be displayed prominently in all public classrooms. and seven days left. we are one week away from the first presidential debate of 2024 amid brand new polling that shows president biden is gaining. let's begin, though, with that weather. in texas, heavy rain and storm surge from tropical storm alberto has caused serious flooding, as you can see right here with coastal areas underwater from 5 to 10 inches of rain, along with that storm surge. new mexico is also dealing with what the national weather service says is extremely dangerous flooding, but look at this. the wildfires are what's really causing problems in new mexico. the state is reeling. hundreds of structures are gone. and at least two people are dead. locals say they had never seen anything like this before. >> it's been nonstop planes, nonstop sirens and almost felt like being in the war zone with all the smoke surrounding the area here in the middle. >> back east, temperatures are reaching 100 degrees in places that normally feel highs in the 80s with roughly 64 million people under excessive heat warnings. and advisories. let's start, though, in texas. joining me now from rockport, nbc news foreign correspondent guad venegas. a lot of flooding there. tell me what you're seeing. >> reporter: flooding and wind, you can see the wind here. there has been tornado warnings in the area, earlier today we also had a wind advisory with the wind gusts getting up to 40 miles per hour. so, yes, we had the storm come through with a lot of that heavy rain. we had the storm surge and the coastal areas and the flooding in parts like these in rockport. now, this is an area that's inland. we still have the island barrier out towards the sea here, and it's still flooded. also, there was an area just south of us where there was a tornado warning yesterday. we went by, met a couple. bob and bonnie who live in a home that was affected by the wind. this is what they had to say about what happened after that tornado warning went into effect. >> it happened so fast that until you come out here and look at it, it's like -- >> i heard whoop whoop whoop, it started picking the building up. >> reporter: wow. >> that's all i heard. >> and i didn't hear none of that stuff. it had been blowing and stuff all day. >> reporter: what did you think when you came outside and saw all the damage. >> we need to fix it up. >> a lot of work to be done. >> reporter: now, that was damage for the wind, just nearby there are communities that are still flooded in the beach areas. south of us in corpus christi, they had a lot of flooding in maria. fortunately, a lot of the preparations did work. authorities for the counties and the cities here did everything they could to prepare. they asked people to stay off the roads. so it looks like the worst of the weather has made its way through. we have had some flash flood warnings today, and again, wind advisories in some communities behind me are still flooded in many of these areas. it looks like most of the heavy rain did make its way through, katy. guad, thank you very much. to new mexico and deadly wildfires. there are just burned cars left, no structures even as wildfires completely tore through towns. let's bring in nbc's dana griffin who's covering all of this out there for us. dana, what can you tell us about new mexico? >> reporter: katy, at this hour, that fire that has been burning since monday, these two fires are 0% contained. that's critical. for a fire that's been burning so long, destroyed 23,000 acres, another 1,400 buildings and homes and has killed two people so far, this is just the beginning of the effort to try to get this fire under control. there was a fierce storm that rolled into new mexico yesterday, which dumped some 2 to 4 inches of rain. that created flash flooding in some areas. because of the burn scars that have been created because of these fires. so it kind of impacted the fire fighting effort. some firefighters had to move out of the area during that storm. the governor has declared a regional state of emergency, and how long it takes these firefighters to get this fire under control still remains unknown. we know that more manpower is on the way, possibly 2 to 500 firefighters will be moving into south new mexico to try to help put owes these flames. right now, we are seeing images of the area, like riodoso, the area between the two fires, the salt fork fire, that wreaked havoc on this neighborhood. you ski a line of cars. we were told by new mexico state police is one of the fire victims was inside one of his vehicles, possibly trying to escape. a second person was found outside of a hotel. his family told a local station that he was waiting for a ride, he was packed up and ready to flee. you've got thousands of other people who have been displaced from their homes, many, i'm sure, wanting answers as to what's the state of their home. at this point, they cannot return until firefighters get a handle on this as you see the heavy smoke and the temperatures did not aid in the fire, it just helped it to grow. right now, firefighters are doing the best that they can, and the governor is saying that this is enormous and is likely one of the most devastating two wildfires to converge on that state in a really long time. katy. >> dana, thank you very much. let's go to nbc meteorologist bill karins tracking the heat across the country. bill, it is really hot here in new york city, a lot hotter than it should be. i'm looking up toward maine, toward upstate new york where the temperatures are 10, 20 degrees higher than they normally are. >> northern new england has been the story. it is at this hour, too. that's where it's dangerous. it is hot in ohio valley to say, new york city. it's not any hotter than what we normally would get each summer. what's happening in northern maine, new hampshire and southern maine is incredible. this isn't a misprint. this is rochester, new hampshire, the reading at the airport. it's taken in the shade. this is the heat index. the temperature combined with the humidity. this is how it would feel to you. 108. and logan airport is not far behind. if you have been in the boston, logan airport, that's near the water. it's a really strong west wind keeping you that cool. notice, it is almost 20 degrees warmer in new hampshire than it feels in d.c., philly, and new york. that's what's been unusual about this. the relief is on its way, though, northern michigan, finally relief coming. after these thunderstorms this afternoon, tonight, and tomorrow will be noticeably cooler. here's the forecast tomorrow. this is where we're going to start to see the humidity building. d.c. to 95. new york to 93. as we come towards the upcoming weekend, it stays blistering hot. washington, d.c., saturday, 99. should have a record high on sunday, hitting 100, and with the humidity, it