hastert became congressman and now he is under federal indictment and accused of lying for hush money. and on the hastert beat since the days with "the new york times" and days with the chicago tribune, jeff this woman's brother, do we know if he received any payment from hastert and he is not the same person because he is deceased to have alleged to have received hush money. >> he is not the same person. and as far as we know he did not receive any hush money. his sister said he did not receive any money. and he left illinois after he graduated from high school and the university of illinois and was living in los angeles until he passed away in 1995. so he received no money or had limited, if any, contact with speaker hastert after high school. >> and in terms of the other two victims, how much do we know about who they are and what happened to them or alleged victims, i should say. >> and we still don't know who they are. individual a. named in the federal indictment and he is the person who had been meeting with dennis hastert and receiving payments of a promise of up to $3.5 million so we know he went to high school around the same time frame in the '70s, possibly as far as into the '80s because he left in 1985 and became an illinois lawmaker but we don't know who the individual a. is. and the other individual who we've confirmed through law enforcement sources that the fbi has been in touch with him, we don't know much either other than he was a student at the time. but we've talked to so many other people on the wrestling team and people from around town no one knows who the individuals are. >> and hastert, he hasn't been seen publicly and he is set to be arraigned in federal court next week. >> he is. and it is important to remind he is being arranged on the bank fraud charges, not sexual misconduct he is being arraigned on bank fraud charges because of not reporting all of the large sums of money he was taking out of his bank account and then lying to the fbi about it. so that is what he is accused of. and these aren't that serious of charges. they each have prison terms of up to five years or so. but the whole sexual misconduct allegations, he is facing so much more public pressure now than the fbi bank charges. >> just the whole hypocrisy given his record in congress and he was to oversee the mark foley investigation, and having inappropriate relations with pages or inturns, and that he was overseeing anybody, in retrospect is stunning. >> it is stunning. and the fact that he became speaker in the first place. newt gingrich had to step aside because of problems in his past and livingston had to step aside because of problems in his past and hastert emerged out of the blue and no one knew much about him. but it is the mark foley scandal from '06 that people were wondering if hastert was doing enough to rein in this member of congress from florida having inappropriate relationships with high school interns working on capitol hill and so much of our time in that story was spent trying to figure out why speaker hastert didn't sort of do much about this and now we certainly have so many more questions now that we know this in hindsight. but at the time nobody was talking about this, even his enemies weren't talking about this. >> thank you so much for joining us. joining me jeffrey toobin and for the time covering this closely for the paper, and the statute of limitations, jeff that is all expired. >> for when he was a high school teacher, yeah. i can't imagine any scenario where those cases could be pros cated any more. >> the question of course could there possibly be other more recent cases, because if he's got some kpulgs or -- compulsion or what are led him to do this to multiple times, to multiple people it would be hard to understand how that could just stop. >> right. but although what changed is access. when you are a wrestling coach, you are around teenage boys all of the time. when you are a united states congressman you are not as much. although it is true and one reason why it is not terribly surprising if one or several is true is that people who abuse children tend to abuse more than one. >> lynn i understand you reached out to hastert's former staffers about the allegations and what did they say? >> everyone is stunned and surprised and absorbing the allegations and especially the sister today by the former student of hastert. so none of this is making sense to his former associates. they are concerned about him because no one has seen or heard from him so they also are wondering how he is doing, anderson. >> it is amazing that none of this came out while he was speaker of the house? >> well here is what is interesting, what one associate told me. that if this sister knew he wouldn't have become speaker. he locked in the votes on one day in 1998, the day when the house voted to impeach bill clinton and charges stemming from his affair with monica lewinsky. as jeff just said bob livingston newt gingrich's heir apparent decided he had to offered to because he was having an affair. if this woman had come forward and had told her story to anyone deny hastert would not have been the speaker, that is what was pointed out to me. there were times when this woman could have come forward but she did not. >> she said she tried i believe to -- >> years later. in 2006. so i'm saying there were inflection points where she or other people who thought they might have been victimized could have come out and change the course of his and house history. and you were asking what people were saying and this is what people were musing about. this is not the man they knew and why didn't this come out sooner and concern because no one has seen him. >> and again, i come back if he was doing this as a high school wrestling coach, there has got to be more -- if these allegations are true and now there is three people this stuff doesn't just stop. and whether it is boys of this age or people who are older and -- i mean i don't know. we'll see what else comes out. in terms of the financial allegations against him, jeff legally, what is he facing? >> he is -- these are two felony -- serious felony charges. if he were to plead guilty and frankly 73-year-old men facing serious charges almost always plead guilty. i can't imagine he'll get prison time. but if he forces the government to prove their case, and it comes out who individual a. is and the story of their relationship comes out, it is entirely possible he could get some prison time. >> so he wouldn't get prison time if he just pleaded guilty? >> i cannot imagine. >> even if it is a syria felony-- a serious felony. >> it is a serious felony. but this is the realm of white-collar crime but under the sentencing guidelines it would be available to the judge to give him proegs. and if he pleads guilty and nothing