and the justice department will not be intimidated. we will continue to do our jobs free from political influence, and we will not back down from defending democracy. >> attorney general merrick garland facing a republican party hell bent on doing everything it can to push conspiracy theories and attack the rule of law in the wake of donald trump's felony conviction in new york. plus, president biden making bold and controversial moves today on immigration and on his rhetoric towards israel. but we begin tonight with the rule of law. in our democrat, system it is the principle under which all persons, institutions, and entities are supposed to be accountable to laws that are publicly promulgated, equally enforced and independently adjudicated. in a perfect world, the idea is to protect the rights of all people in our society. it hasn't always worked out perfectly, to say the least, in this country's long and difficult history, but that is the idea. donald trump and his maga republican party like to claim they believe in the rule of law. that they are the party of law and order. that is unless they are the ones having to answer to it. at that point, the law and order stuff goes out the window and magas start bargaling about the weaponization of the justice system. corruption throughout the deep state. that's all we have heard from them following a new york jury's verdict finding trump guilty on all 34 counts for falsifying business records in his attempts to influence the 2016 presidential election. and today, we saw the latest round of this theatrical performance of republicans descending into the upside down. merrick garland appeared before the house oversight committee and had to play whack-a-mole to the multitude of conspiracy theories spewed by the so-called party of law and order in their pursuit to protect, not the rights of all americans, but rather to distract from the unlawful transgressions of just one. >> the first time in american history, we do have a presidential administration that's working to put its opponent in jail. that's a fact. >> prosecutors aren't supposed to tamper with evidence, and it looks like that's what he did. he changed the sequence of the documents he seized from mar-a-lago. >> i'm sorry, that's a false characterization. i did not hear the words tamper in the statement mr. smith filed. he did not use those words. >> you come in here and lodge this attack it's a conspiracy theory that there's coordinated lawfare against trump. we say fine, give us the documents. give us the correspondence. if it's a conspiracy theory, that will beeft. >> republicans tried to make a connection between the doj and trump's criminal conviction in new york which was easily debunked by the adults in the room. >> did you select the judge in that case? >> no. >> of course not, the judge was randomly selected. did you select the jury in that case? >> no. >> the jury was selected by donald trump and his attorneys. >> did you reach a verdict in that case? >> no. >> did you instruct the jury in that case? >> no. >> did you tell the prosecutor what charges to bring in that case? >> no. >> i have to say i'm pleased and a bit surprised to see that the flag in this committee is still flying right side up because they want to turn it upside down even as they want to turn our justice system upside down. >> oh. garland not only staunchly defended the mission of the doj but warned about the dangerous consequences of what trump and the republicans have been doing. >> it comes as individual career agents and prosecutors have been singled out just for doing their jobs. it comes as baseless and extremely dangerous falsehoods are being spread about the fbi's law enforcement operations. and it comes at a time when we are seeing heinous threats of violence being directed at the justice department's career civil servants. these repeated attacks on the justice department are unprecedented and they are unfounded. >> this hearing also comes as some of those same house republicans are threatening to hold a contempt vote over the doj's refusal to share audiotapes of president biden's interview with special counsel robert hur who investigated his handling of classified documents. a healthy reminder that trump still faces charges of stealing classified documents and secreting him at his house with zero consequences thanks to a florida judge who behaved more like a fan. just the way republicans like it, when a republican faces the justice system. garland responded to republican demands for the hur tapes, which to be clear, they want so they can try to embarrass the sitting president by playing them on fox or on their goofy podcasts. garland stated multiple times today that releasing those tapes serves no legitimate purpose and could harm the integrity of future investigations, oh, and it's also worth noting at the same time, these republicans were blathering on about the so-called weaponization of the doj by president biden, the president's own son was sitting in a federal courtroom for opening statements in his federal trial. whoops. i guess biden's weaponized doj dropped the ball on that one. i'm joined now by pennsylvania democratic congressman madeleine dean who was in that hearing with attorney general merrick garland today. congresswoman, thank you for being here. >> thank you for having me. >> it is sort of basic civics 101 and one would thing a congressman would know it, that a state trial and a state case has nothing to do with the department of justice. what was the point of that hearing today? >> to mislead the american public. that's what the republicans literally wanted to do. they want to continue whether it's on newscasts or in the newspaper or in a hearing with the attorney general of the united states, to