of presidential immunity and a quest to avoid being held accountable for the january 6 insurrection. the reset, president biden is with his family at camp david amid the new reports of concern over his debate performance as his own party continues to worry if he can or should go to the distance. biden harris campaign national cochair congressman jim clyburn and former alabama senator doug jones are here to discuss this looming consequential week. as we end month of pride celebrations around the country, i will talk to the leaders of top lgbtq+ organizations about challenges facing the community including a new warning about a potential threat to marriage equality. i am jonathan capehart this is the sunday show. tomorrow is a big day for american democracy and the power of the president of the united states. for tomorrow■ç on the final day of its term the supreme court will issue its long-awaited decision on donald trump's claim of presidential immunity in his federal election interference case. the ruling to determine whether trump will ever face accountability for his role in the violent insurrection at the u.s. capitol on january 6, 2021. but no matter what the justice is decide, the court's decisions to delay this important case until now has all but guaranteed that trump will not have to stand trial before the november election and this decision will drop after a weekend in which president biden has had to contend with growing calls for him to bow out of his reelection bid after his shaky debate performance on thursday. right now he is with his family at camp david ça trip originall planned before the debate but a trip where the debate and the democratic panic will no doubt,. the washington post editorial board correctly says any decision to drop out of the race should ultimately rest with the president. renting out that biden quote cannot be coerced into doing something he does not want to do. nor should he be. but, other editorial boards have flatau urged him to step aside. the new york times editorial board was first out the gate writing quote to serve his country, president biden should leave the race. and the atlanta journal- constitution from the key battleground state of georgia suggested that quote it's time for biden to pass the torch. but, what about the twice impeached four times indicted on 88 counts and convicted on 34 felonies for president and his disastrous debate performance that was filled witç an avalanche of more than 30 false claims not to mention projection and veiled threats, so far the inquirer and battleground pennsylvania is the only major editorial board to call on trump to drop out saying quote the debate served as a reminder of what another four years of trump would look like. more lies, grievance, narcissism and hate. nevertheless, the glare of the media spotlight remains focused on what president biden and the democratic party planned to do next. nbc news reports that some top democratic leaders have privately expressed concerns about the presidents viability according to two sources a price of those discussions but publicly, two of the parties biggest leaders are pushing back on that characterization and standing by him. here's what speaker meredith, nancy pelosi and house ■çminori leader jeffries had to say earlier on msnbc. >> i am not abandoning joe biden right now for any speculation. biden harris both of them, i enthusiastically supporting them as are many of our grassroots people. >> the reality is joe biden has confronted and had to come back from tragedy from trials, from tribulations, throughout his entire life. so the moment that we are in right now is a comeback moment. >> joining me now, clyburn, national cochair, as well as thank you for coming to the sunday show, so let me get word from you, do you agree with minority leader jeffries that xrdsident biden's come back that this is president biden's comeback moment? >> yes i do, thank you for having me. the fact of the matter is i have made it very clear, ever since the morning after that is friday morning, that i think people ought to just chill out. because this is something that he knows, any time a sitting president takes it upon himself to debate. it happened historically, so it happened to ronald reagan. it happened to barack obama. and now it has happened to joe biden. we have been running the country as he has been, for 3 1/2 years, with all of the issues faced, that he is faced with. you don't have time to sit aside and make up stories aboutç the past. or, to forget. about what is going on around you. you've got to face your job. and he has been doing that. and so for him to go into preparation and what i have been calling this, a classic example of preparation overload. i just think that there should have been much less preparation for this debate and much more activism at his job. >> you know congressman i actually agree with you, you can see the president trying to remember the dollars and the figures and everything and there were moments when just the president biden from the heart as one person called him irish biden would come out çand say more of that, more of that please, congressman have you spoken to the president since the debate? >> i have not. we knew before the debate that he was going to do that debate. and was going to go to new jersey. and on over to delaware. with his family. and i never planned to talk to him until after i finished here in wisconsin until tomorrow. i am doing my fifth event of the day. here in wisconsin and i will be here all day tomorrow and then, i will talk to him afterwards. >> congressman clyburn since you are doing lots of events tell me the truth what are you hearing from people on the ground? >> almost total and i am ■çsayi almost because i have not heard a single person express anything negative, all they are saying to us is keep joe biden moving