amid the latest sighting of the fugitive in south coventry township. our affiliates reports that the stolen when season a .22 caliber rifle. shoes that were believed to be his were found overnight. officers quickly swarmed the scene. police called nearby residents warning them to stay inside with their doors locked. this is the latest sighting of cavalcante over his 13 days now on the run. moments from now police are set to hold a news conference to update us all on the case. danny freeman has been following the developments throughout since the manhunt really began. danny, give us a sense of what's going on behind you and what police are saying about how dangerous he has become now. >> reporter: absolutely, sara. just to start off, this was the update that so many feared for so many days, danelo cavalcante now armed and still on the loose. where we are right now, we are at ridge road and route 100, we're really at the corner of this now expanding perimeter just outside of south coventry township where police are throwing everything at cavalcante at this point. we have seen armored vans, we just saw two trailers full of police horses taken into the search perimeter. we've seen officers behind me with long guns, they're searching cars, opening trucks. there is an enormous presence right now an all-out push to capture the escaped inmate. i want to tell you how we got to this point. you might remember yesterday was a relatively quiet day when it comes to the manhunt. law enforcement was focused on this area, it was about 20 miles north of the chester county prison, a small community, but importantly it was the area where cavalcante was said to have ditched his stolen dairy farm van that he stole over the weekend. later last night, though, that low key profile completely changed. we saw a flurry of police activity. we saw police vehicles flying up pottstown pike, one of the main roads here, helicopters surrounding this area in south coventry behind me. then a few things happened. first chester county alerted there was a shooting around 10:10 p.m. last night in the area of coventriville road and ridge road. we are on ridge road right now. police confirmed to cnn around 10:24 last night that there was a confirmed sighting of cavalcante. then that reverse 911 call went out to the folks in the south coventry township community advising citizens to locks their doors and windows. at that time they said cavalcante may be in the area and he may be armed. overnight at 1:45 in the morning pennsylvania state police confirmed that cavalcante is armed and they're searching this area. so this perimeter is about four and a half miles north of the area where cavalcante is said to have ditched that van that i mentioned earlier. so police were right when they said yesterday that cavalcante was still in chester county, still in areas where they were searching but they were not able to get their hands on him at this time. sara, this really is the nightmare scenario that he finally has his hands on a weapon. we are hoping to learn more about what exactly happened to lied to this presence at a press conference like you said at 9:30. >> for the parents there, for the residents there, what can you tell us about the schools in the area? >> reporter: well, sara, like i said, we're right on the edge of the perimeter, you see this heavy prison presence, just a block east that's owen j. roberts high school and middle school. they announced early this morning they have closed all of their cares out of an abundance of caution because there is just so much police presence while this search a happens to close to the campus. the do downingtown school dist said activities will be contained to indoors. there is a lot of concern. we have been speaking to people coming out to the gas station who want to see what's going on behind us. i have to tell you the concern is high, but the -- the residents here are ready for cavalcante to be caught. sara? >> it's causing an extreme amount of disruption there. we will be watching. i know you will be waiting and watching to see what happens next. appreciate your time, danny. john? this morning the heavily armed private train carrying north korean leader kim jong-un crossed into russia's far eastern region. there's new video showing kim arriving at a russian train station. kim is expected to meet with vladimir putin with his top party leaders, members of the government and armed forces at his side. u.s. officials have been warning that an arms deal could be on the table. putin needs more ammunition and shells for his war on ukraine. authority korea is short on cash and food. the deal could give pyongyang's nuclear missile program a boost. paula hancocks joins us from seoul in south korea. this meeting has a lot of nations in the region including the one where you are nervous this morning, paula. >> reporter: absolutely, john. this is certainly a meeting that seoul, tokyo, washington, the list goes on, would really rather did not happen, but it is looking like it's going to happen, in fact, we do have new video of kim jong-un in russia. this is the station of hassan which is in russia, getting off the train, meeting with russia officials, according