mislead the american public. it is extraordinarily dangerous. and i don't think the american public is naive that there's a federal system and there's a state system. but we each, many of us on the democratic side, had to just reiterate, please, mr. attorney general, what was your connection to the alvin bragg d.a. case, the state case in new york? >> let's -- >> the answer is nothing. >> just in case there's somebody out there that wants to send this clip to their trumpy uncle, i'm going to go through these quickly. if somebody is charged with a crime in the state of pennsylvania, in your state, does the department of justice determine who the judge is? >> no. >> if the person is charged in the state of pennsylvania or the state of new york, does the department of justice choose what the charges are? ? no. >> does the department of justice prosecute the case? >> no, they don't. >> can the department of justice stop that case from happening? >> no. >> can they intervene in any way? >> did garland have anything to do with donald trump being charged in new york? >> no. >> did he hire alvin bragg? >> bragg was elected. >> boom. was merrick garland elected? >> no, he was appointed. >> the person who is accountable to the people of new york in charges donald trump, that would be alvin bragg, not merrick garland. >> correct. >> this is because i know my audience is super mart and they understand there's a federal system and a state system, but send this to your trumpy uncle because they keep on bringing this up on radio shows. >> and to my republican colleagues. on the committee. >> let's play one more piece. this is, to me, the most galling part of all, because this strikes me as trying to make another january 6th. here is a.g. garland responding to these conspiracy theories about assassination of donald trump. >> most recently, there was an allegation that the fbi was authorized to, quote, kill the former president. what impact does this have on the career prosecutors and law enforcement agents at the department of justice? ? this is dangerous. it raises the threats of violence against prosecutors and career agents. the allegation is false. as the fbi has explained, the document that's being discussed is our standard use of force protocol, which is a limitation on the use of force, and which is routinely part of the package for search warrants. and was part of the package for the search of president biden's home as well. >> your colleagues know that, don't they the. >> sure they do. >> why would they do this? do they want to get fbi agents killed? >> in service of one man. one now felon, 34 counts. i'm so proud of the new york system, that the rule of law held, that we had by all reports from reporters in the courtroom, the judge, the lawyers on both sides prosecutor and defense, and 12 citizen strangers who did their job. they listened to the evidence. they applied the rule of law. and they came back with clarity, 34 felony convictions against a former president. why are my colleagues doing it? in service and protection of a single man. as the attorney general has said, and i have been blowing the whistle for six years on this committee, they are spewing misinformation and lies to deceive the american people. and to tear down our belief in our system of justice, our electoral system, you have seen it, the speaker of the house has been one of the architects of this, and this information is extraordinarily dangerous. something a.g. garland said. they have 115,000 civil servants in the department of justice. the spike of threats against them has gone through the roof. >> and these members of congress cowered in fear with all of you, everyone else, on january 6th, and they don't mind at all that police officers were hurt defending y'all. they have no problem with letting those people continue to be threatened, have michael fanone's mom be doxed. this doesn't bother them. there are right wing entities trying to find out who the jurors are and dox them. meanwhile, you have this piece of news, todd blanche, donald trump's attorney, to ask that the gag order be lifted against donald trump so he can go back to attacking the judge, the judge's daughter. what kind of threat would that put these people in? including the jurors at this point. >> we're all at risk of threats of violence.ress. it's true for election citizens just sayday. i'll sit there at the polls for ten hours. but no, not if i'm under threat of violence. this is extraordinarily dangerous. the a.g. has said it, and as i have said, it is -- it's so insidious that the very people who are decrying that americans don't have faith in our constitution and our capitol police and all of these things are the very ones who are sowing it. i was there on january 6th, got hauled out in a gas mask. held in a safe room for hours and hours. with journalists, with republicans, with democrats. and we went back onto that floor and many of these republicans including speaker johnson, voted not to certify the election. >> let's talk about speaker johnson and also jim jordan. jim jordan is the chairman, right, of the committee. >> yes, he is. >> jim jordan, let me play what your colleague, representative eric swalwell had to say about him. >> before anyone else on the other side saddles up and gets on their high legal horses i want to remind the committee that the chairman is 754 days into his own subpoena defiance. >> does jim jordan expect the people he subpoenas to respond to them? >> absolutely. >> and to show up? >> and holds people in contempt if they don't. >> how is it he has responded if at all, has he responded to colleague requests he comply with the subpoena? >> not that i'm aware of. rule of law. >> yeah, rule of law. >> answer your subpoena if you believe