raising concern among democrats. we'll tell you what the president's family wants him to do and the state of his campaign right now. plus, just hours from now, the supreme court will finally issue a ruling on donald trump's presidential immunity claim. we'll break down this pivotal moment and the final cases that the justices are set to weigh in on. also ahead, former trump adviser steve bannon this monday, juul /* july 1st. i'm jonathan lemire. thanks for spending your morning and weekend with us. we have so much to cover. the biden family is urging president joe biden to stay in the presidential race following his disaster of a debate last week in atlanta. the president gathered with his closest family members at camp david for a preplanned trip over the weekend. the major talk with us the future of his re-election campaign after his troubled performance on thursday. the message of the biden family was to keep fighting with the president's son, hunter biden, one of the strongest voices, urging his father to stay in the race. americans say he wants to see the father he knows, scrappy and commanding rather than the aging american they saw on thursday night. some focused frustration on allies that include advisers anita dunn, bob bauer, and ron klain, but others call those allegations false and the biden campaign told nbc news in a statement that the president maintains strong confidence in his most senior staffers. there have been some calls for the president to oust some of his advisers. we've been told that's not going to happen. following his poor debate performance, president biden is now trying to reassure supporters he can beat donald trump saturday night. the president -- he can beat donald trump. on saturday night the president and first lady attended the fund raiser at the home of governor phil murphy. in a speech there, biden brought up the debate, telling attendees this, i didn't have a great night, but i going to be fighting harder. it's the same message he conveyed to a star-studded crowd earlier in the day out in east hampton, new york. that was hosted by a hedge fund manager and several actors including sarah jessica parker and michael j.fox. the president told that crowd he's converted more undecided voters than trump has. he also reported out the number of times trump hide during the debate, adding, people remember how bad things were during his presidency, how much they disliked him. at the end of his remarks, the president promised to win the election. biden tried to ease voters' concerns almost immediately after thursday night's high-stakes matchup. on friday he put on a completely different performance than the one seen less than 24 hours earlier. >> i don't walk as easily as i used to, i don't speak as flew smoothly as i used to, i don't debate as well as i used to, but i do how do what i know how to do. i know how to tell the truth. i know -- i know -- i know right from wrong. and i know how to do this job. i know how to get things done. and i know like millions of americans know, when you get knocked down, you get back up. >> congressional democrats have largely rallied and why president biden this weekend. take a listen to what they had to say after the debate performance. >> i believe the setback is nothing more than a setup for a comeback, and the reality is joe biden has confronted and had to come back from tragedy, from trials, from tribulations throughout his entire life. so the moment that we're in right now is a comeback moment. >> i'm saying to you that i support the biden/harris ticket. i ooh i'm not abandoned joe biden right now for any speculation. biden/harris, both of them. i'm enthusiastically supporting them as are many of our grassroots people. >> i spent time around three different presidents, margaret, and i will tell you that the president's job is enormously hard and involves all kinds of things, none of which are standing and doing a debate for 90 minutes on tv. i'm not so cynical to believe the american people are going to choose a president based on a 90-minute debate over a four-year startling level of achievements. >> i might say i had a more difficult evening than the president did and here i am right now having this conversation, and i'd really like to remind everybody watching biden is 1 and trump is still zeroing and he's the only person who's ever beaten trump. >> importantly, barack obama supported him. he wrote this, bad debate nights happen. trust me, i know. but this election is still a choice between someone who has fought for ordinary folks for his entire life and someone who only cares about himself. between someone who tells the truth, who knows right from wrong and will give it to the american people straight and someone who lies through his teeth for his own benefit. last night didn't chachlk that, and that's why so much is at stake in november. joining us now. senior national politics reporter jonathan. good to see you. let's start with the family meeting in camp david. what else have we learned where the messages there from the family to the president and also the president and his team to nervous democrats? >> i mean, what's going on with the family here is what we've seen in the past from joe biden's family, basically, you know, different levels of bucking him up when he's, as described, been embarrassed with his own moments. more importantly, i'm not shocked he huddled with his