will probably feel like 105 to 106. this is not what a lot of people want to see. this just came out today. the forecast prediction for the month of july. if it was cooler than average, you'd see blue on this map, and there is no blue from coast to coast. it looks to be a very hot july, almost the entire eastern sea board, and also in the southwest, where we're already dealing with fires into the rockies. this could be a summer to forget. but remember at the same time because of how hot it's going to be. katy, we're going to start talking more about drought. a lot of people in the mid atlantic, things are getting very dry in a hurry. >> bill karins, thank you, a louisiana law mandating that the ten commandments will be displayed in public classrooms is taking a lot of heat, but will it survive legal challenges? boring. think about it. boring is the unsung catalyst for bold. what straps bold to a rocket and hurtles it into space? boring does. boring makes vacations happen, early retirements possible, and startups start up. because it's smart, dependable, and steady. all words you want from your bank. for nearly 160 years, pnc bank has been brilliantly boring so you can be happily fulfilled... which is pretty un-boring if you think about it. it is now the law in louisiana to display the ten commandments in every single public school classroom from kindergarten to college. republican governor jeff landry who signed the bill into law wednesday said he can't wait to get sued over it. if you want to respect the rule of law, you've got to start from the original law giver, which was moses. joining me now, former federal prosecutor and msnbc legal analyst, paul butler. there was a case back in 1980 with the same thing at issue and the supreme court said no way, no how. it is ununconstitutional to have the ten commandments in public classrooms. why would this case -- why would this state, louisiana, do this again, knowing that the supreme court already ruled that that was not constitutional 30 years ago. >> because, katy, this is a test case, that's what the governor of louisiana meant when he said he can't wait to be sued. he's hoping that the current supreme court will reverse years of precedent about the importance of separation between church and state. based on that precedent, this louisiana law seems nearly unconstitutional in that 1980 case, it was called stone versus graham. the court ruled that requiring the display of the ten commandments violates the first amendment's establishment clause that says that the government can't support one religion over another religion or even require that people be religious as opposed to not being religious. >> 40 years ago, excuse me, i'm getting my math wrong, so they are trying this again. they believe this court is going to be friendlier to them. is this court going to be friendlier to them is this. >> it very well may be under chief justice roberts, this court has greatly expanded religious rights. in 2022, the court ruled in favor of a football coach's right to pray on the field. that was a 6-3 decision with the court's liberals dissenting. the court has also said that a catholic social services agency can turn away gay and lesbian couples who want to take in foster children. the court has allowed religious schools to give government money, and said employers who have religious objections to birth control can deny insurance coverage for contraception to women, so, again, this is court is eroding the distinction between church and state. and louisiana's governor is hoping to capitalize on that with this new law. >> i get that. this one seems to go a step further even than those other cases. this is putting up a religious document. they're arguing that their secular value to it, u.s. law is based off of it. that's the same argument that was made back in 1980 in the other state that was trying to do this, and the same exact argument that was struck down. i know the lemon rule has been basically overturned. but having this displayed prominently on every single public classroom, wouldn't that -- if you were trying to not have a -- you know, a strong connection or a unconstitutional connection between church and state, wouldn't you also have to display the commandments for other religions and their basis of law, as prominently in public schools alongside it. >> such an important point, katy. in most of the other cases, the court is protecting people who want to exercise their religion. this louisiana case is different. the state government is requiring that public school students must be exposed to the ten commandments in every classroom. no state has gone that far. if this case makes it to the supreme court, the big question is whether the court will respect precedent and say that the louisiana law's unconstitutional or whether it will reverse years of settled law like it's done in cases involving abortion, affirmative action, voting rights, this is an ultra conservative court that advances its right wing jurisprudence and sometimes doesn't seem to care about the impact of its ruling on real people. >> is the fifth circuit likely to uphold this? >> again, because this case is different from the precedent, it's quite difficult to predict. again, and the supreme court, now these cases take a conservative versus liberal vote. the fifth circuit is one of the more conservative courts. it might well uphold the louisiana law, which would send the case to the supreme court. >> paul butler, thank you very much. and before the summer break, pro palestinian demonstrators paralyzed dozens of universities nationwide, protesting israel and the war in gaza. most prominently in new york, where some of the students and outside protesters broke into and occupied several academic buildings. today, they are in court. met there by a new set of protesters. nbc's antonia hylton is there for us. what were they in court for, and what was happening outside of court? >> reporter: hey, katy, so court is going to get going, actually right at this moment, 2:15. that is when the students, the outside activists, in some cases, they were even columbia employees and lab researchers who were arrested, that sort of infamous night when the nypd entered hamilton hall and ended the occupation there. those are the people who are appearing in court to respond to all of the charges connected to what authorities have called trespassing that night. we spent time with protesters as they gathered in nearby columbus park. they were meeting with legal aid observers and lawyers. they were talking to each other. gathering supplies and water bottles. it's incredibly hot out here right now, and they're planning to protest for the next several hours. at the time, it was a group of dozens of students and supporters. they're here to show solidarity to friends and themselves. they were getting