forward. and from what i have heard, around $33 million in small donations most of them, two thirds coming into the party. when i left washington on friday night, i went directly to tampa, florida. i was in a meeting with 8400 african-american men, every single one of them when i mentioned joe biden they were standing on their feet, they had nothing to say but positive things about this campaign. so when i hear all this talk about he should drop out. i don't see that anywhere out here. no place. here, in madison■ç, i am going to milwaukee. nothing. >> one more question for you since you mentioned that even you did with all those black men, donald trump said at the debate that migrants were taking so-called black jobs. congressman clyburn what is a black job? >> that's what i've been trying to figure out and all the men i talked to down there in tampa florida were asking me is your job a black job? i'm sitting in court, a federal judge, and now senior status, is my job a black job? what is donald trump talking about? i said well, he has always categorized black people as ■ç being different from white people and therefore having a special type of job and that's what he is talking about. there is no black jobs or white jobs, these are jobs from the american economy and all of us are to be pursuing the opportunity to fill these jobs except in donald trump's world. >> yes, as i said yesterday, with donald trump saying black jobs, she immediately thinks that he looks down on us. and things that we are inferior. but we know better. congressman james clyburn of the great state of south carolina thank you for coming to the sunday show. ■ç >> thank you for having me. >> joining me now is former senator from alabama and u.s. attorney for alabama doug jones who is also a distinguished senior fellow at the center for american progress all right, senator jones your opinion on the calls for president biden to step aside as a result of his performance at the debate on thursday. >> you know jonathan i totally agree with congressman clyburn i think he said it better than anybody and what you are seeing across the board. whether it's leader jeffries or speaker pelosi, others that are coming on show after show over the weekend and expressing their support what you are seeing is an underlying confidence that people have in joe biden, a habit not just because of the most consequential presidency in at least in my lifetime over the last 3 1/2 years but his lifetime. of service to the american people because everyone knows joe biden's first ■çand foremos interest is to do what is in the best interest of the united states of america and that's what he is going to do. that's what he has continually done. and i think that representative clyburn said it in an earlier statement, the best performance for the future is what has gone in the last 3 1/2 years and it has been an amazing run for the biden harris team so i think that these calls are way premature and by the way they are not really public calls, there's a lot of discussions that have gone on behind the scenes and there should've been, there is no question it was a bad night. but i think at this point people have to understand and you are seeing a confidence in joe biden that will go forward. >> senator let's talk about the big decision that we are waiting that will hit tomorrow at about■ç 10 am tomorrow morni and that is trump versus the united states and this is whether trump's claim of presidential immunity has merit in the federal election interference case, do you first see the sixth conservative super majority granting complete immunity to donald trump? >> no, absolutely not. i can't imagine that that is going to happen but i also believe jonathan that this is not just the black and white issue of blanket immunity, i would be absolutely shocked if even the two most conservative justices gave a blanket immunity to any president of the united states. what i do think that they are going to try to do is try to determine the difference between some presidential acts versus personal acts and that's where i think it's going to be an interesting dynamic between the justices and how ■çthis decision is going to come out. and quite frankly i think that the decision will ultimately go back to the district court judge for additional findings. this case is not going to be tried before the election. but at the same time if it does go back and the court requires some evidentiary hearings we could see a monumental evidentiary hearing although the likes of which we have not seen since the january 6 committee and the evidence that will come out because that's where i think the rubber meets the road is the evidence and not the ultimate verdict. >> senator one more quick question for you, i am darting out here what would a grant of partial immunity mean for presidential power because in the end we are talking about donald trump, whatever ?e$is decision is will apply to future presidents. also. >> that is true and it's hard to say what they are looking at, for instance, you can speculate all day long but suppose they simply grant say, there is no immunity for personal acts, things outside the president. but we have to take acts that were done in the course of official duties and take those one at a time and do a specific fact-finding on each one, that happens all of the time. i know that they are trying to do something for the ages as i think justice said but the fact of the matter is that this will not be the last that we see of this particular case hopefully it's going to be the last that we see the president who gets indicted but it's not going to ç be the last we see of evidentiary hearings and rulings about immunity for donald trump. >> former alabama senator doug jones as always thank you very much for coming to the sunday show. >> pleasure jonathan. my sound off panel weighs