family and was told to run. i think the most important thing is this effort to calm nervous democrats. there was a campaign call yesterday. julie chavez rodrigues, chris coons, the senator from delaware who's very close to joe biden with a very small group of some of the most elite democratic donors, their message was largely about the mechanics. they said, if biden were to get out, the only way to transfer the money from the campaign is if kamala harris was to replace him. i think that's an interesting strategy on their part. >> and we should know the family's supporting the president's continuing to run, also blaming some staff. maybe there were some legitimate concerns over the debate staff, but by blaming them, it shows how disappointed the president was on thursday night. let's talk about the full-on freak-out by democrats. senior democrats are standing behind the president. but we know behind the scenes, elected officials, donors, a lot of democrats are really anxious about whether biden should continue or if he does, if he can still win. >> i've spoken to elected officials who are not out there publicly criticizing biden, at least not by name. one of them told me thursday night he should throw in the towel. i spoke to one yesterday who said donors are done with biden and in their own race when they call donors, they're hearing that the donors don't want to give money unless biden is off the ticket. so there's definitely some frustration, concern, anxiety within the democratic party, not just about biden's performancing but what it means for some of the down-ballot races. at the same time, there's not a lot that folks who would like to see him move aside can do. this is in joe biden's hands. no one can force him to walk away. all the delegates, almost all of the delegates -- i don't have an exact percentage. but 95% of the delegates going to the convention are pledging to nominate him. so those are people that are going to nominate him unless he chooses to step aside. in addition to that, if he were to step aside now, you would have some sort of ugly floor fight at the convention, whereas, if he were to say win the nomination and step aside, there are rules in place for the democratic party to replace him on the ballot. i don't think there's any scenario in which anyone else is going to urge him effectively to get out. this is joe biden's decision and he appears to have made it. >> democrats told me if he were to change his mind, it would come in the coming days. if he does, though, make the decision to bow out, remind viewers exactly how that would work. vice president harris would certainly be the favorite to be the nominee, but i don't think the field would be clear for her, do you? >> i think it depends on what joe biden's departure would look like and certainly the timing. the campaign says they don't have the ability to raise money for anybody else, so kamala harris is the next person. you know, you've got to look into the ftc rules and they have an idea about that. i think there are a lot of people who would be interested in that, but i also think there are people who would want to pass on 2024 and run in 2028. the top contenders obviously as you mentioned, kamala harris, governor newsom, governor whitmer of michigan, and josh shapiro, the governor of pennsylvania are the most that have been mentioned. obviously in michigan and pennsylvania, you have two of the key swing states for joe biden [laughs] a home router should never be a home wrecker. oo this is a good book title. welcome back. as we turn to some of the morning's other headlines, hours from now former trump adviser steve bannon must report to prison. he's saying he has no regrets. this after the court rejected his last appeal to stave off his sentence for defying the subpoenas from the house committee. he was convicted on two counts of contempt of congress and sentenced to four months in prison in 2022. a u.s. district judge put a sentence on hold as he pursued an appeal of his conviction, which was rejected back in may. the judge then reported bannon to report to prison by july 1st saying there was no basis to continue to delay the sentence. banen will become the second former trump aide to serve prison time for disregarding a subpoena from the house panel. peter navarro is nearing the end of his own four-month sentence in a federal prison in miami. his sentence will sideline bannon, a major maga thinker days before the election. meanwhile doug burgum claims there was a smooth transition of power at the end of donald trump's presidency. burgum, who is a top contender to be selected as trump's running mate, made that ridiculous comment during an interview with nbc news' "meet the press" yesterday. he was repeatedly asked if trump's refusal to accept the election was repeatedly undermined. >> it went down to one county, the hanging chads in florida in 2016. yes, hillary clinton conceded the election, but immediately after that began what's still going on today, the smear campaign, about whether the election results were legitimate. both parties have done this. as a country, if we move forward, we have to have an election both parties can agree to. >> governor, let me push back for a moment. therein lies the difference. everyone has a right to challenge the election. everyone conceded. donald trump has yet to concede. is that not undemocratic, particularly for someone running to