ready to walk into the courtroom. take a listen to a conversation we had with one person who was arrested that night. >> we have our court date today for the liberation. >> were you arrested? >> it's a little bit different than what monica just outlined. donald trump and his campaign team have said he's not doing formal debate prep sessions, like he did in 2020, when he debated with chris christie, when they were still allies. they are not trying to go through mock sessions the campaign is suggesting and instead, they say donald trump is doing exactly what donald trump does normally. tonight he's got a fundraiser with jd vance in cleveland. that's how he's going about this. donald trump, at the same time, has gone back to the same track on the album that he played after the state of the union address and after the first 2020 debate, and that's the suggestion that joe biden is going to be high on drugs. he said this after the state of the union address this year. he said that joe biden was as high as a kite. he said it after the first presidential debate in 2020 that he suggested that he had an injection of some type. they are baseless. there's no suggestion that the current president did anything like that, and yet, we have already heard from donald trump, suggesting there should be a drug test, and essentially preempting everybody's expectations before next week's debate that the joe biden you see on stage is not joe biden -- >> let's play the sound. >> he's going to be so pumped up, he's going to be pumped up. you know all that stuff that was missing about a month ago from the white house. somebody didn't pick up hundreds of thousands of dollars worth of cocaine. i wonder who that could have been. i don't know. actually, i think it was joe. >> i'll just say, katy, folks repeat that. his supporters repeat that and it gets into the communities around the country. >> there's always a debate about whether we should play the completely absurd things that he says, the unfounded allegations, and the old rules would dictate, no, don't give it oxygen. but it's not just msnbc and cnn, abc, cbs and nbc that are out there now. it's everybody can go to social media and they can see things played over and over again. it is already there, and the effort is then to, okay, here's what he said, and then to give context and to fact check it. but, again, it can be a fool's errand when people go wherever they want to go to get the information they want to hear. >> it's so important, though, to hear what his argument is, and what he's going to be putting out there, and how that's been percolating within right wing media, and within the republican electorate. it's important to know what those arguments are if you're going to look at this election and have any sense of what the battle is really going to be about. and i do think that donald trump is probably in better technical fighting shape, going into this debate. just because he's willing to sit down for two-hour long rambling interviews, and he obviously isn't constrained the way joe biden is by truth and by facts. >> he has made very little sense since he started running for office. i mean, if you would just write down verbatim the things that he would say at a campaign and try to read them out loud, they didn't make any sense. when donald trump has a rambling interview, it doesn't sound different. it sound like he's always sounded. >> and it doesn't matter. it doesn't matter. but it will matter for joe biden because he is operating from a more traditional higher standard by presidential norms, so to speak, and i do think it is -- it has been to biden's detriment that he hasn't done a lot of tough interviews since the start of his presidency. really press conferences also. >> what is the bar for the debate for president biden? >> i think joe biden has to seem alert, on top of it, and completely sharp, and if there's any misstep, it could torpedo his campaign. that's what voters are looking for. >> is there any talk that if there is a complete misstep as elise just warned against, that there would be a reconsideration? >> with any kind of a live debate not on teleprompter, you have a risk of the unknown and uncertainty is certainly there. they're also pointing to things like the president constantly doing events and speaking off the cuff at fundraisers and all of that, that he will be so prepared for this because he is, in effect, taking the time to do it, but also because they're saying this is a president who's talking about his record which is something literally he has been doing day in and day out for the last three-plus years. now they will always say there can be these moments that certainly are the unexpected ones, that could be the ones that everybody is talking about the next day, and i think what they're trying to do in terms of framing some of that is saying, look, we know that the president is 81 years old. they have leaned into his age. they have leaned into that. the president has joked about it. they're trying to make that a nonissue and saying the person standing with him with president trump is also an older person, an individual, who also similarly in recent speeches and events has certainly had moments where it has been raised that there have been questions about what he was talking about and where he was going and that there have been plenty of examples for that as well. they want to point to that. but going into this, they know that the unknown certainly could bring that risk, but it wouldn't necessarily be a reconsideration for running or pursuing this campaign. >> so donald trump has, you know, a moment -- i'm sorry, monica, where he talks about sharks. just goes on a ramble, makes no sense. would there be a reconsideration within the donald trump campaign of whether he's the best candidate? >> it's a good question. probably wouldn't be framed that way. i think that's where donald trump is already expectation setting. not even for himself, but by highlighting the idea that joe biden is on drugs, right, you know, the biden camp would argue every single time that the american public has had the opportunity to hear joe biden articulate over a long period of time, a message, whether it be in a debate or in one of his three state of the union addresses, he's effectively done that. that's so often not what folks are seeing. >> so low on the state of the union. >> that's what people are seeing on instagram and x and tiktok. they're seeing a different version of joe biden. >> they're setting the bar so low, and trying to say that he's incompetent. by setting the bar so low, the way he's seeing on social media, does that make it easier for biden to clear that hurdle? >> maybe it will be like state of the union where expectations were low for joe biden, and then by performing decently, he manages to exceed expectations and got