in on the future president biden's campaign and georgia senator raphael warnock's passionate response to the question of whether biden should drop out of the race. plus one year later, the massive implications of a historic supreme court decision are explored in a new documentary on how the fall of affirmative action is affecting college admissions process. try dawn platinum. it removes 99% of grease and food residue. that's why dawn is trusted to save wildlife affected by oil. dawn platinum cleans to the squeak. nexium 24hr prevents heartburn acid before it begins. get all-day and all-night heartburn acid prevention with just one pill a day. choose acid prevention. choose nexium. her uncle's unhappy. cho i'm sensing antion. underlying issue. it's t-mobile. it started when we tried to get him under a new plan. but they they unexpectedly unraveled their “price lock” guarantee. which has made him, a bit... unruly. you called yourself the “un-carrier”. you sing about “price lock” on those commercials. “the price lock, the price lock...” so, if you could change the price, change the name! it's not a lock, i know a lock. so how can we undo the damage? >> absolutely not, bad debates happen as president obama has said. and this was 90 minutes. but let me tell you about that 90 minutes, donald trump lied the entire 90 minutes. joe biden has demonstrated not over 90 minutes but over the last four years the character and the metal of the man that he is. >> that was georgia senator raphael warnock this morning on meet the press making clear what is at stake and why president biden needs to stay in the race in other words folks, keep your eyes on the prize. joining me now my sound off panel rick wilson cofounder of the lincoln project former republican strategist and devil, a plot to save america from trump and democrats from themselves. and selena maxwell hosts of mornings with selena on sirius xm and the former director of progressive media for the clinton campaign she is also the author of the end of white politics, how to heal our liberal divide. rick certainly thank you for coming to the sunday show so we just heard senator warnock i want to ask, i had the job of moderating the debate watching party during the aspen ideas festival and i want to play something so afterwards we did a pregame and a post game. let me play for you what republican strategist mike madrid had ■çto say to the very despondent crowd, mostly democrats in this crowd, the despondent crowd about their reaction to the debate, watch this. >> you have a candidate that has flaws. there is significance but he is better than a 34 time convicted felon. pick up your swords and march down the battlefield. that's how you win. it's not taking off ramps folks. the republicans are not taking off ramps. if you don't think this is a winnable race you are not paying attention to the data. it's extremely winnable. >> and so rick, i think it was very clarifying for the democrats in the audience to hear a republican tell them to basically put your big boy pants on, buck up and circle the wagons ■çaround the guy. >> mike is a former lincoln project colleague and we come out of the same school of thought where when something goes wrong, our answer is not to hide under the blankets, the answer is to go out and find the bad guys and punch them in the face and every single person who is writing around in pain on the floor saying oh, woe is me all is lost they need to keep in mind that no matter what happens with joe biden no matter what he decides or what happens to the democratic party, you can never take your foot off the gas of attacking donald trump and mike has it exactly right in that moment and for people who are throwing their hands up and saying he has to leave the race tomorrow, it's a fantasy. it's■ç meeting the underpants gnomes, it's not real. we've got to fight against donald trump you cannot take a day off we have 149 days left there are no extra days in the campaign. we've got to fight trump every single day. and mike is exactly right on that. >> what do you think about what mike has to say and overall your observations? >> look, i think democrats have always been freaking out and going back several months every month an article that anxious democrats, democrats tend to be a little bit more anxious and i understand that because i work for hillary clinton and we were all very traumatized from that experience but at the end of the day i don't think anybody who watched the debate should be saying that either one of the people we saw on the screen did a good job. all right? trump lied through the entire debate, joe biden had some stumbles in the beginning and ■ç got stronger as the night went on it was not overall a good performance from either one of them. and i think that we often overlook the fact that donald trump is, his unfavorable's are because of how he behaves. right? it's not about republicans spin about his record as in the case with joe biden it's actually because of how he is so one of the things that i hate to hear is that well, you know his lying and racism and misogyny even his criminality is all baked in. we should talk about that every single day also we should talk about the fact that at the debate on thursday night he said he wouldn't accept the results of the 2024 election like he didn't in 2020 and also in 2016. i also want to point out he needs a ■çvice president why? because mike pence is not available, why? because on january 6 he incited an insurrection for donald trump supporters ran up on the capital and mike pence had to run for his life so this is not a normal election and everyone should calm down. >> i wish this were another cable that we could use the actual word that you wanted to use. >> i can do it on the radio but not here. >> that's a nice job. that's a nice black job you got there zerlina. you know what i'm