of presidential immunity and a quest to avoid being held accountable for the january 6 insurrection. the reset, president biden is with his family at camp david amid the new reports of concern over his debate performance as his own party continues to worry if he can or should go to the distance. biden harris campaign national cochair congressman jim clyburn and former alabama senator doug jones are here to discuss this looming consequential week. as we end month of pride celebrations around the country, i will talk to the leaders of top lgbtq+ organizations about challenges facing the community including a new warning about a potential threat to marriage equality. i am jonathan capehart this is the sunday show. tomorrow is a big day for american democracy and the power of the president of the united states. for tomorrow■ç on the final day of its term the supreme court will issue its long-awaited decision on donald trump's claim of presidential immunity in his federal election interference case. the ruling to determine whether trump will ever face accountability for his role in the violent insurrection at the u.s. capitol on january 6, 2021. but no matter what the justice is decide, the court's decisions to delay this important case until now has all but guaranteed that trump will not have to stand trial before the november election and this decision will drop after a weekend in which president biden has had to contend with growing calls for him to bow out of his reelection bid after his shaky debate performance on thursday. right now he is with his family at camp david ça trip originall planned before the debate but a trip where the debate and the democratic panic will no doubt,. the washington post editorial board correctly says any decision to drop out of the race should ultimately rest with the president. renting out that biden quote cannot be coerced into doing something he does not want to do. nor should he be. but, other editorial boards have flatau urged him to step aside. the new york times editorial board was first out the gate writing quote to serve his country, president biden should leave the race. and the atlanta journal- constitution from the key battleground state of georgia suggested that quote it's time for biden to pass the torch. but, what about the twice impeached four times indicted on 88 counts and convicted on 34 felonies for president and his disastrous debate performance that was filled witç an avalanche of more than 30 false claims not to mention projection and veiled threats, so far the inquirer and battleground pennsylvania is the only major editorial board to call on trump to drop out saying quote the debate served as a reminder of what another four years of trump would look like. more lies, grievance, narcissism and hate. nevertheless, the glare of the media spotlight remains focused on what president biden and the democratic party planned to do next. nbc news reports that some top democratic leaders have privately expressed concerns about the presidents viability according to two sources a price of those discussions but publicly, two of the parties biggest leaders are pushing back on that characterization and standing by him. here's what speaker meredith, nancy pelosi and house ■çminori leader jeffries had to say earlier on msnbc. >> i am not abandoning joe biden right now for any speculation. biden harris both of them, i enthusiastically supporting them as are many of our grassroots people. >> the reality is joe biden has confronted and had to come back from tragedy from trials, from tribulations, throughout his entire life. so the moment that we are in right now is a comeback moment. >> joining me now, clyburn, national cochair, as well as thank you for coming to the sunday show, so let me get word from you, do you agree with minority leader jeffries that xrdsident biden's come back that this is president biden's comeback moment? >> yes i do, thank you for having me. the fact of the matter is i have made it very clear, ever since the morning after that is friday morning, that i think people ought to just chill out. because this is something that he knows, any time a sitting president takes it upon himself to debate. it happened historically, so it happened to ronald reagan. it happened to barack obama. and now it has happened to joe biden. we have been running the country as he has been, for 3 1/2 years, with all of the issues faced, that he is faced with. you don't have time to sit aside and make up stories aboutç the past. or, to forget. about what is going on around you. you've got to face your job. and he has been doing that. and so for him to go into preparation and what i have been calling this, a classic example of preparation overload. i just think that there should have been much less preparation for this debate and much more activism at his job. >> you know congressman i actually agree with you, you can see the president trying to remember the dollars and the figures and everything and there were moments when just the president biden from the heart as one person called him irish biden would come out çand say more of that, more of that please, congressman have you spoken to the president since the debate? >> i have not. we knew before the debate that he was going to do that debate. and was going to go to new jersey. and on over to delaware. with his family. and i never planned to talk to him until after i finished here in wisconsin until tomorrow. i am doing my fifth event of the day. here in wisconsin and i will be here all day tomorrow and then, i will talk to him afterwards. >> congressman clyburn since you are doing lots of events tell me the truth what are you hearing from people on the ground? >> almost total and i am ■çsayi almost because i have not heard a single person express anything negative, all they are saying to us is keep joe biden moving forward. and from what i have heard, around $33 million in small donations most of them, two thirds coming into the party. when i left washington