a slew of good press coverage out of it. certainly that's one possibility, but the thing with donald trump as you two both know, following him around as long as you have, is that he really can scramble and upset anything, and he has pulled so many antics at these various debates that it really is going to be all about what happens. . >> i struggle with him generally, you never know what hurts him, what helps him. it was difficult to cover him in 2016. it was difficult to figure it out in 2020, although the covid pandemic certainly didn't help him in any way, i think it's just did i feel to assess where the campaign is right now and what american public is feeling. i mean, we have polling, but i think it's hard to tell where the public's going to go on this. but we will all be watching the debate because it will be interesting. monica alba, vaughn hillyard, and elise jordan, thank you very much. michigan isn't just a presidential battle ground, it's a cincinnati battleground as elissa slotkin is running against republican mike rogers for an open senate seat. she sat down with nbc's shaquille brewster, and he is in grand rapids, and she told him, what, shaq, what did she tell you? >> reporter: well, it's clear that she believes that abortion is still an animating issue and a motivating issue for democrats and for voters in this election. you know, it's interesting. it was the first time that we saw the leaders of these prominent organizations on stage backing a 2024 candidate, and they did it here in grand rapids, which it's in kent county. it's a county that we have been following closely because it's a traditionally republican county that joe biden flipped in 2020, and it's a sign that democrats are leaning into this messaging around reproductive rights because they believe it still can have some success for them in upcoming elections. katy, you know the dynamicings here around this conversation have shifted. when you look at how republicans have tried to moderate their positions. donald trump says this is ago issue he wants to be left to the states. michigan is a state that enshrined abortion rights in its constitution during the midterm elections and her likely opponent says he wouldn't vote for a 15-week abortion ban. i asked, what do you say to republicans who want to take them at their word? >> they are not to be believed. look at their voting records, look at what they have done. not to say now because it's politically unpopular. i just -- these guys have shown no backbone against the far right extremists who have been pushing this issue for 50 years. if someone is going to tell me that donald trump, the guy who brags, glorifies how he was the president who overturned roe is somehow going to be the guy who protects women. again, that is on you if you believe him. >> reporter: that encapsulates the message you heard on stage from these leaders where they were celebrating what michigan that has done in terms of reproductive rights, but they were also warning folks that that progress is fragile, especially if things change at a national level, and i have to add that, when you look at polling, you see the economy, immigration, usually come up with voters as their top issues. but these leaders believe that it's abortion that is the most animating for them, and for many voters, it's something that disqualifies many republican candidates as they make their considerations, katy. >> shaquille brewster, thank you very much. breaking news, former president trump's legal team has filed a motion asking judge arthur engoron to recuse himself from trump's civil fraud case. nbc's tom winter is following this for us. what are their grounds? >> they're specifically citing a series of reports done by our colleagues at nbc new york, melissa rousseau and jonathan dienst. this stems from an interview with adam bailey who's not a party to the case. he's an attorney in new york. he once had his license suspended. basically what happened over the course of two interviews, bailey said that he reached out to the judge in this case, judge engoron, asking him or excuse me, suggesting to him potentially how this case should proceed and i want to read the quote so we can get it right. i wanted him to know what i think and why. i wanted him to get a right. in a subsequent interview, bailey said he never mentioned the word donald trump but when asked if it had been clear which case they were discussing, bailey responded obviously we weren't talking about the mets. so there's a potential issue here that exists when a nonparty to the case, it's not trump's attorneys, it's not the attorney general, when a nonparty reaches out to the judge, the judge should immediately, traditionally, according to the legal experts we talked to, stop that discussion. it might be prudent for the judge to notify the parties, hey, i was walking down the hall and having lunch, and all of a sudden tom winter this reporter approaches me and said x, yz about the case. that's an unlikely example, but to give folks a sense of what could have happened here. that's an argument that trump's attorneys are make. effectively the judge should have told us this attorney reached out to him with specific information. and it's not a random attorney. someone cited by "the new york times," speaking about their professional opinion because he has a lot of experience in real estate law, and as we know, the new york ag's case against donald trump really centered around his properties in real estate. so that's where the focus of this was. that's where the discussion may have taken place. we should note that at the time, our colleagues reached out to a court spokesperson who did not deny that a conversation had taken place between the judge and lawyer, but said that the interaction was infant. i want to read that statement no ex parte occurred between justice engoron or any other person. the decision justice engoron issued was his alone, deeply considered and wholly uninfluenced by this individual, according to al baker, a spokesperson for new york's office of court administration. so to recap it all. we've got an attorney with experience in real estate law, in an interview, suggests that he had had some sort of communication with the judge. it's that communication and the judge's lack so far, according to trump's attorneys of notifying them that any sort of discussion took place where they say, look, he's going to recuse himself. whether that ultimately impacts this nearly half billion dollar fine leveed against trump, katy, big question mark. i think that's way down the road. it's still an if, not a when. >> he's appealing it. there's also that course. tom winter, thank you very much. coming up, one of the biggest school districts in the country bans students from using cell phones and social media during the school day. how will it be enforced? be