be leader of this country in the free world again? >> yes, so jonathan, i think there are three possibilities here. one is that the court completely buys donald trump's immunity claim. he's immune, case over. that's a high possibility. the other is the court adopts the ruling from the court below and says the argument is completely rejected and the case proceeds. i think it is in between. one of the oral arguments we got from justice neil gorsuch, he said, i'm not so much concerned about this case bus we have to think about future cases and draw a line. i imagine they're going to engage in some line drawing and say something like the standard is whether a president is, as you say, engaged in official acts or acting outside the acts of the presidency. whether the president is acting in his role as president or in his role as candidate. and so wherever that line gets drawn, it seems likely that the court will say it has to go back to the lower court to look at this case and see whether these allegations are on the right or wrong side of that line. and that could take at least some weeks to get through that hearing, which would cause just enough delay, i think, to put us past the election before this case could proceed to trial. >> so remarkably after all four cases that donald trump faces, the only one likely that will go to trial was that new york case where he received that guilty verdict. the other three will not. first, your quick reaction to the fisher case, is sth a win for insur recollectionists? >> they're looking at an obstruction of justice. they're talking about destroying or mutilating of documents or otherwise destroy or obstruct proceedings. otherwise means by any other means, but the court interpreted it very narrowly to say when it says otherwise, it's still talking about documents. because of the false state of electors, i will still apply to the indication and stands to continue. what the justice department said in issuing the statement after this decision was rendered is they believe it applies to about 52 of the more than 1,200 cases, so a small number, but certainly 52 cases. so those cases will have to go back and either be dismissed or looked at for new trials or for resentencings. so all in all, it's probably not a massive impact on any of the january 6th cases, but it will have a massive impact around the country in obstruction of justice cases. >> certainly another conversation for another time, how important the chevron case is as well. we'll talk about that later this week. barbara mcquade, thank you so very much. still ahead, we'll take a look at what's driving the market this morning after stocks ended weaker. plus we'll go over warren buffett's largest contribution ever as he continues with his philanthropy. we'll be right back. we'll be ri. i know you love your dadda. of course he loves you. he just doesn't show it on his face... or with his body language. come on. oh, junior! haha! good job junior. way to go. >> that's right. good morning. we're seeing futures suggesting it could be ahere start to the trading session on wall street today, however, we are expecting this could be a bit of a quiet week in terms of equity moves exactly because on thursday, july 4th, we're going to see wall street closed. however, today, a lot of focus on politics. there's still a lot of pressure on the president, joe biden, in the wake of what was described as a weak performance on thursday's debate. let's see how that might impact markets today. but when you think about the performance over the first half of this year, we saw actually quite a lot of support for u.s. stocks, particularly ai and tech names. just to give you an idea over the last quarter, we saw the dow down by about 1.7% on the quarter. however, the nasdaq ended the quarter up by more than 8%. those numbers are very clear how much interest and support there has been so far for some of those ai names. >> you mentioned the potential fallout of the campaign in the u.s. let's tack about europe and the first round of electionings in france with the far right having a big day, having an impact on the european markets. tell us about it. >> at this stage we're seeing french equities moving higher. we're seeing the euro trading higher against the u.s. dollar exactly because investors are looking at the outcome of the first round of the preliminary election in france and thinking, okay, this is not as bad as we originally thought, however, though, this could be a premature move because we only had the first round. there's negotiations happening as we speak, and voters will head to the polls once again on sunday for the final voting of this preliminary election. let's see what happens, but, however, for the time being, because these initial results suggest the far right might not get the outright majority that some predicted is giving some relief to some of those french stocks. but let's see what's going to happen over the next week, jon. >> it certainly seems president macron's decision to call for a snap election may have backfired. warren buffett made his biggest donation yet. tell us about that, please. >> he announced another 5.3 u.s. billion dollars in charity last friday. however, though, there's been a major shift in where the money goes. he said that once he's passed, that he might not -- that the foundation of bill and melinda gates might not be getting some funds, however, that