on friday night, i went directly to tampa, florida. i was in a meeting with 8400 african-american men, every single one of them when i mentioned joe biden they were standing on their feet, they had nothing to say but positive things about this campaign. so when i hear all this talk about he should drop out. i don't see that anywhere out here. no place. here, in madison■ç, i am going to milwaukee. nothing. >> one more question for you since you mentioned that even you did with all those black men, donald trump said at the debate that migrants were taking so-called black jobs. congressman clyburn what is a black job? >> that's what i've been trying to figure out and all the men i talked to down there in tampa florida were asking me is your job a black job? i'm sitting in court, a federal judge, and now senior status, is my job a black job? what is donald trump talking about? i said well, he has always categorized black people as ■ç being different from white people and therefore having a special type of job and that's what he is talking about. there is no black jobs or white jobs, these are jobs from the american economy and all of us are to be pursuing the opportunity to fill these jobs except in donald trump's world. >> yes, as i said yesterday, with donald trump saying black jobs, she immediately thinks that he looks down on us. and things that we are inferior. but we know better. congressman james clyburn of the great state of south carolina thank you for coming to the sunday show. ■ç >> thank you for having me. >> joining me now is former senator from alabama and u.s. attorney for alabama doug jones who is also a distinguished senior fellow at the center for american progress all right, senator jones your opinion on the calls for president biden to step aside as a result of his performance at the debate on thursday. >> you know jonathan i totally agree with congressman clyburn i think he said it better than anybody and what you are seeing across the board. whether it's leader jeffries or speaker pelosi, others that are coming on show after show over the weekend and expressing their support what you are seeing is an underlying confidence that people have in joe biden, a habit not just because of the most consequential presidency in at least in my lifetime over the last 3 1/2 years but his lifetime. of service to the american people because everyone knows joe biden's first ■çand foremos interest is to do what is in the best interest of the united states of america and that's what he is going to do. that's what he has continually done. and i think that representative clyburn said it in an earlier statement, the best performance for the future is what has gone in the last 3 1/2 years and it has been an amazing run for the biden harris team so i think that these calls are way premature and by the way they are not really public calls, there's a lot of discussions that have gone on behind the scenes and there should've been, there is no question it was a bad night. but i think at this point people have to understand and you are seeing a confidence in joe biden that will go forward. >> senator let's talk about the big decision that we are waiting that will hit tomorrow at about■ç 10 am tomorrow morni and that is trump versus the united states and this is whether trump's claim of presidential immunity has merit in the federal election interference case, do you first see the sixth conservative super majority granting complete immunity to donald trump? >> look, i think democrats have always been freaking out and going back several months every month an article that anxious democrats, democrats tend to be a little bit more anxious and i understand that because i work for hillary clinton and we were all very traumatized from that experience but at the end of the day i don't think anybody who watched the debate should be saying that either one of the people we saw on the screen did a good job. all right? trump lied through the entire debate, joe biden had some stumbles in the beginning and ■ç got stronger as the night went on it was not overall a good performance from either one of them. and i think that we often overlook the fact that donald trump is, his unfavorable's are because of how he behaves. right? it's not about republicans spin about his record as in the case with joe biden it's actually because of how he is so one of the things that i hate to hear is that well, you know his lying and racism and misogyny even his criminality is all baked in. we should talk about that every single day also we should talk about the fact that at the debate on thursday night he said he wouldn't accept the results of the 2024 election like he didn't in 2020 and also in 2016. i also want to point out he needs a ■çvice president why? >> these hypothetical questions that keep coming up imply that somehow the and every one of our 3100 counties in america that everything will go perfectly. >> you won't admit to accepting the election results? >> if they're free and fair of course. >> come on. like why can't he just answer ■ç the question. you go first zerlina. >> because then he wouldn't be on the short list for vice president, he has to add in these caveats the only acceptable answer is yes i will accept the results of the election because black people voting and latino people voting those are legitimate votes and that is the unspoken subtext when republicans question the results of elections. since 2020 donald trump has basically been saying the only reason why he lost in 2020 is because millions of illegal people voted now people are not illegal i am not saying that i'm quoting donald trump but the point is is that's the subtext and that's what they are not saying so again, it's a bunch of gas lighting but another word for gas lighting is lying. >> let me play ■çanother for yo rick, another bp contender and that is senator jd vance who was on face the nation and he was asked whether, asking senator vance whether donald trump should pardon himself if he wins