to state run media they said the head of ministry of natural resources came to meet him as he crossed into russia. now, according to the defense ministry here in seoul he actually crossed into russia in the early hours of tuesday morning. it's now about 10:00 p.m. on tuesday so a good 12 hours ago this is expected to be and he is heading north. this train he is on is pretty slow, the speculation that he may be going somewhere a little further north where there is a space launch center. we've already heard from vladimir putin that he will be going to this area saying he has his own agenda there. not specifying that that is where he will be meeting kim jong-un, but it is certainly what the speculation is and of course the fact it is a space launch center is significant. u.s. officials have told cnn they believe that satellite technology could be one of the benefits that north korea might get if they were to agree to an arms deal with russia. john? >> certainly a very public journey. kim jong-un in that train, everyone knows what it looks like, everyone knows when it crosses borders, paula hancocks, thank you for that report. >> joining us to talk more about this is former white house deputy national security officer for russia, andrea kendall taylor, now a senior fellow. what worries you about this, what do you see most that worries you? >> most immediately we know that russia is after more ammunition which it sorely needs in its confrontation with ukraine. we know that north korea has a ready supply of that ammunition. it enables russia to sustain its war in ukraine and we know that vladimir putin is looking to fight a long war in russia. but i think more importantly than that i worry most about not what north korea can give to russia, but what russia can give to north korea and as the previous commentator was talking about we know that north korea is after technology, they're after missile technology, they're after russian capabilities that can help north korea with its nuclear-powered submarines. so as russia is getting more desperate because of its war in ukraine the more it's going to be willing to give away and so this war really by making russia more desperate is amplifying the other challenges that the united states faces in north korea, but also places like iran and china. so it is amplifying the global threats that the united states is facing. >> that's really an important context around this. as you're talking we're throwing pictures and some of the video that was released this morning of kim jong-un arriving in russia. as john said, very public arrival. there is no secret that he is arriving. there's no secret kind of surrounding this trip, this visit and what will be expected to be this meeting. what does that mean? what are they trying to do with this in such a public way? >> well, i mean, i think russia is trying to build a coalition of countries that share its hostility towards the current status quo in the world and that shares russia's hostility towards the united states and our power and influence in the world. so we see them drawing not just the north koreans closer but also the iranians, certainly trying to pull the chinese in. and that creates this kind of coalition of countries that are willing -- trying to demonstrate globally their willingness to stand up to the united states. also with the publicness i think what you worry is now what north korea gets out of this. they get top cover. in places like the u.n. russia can be an important partner for north korea in trying to mitigation actions that the u.n. could take to sanction north korea for things that it does in it's nuclear program. this top cover can embolden north korea, lead them to be more belligerent on the world stage which russia would welcome because that's a distraction from the war in ukraine, it saps resources and time and attention that the u.s. could focus on russia. >> i want to play for you something that we heard from general mark milley, he spoke with abc's martha raddatz in an interview and i want to play what he said when asked how serious this potential partnership and arms deal is. listen to this. >> it was previously that north korea was dependent upon russia or china for support. now because of the war in ukraine russia is having all kinds of challenges. it looks to me as if putin has gone to north korea with tin cup in hands asking for munitions and support which is an inversion of their previous relationship which is fascinating. >> right to the point that you were making. milley also told abc that he doubts the new ammunition will make a substantive difference in russia's efforts in ukraine. what do you think of that? >> yeah, i think that's right. so it does -- you know, if there's not a lot that north korea can really do for russia and so, again, it's really the inverse that we worry about, that russia is amplifying the north korea challenge and as the chairman of the joint chiefs said -- you know, north korea has new found leverage in this relationship and the thing that worries me, too, is that russia historically has been a productive actor on north korea, they've passed sanctions, they've generally implemented sanctions on north korea