in the rule of law. >> let's talk about mike johnson. he now says that his plan is to attempt to defund the department of justice, to defund the atf, the bureau of alcohol, tobacco, and firearms, to begin defunding the fbi and everyone else they hold responsible for donald trump's crimes. here's what they had to say about the calls to defund the police for killing black people. >> guess what americans also get? guess what else they understand. they know it is pure insanity to defund the police. and the fact that my democrat colleagues won't speak out against this crazy policy is just that, frightening. >> we need to honor that and recognize and empower those law enforcement officers which is precisely the opposite of the radical dangerous proposals we're seeing right now to defund them. a government of, by, and for the people must be a nation of law and order. and public safety, of course, is the key to maintaining our republic. >> calls to defund the police at the local level were simply saying to take the budgets of police departments and rethink them and remove some of the money and put it toward other ways to deal with mental health crises. >> public safety. >> public safety. it wasn't about not having the police get paid. they're saying we actually want to defund these agencies. what would happen to the country if they did that? >> i was here for that nonsense set of arguments. you know how they weaponized that in the election cycles in 2020, 2022, scaring my constituents, saying do you want to defund the police? of course not, i want to make sure the police are properly resourced and make sure that mental health is addressed, drug addiction is addressed, all of those things. look at them now. they want to defund atf, at a time when gun violence is a problem in this country. at a time when the doj has made it drastic reduction in gun violence thanks to the safer communities act that democrats put forward and the president signed. they want to defund atf? it is the agency that supports our local police at a scene where guns have been used. they want to strip them of their resources so we have less ability to track down illegal guns. it's dangerous, what they're arguing is dangerous. and their deflection, i'm not a psychiatrist. i wish i had more training in this, but their deflection and projection is so scary, i thought after the conviction of the president, this is what i thought. i thought, think of the number of twists and turns where they could have done the right thing. where they could have separated themselves and said, that's enough. i stand for the rule of law. i honor these 12 citizens who sat for that trial for six weeks and listened carefully and came up with the verdict that they came up with. i honor our system of governance and justice. and yet, what did they do? they said it was a kangaroo court. they're demonizing those folks. the speaker himself has said he wants the supreme court to overturn it. and you notice he threw in the fact that he's friends with a few of them. >> i'm sure he is. >> think of the appropriateness of that kind of statement from the speaker of the house. whisper, whisper, please over turn this conviction. >> which would be unprecedented intervention in a state case of which the supreme court has literally zero jurisdiction, but watch alito try to find a way to do it. he's got an upside down flag hanging outside his house, and he'll post it up again in the form of intervening in a case he has no business in. congresswoman madeleine dean, thank you. and to the politics outweigh the humanitarian impact? "time" magazine today published alengthy interview with president biden where he explain his vision for a second term. over the course of the interview, biden spoke at length about his foreign policy agenda including his views of china, taiwan, ukraine, and israel. when asked about the situation in the middle east, he said that he's been calling for a cease-fire to get the hostages home. he told reporters that he wanted netanyahu not to make the same mistake america made in iraq and afghanistan but added this, they're making that mistake, i think. when asked if netanyahu was prolonging the war for his political benefit, he said, quote, i'm not going to comment on that. there is every reason for people to draw that conclusion. adding, whether he would change his position or not, it's hard to say, but it has not been helpful. "time" magazine also asked if he regretted lifting trump era immigration orders at the border and he said no. today, the president made some news regarding the border. flanked by border area politicians and other state officials, he issued an executive order that would shut off asylum requests and automatically deny entrance to migrants once the number of people encountered by u.s. border officials exceeded a new daily threshold. >> i'm moving past republican obstruction and using the executive authorities available to me as president to do what i can on my own to address the border. frankly, i would have preferred to address this issue through bipartisan legislation, because that's the only way to actually get the kind of system we have now that's broken fixed. for those who say the steps i have taken are too strict, i say to you that be patient, and good will and american people are wearing thin right now. doing nothing is not an option. we have to act. >> public polling shows a growing frustration with border crossings, even if those crossings have dropped by more than 50% since december. i'm joined by msnbc contributor paulo ramos and jennifer paul marry, former white house communications director for president obama, former communications for hillary for america, and the cohost of msnbc's how to win 2024 podcast. thank you both for being here. i want to start with you because there is this, the polling is very clear. and i have seen a lot of your reporting that backs it up that people are more than just frustrated on the border. people are warming to the idea of mass deportation which is alarming to me. 51% say they're for mass deportation. 