election, watch this. >> so you do believe the president could pardon himself for federal crimes? >> i believe the president has broad pardon authority but more importantly i think the president has immunity it's not whether he should pardon himself is about whether he should be prosecuted in the first place for discharging his official duties. >> now i am no lawyer but am i wrong in order for you to get a pardon.you have to admit some kind of guilt? >> ■çyou must accept guilt and responsibility and admit guilt and obviously donald trump will never do that. jd is another one of the contenders here. and you know he sort of has been up and down in the standings lately, doug burgum seems to be moving up, it takes a lot of work. it takes a lot of effort and he is really putting in the time to be the king of suck up mountain for donald trump right now. >> i hear you chuckling zerlina do you have any words on that before we go to the next soundbite? >> i don't have anything to add i think that was well put. i think the only reason why they need another vice president is mike pence is not available, he did not retire.■ç it's a dangerous job at being his vice president. >> if i could jump in i just want to say doug burgum reminds me of mike pence without the smoldering sensuality. this is not an exciting guy. >> it took me a while like what? and i just want to point out that north dakota is where my husband is from and where my in- laws live, so not laughing at north dakota but it is actually. okay wait, so speaking of vice president here's what lera trump had to say on sunday morning futures, that show with maria listen to what she had to say about what a vote for president biden would mean in 2024. >> most people would say if you vote fmr@■joe biden you're actually voting for kamala harris because there is a low likelihood that joe biden gets through all four years. >> it's a bad situation all around for the democrats because look, in order for them to put someone else in to run, they have to get joe biden either to quit or they have to remove him as you noted via the 25th amendment. >> zerlina, what? just your reaction. >> okay, so what's wrong with vice president kamala harris? i just want them to admit why they don't like her? and then we can move on with a sane discussion because there is subtext in what they are aj democrats but what they don't want to say is it would be a problem for democrats to nominate a black woman? [ screams ] this final weekend of pride month is a good time to acknowledge how far the lgbtq+ community has come and to recognize the new challenges we face spanning from a potential second trump term and project 2025 the looming threats from the supreme court. joining me now to discuss the state of lgbtq+ rights in our country, james black president and ceo of family equality, kira johnson, executive director of the national lgbtq+ task force and ■ç kelly robinso president of the human rights campaign. i am just squealing over all this black excellence on the screen right now so i will go around the table and i will start with you kelly because you are not here, how concerned are you about the fate of marriage equality? >> anybody looking at the supreme court wouldn't feel confident that this is a court that will make sure they protect the rights that we have gained over the last several decades, you don't have to look over the overturning of roe v wade. taking over 50 years a president that is for our rights. two things are clear for me when the supreme court is on the ballot this election cycle and two that any of our rights that are protected through supreme court precedent are fragile and that means txa, we've got to move forward deeper and stronger protection through legislation and law. some of that has been done through things like the respect for marriage act but we have a long way to go. >> to that point the munoz case that was decided by the supreme court arguably was a case about immigration but, justice amy connie barrett writing for the majority turned this immigration case into a marriage case and denying a visa to the el salvador he and national husband of a u.s. citizen whose daughter is also a u.s. citizen and saying basically there is no fundamental right for this married person to have their spouse in the country which strikes right at the heart of the other decision, this was a big red flag that was pointed out in her dissent, how worried should the community be that■ç is maybe a supreme court term or two away from being overturned? >> i think we have to do more than be afraid i think we have to really move towards action i think what we have been able to see is how connected how linked our faiths are, there is no issue that people care about, immigration, housing, resin reform that does not directly and often uniquely impact lgbtq+ people and so this is a community, these are community issues and these are doug burgum issues , lgbtq+ issues and we have to be out and counted not just for the election but locally, school board elections and statehouses , etc. so now is the time to galvanize for sure. >> james what do you make of all this? > , the project out of the heritage foundation that is looking at a wholesale reorganization not just of the government but of the country. you know, kelly this week the court announced that it's going to hear an appeal by the biden administration, that gets or put the court in the debate over gender affirming care for transgender minors, how concerned, when i first saw the news i got very concerned that the supreme court is going to weighed in on this issue but then because it's the biden administration that is calling for this case to be heard, should i not be as worried? >> look, it's the last day of ■c pride month i thought we were going to do happy pride things. >> we will get there, just answer this question. >> okay, all right well look, again the supreme court is not an institution right now that people are feeling very confident in which is why i think that there