in large part because they perceived that there were geopolitical advantages in advocating nonproliferation. now that russia is such a rogue actor i worry a lot that then it's no longer we will see those advantages and it's going to be much more willing to do things that it wouldn't previously have done. >> so you lay this all out. is there any leverage the united states then has to stop or slow this partnership or this coalition that he's trying to build? >> well, i think the declassification of intelligence that we've seen, so the fact that the u.s. intelligence community has come out and very publicly warned about the trajectory of this relationship, about the nature of the deepening military partnership in particular is one strategy that the u.s. is doing to really shine a light on what's happening, to make it more clear to other actors. the second thing they can do in addition to declassifying this intelligence is to really try to pressure other countries and in particular china which may have more leverage in the situation to try to put the brakes on the relationship. but the united states itself i think given that both countries are so heavily sanctioned already have limited tools. >> that's a great point, adding to how complicate this had whole thing is as we watch it play out. great to see you. thank you for coming in. a new judge and charges tossed. that is what trump's legal team is asking for in new legal motions. will the judge agree? new this morning, cnn has learned that house speaker kevin mccarthy is planning to endorse an impeachment inquiry into president biden when he meets with house republicans this week. mccarthy will tell husband caucus the inquiry is the, quote, next logical step in the republican investigations into the president and his son hunter biden, although they haven't presented any evidence the president himself did anything wrong. so there's that in a looming government hut doun at the end of the month not to mention the fact that some republicans want to oust mccarthy as speaker potentially. cnn's lauren fox is on capitol hill this morning. chaos ensues, lauren. >> reporter: welcome back from recess to the house of representatives today, they will return to washington. they have a vote this evening at 6:30 p.m. and there's going to be a lot of meetings preceding that where lawmakers are expected to huddle and have some initial conversations about how to fund the government, but looming over all of this is that question of whether or not the house will move forward with trying to open an impeachment inquiry into president joe biden. like you noted, house speaker kevin mccarthy for weeks has been inching closer and closer to endorsing the idea of opening an impeachment inquiry, telling people privately behind closed doors it was likely it could happen as soon as september, but we should note that he wants to put this on the floor of the house of representatives and, john, that means he will need the support of his republican conference. right now he's not there yet. more effort would have to be done in order to whip the votes, to get the votes to open that impeachment inquiry. there are a lot of republicans who are running in swing districts who are not so sure that this is the right step, especially because there is that large question looming about government funding and how the republicans are going to find a way forward on this question of making sure the government doesn't shut down after the september 30th deadline. this week the house of representatives is going to try to move one stand-alone spending bill on the defense department. the expectation is that they still have work to do to get the votes on that. meanwhile, the u.s. senate is moving forward on a bipartisan basis to try to pass their bills. and that just gives you a little sense of the split screen happening right now. house republicans are having this fight about the impeachment inquiry, trying to find a way forward on even individual spending bills, while the senate is moving full speed ahead on a bipartisan bases to fund the government past september 30th. >> mccarthy needs to find a way through this potentially this week in order to keep his job. lauren fox on capitol hill, keep us posted on all of this. thank you. >> to talk more about this we're join by paul kane senior congressional correspondent for the "washington post." thank you for being here. mccarthy sounds like he's particularly between a rock and a hard place. it took 15 rounds of voting to get him in the speakership and now he has to work with democrats in order to avoid a government shutdown which is going to of course upset one section at least of his party. what's he to do? and can he get through this without losing his job, do you think? >> yes, he can get through it without losing the job. he could lose a heck of a lot more stature, i know that sounds hard to believe given how little he has had so far. ultimately there is a belief in some corners that what they really want, these far right 20, 25, 30 house republicans, really just want a really weak speaker and that's what the sort of goal has been for a long time. now, he has to balance these 20 to 25 who are always