displayed prominently in all public classrooms. and seven days left. we are one week away from the first presidential debate of 2024 amid brand new polling that shows president biden is gaining. let's begin, though, with that weather. in texas, heavy rain and storm surge from tropical storm alberto has caused serious flooding, as you can see right here with coastal areas underwater from 5 to 10 inches of rain, along with that storm surge. new mexico is also dealing with what the national weather service says is extremely dangerous flooding, but look at this. the wildfires are what's really causing problems in new mexico. the state is reeling. hundreds of structures are gone. and at least two people are dead. locals say they had never seen anything like this before. >> it's been nonstop planes, nonstop sirens and almost felt like being in the war zone with all the smoke surrounding the area here in the middle. >> back east, temperatures are reaching 100 degrees in places that normally feel highs in the 80s with roughly 64 million people under excessive heat warnings. and advisories. let's start, though, in texas. joining me now from rockport, nbc news foreign correspondent guad venegas. a lot of flooding there. tell me what you're seeing. >> reporter: flooding and wind, you can see the wind here. there has been tornado warnings in the area, earlier today we also had a wind advisory with the wind gusts getting up to 40 miles per hour. so, yes, we had the storm come through with a lot of that heavy rain. we had the storm surge and the coastal areas and the flooding in parts like these in rockport. now, this is an area that's inland. we still have the island barrier out towards the sea here, and it's still flooded. also, there was an area just south of us where there was a tornado warning yesterday. we went by, met a couple. bob and bonnie who live in a home that was affected by the wind. this is what they had to say about what happened after that tornado warning went into effect. >> it happened so fast that until you come out here and look at it, it's like -- >> i heard whoop whoop whoop, it started picking the building up. >> reporter: wow. >> that's all i heard. >> and i didn't hear none of that stuff. it had been blowing and stuff all day. >> reporter: what did you think when you came outside and saw all the damage. >> we need to fix it up. >> a lot of work to be done. >> reporter: now, that was damage for the wind, just nearby there are communities that are still flooded in the beach areas. south of us in corpus christi, they had a lot of flooding in maria. fortunately, a lot of the preparations did work. authorities for the counties and the cities here did everything they could to prepare. they asked people to stay off the roads. so it looks like the worst of the weather has made its way through. we have had some flash flood warnings today, and again, wind advisories in some communities behind me are still flooded in many of these areas. it looks like most of the heavy rain did make its way through, katy. guad, thank you very much. to new mexico and deadly wildfires. there are just burned cars left, no structures even as wildfires completely tore through towns. let's bring in nbc's dana griffin who's covering all of this out there for us. dana, what can you tell us about new mexico? >> reporter: katy, at this hour, that fire that has been burning since monday, these two fires are 0% contained. that's critical. for a fire that's been burning so long, destroyed 23,000 acres, another 1,400 buildings and homes and has killed two people so far, this is just the beginning of the effort to try to get this fire under control. there was a fierce storm that rolled into new mexico yesterday, which dumped some 2 to 4 inches of rain. that created flash flooding in some areas. because of the burn scars that have been created because of these fires. so it kind of impacted the fire fighting effort. some firefighters had to move out of the area during that storm. the governor has declared a regional state of emergency, and how long it takes these firefighters to get this fire under control still remains unknown. we know that more manpower is on the way, possibly 2 to 500 firefighters will be moving into south new mexico to try to help put owes these flames. right now, we are seeing images of the area, like riodoso, the area between the two fires, the salt fork fire, that wreaked havoc on this neighborhood. you ski a line of cars. we were told by new mexico state police is one of the fire victims was inside one of his vehicles, possibly trying to escape. a second person was found outside of a hotel. his family told a local station that he was waiting for a ride, he was packed up and ready to flee. you've got thousands of other people who have been displaced from their homes, many, i'm sure, wanting answers as to what's the state of their home. at this point, they cannot return until firefighters get a handle on this as you see the heavy smoke and the temperatures did not aid in the fire, it just helped it to grow. right now, firefighters are doing the best that they can, and the governor is saying that this is enormous and is likely one of the most devastating two wildfires to converge on that state in a really long time. katy. >> dana, thank you very much. let's go to nbc meteorologist bill karins tracking the heat across the country. bill, it is really hot here in new york city, a lot hotter than it should be. i'm looking up toward maine, toward upstate new york where the temperatures are 10, 20 degrees higher than they normally are. >> northern new england has been the story. it is at this hour, too. that's where it's dangerous. it is hot in ohio valley to say, new york city. it's not any hotter than what we normally would get each summer. what's happening in northern maine, new hampshire and southern maine is incredible. this isn't a misprint. this is rochester, new hampshire, the reading at the airport. it's taken in the shade. this is the heat index. the temperature combined with the humidity. this is how it would feel to you. 108. and logan airport is not far behind. if you have been in the boston, logan airport, that's near the water. it's a really strong west wind keeping you that cool. notice, it is almost 20 degrees warmer in new hampshire than it feels in d.c., philly, and new york. that's what's been unusual about this. the relief is on its way, though, northern michigan, finally relief coming. after these thunderstorms this afternoon, tonight, and tomorrow will be noticeably cooler. here's the forecast tomorrow. this is where we're going to start to see the humidity building. d.c. to 95. new york to 93. as we come towards the upcoming weekend, it stays blistering hot. washington, d.c., saturday, 99. should have a record high on sunday, hitting 100, and with the humidity, it