comes out about other bad conduct he almost certainly wouldn't get jail time. >> thank you. there are other develops involving another member of congress aaron schock the ab flexing representing the 18th district of illinois. yesterday more than a dozen federal agents raided his office in junction city illinois taking boxes of documents and a computer and items from the residents. he left ore spending irregularityies and spending improper gifts and he since paid some of the money but his troubles are far from other. and the grand jury has been hearing from current and former staffers. joining us is crist care guard of the local paper, the peoria journal star. chris, good to have you on. why was the campaign office raided and why it was raided now? >> what is interesting about that anderson it came one day after one of his aids testified before the grand jury. this was the aid sara rogers who arranged most of the congressman for his official office travel and handled the scheduling out in washington, d.c. so there is talk about that. and there is also talk about other things in connection about it. so it seems about time. what surprised me is they and hadded raided it sooner. >> how long is he going to have an office for? >> my guess on that would be that there are still some things with a campaign to wrap up. as you know he just won re-election last year and stepped down at the end of march so i'm sure there is some record-keeping things and plus he's under serious questions about not just his office expenses but also campaign expenses that people were looking at and some irregularities there that were reported. >> the justice department issued subpoenas to eight former -- former savers -- staffers correct? >> correct. everybody from the chief of staff down to an in attorney. >> and is it possible there are other possible staffers we don't know about. >> there may be other staffers particularly on the campaign side. if they don't work for him in congress they are under no obligation to raise their hand and say i got a subpoena. so for example his former chief of staff who worked as his campaign manager and has neither job would have no obligation and his political director and a whole host of others. >> do we have any idea where aaron schock is because we haven't seen him since he resigned. >> we haven't seen him since his resignation but there have been a number of sightings around town a moment. but first the sisters jill and jessa spoke with meggin kelly and said that josh's record shouldn't be released and what he did wasn't that bad. >> today when i said victims, you furrowed your brow a little. do you feel like the victim of a molestation? >> i do want to speak up in his defense against people calling him a child molester or a pedophile or a rapist people are saying. that is so overboard and a lie, really. i mean people get mad at me for saying that but i can say this. i was one of the victims. >> in touch magazine broke the story and now said there are discrepancies in what michelle and jim bob said when they broke their silence. jean casarez has that. >> the first thing that isn't true in the interview, is the family's claim they cooperated with police. >> we met with them and they said we want to interview the kids and we said we have nothing to hide. but the fact is josh himself didn't come forward at that time with the rest of his family. duggar admits that later in the interview. >> not josh. josh was 18 at the time. he was not a juvenile any more. >> the duggars say they developed and carried out a plan after josh confessed to his parents what he had done. >> we talked to him and put all kinds of punishments on him and he watched him all of the time. >> and removed him from the home for counseling. they say they had no obligation to come forward with what they knew. >> as parents you're not mandatory reporters, the law allows for parents to do what is best for their child. >> in touch spoke with legal experts that say that isn't true. marcy hampton said they do have a legal obligation. >> they are partly responsible for letting it happen because the minute they heard this they should have removed him from the home. >> had they come forward, they could have faced charges of permitting abuse of a minor, that carries a penalty of up to six years imprisonment. the next point, the duggars claim that law enforcement may have released juvenile records because of an in sentive. >> was there any motive for the police chief to want to hurt your family. >> i'm not sure. >> there must be an agenda. >> if there was a bribe or some kind of personal agenda. >> the fact is there is no eds of a bribe and in touch magazine got the records through the freedom of information act, not once but twice. >> but generally, any abuse charges and a particular sexual abuse in public records, the names of the victims are redacted and often the names of the perpetrator are, if they are underage. >> and what may be the biggest issue with the duggars' story of all, in touch said the duggars implied the man they talked to at the police department was unknown to them. >> we went into the arkansas state police. >> at the police headquarters. >> walked in and was there and we went in and talked to him and said hey, my son has something that he needs to share with you and we took a witness with us and that went in and sat down and he shared everything. >> and that officer was trooper jim hutchins who knew the duggars. ironically hutchins is now serving 56 years in prison for child pornography. the duggars visit to the police station could have ultimately led to charges. but no charges were ever filed. jean casarez, cnn, new york. >> joining me now brian stelter. it is interesting in this interview where they are trying to set the record straight there is allegations that they weren't telling the truth. suggesting there was a bribe when it seems like there was a freedom of information act request which is totally legal. >> bottom line is this interview made a bad situation worse. you use these interviews to get ahead of the crisis and their reputation has worsened as a result of the interview. and we're going to hear from the daughters. and that interview was taped on wednesday and that won't respond to the charges that they were making mistakes or distortions. >> did tlc set the interview up. >> the opposite. they probably would have set it up with a different network but it was the duggars personal p.r. firm the same that works for huckabee. >> they are the same p.r. firm. >> trent gallagher, he is a close adviser to huckabee and he advises them on what to do. he has a good reputation when it comes to public relations but it seems like a mess for the duggars and it is hard for them to get back to tlc. >> and duggar was coming out in support to them and has taken off their