agitating against the broader interest of the national republican party. senate republicans want no -- want nothing to do with an impeachment inquiry. each some of the most conservative senators, people like tommy tuberville have expressed no interest in an impeachment inquiry but then on the other hand his far right flank are saying if you don't do an impeachment inquiry, then we're not going to vote to keep the government open. once the government does shut down, nobody knows how and when they would be able to open it back up, when would they realize that this is such a bad political play that we can really open the thing back up and wave the flag of surrender. >> yeah, when you think about it, playing chicken with government spending every single time for the american people it gets really old really fast. i do want to ask you what some of the main sticking points r i know that ukraine funding is an issue, defense funding is an issue. what are some of the real problems that you see, some real sticking points that you see that he's going to have to fight through and try to negotiate? >> yes. now, there was this deal back in may between -- negotiated between president biden and his advisers and kevin mccarthy and his topical lies and they set these top-line numbers for what you were supposed to spend on domestic agency programs and national security, pentagon issues, and then after that the same 20 or 30 hard right republicans basically said that deal wasn't good enough and they have said that we're not going to move any of these bills forward, we're going to continue to undermine you and threaten your speakership unless you spend at dramatically lower levels and also include a whole bunch of culture war policy riders on things like the woke pentagon, so-called woke pentagon, and that has made it impossible for democrats to vote for these bills. so now you have a senate that is moving forward not including any of these culture war issues, spending at the exact levels that biden and mccarthy agreed to in may and they are going to be wracking up 75, 80 votes for these bills out of 100 and over in the house they're like barely getting these bills across the finish line. so it's setting up a very bad negotiation. >> a battle royal, if you will. i want you to listen to what we heard this morning from representative nancy mays, a republican, who supports going forward with the impeachment trial, if you will, or impeachment inquiry into joe biden. let's listen. >> the inquiry, my understanding, gets us or will assist us in getting joe biden's bank records. there is no doubt based on the evidence that i've seen, whether it's the stars reports or evidence from the fbi, whistleblowers, et cetera, there is no way that any of this happens without joe biden. if that is a tool in the toolbox that we can use to get more evidence for the american people then i'm going to support it. >> do you think there is any chance that mccarthy will not go forward with an inquiry because you have these few house republicans who are insisting on it and that may be the sticking point that he can't avoid? [coughing] when caroline has a cough she takes robitussin. so, she can have those one on ones again. hey jim! hey! can we talk about your yoga breaks? sure. get fast, powerful cough relief with robitussin, and find your voice. ♪ robitussin ♪ utilized them to form a perimeter around that area. a border patrol tactical team was also in the immediate vicinity and went directly to the location of the sighting. they observed footprints and some mud which were identical to the prison shoes worn by cavalcante. a track was initiated and shortly thereafter both of his prison shoes were located. information was received from another resident in that immediate area that a pair of work boots had been stolen from a porch at her residence. the tracking of cavalcante continued in a northerly direction and at 10:10 p.m. a call was received from a resident on coventryville road indicating a short hispanic male, no short, wearing dark pants had entered his garage while the homeowner was in it and that he grabbed a .22 rifle leaning in the corner of the garage. the homeowner drew a pistol and fired at cavalcante as he fled with the rifle. psp responded and secured that scene. at that time a green sweatshirt and white t-shirt believed to belong to cavalcante were discovered near the edge of the driveway. the perimeter was expanded to include that area. overnight searches of the area within the perimeter was conducted by tactical teams from multiple agencies. teams from pennsylvania state police, border patrol, atf, fbi, u.s. marshals and chester county have been active through the night. teams are currently being rotated out and replaced with fresh teams. aviation assets, k-9s, mounted patrols and numerous other assets have been mobilized and are currently operating in this search area. upwards of 500 law enforcement officers are engaged in securing the perimeter and conducting the searches. we are mobilizing additional resources as we speak and are planning for an extended operating period, if necessary. cavalcante is considered armed and extremely dangerous. he is now armed with a .22 