68% of republicans and 46% of independents and even 42% of democrats. when axio asked what the greatest concerns were about immigration, people related to increased crime rates, drugs and violence, the additional cost to taxpayers and the risk of terrorism and national security. none of which are factually actually issues. what do you -- to what do you ascribe this increased hawkishness. is it just fox propaganda? >> it is, and the problem is the president seems to be listening to that. i think what we heard today is a decision that is based on exactly what you just read and not on actual policy solutions. the numbers say it clearly. for the first time since 2019, immigration is suddenly listed as a top problem among u.s. voters. we also know know that at least 50% of adults believe immigrants provide a danger, and among latinos this anti-immigrant rhetoric seems to be resonating, to the point that even in the bronx, a small but significant number of black and brown voters are saying build the wall. what we all have to confront, we have to confront this idea that this anti-immigrant rhetoric isn't just spreading in conservative circles. i think that what we saw today. the only thing i will say is that's one set of numbers. to me, the important set of numbers is that critical voting bloc that was part of the 2020 winning coalition that were those latino voters that listened to president biden's promises and voted for him. i'm thinking about the young latinos in arizona, in nevada, over 10 million u.s. citizens that are part of mixed status families, the dreamers that organized for president biden, perhaps it's a small number, but that's a critical part of that coalition. >> speaking of that, i'm glad you mentioned dreamers. jennifer, let's go back to june of 2012. because president obama, and i believe you were working for him at the time, also faced an immigration crisis that the right was literally dredging up these fears of, you know, border crossings, these fears of caravans. they did all of that at the time, and actually, president obama had initially also gone to the right. deporting people to the point where a lot of latinos were calling him deporter in chief. saying, obama, don't deport my mama. all that stuff. he responded in june with daca, an executive order just like president biden did, but an executive order in the other direction, which created the dreamers, which created not just daca, but dapa, which kept the grandmas here as well, the parents as well. what do you make of the fact that it's june again, but president biden seems to be kind of going in the opposite direction? >> that's not actually wants happening. what's happening is the problem has gotten a lot worse. i think what's happening is not just that the problem has gotten worse at the border but the reason part of the reason why i think we have seen such a change in public opinion is because migrants are in cities across the united states and it's no longer being experienced by americans as just a border problem. if you live in new jersey, or connecticut or new york, you are saying a lot of coverage about the impact that migrants are having on local governments, on the state governments. if you live near chicago, you're seeing the same thing. so i think that is part of what is happening. i think that's why, at least why the president felt he had to reluctantly take this action. he gave congress every opportunity to act. it is -- he knows he talked about how people have run out of patience. he's trying to ward off president trump from becoming pred. he said he wanted to do things in the second term that would be more positive and actual solution, but you can't do that when congress is standing in the way because donald trump said they should not pass a bill that would fix the problem. and i think they felt just not even in terms of politics but in terms of being a responsible president, he had to take some action, and while it might be reluctantly and this is what he needed to do. >> and the thing is, you know, this is a good point that jennifer makes. one of the things that red state governors like the governors of texas and florida have done, is they have sent the problem, if you want to call it a problem, of undocumented people and shipped them all over the country like the old segregationists used to put black people on buses and say, let's send them to your city. then you have twin pressures. people can't afford rent, they're seeing economic challenges in terms of affording things and they see migrants and say they're getting the money that should be coming to me. this has become really effective, so biden's response is to say, i'll be punitive. does that seem to address it? >> it doesn't. and that's another problem. and you're right, i think that's the interesting dynamic that's happening. one thing is being a new yorker and talk about the border being miles and miles away from the border. the other thing is suddenly all of these states becoming border states. here's the thing, the bottom line is that any humanitarian aid worker at the border, any catholic charity there, anyone working with migrants every day will tell you that this initiative does not equal border security. for one very simple reason. as this is happening, the cartels will simply profit more. i mean, all this does is drive migrants and asylum seekers to rely on the cartels to find other ways and other routes and more money to do what inevitably happens