will be a decision for his three children. they will be the ones deciding where some of those charity funds will go. >> all right. cnbc's silvia amaro live from london. thank you as always. next up here, president joe biden is facing calls within his own party to drop out of the presidential race. we'll dig into the criticism in the high-stakes debate and ask a democratic lawmaker what biden should do. that's when we come right back. n should do. that's when we come right back type 2 diabetes? "the new york times'" editorial board said biden should drop out, calling his candidacy a reckless gamble, and "new york times" argues, quote, it's because biden is beloved and because he has real accomplishments as a president that he needs to top the nerve-racking tight-roping walk at the oval. it's put this way. if biden has the strength and wisdom to step aside, the democrats will have two months to choose another democrat. even longtime democratic strategist james carville said biden will be off the election ticket. axios blasted carville just over the weekend. joining us now, democratic congressman wiley nickel. congressman, thank you so much for joining us this morning. we really appreciate it. let me just ask you. do you believe that president biden should continue his re-election campaign? >> the reason i really wanted to be on this interview, "way too early" does a great job of setting the tone for the day. the folks need to hear this. there's only one president who should step down. it's simply not going to happen. >> let's talk. as noted, a lot of pages are suggesting the president should step down. there are a lot of democrats privately saying the same, though, to be clear, not much in the way of public calls for that yet. but the perception is out there that the president is sort of weakened. so what advice would you give to him? what should he be doing in the days ahead to reassure fellow democrats he is up for the? >> he did it here in my home state of north carolina. he came to just outside of my district in rally right after the debate. gave a great speech. i think we're going to see a lot more of that. i think these are very fair questions. this is an important discussion to have. i wish we were talking more about all of donald trump's lies at the debate, but he's going to get out there in front of the press, get out there in front of the public, and they're going to get to judge for themselves, but i believe this was just a bad night, a candidate who was way overprepared. i think there are some questions about how he was prepared for the debate. he was trying to get so much in in these questions. in fairness, it's hard to keep up with donald trump when he just continues to go all over the place with crazy stuff. >> yeah. and let's be clear. the president by his own admission said he had a tough night. will let me ask you this. what are you hearing from your fellow democrats behind the scenes. are you hearing members who are at up ease or they're still with him? >> it was not at a great performance by president biden, that's clear. i think the place -- the folks i serve with in congress, it's pretty simple. we need to continue to talk about the good work the biden administration has done and go out there and make the case. we're going to have to carry joe buddhen to victory just the same way we carried barack obama to victory and president biden to victory in the last election. but for folks watching, it's on us to make that case with our friends, our neighbors that this is a president we need to keep because we can never let donald trump get back to the oval office again. >> let's talk about that race ahead. the president, we take him at his word, he stays in. what's in contrast that he needs to do with trump that will resonate with your state that the democrats think they could potentially put in play? >> we need to make the case about protecting the right to vote, protecting the right to choz. those are the issues that matter in north carolina, and doing the good bipartisan work. there's only one candidate for president who's going to work across the aisle in a bipartisan way. joe biden has demonstrated that. i'm going to be with secretary pete buttigieg in a few they're here a ton. they're making those investments. because north carolina is a state that will determine the president of the united states. i believe we're going to be the state that decides. joe biden only lost by a point and a half in the last election, so it is incredibly close. i think we're a point and a half more to the center since then. >> democratic congressman wiley nickel of north carolina, appreciate you being on this morning. up next here on "way too early," donald trump is touting his debate performance. we'll play for you the presumptive gop nominee's comments just a day after he took the stage in atlanta. then, coming up on "morning joe," a panel of legal analysts is standing by with their key takeaways from friday's supreme court rulings as well as a look ahead to decisions that are going to come out today, including, finally, donald trump's immunity claim. plus, senator chris coons of delaware and congressman jim clyburn of south carolina, two staunch biden allies, will join the conversation on the heels of that first presidential debate and the president's shaky showing. also ahead, emmy award nominated actor paul reiser and grammy award winning singer