caliber rifle with a scope and flashlight mounted on it. throughout the night we spent -- or we sent several reverse 911 messages to residents within a three-mile radius of this incident as well as posted information to social media in an effort to inform the public and to keep them safe. we also notified the affected schools of this incident in the very early morning hours and a decision was made to close schools for today. the current perimeter including pa 23 to the north, pa 100 to the east, fairview and nant mill roads to the south and iron bridge and county park roads to the west. we ask residents in and around this facility to please secure homes, outbuildings and vehicles. it is imperative that anyone with information about cavalcante contact us immediately so we can act on it in a timely manner. they can call 911 or our tip line at 717-562-2987. 717-562-2987. we will take questions at this time. >> what was the response time, sir, from the moment the homeowner called the state police after the shots had been fired? what was the response time? >> minutes. >> do we believe he's injured? >> we have no reason to believe that he is injured as a result of that shooting? [ inaudible question ] >> i think he is just trying to survive and avoid being captured right now. [ inaudible question ] >> yes. [ inaudible question ] >> we have considered her dangerous right from the very start. it changes nothing. we have always considered him to be a risk. we just now absolutely know that he has a weapon. >> do you think he knows where he is. >> yes. >> do you think -- >> i think, yes, he has been in that area before. >> [ inaudible question ] >> we are not evacuating homes at this point. we are asking residents to be vigilant and, again, lock their doors, call us if there is any issue or any concern on their part. [ inaudible question ] >> it was several shots. i don't have that number at this point. [ inaudible question ] >> not as a result of anything with the search. we've had a few minor incidents or issues with officers out on -- on the perimeter and things, but nothing related directly to the search. >> has he gotten help from anyone at any point? >> i'm not going to comment on whatever assistance he may or may not have received. what i will tell you is that at this point i believe he is beyond assistance and he is in that perimeter and we will actively hunt until we find him. [ inaudible question ] >> yes. >> now that he has a firearm and you have a general location of containment is it imperative to push now, especially given the urgency of the firearm? >> sir, we have been pushing anytime we had him contained from the very start. we have seen this as a high priority throughout. it is in this particular case -- the search area is probably close to three miles across east to west and two to two and a half miles north to south. it's a large area, wooded, hilly terrain. it's not something that it's a matter of just sending a few people in and searching. as i said, we've had a number of tactical teams operating in there through the night. we continue to have teams operating in there now. it will take a long time to clear that -- that entire area and -- and we will -- but we will continue until we do locate him. >> you talked about how difficult the area was to search in. is this similarly difficult, more or less difficult? >> some similar challenges, the difference here it's a little larger area. and so anytime you are in an area like this you can imagine if you went out and took a several square mile area and had to three and find a single person who is trying to hide, it's a challenge. >> is he contained now in that area? >> as i said before no perimeter is ever 100% impenetrable. we are absolutely -- have absolutely stood up a very strong perimeter, we will do our very best to contain him in there and to capture him. [ inaudible question ] >> there are some creeks in there, yes. >> are the officers instructed to wear tactical gear? >> the officers have been wearing their gear throughout this entire search. again, we have always considered him dangerous, we just now -- we now have confirmation that he has a firearm. the tactics are the same. [ inaudible question ] >> is with the firearm. was with the firearm. it was with the firearm. >> he is so close to -- [ inaudible question ] >> we are focusing on that entire area, again, we have people -- supervisors on the ground out there assessing any issues or risks of escape and we are trying to address any -- any possibility out there. >> it sounds like these residents contacted officials pretty quickly. the fact that the team was able to see the fresh prints, identify them as prison shoes. what happened? why weren't they able to find him? >> they have been searching for him. it was only minutes, but in that amount of time he traveled a significant distance. we've been utilizing dogs and we've been utilizing tactical teams. so, you know, again, just because we find a footprint because mean we necessarily know which direction he traveled and, in fact, he had traveled south and then went back north. so it's not a matter of just charging into the woods and knowing that, you know, it's that away. it's a