which is finding different ways into the united states. i mean, and that is sort of human nature. that's the story of migration. deterrence, walls, these punitive policies do not stop desperation. we know that. that's part of the story, and that's what we're going to see, more violence, more dangerous. >> jennifer, also, there's a different republican party now. a trump party, and now you're seeing people like marco rubio and lindsey graham who were on the gang of eight, it's almost kind of hard to fathom that these people at the time were talking about a legislative solution and now they're saying deport everyone, and i wonder if marco rubio is wondering about traveling through texas with his brown family if they start rounding anyone up who looks latino to them. >> this is what's happened in the last, since 2012, oh, my gosh, 12 years ago, when obama took the daca move. it was because even though there's bipartisan support, republicans were standing in the way of passing the dream act. and this was the action he could take at the time. and you have not had any progress on the republican side. other than people going to agree to a bipartisan bill that was an agreement, but they would not pass it, and it's just until trump is no longer a threat for the republicans, you know, the president is left with bad choices. >> yeah, and by the way, the person who broke up that deal last time, rush limbaugh, who donald trump gave a presidential medal of freedom to. look at that. thank you both. president obama in a rare display of dissent during the state of the union. >> last week, the supreme court reversed a century of law that i believe will open the floodgates for special interests. including foreign corporations. to spend without limit in our election. >> that was back when justice alito was more known as a conservative justice rather than a scandalous troll leading the country into a dystopian hellscape where women are property and the american flag flies upside down. it's also before the maga parasite infected the republican party, but the signs were there hiding in plain sight. samuel alito didn't like hearing president obama publicly criticize the high court's ruling removing corporate campaign spending limits. he didn't try to hide it. it was a striking moment in american politics. you got to see who alito was and is. it's also about a material change in our politics because obama was right. a narrow majority of the supreme court overturned a century of campaign finance law giving wealthy donors and corporations nearly unlimited ability to influence our elections. the federalist justices had opened up a pandora's box, opening the campaign spending floodgates. according to a university of chicago study, on the effects of citizens united, on corporate spending, the 2012 presidential election saw a 594% increase in independent expenditures versus the 2008 election. in dollar amounts, that meant $144 million in 2008 compared to $1 billion in 2012. $1 billion with a "b." it's an insane amount of money. with money and politics even more aligned, billionaires felt a sense of ownership, not just over politics but the presidency itself, and no one senses that almost organically than donald trump, the long time grifter and snake oil selling president who is promising to sell his second term for parts to wealthy donors. billionaires like miriam adelson, his top donor in 2020. one of the richest women in republican circlesering she plans to donate millions. what does she want inaccording to new york magazine, beyond unconditional support for the israel/hamas war, one can assume israel agenda from last term. top of the list, israel annexing the west bank and the u.s. recognizing its sovereignty there. trump is making sweeping promises to donors essentially offering them a heavy hand in policy. that's how desperate he is to win so he can stay out of prison. donors and advisers told "the washington post" trump has been meeting with moguls and executives for big money contributions. they report trump told a group if he was not put back into office, taxes would go up for them under president biden who vows to let trump era tax cuts on the wealthy and corporations expire at the end of 2025. and another meeting, trump asks oil industry executives to raise $1 billion for his campaign and said raising such a sum would be a deal given how much money they would save if he were re-elected president. wasn't this the guy in 2016 promised to drain the swamp? it wasn't true the last time and it certainly isn't now. here's the thing, these rich guys, the elite who george w. bush once called his base, they're getting rich off biden too. biden has a roaring stock market that is outperforming truck's, but they don't like biden because he's pushing back on the tax cuts that are due to expire. it's the citizens united nightmare come to fruition, billionaires buying politicians. it's the hawking of the presidency, but in an even more grotesque way. it's a fire sale, and rich people are doing what rich people do. we sat during the specials i want to bring those conversations to the public. this really is i think the clearest example of the wealthy attempting to buy the white house. what do you think? >> not just the wealthy, the wealthiest. and they can. remember, people understand, especially the richest of the rich, that donald trump is transactional. he keeps score of who stands with him, and right now, he's at the bottom. he's at a low point. when you're looking at where he is, whether you're talking about sheldon adelson's widow or nelson peltz or john paulson or bill ackman, they know that donald trump needs a positive headline. they know that they are the group of people, the quote/unquote, ruling class whose affirmation, whose