will probably feel like 105 to 106. this is not what a lot of people want to see. this just came out today. the forecast prediction for the month of july. if it was cooler than average, you'd see blue on this map, and there is no blue from coast to coast. it looks to be a very hot july, almost the entire eastern sea board, and also in the southwest, where we're already dealing with fires into the rockies. this could be a summer to forget. but remember at the same time because of how hot it's going to be. katy, we're going to start talking more about drought. a lot of people in the mid atlantic, things are getting very dry in a hurry. >> bill karins, thank you, a louisiana law mandating that the ten commandments will be displayed in public classrooms is taking a lot of heat, but will it survive legal challenges? boring. think about it. boring is the unsung catalyst for bold. what straps bold to a rocket and hurtles it into space? boring does. boring makes vacations happen, early retirements possible, and startups start up. because it's smart, dependable, and steady. all words you want from your bank. for nearly 160 years, pnc bank has been brilliantly boring so you can be happily fulfilled... which is pretty un-boring if you think about it. it is now the law in louisiana to display the ten commandments in every single public school classroom from kindergarten to college. republican governor jeff landry who signed the bill into law wednesday said he can't wait to get sued over it. if you want to respect the rule of law, you've got to start from the original law giver, which was moses. joining me now, former federal prosecutor and msnbc legal analyst, paul butler. there was a case back in 1980 with the same thing at issue and the supreme court said no way, no how. it is ununconstitutional to have the ten commandments in public classrooms. why would this case -- why would this state, louisiana, do this again, knowing that the supreme court already ruled that that was not constitutional 30 years ago. >> because, katy, this is a test case, that's what the governor of louisiana meant when he said he can't wait to be sued. he's hoping that the current supreme court will reverse years of precedent about the importance of separation between church and state. based on that precedent, this louisiana law seems nearly unconstitutional in that 1980 case, it was called stone versus graham. the court ruled that requiring the display of the ten commandments violates the first amendment's establishment clause that says that the government can't support one religion over another religion or even require that people be religious as opposed to not being religious. >> 40 years ago, excuse me, i'm getting my math wrong, so they are trying this again. they believe this court is going to be friendlier to them. is this court going to be friendlier to them is this. >> it very well may be under chief justice roberts, this court has greatly expanded religious rights. in 2022, the court ruled in favor of a football coach's right to pray on the field. that was a 6-3 decision with the court's liberals dissenting. the court has also said that a catholic social services agency can turn away gay and lesbian couples who want to take in foster children. the court has allowed religious schools to give government money, and said employers who have religious objections to birth control can deny insurance coverage for contraception to women, so, again, this is court is eroding the distinction between church and state. and louisiana's governor is hoping to capitalize on that with this new law. >> i get that. this one seems to go a step further even than those other cases. this is putting up a religious document. they're arguing that their secular value to it, u.s. law is based off of it. that's the same argument that was made back in 1980 in the other state that was trying to do this, and the same exact argument that was struck down. i know the lemon rule has been basically overturned. but having this displayed prominently on every single public classroom, wouldn't that -- if you were trying to not have a -- you know, a strong connection or a unconstitutional connection between church and state, wouldn't you also have to display the commandments for other religions and their basis of law, as prominently in public schools alongside it. >> such an important point, katy. in most of the other cases, the court is protecting people who want to exercise their religion. this louisiana case is different. the state government is requiring that public school students must be exposed to the ten commandments in every classroom. no state has gone that far. if this case makes it to the supreme court, the big question is whether the court will respect precedent and say that the louisiana law's unconstitutional or whether it will reverse years of settled law like it's done in cases involving abortion, affirmative action, voting rights, this is an ultra conservative court that advances its right wing jurisprudence and sometimes doesn't seem to care about the impact of its ruling on real people. >> is the fifth circuit likely to uphold this? >> again, because this case is different from the precedent, it's quite difficult to predict. again, and the supreme court, now these cases take a conservative versus liberal vote. the fifth circuit is one of the more conservative courts. it might well uphold the louisiana law, which would send the case to the supreme court. >> paul butler, thank you very much. and before the summer break, pro palestinian demonstrators paralyzed dozens of universities nationwide, protesting israel and the war in gaza. most prominently in new york, where some of the students and outside protesters broke into and occupied several academic buildings. today, they are in court. met there by a new set of protesters. nbc's antonia hylton is there for us. what were they in court for, and what was happening outside of court? >> reporter: hey, katy, so court is going to get going, actually right at this moment, 2:15. that is when the students, the outside activists, in some cases, they were even columbia employees and lab researchers who were arrested, that sort of infamous night when the nypd entered hamilton hall and ended the occupation there. those are the people who are appearing in court to respond to all of the charges connected to what authorities have called trespassing that night. we spent time with protesters as they gathered in nearby columbus park. they were meeting with legal aid observers and lawyers. they were talking to each other. gathering supplies and water bottles. it's incredibly hot out here right now, and they're planning to protest for the next several hours. at the time, it was a group of dozens of students and supporters. they're here to show solidarity to friends and themselves. they were getting