matter of trying to track him, a matter of sweeping methodically through the woods, checking buildings and so forth. we don't have the luxury of just charging up the nearest trail and hoping that's the direction he went. >> he went to the garage, the firearm was laying there. had he been watching that house? >> i don't believe so, sir. i think at that point he was being pushed by the teams that were pursuing him from the original sighting. i think it was -- in my opinion i believe it was a crime of opportunity. i think he went in there, probably trying to hide, the garage door was open. he didn't, i believe, recognize that the owner was in there and i think he was probably looking for a place to hide, ran for that garage, saw the firearm, grabbed that and encountered the homeowner and fled with the firearm. >> what square mile area are you searching. >> eight to ten square mile. >> two instances of cavalcante picking up supplies that changed the search, whether it was a van or a firearm that was unsecured. do you have any way to change the messaging in this new containment area to really emphasize -- >> i don't know how much more i could emphasize it, sir. i've been very clear about securing things. we have sent as i said several reverse 911 messages through the night, again, emphasizing that point, again, telling residents what they can do, just advising them of the situation. i can't be any clearer that they need to secure things. >> maps of culverts, drainage areas -- >> we are working with maps, we have county management people on site and have had them on site here in the command post so that we do have access to the available information. >> an officer that passed out around 9:00 a.m. -- >> i don't, i was told it is not a life-threatening situation but i don't have any other information. >> you said it is a matter of time before he is captured. it feels like you're getting very close. how many officers do you have on the ground right now? do you have a number? >> we're well past the 400. we are probably around 500 right now. it's very fluid. we have people still coming in. we've been releasing people that were held overnight. we have people that have been on duty for 20 hours, 24 hours or more and we're relieving them. we held people over because of the seriousness of the situation last night. so we're working through replacing all of those. we have people coming in, i can speak for the state police, from all over pennsylvania to support this effort and to be able to sustain it and our partner agencies are doing the same, not only from pennsylvania, but from out of state as well with various specialty teams. [ inaudible question ] >> no, this is the area where he left the van. it's very close in proximity to where the van was abandoned and where i talked about that i believed he was in the woods and was likely hiding. >> the homeowner interviewed him, can you give us any more detail about what he told you. had he gotten the reverse 911 call, the homeowner who shot at him? >> i can't provide any more detail. what i can tell you, again, he encountered him, did he call us very quickly. he did what we asked him to do with regard to that. >> what road was that? >> coventryville road. >> how many times did he fire at him? >> i don't have that number of shots. several shots i was told. >> there are reports that cavalcante stole a pair of boots. are those accurate? >> yes. [ inaudible question ] >> i'm sorry, which homes are you referring to, ma'am? [ inaudible question ] >> those homes -- well, the ring door camera is nowhere -- it's not in this search area, and the home with the garage that we talked about is within the search area and we are actively working that area. >> does he have food? >> i don't know. >> do you have a sense of how many other houses he might have been in in this area? >> i don't have reports of any other houses he's been in. doesn't mean he wasn't been but we don't have reports of those. >> what has gone wrong here? have you underestimated him? >> sir, i don't know why you would think something has gone wrong. our law enforcement people have done an amazing job tracking him and locating him. that proverbial needle in a haystack and they have located that needle repeatedly. the questions yesterday about is he out of state, is he somewhere out of the country and we told you we were actively searching in this area. our people have done an amazing job, i'm proud of the work that they have done and have continued to do. nothing has gone wrong. our agencies are all working very well together and i believe we will be successful in the long run. >> is there a change of posture in how your troopers and law enforcement in the field are pursuing him now that he's armed? >> we have always considered him to be very dangerous and i have stressed that in every one of my press conferences and every briefing that i have given to our people that are out there searching. we considered him desperate, we considered him dangerous, all this does is confirm for us that he has a weapon. >> is he desperate enough to use that weapon on law enforcement? >> he has killed two people previously i would expect that he is desperate enough to use that