is so much worry and concern. at the end of the day right now there is a ban on gender affirming care on healthcare access for trans-people in some states particularly in tennessee where this case comes from so the supreme court hearing it is an opportunity for them to decide on the side of the facts and uphold the constitution and uphold the rule of law by not allowing the band is currently in place to continue. there's a little bit of a silver lining here. but i also want to say this, weç know the supreme court currently has not been doing their job they have been creating laws and legislating through their decisions instead of upholding the constitution and upholding laws as they are. so our job right now is to tell our stories, to bring more visibility to what this case is all about and make sure that when they are in oral arguments and actually hearing the facts that there's enough room for them to do their job and upholding the rule of law. because at the end of the day when you look at this case but it's trying to do is legalize discrimination in healthcare for certain people based on their gender identity, that is not right and the majority of americans do not want politicians deciding their healthcare for them, we learned that time and time again so as people are looking at this i know there's a lot of concern and worry but i have to have you remember that we are not without hope and we are certainly not without power. and there is something that we can do about it to all of these things that are causing us such concern and worry. >> james to kelly's point because she said i thought this was going to be a happy conversation, talk about some ■ç happy things the communities should be happy about. >> i think the community should be happy that we are still making progress, right? in the midst of this barrage of anti-lgbtq+ legislation that all that we are sort of in this defensive posture, we are sort of battling all these laws and all these bills, we are still making progress and i think about the historic settlement that we just won over florida, the floor the, the florida don't say 1011 law. you can say gay now in florida and i think that's something we should be proud of. i think that there are ways that we are being proactive and not just fighting laws but thinking about what are the ways in which we can start to implement legislation that hel( biden administration is a great demonstration of that, we should be proud and we should be happy and also note all of the work that this administration has done to protect our families. >> keira? >> we have been out during pride season, all month long and it has been really inspiring for me to see pride's grow this year, you look at houston and phoenix, kissimmee, florida, there are places that are having their very first pride this year and some of them are growing three, four, five, six times. that is telling us that we are not shrinking away but actually our base is growing not just in numbers are in active and action and so that is a telling story, that is not people that are looking to hide or shrink away but they ■çare hungry to b in this fight. >> people not hiding or shrinking away but also in hearing what you just said, is it also allies? are coming out. and joining us and basically saying to their communities and therefore to the country by your example, you are not alone. >> it's a family affair, teachers, listen, administrators, parents, aunties, we are out in the streets, grandma is supporting our family and we are only getting stronger. >> i will give you 20 seconds we are already over time but give me your happy talk. at the end of pride. >> it is really a beautiful thing and i am very clear people are worried because it felt like equality was inevitable for so long and we [iencing the backlash and we that comes when you start to move forward your rights and your power and it's happening not because lgbtq+ community is weak but because we are powerful so our job right now is to not lose sight of our power. there are 75 million voters that prioritize lgbtq+ issues when deciding who to vote for, 75 million. if we show up we win period. so this is one of those moments where even though things are dark and scary in some places, we cannot lose sight of hope and cannot lose sight of our power. because we are in the precipice of change that really can save and protect our rights for generations to come. >> what was that? >> i wanted to participate in the documentary to tell a little bit about that history from my own personal lens, my mom grew up in the jim crow south and attended texas southern university that was her only option at the time because it was pre-the civil rights act's affirmative action was the throwing open of doors for many people including women, native americans, asian americans, black americans but prior to the civil rights act that really was not possible so affirmative action is really every sconces and about equity and that's what the supreme court attacked when the overturned affirmative ■çaction last year. >> what has been the impact of that overturning of affirmative action? >> it's had a tremendous impact and what we are seeing is an attack across the board on the idea of racial diversity we see the attacks on di and noticed the attacks and other programs including the fearless first fund that really supported black women and venture capital but it's an attack on the idea that we are multiracial democracy in which all people should really have the chance to rise to leadership and having holistic admissions that consider race really was an attempt to make sure that everyone in the united states could rise together because if we don't rise together we are going to paris together so affirmative action really stood for that and that's why it's so critical that we began to talk about why we still must value racial diversity in all spaces but especially colleges and universities. >> what do you hope people will take away after watching admissions granted?