ready to walk into the courtroom. take a listen to a conversation we had with one person who was arrested that night. >> we have our court date today for the liberation. >> were you arrested? >> it's a little bit different than what monica just outlined. donald trump and his campaign team have said he's not doing formal debate prep sessions, like he did in 2020, when he debated with chris christie, when they were still allies. they are not trying to go through mock sessions the campaign is suggesting and instead, they say donald trump is doing exactly what donald trump does normally. tonight he's got a fundraiser with jd vance in cleveland. that's how he's going about this. donald trump, at the same time, has gone back to the same track on the album that he played after the state of the union address and after the first 2020 debate, and that's the suggestion that joe biden is going to be high on drugs. he said this after the state of the union address this year. he said that joe biden was as high as a kite. he said it after the first presidential debate in 2020 that he suggested that he had an injection of some type. they are baseless. there's no suggestion that the current president did anything like that, and yet, we have already heard from donald trump, suggesting there should be a drug test, and essentially preempting everybody's expectations before next week's debate that the joe biden you see on stage is not joe biden -- >> let's play the sound. >> he's going to be so pumped up, he's going to be pumped up. you know all that stuff that was missing about a month ago from the white house. somebody didn't pick up hundreds of thousands of dollars worth of cocaine. i wonder who that could have been. i don't know. actually, i think it was joe. >> i'll just say, katy, folks repeat that. his supporters repeat that and it gets into the communities around the country. >> there's always a debate about whether we should play the completely absurd things that he says, the unfounded allegations, and the old rules would dictate, no, don't give it oxygen. but it's not just msnbc and cnn, abc, cbs and nbc that are out there now. it's everybody can go to social media and they can see things played over and over again. it is already there, and the effort is then to, okay, here's what he said, and then to give context and to fact check it. but, again, it can be a fool's errand when people go wherever they want to go to get the information they want to hear. >> it's so important, though, to hear what his argument is, and what he's going to be putting out there, and how that's been percolating within right wing media, and within the republican electorate. it's important to know what those arguments are if you're going to look at this election and have any sense of what the battle is really going to be about. and i do think that donald trump is probably in better technical fighting shape, going into this debate. just because he's willing to sit down for two-hour long rambling interviews, and he obviously isn't constrained the way joe biden is by truth and by facts. >> he has made very little sense since he started running for office. i mean, if you would just write down verbatim the things that he would say at a campaign and try to read them out loud, they didn't make any sense. when donald trump has a rambling interview, it doesn't sound different. it sound like he's always sounded. >> and it doesn't matter. it doesn't matter. but it will matter for joe biden because he is operating from a more traditional higher standard by presidential norms, so to speak, and i do think it is -- it has been to biden's detriment that he hasn't done a lot of tough interviews since the start of his presidency. really press conferences also. >> what is the bar for the debate for president biden? >> i think joe biden has to seem alert, on top of it, and completely sharp, and if there's any misstep, it could torpedo his campaign. that's what voters are looking for. >> is there any talk that if there is a complete misstep as elise just warned against, that there would be a reconsideration? >> with any kind of a live debate not on teleprompter, you have a risk of the unknown and uncertainty is certainly there. they're also pointing to things like the president constantly doing events and speaking off the cuff at fundraisers and all of that, that he will be so prepared for this because he is, in effect, taking the time to do it, but also because they're saying this is a president who's talking about his record which is something literally he has been doing day in and day out for the last three-plus years. now they will always say there can be these moments that certainly are the unexpected ones, that could be the ones that everybody is talking about the next day, and i think what they're trying to do in terms of framing some of that is saying, look, we know that the president is 81 years old. they have leaned into his age. they have leaned into that. the president has joked about it. they're trying to make that a nonissue and saying the person standing with him with president trump is also an older person, an individual, who also similarly in recent speeches and events has certainly had moments where it has been raised that there have been questions about what he was talking about and where he was going and that there have been plenty of examples for that as well. they want to point to that. but going into this, they know that the unknown certainly could bring that risk, but it wouldn't necessarily be a reconsideration for running or pursuing this campaign. >> so donald trump has, you know, a moment -- i'm sorry, monica, where he talks about sharks. just goes on a ramble, makes no sense. would there be a reconsideration within the donald trump campaign of whether he's the best candidate? >> it's a good question. probably wouldn't be framed that way. i think that's where donald trump is already expectation setting. not even for himself, but by highlighting the idea that joe biden is on drugs, right, you know, the biden camp would argue every single time that the american public has had the opportunity to hear joe biden articulate over a long period of time, a message, whether it be in a debate or in one of his three state of the union addresses, he's effectively done that. that's so often not what folks are seeing. >> so low on the state of the union. >> that's what people are seeing on instagram and x and tiktok. they're seeing a different version of joe biden. >> they're setting the bar so low, and trying to say that he's incompetent. by setting the bar so low, the way he's seeing on social media, does that make it easier for biden to clear that hurdle? >> maybe it will be like state of the union where expectations were low for joe biden, and then by performing decently, he manages to exceed expectations and got