weapon. [ inaudible question ] >> i'm sorry? >> any efforts under way to prevent a carjacking? >> sir, we're actively working that area. i don't know what other efforts we could make to prevent a carjacking. we've asked people to secure everything. anything that occurs in there we will be on top of. you know, we're making every effort to find him as rapidly as we possibly can. >> is there still a shelter in place within the search perimeter? >> people can leave their homes, that's entirely up to them. we have not tried to direct anybody to shelter in place, we have simply asked them to secure their homes. it's up to them if they want to leave, if they need assistance they can let us know and we will work with them to make sure they can get out of the area. >> does coventryville have a video of the interaction from last night? >> no. i'm sorry? [ inaudible question ] >> i have been in regular communication with the governor's office and the governor himself. he has been closely monitoring this situation and has offered any resources that are necessary. has offered to contact other states if need be. so he's been closely monitoring this, he is on top of it and we continue to keep him advised. >> other than the rifle has cavalcante made any aggressive moves to the homeowner who i believe is in his 80s, is that accurate? >> he did not to my knowledge make any other aggressive moves. they confronted each other, the shots were fired and he fled. and i'm not going to release anything else about the homeowner at this point. >> do we know how close they actually got to each other, the homeowner and cavalcante? >> it was a number of feet. >> anything you'd like the public to know at this juncture? i know you've reiterated some very important facts. >> no. i think, again, i stress, please secure things and not just within the perimeter, in the vicinity around it, and please call us immediately if they see something suspicious, if they believe that cavalcante might be in the area. we need that information. again, it's a large search area. we're going to very thoroughly search it, but their assistance is very much appreciated. >> can you explain why you can't just push through on the terrain, what you're dealing with. >> we are pushing through with the terrain with tactical teams, but it is not -- not really practical to suggest that we could line up a line three miles long and push in one long line through there. we've got to methodically search it, we've got trained teams that are doing that and we're going to cover that ground as quickly and thoroughly as we possibly can. thank you very much. we will get additional information to you as things unfold. thank you. >> major developments out of pennsylvania overnight. you've been listening to lieutenant colonel george bivens with the pennsylvania state police reporting that the convicted killer on the run dan low ca danelo cavalcante, armed and on the run. this is how it happened at 10:10 p.m. they received a call from a resident indicated that a short shirtless hispanic male had been in his garage while the guy was in it. this man fired at cavalcante, cavalcante ran off. not injured, we believe. >> right. he said they don't believe that he has been injured, but there were several shots fired. they were just feet away but they think that cavalcante got away with that gun. >> again, these developments happening overnight. they are now flooding the zone where this man was last seen. >> one thing with he all were noting as we were listening to this. the tone in this press conference, there was a difference and a change from the press conference in just the urgency and the message and the seriousness of how this message was delivered. this press conference also was not planned, you know, when we woke up this morning. we learned about it partway through the morning showing that things are developing, they're very clear that they have upwards of 500 law enforcement officers on this, in this search area, looking for him, warning everyone in the chester county area to lock your doors and secure -- you know, if you have firearms, secure them and secure obviously your property because the manhunt is very much under way and in a very -- almost a very different phase now because it's much more dangerous, as we know this man now has -- has a rifle. let's get over to danny freeman, he has been on the ground covering all of this. danny, you noted this morning that there was a lot of activity this morning and overnight. activity overnight and what stands out from the press conference? >> yeah, the first thing they want to mention is directly to your point that we have seen this most recent push in action and we are at the edge of the most recent perimeter on state route 23 and 100 and that intersection there and we have seen the horses and trailers going in and armored vans and multiple armored vans with multiple officers in fatigues and a presence in the sky, and we can feel the extra officers and as the lieutenant colonel bivens saying that they are behind me searching for cavalcante, and starting with the press conference and hard to begin that we have been giving the first, the primary sighting of the 10:10 where he stole