support he's always been desperate for. standing with donald trump now, what does that give you? a free pass, a get out of jail free card when and if he's the next president. here's what's important for us to clarify. now, lots of them are saying things like it's immigration that matters to me most. it's inflation. it's israel. well, let's break that down. if it's immigration, president biden tried to pass bipartisan, bipartisan bill that mostly republicans put together, and it was donald trump who blocked it. joe biden said yesterday, he's planning to make a move to shut down the border. president trump -- former president trump isn't doing that. if it's inflation, which is a problem, donald trump has not offered one single policy solution that would curb inflation. and last thing, if it's israel, last i checked, globalists which trump campaign has talked about over and over again, charlottesville or what did they recently say in a campaign post, the united reich, none of those things are in support of the jewish community. so what is this really about? it's about extending those corporate tax cuts, insuring there isn't president biden's proposed billionaire tax, and making sure deregulation is headed their way. so my last point, miriam addleson, this is all about israel. make no mistake. how does the addleson make all that money? gaming, one of the most highly regulated industries in this country. if you ran one of the biggest gaming operations, wouldn't you love a direct call to the white house to make sure you have no regulations standing in your way? and wouldn't they love to pay for that free pass, and they can. >> they also own the dallas mavericks. they have money on the table. if you think about it, the point you're making, joe biden has been trying to do something about inflation. number one, over the last four years the justice department and these high rents people are complaining about, over the last four years rents have skyrocketed by over 30% nationwide. they're a variety of factors behind the increase including an overall housing shortage but the department of justice is now investigating another potential cause, a massive criminal conspiracy among large landlords. they're looking into a scheme to artificially increase rents. you have ticketmaster, the biden administration going after ticketmaster, and filed a lawsuit to break up ticketmaster's parent company, livenation entertainment accusing it of operating an illegal monopoly. i could go on. you also have a president biden personally going after grocery chains and walmart and others and saying you need to lower your prices because they're artificially high and some are doing it. if those are the issues people care about, biden is actually addressinglower your prices because they artificially high and some are doing it. trump is addressing them. -- biden is addressing them. trump is saying give me money and i will give you oil leases. >> it was just a couple weeks ago when he laid out, you give me $1 billion and i will give you whatever you want. if you are running a giant oil company, that is worth a lot of money to you. the american people should pay attention to what former president trump is offering these people, because they already have ultimate wealth. now they are in a position where they could be buying ultimate power. >> right. what people don't understand, the new yorker article basically said that the late sheldon adelson already played this game. he said move the embassy. trump said how much money are you going to give me. trump got the money and they moved the embassy. this is been the opposite of policy through every administration, but he got it moved because he had money. citizens united, fundamentally, to me changed the calculus for the wealthy. now they can say i will give you this amount of money for these policies. that gets around our democracy because if an administration is willing to literally change policy for cash, that is no longer a democracy, it is an oligarchy. >> you are 100% right, but it is also absurd to think president biden has not been pro-israel. he has been so pro israel that it has cost him support from progressives. what this is isn't big, wealthy, gop donors looking for a specific thing. what they want is a get out of jail free card for anything they could potentially want in the next four years and former president trump has made it clear that is on offer. >> and the thing is, at the same time you have donald trump representing himself as a populist. what is in this agenda for a regular person who somehow thinks they will get paid? i don't want another person to say stimulus because that was because of covid. he will not just send black people checks. that's not the plan. >> and let's remember whose actual idea it was. who led the effort on the stimulus checks? it was nancy pelosi. it was democrats and republicans eventually signed on to it. if you take issue with inflation, one of the reasons we have faced inflation is because of stimulus. it is because the government put so much money into this system, so pick your poison. one of the issues is, president biden does work with business leaders. he does work with corporate america, but the oval office does not have an open, swinging door. that's the difference. it is not that the biden administration hasn't seen an extraordinary economic recovery. look at the stock market breaking record after record. excuse me, look at what president biden has done for electric vehicles. president trump and the maga base hate ev's, yet it is elon musk who is saying i am getting closer to president trump and going to raise money for him. has policies don't align with many of these people, but the fact they can call him on the phone and get what they want