a slew of good press coverage out of it. certainly that's one possibility, but the thing with donald trump as you two both know, following him around as long as you have, is that he really can scramble and upset anything, and he has pulled so many antics at these various debates that it really is going to be all about what happens. . >> i struggle with him generally, you never know what hurts him, what helps him. it was difficult to cover him in 2016. it was difficult to figure it out in 2020, although the covid pandemic certainly didn't help him in any way, i think it's just did i feel to assess where the campaign is right now and what american public is feeling. i mean, we have polling, but i think it's hard to tell where the public's going to go on this. but we will all be watching the debate because it will be interesting. monica alba, vaughn hillyard, and elise jordan, thank you very much. michigan isn't just a presidential battle ground, it's a cincinnati battleground as elissa slotkin is running against republican mike rogers for an open senate seat. she sat down with nbc's shaquille brewster, and he is in grand rapids, and she told him, what, shaq, what did she tell you? >> reporter: well, it's clear that she believes that abortion is still an animating issue and a motivating issue for democrats and for voters in this election. you know, it's interesting. it was the first time that we saw the leaders of these prominent organizations on stage backing a 2024 candidate, and they did it here in grand rapids, which it's in kent county. it's a county that we have been following closely because it's a traditionally republican county that joe biden flipped in 2020, and it's a sign that democrats are leaning into this messaging around reproductive rights because they believe it still can have some success for them in upcoming elections. katy, you know the dynamicings here around this conversation have shifted. when you look at how republicans have tried to moderate their positions. donald trump says this is ago issue he wants to be left to the states. michigan is a state that enshrined abortion rights in its constitution during the midterm elections and her likely opponent says he wouldn't vote for a 15-week abortion ban. i asked, what do you say to republicans who want to take them at their word? >> they are not to be believed. look at their voting records, look at what they have done. not to say now because it's politically unpopular. i just -- these guys have shown no backbone against the far right extremists who have been pushing this issue for 50 years. if someone is going to tell me that donald trump, the guy who brags, glorifies how he was the president who overturned roe is somehow going to be the guy who protects women. again, that is on you if you believe him. >> reporter: that encapsulates the message you heard on stage from these leaders where they were celebrating what michigan that has done in terms of reproductive rights, but they were also warning folks that that progress is fragile, especially if things change at a national level, and i have to add that, when you look at polling, you see the economy, immigration, usually come up with voters as their top issues. but these leaders believe that it's abortion that is the most animating for them, and for many voters, it's something that disqualifies many republican candidates as they make their considerations, katy. >> shaquille brewster, thank you very much. breaking news, former president trump's legal team has filed a motion asking judge arthur engoron to recuse himself from trump's civil fraud case. nbc's tom winter is following this for us. what are their grounds? >> they're specifically citing a series of reports done by our colleagues at nbc new york, melissa rousseau and jonathan dienst. this stems from an interview with adam bailey who's not a party to the case. he's an attorney in new york. he once had his license suspended. basically what happened over the course of two interviews, bailey said that he reached out to the judge in this case, judge engoron, asking him or excuse me, suggesting to him potentially how this case should proceed and i want to read the quote so we can get it right. i wanted him to know what i think and why. i wanted him to get a right. in a subsequent interview, bailey said he never mentioned the word donald trump but when asked if it had been clear which case they were discussing, bailey responded obviously we weren't talking about the mets. so there's a potential issue here that exists when a nonparty to the case, it's not trump's attorneys, it's not the attorney general, when a nonparty reaches out to the judge, the judge should immediately, traditionally, according to the legal experts we talked to, stop that discussion. it might be prudent for the judge to notify the parties, hey, i was walking down the hall and having lunch, and all of a sudden tom winter this reporter approaches me and said x, yz about the case. that's an unlikely example, but to give folks a sense of what could have happened here. that's an argument that trump's attorneys are make. effectively the judge should have told us this attorney reached out to him with specific information. and it's not a random attorney. someone cited by "the new york times," speaking about their professional opinion because he has a lot of experience in real estate law, and as we know, the new york ag's case against donald trump really centered around his properties in real estate. so that's where the focus of this was. that's where the discussion may have taken place. we should note that at the time, our colleagues reached out to a court spokesperson who did not deny that a conversation had taken place between the judge and lawyer, but said that the interaction was infant. i want to read that statement no ex parte occurred between justice engoron or any other person. the decision justice engoron issued was his alone, deeply considered and wholly uninfluenced by this individual, according to al baker, a spokesperson for new york's office of court administration. so to recap it all. we've got an attorney with experience in real estate law, in an interview, suggests that he had had some sort of communication with the judge. it's that communication and the judge's lack so far, according to trump's attorneys of notifying them that any sort of discussion took place where they say, look, he's going to recuse himself. whether that ultimately impacts this nearly half billion dollar fine leveed against trump, katy, big question mark. i think that's way down the road. it's still an if, not a when. >> he's appealing it. there's also that course. tom winter, thank you very much. coming up, one of the biggest school districts in the country bans students from using cell phones and social media during the school day. how will it be enforced?