michael mcdonald will be our guests. man! that was a big one. but as you saw on television last night, we had a big victory against a man that really is looking to destroy our country. >> so that was former president trump speaking at a rally in virginia on friday, the day after his debate with president biden. joining us now, special correspondent at "vanity fair" and host of the "fast politics" podcast, molly jong-fast, an msnbc political analyst. let's talk about trump for a moment. he wasn't good at the debate. >> no. >> he lied repeatedly. >> yes. >> though he did, i guess, for him, keep a relatively calm demeanor and a better television performance than his opponent. do you think, though, did trump -- set aside biden for a moment. did trump win over any new voters on thursday? >> no. when you look at the snap numbers you saw right away, it showed that voters, they're cured from trump amnesia by seeing trump. in fact, there were poor ratings for his performance, as well. you know, the other thing about trump, he's so in this right-wing media bubble that he has just a few kind of things he does, right? now he says, you know, they're coming. they're rainistrapists. they're poisoning the blood. he has a few things. he said, i'll bring back your jobs in 2020. i'll bring back coal jobs. it wasn't true. it wasn't going to happen. coal is super expensive. he'd promised things that people really wanted. now, he's not doing that, right? he just has this one immigrant rhetoric and does it again and again. he gets so much positive reinforcement from this conservative news bubble, that i actually think it doesn't deserve him as a debater or politician in any way. >> let's talk about the fallout from the democrats. as you sat down, you have an argument that maybe things aren't as bad as so many in the party believe. >> so i would say this. again, the debate was on thursday. we've had one working day, right, which was friday. the quick polls so far have not shown anything, right? they've just shown sort of static. they've actually shown that trump, that you bring trump back, and trump amnesia is cured. you know, the thing i was struck by is there were a lot of people who were like, oh, god, this guy again. again, we don't know. what i would say is that biden world had its biggest grassroots fundraising day on thursday. the second one was friday. there are people in this space who still really feel for joe biden. i think the elite and, you know, the editorial boards have turned on him, but i'm not sure that that dynamic doesn't serve him on some level. remember, with donald trump, it actually did. >> yeah. certainly, there's been no public outcry from democrats for him to step aside. more private consternation, private concern. >> nobody on the record who is a biden supporter has even come anywhere close to raising any kind of questions. i think that's a really important point. you have to remember, like, vice president was out there. they have been really out there for him. i just -- you know, to say democrats aren't with him, i would say pundits are definitely not with him. >> there was one poll that did come out this weekend, cbs suggesting more than 70% of americans think biden is not up for the job. >> right. >> i'm paraphrasing. that's a concerning number. it did seem like, on thursday, he had a chance to spell the notion he was too old, and in some people's minds, he seems to have affirmed it. what can he do to counter it? what does he need to do in the weeks ahead? >> that's the number one question, and he needs to be out there. what you saw in the debate performance was not good, but the next day, he was in north carolina. yes, he had a prompter. yes, he was giving a speech. yes, the crowd was into it. but he was great. then you had him going to fast food restaurants, interacting with people, and people really liked it. he's a very good retail politician. he's been doing this for a million years. he just has to get out there, talk to people, has to do politics, and he has to dispel fears. you know, it makes it a little harder, but if you think about it, like, the idea that he -- i think the idea that a bad debate performance, especially when he has this history of bad debate performances, is really not -- it should not be the measure. >> we should note, obviously, he did so well at the state of the union. he did have a teleprompter there. had them at the rallies. he didn't have one at the debate. you're right, today is july 1st. we have months to go. there are a lot of events between now and election day that could change this race again. >> yeah. >> one in a few hours potentially with the supreme court ruling on presidential immunity. >> yeah. look, the supreme court, you know, they're so partisan. they're remaking the federal government in this heritage foundation image. i think that they're hoping it won't hurt trump in this election because there are two extreme maga justices who really want to retire under donald trump. i think those are important data points as we look at this last immunity decision, which they have punted so far that it is not even in the month of june. >> likely means no matter what they decide, a trial seems unlikely, shall we say, before the election. msnbc political analyst molly jong-fast, thank you. we'll talk later on "morning joe." thanks to all of you for getting up "way too early" with us on this monday morning.