going to do, i'm going to go to break early because whatever question i ask you we are going to be out of time so we are going to go to break early and come back and finish this conversation with my sound off panel, zerlina maxwell and rick wilson after this. this. try dietary supplements from voltaren, for healthy joints. just your reaction. >> okay, so what's wrong with vice president kamala harris? i just want them to admit why they don't like her? and then we can move on with a sane discussion because there is subtext in what they are aj democrats but what they don't want to say is it would be a problem for democrats to nominate a black woman? why? because there's a lot of people in the country who do not like black women. but black women are the base of the democratic party so i would say to democrats anybody considering replacing joe biden with somebody other than kamala harris might want to do some math because they are not going to win an election without black women turning out in droves. >> and rick more to the point, the most reliable voters in the united states are black women. >> i'm looking as a subtext i look at it like 400 point comic sans type really just out there saying the scary black lady could replace joe biden. be afraid. and it's really as outrageous as it is predictable unfortunately and for laura trump to go out there and ■çbri this out is one of many, many dog whistles like we saw trump during the debate talking about the black jobs. and which went over very well for him i noted with the african-american community in the country so far. this is an unsubtle game that they are playing and they're going to keep playing it because a certain part of their audience is convinced that she is the most dangerous person in america. and it's sort of absurd of course. >> rick wilson and my fellow roma buddy, zerlina maxwell thank you both very much for coming to this sunday show. and still to come. amid the pride flags unfurled during this lgbtq+ pride month, where new red flags about potential threats ■çto hard- earned rights, i will discuss the state of the community with three of its major leaders after this. is. which penetrates deep to target the source of pain with nonsteroidal anti-inflammatory medicine directly at the source. voltaren, the joy of movement. looking for a smarter way to mop? >> i wanted to participate in the documentary to tell a little bit about that history from my own personal lens, my mom grew up in the jim crow south and attended texas southern university that was her only option at the time because it was pre-the civil rights act's affirmative action was the throwing open of doors for many people including women, native americans, asian americans, black americans but prior to the civil rights act that really was not possible so affirmative action is really every sconces and about equity and that's what the supreme court attacked when the overturned affirmative ■çaction last year. >> what has been the impact of that overturning of affirmative action? >> it's had a tremendous impact and what we are seeing is an attack across the board on the idea of racial diversity we see the attacks on di and noticed the attacks and other programs including the fearless first fund that really supported black women and venture capital but it's an attack on the idea that we are multiracial democracy in which all people should really have the chance to rise to leadership and having holistic admissions that consider race really was an attempt to make sure that everyone in the united states could rise together because if we don't rise together we are going to paris together so affirmative action really stood for that and that's why it's so critical that we began to talk about why we still must value racial diversity in all spaces but especially colleges and universities. >> what do you hope people will take away after watching admissions granted? >>■ç i think it's a comp locate story, and i think it's from a lot of different perspectives but i hope what people will take away is that the supreme court has really attempted in this space as they did with roe v wade is they are doing with chevron and so many other places to redefine america. do not let colleges and universities redefine and define who we are for ourselves but the supreme court is making a grab for power in so many areas including the administration of colleges and universities and we have to stand for our values and i think that's what i take away from this documentary. our values are incredibly important and we stand for racial diversity, equity, inclusion, all of the things that will help to produce the leaders of the future. >> we will have to have you come back to the show because you're also a lawyer and an expert on all the things i wanted to ask you about your thoughts olthe immunity case but we don't have time. president of mount holyoke college, daniel holly. our executive producer catherine snyder is an alumni. >> we love catherine. hello to all the alums out there in the seven sisters alums. we love our women's colleges. >> great to see you. >> and you can watch admissions granted tonight at 9 pm eastern time on msnbc, more of the sunday show after a quick break. break. nd prevent, all in one. to those with migraine, i see you. for the acute treatment of migraine with or without aura and the preventive treatment of episodic migraine in adults. don't take if allergic to nurtec odt. allergic reactions can occur, even days after using. most common side effects were nausea, indigestion, and stomach pain. it's time we all shine. talk to a healthcare provider about nurtec odt from pfizer. liberty mutual customized my car insurance and i saved hundreds. with all the money i saved i thought i'd buy stilts. being so tall definitely has its advantages. oh whoa. here you go, kiddo. thanks. hi honey ready to go?