that gun and a lot of attention, but don't forget that there were two sightings last night, and one at 8:00 p.m. in this press conference a woman said that she saw someone running along the street at fairfield road, and to give you perspective, a tremendous amount of media and law enforcement in that exact area of of the fairfield road where the van was ditched by cavalcante along the weekend where a woman spotted him, and then the police came to the scene at 8:00 p.m., and they found his prison shoes on the ground discarded after they found footprints and they also had a report of the work boots stolen off of a woman's porch that cavalcante has. they sent the dogs after him, and other teams searching for him, and then nothing. then we have the 10:10 sighting that cavalcante according to the state police entered a homeowner's garage right from that garage, and.22 caliber right from that garage with ammo, and the homeowner in the garage and fired back with him of a handgun and they got there within minute, and cavalcante was gone and in the wind. one thing they want to touch on that is something that stood out the me in the press conference, lieutenant colonel george bivens is asked if he knows where he is in this moment, and the lieutenant colonel said that he does believe he knows where he is in this vicinity, and he believes he has been in this area before. that's a surprise. and something that we have not heard yet from the law enforcement, and we knew that he had acquaintances in phoenixville where he went saturday night to get help and the ring video of him clean shaven and changed the appearance, but this is what seemed to be a random area of where the phoenixville was, and this is not random, and he knew where he was going, and where he wanted to ditch the van and he has been in this area before, and one other thing to note, this is a large area that law enforcement is trying to sweep right now, and the lieutenant colonel saying 8 to 10 square miles and describing this area as wooded and hilly and even though they have a show of force in there right now, as we have been saying all morning, they it is a is difficult to actually sweep and clear the area, and the lieutenant colonel saying it is difficult, dand 13, we are surprised by this manhunt, and it does not seem they have eyes on him despite two sightings last night. >> danny is putting it together for us, and this is a urgent and dangerous phase, and danny freeman on the ground, and danny, we will continue the follow it, and let us know what you are picking up, as things are changing quickly. >> and luckily, we have our john milnler in to talk us through i. and over and over in the press conference, have things changed, because he has a .22 caliber rifle, and it has rounds nit, and the response has been that it is the same, and he is dangerous, and we have been telling everybody that he is dangerous, and you know law enforcement better than everybody, and what has changed? >> well, the rules of engagement have been changed, and the word out to search team is that if he has does anything other than surrender peacefully, you have a green light to use deadly force, and it is a nuance, but it is really important which is under both supreme court rulings and law enforcement procedure, if somebody is running away from you, and they are running away from you, and they are fleeing, you cannot shoot from the fleeing felon, and this is nuance, but if that person getting away constitutes a greater danger to the public than using the deadly force to stop them to wit, they have committed a couple of murders and likely to commit another, and then the instructions to the field is that now he is armed and has a long weapon and can be used at a distance and he is clearly desperate, and this is going to be a big difference in that potential encounter. >> 10:10 p.m. is when they got the call last night that this encounter had happened in the garage, and cavalcante goes into the garage where the resident was, and cavalcante takes the .22 with the scope and the rifle -- >> he has another pistol somewhere. >> and then he fires at him, and the call came within minutes, minutes of the encounter, and how does that help them now? >> well, it is giving them a new search area, and some precision, but what danny freeman touched on is that he went to phoenixville which is like a suburban town, and all of the houses are stacked together, and he went to try to find a human contact, and when he switched to the area that he is in, and this is not far from phoenixville, but the terrain is much more diff different, and it is wooded and treed, and it is what the colonel bifvens has alluded to that is what has been the comfort zone, and unfortunately he is the hunted, but the game-changer here again is that he has a rifle with a scope, and he is in a wooded terrain, and he has changed the dynamic to take the search teams and make them the hunted. >> one thing -- >> it is ratcheted up a little bit. >> sorry, kate, but we are seeing the pictures and the area they are dealing with, and it is 8 to 10 square miles, but all sorts of out buildings and trees, and with the scope, he is ten times more dangerous, does it is not?