endorsement. >> yes, after the campaign website and that was telling a couple of days ago. that makes it hard for tlc to bring the show back. and i think the network is still not commenting. and they don't have to. because the show is not in production. >> it is one of their top rated show. >> that show and the little people. and tlc normalizes families that aren't always seen as normal. that is what the channel is known for. but this with family they were normalized by tlc but now it seems like a more complicated story is out because the family's secret has been revealed and it is not normal. >> and are they having emergency meetings about it. >> there has been no meeting about it. they want to be seen as budding out and not being involved. there are a couple of camps inside of the channel. one camp is clear, they can't bring this show back and they know they can't. but some people still think they can with a spinoff. >> about the daughters or the daughters that have come forward. >> that is right. the two daughters in the new interview, a subject of a spinoff as they start their own families. that would be a way to stay in business with the family but not with the parents. but even a spinoff. it appears less and less likely. two of the sisters are speaking and two of the other victims are not speaking. by having two come out and the others not, it makes you think more about the other two victims and what they are going through and we haven't heard from josh duggars. >> thank you, and you >> we had a close relationship. i liked her very much. >> may i ask, was it a sexual relationship. >> well connie i've been married for 34 years and i've not been a perfect man and i've made my share of mistakes but out of respect for my family and out of a specific request from the leafy family levi family i think it bet i not get into these details about chandra. >> condit was thoroughly investigated and many believe they spent too much time trying to link him to the detriment of the case. >> cops and the prosecutors were so focused on that theory of the case they missed the suspect hiding in plain sight. >> evidence to find any clues in rock creek park failed it. wasn't clear if she would be found. >> but her body was in this 2800 acre park. her remains were found right about here. not by police. but for a man looking for turtles, the discovery one year after she disappeared. police had never searched this remote area of the park. >> even before her body was found, an informant names morales told authorities that ingmar guandeke told him he killed her, after admitting to assaulting two other women in the same park. morales's tem would lead to the murder conviction with the sentence of 60 years in prison. during the trial morales testified he had never cooperated with investigators before in an effort to win leniency for himself. >> it turns out he had cooperated with other investigations none of them related to this case. >> and that was enough to get a retrial. >> yes. he committed perjury. >> if guandique is found not guilty this time the question on so many minds 14 years ago will be asked again, who killed chandra levy? gary tuchman, cnn, washington. >> and joining me again, jeffrey toobin and also with us mar geragos who represented gary condit back in those days. it is incredible when you think there is -- a. how much time has gone by and what this means for the family. are you surprised there is going to be a retrial? >> not really. one thing we've learned from the exonerations is cell mate are some of the worst evidence that the prosecutors can ever put on. these people lie. they know exactly what prosecutors want. they have tremendous incentives to lie. >> because they get better facilities or treatment. >> right. or they can get released. and it is -- there was tremendous incompetence in this investigation. they didn't find the body which was in rock creek park. and they didn't find guandique which fit the profile and he had assaulted people in this park and they didn't look at him as a suspect. this was a zaft fresh day one and continued to be a disaster. >> and was the problem they spent all of the time investigating congressman condit? >> that is clearly what it was. for those who don't remember this was wall to wall on that summer leading up to and the only thing that stopped the coverage of this case was september 11th. up until that it was wall to wall. you couldn't turn on any cable news station or any nightly news and see anything about this case. and the only thing that broke through it was september 11th. now mind you, as jeff says the lesson to be learned here is why prosecutors felt it was necessary to put on a snitch because that is what they call it snitch testimony, is beyond me because next to eyewitness testimony that may be the most disheartening tool that is used by prosecutors in the criminal justice system. but the fact is they knew about it. we had gone public within a year to a year and a half with guandique because the art investigation showed as you mentioned, that twice before he had assaulted women who were jogging in that park. there was ever reason to believe that chandra was jogging that day that she disappeared. down to almost the exact lotion where he assaulted the other women within a very short distance was where they found chandra's remains. so if it wasn't for the nonsense focus on gary because that was the sex and scandal that sells, they probably could have solved this case. >> jeff what is the prosecution going to base their case on if they don't have this testimony? >> it is a really good question. i don't know what they have. because he was the key to the prosecution's case. they can still put him on. but they now have to disclose that he committed perjury in the last trial and that he has this very shifty background of having all of these confessions in prison. so i mean they can try, to try this case again. but boy, they have their work cut out for them. >> mark do you think they have a case? >> yes, i do. because there was -- there were witnesses at the time who had seen this gentleman with scratches and cuts that he had no good excuse for at the time when she went missing. you can use this similar crimes-type evidence to get in on the other two and i think that that is what they will base the case on. it would be the ultimate irony and injustice if he goes free and not having been tried because they were so focused on the sal. >> and titillating in this case. >> good to have you on. up next the keep them honest reporting, spotlight on a hospital after babies were dying, after performing surgeries that they had too little experience. and apparently we got attention. the action that is taken now. and the owners whose were forces to pay $11,000 in legal bills for their dogs. we have an update next. hey, what are you doing?
